REQUESTS FOR PRIOR ACCEPTANCE

1. Accepted: The following colors of AMCON Burnished CMU are equivalent to Anchor Block colors as noted

as noted in Section 04 2000 Unit Masonry:

a. Amcon Color #302 ‘Shadow’ is accepted as an equivalent color to Anchor Block Burnished CMU

Color ‘Onyx’.

b. Amcon Color #704 ‘Coral’ is accepted as an equivalent color to Anchor Block Burnished CMU

Color ‘Sahara’.

2. Accepted: It is acceptable to substitute a ‘G60’ zinc coating for a ‘G90’ zinc coating for the steel

connectors as described in Section 06 1753 the Shop Fabricated Wood Trusses.

MECHANICAL & ELECTRICAL

E. QUESTIONS

1. The specs contradict whether the owner or the contractor is to supply/pay for the following:

Temp. Water, Temp Heat, Temp. Electrical, Temp. Lighting.

Response: Contractor to provide temporary connections and temporary distribution from

Owner’s existing water, sewer and electrical services to the areas of construction per the

requirements of the specifications. Contractor is responsible for temporary lighting and heating

per the specifications. Contractor is responsible for removal of all temporary installations when

project is complete. See Section 01 5000 for additional information.

2. The specs contradict whether we are required to supply a temp construction office or if it is up to our

discretion. Please clarify

Response: Per Section 01 5000 Contractor has discretion whether to provide a temporary construction

office; if provided, the temporary construction office shall meet requirements in the specifications.

3. Are winter heat charges to be included in our bid?

Response: Yes, heating is required per Section 01 5000.

4. The specs note that we are required to supply and install wash facilities and drinking-water facilities – are

these required?

Response: Yes, per Section 01 5000 these are temporary provisions for construction workers.

5. The specs note that we cannot hold waste materials more than 7 days during normal weather or 3 days

when the temp is expected to rise about 80 degrees. This would mean emptying the dumpsters at least

once a week. Is this required?

Response: Yes, remove waste per requirements of Section 01 5000. See Section 01 7419 for additional

waste handling requirements.

6. Is a NPDES permit required? If so, who is to pay for it?

Response: An NPDES permit is not required.

10. Plans have been submitted to the City of Medina for administrative review. a. Contractor must pay for the building permits. Separate permits will be required for each building

demolition and each new building construction. There are no SAC fees required. The plumbing review with the State has been initiated.

11. The following are questions and answers: a. Question: Who is responsible for tree removal?

i. Answer: Three Rivers Park District will remove trees before construction begins. b. Question: How close are the buildings to the waterline?

i. Answer: as shown on the drawings. c. Question: Are there special requirements for construction noise?

i. Answer: Follow city noise requirements. d. Question: Is work permitted on holidays?

i. Answer: No work is permitted on Memorial Day, Fourth of July, or Labor Day e. Question: Is privacy fencing required?

i. Answer: No f. Question: Where can staging occur?

i. Answer: All staging must occur in main parking lot where designated on the Overall Site Plan (A0.1). Staging is not permitted in the boat parking area.

g. Question: Is work permitted on the weekends? i. Answer: No, work area must be cleaned-up and parking lots cleared, except for designated

staging area. h. Question: Is restoration of sod part of the contract?

i. Answer: Yes, see civil drawings. i. Question: Will the masonry have a factory applied sealer?

i. Answer: Yes. j. Questions: Do the restroom floors have any special coatings?

i. Answer: No, just sealed concrete.

3. NEW 1-PHASE UTILITY TRANSFORMER BY LOCAL UTILITY (XCEL ENERGY). PROVIDE NEW SINGLE PHASE ELECTRICAL CABINET WITH SERVICE ENTRANCE RATED DISTRIBUTION PANELBOARD TO FEED NEW BUILDINGS. PROVIDE CONCRETE PAD AND ALL SECONDARY SERVICE LATERALS.

4. PROVIDE TWO (2) 2-1/2" EMPTY CONDUITS STUBBED TO 24"x24"x36" FLUSH HAND-HOLE FOR FUTURE USE.

5. PROVIDE 100 AMP, SINGLE PHASE, UNDERGROUND FEEDER TO BUILDING ELECTRICAL PANEL. REFER TO FEEDER SCHEDULE ON RISER DIAGRAM FOR CONDUIT AND WIRING SIZES. COORDINATE EXACT ROUTING PATHWAY WITH CIVIL/ARCHITECT PRIOR TO INSTALLATION. FEEDERS TO BE DIRECTIONAL BORED TO EACH BUILDING TO MINIMIZE DISRUPTION TO EXISTING SITE CONDITIONS.

6. PROVIDE NEW UNDERGROUND FEEDER TO EXISTING LIFT STATION PUMPS VIA 1-1/2" CONDUIT WITH 3#1/0 PLUS #6 GROUND. UNDERGROUND FEEDER TO BE DIRECTIONAL BORED TO LIFT STATION PUMP LOCATION TO MINIMIZE DISRUPTION TO EXISTING SITE CONDITIONS. MAKE ALL TERMINATIONS TO MATCH EXISTING CONDITIONS.

7. PROVIDE NEW 1" EMPTY CONDUIT FROM RELOCATED LIFT STATION PUMP CONTROLLER TO MECHANICAL ROOM OF BOAT RENTAL HOUSE FOR LIFT STATION PUMP CONTROL WIRING (CONTROL WIRING BY OWNER).

8. PROVIDE NEW 2" EMPTY CONDUIT STUBBED FROM BOAT HOUSE MECHANICAL ROOM TO HAND-HOLE FOR FUTURE FIBER. FIBER AND HAND-HOLE BY OWNER'S FIBER CONTRACTOR. COORDINATE EXACT LOCATION WITH OWNER.

9. ALTERNATE #6: PROVIDE A DEDICATED 20 AMP, 120 VOLT, UNDERGROUND CIRCUIT VIA 1" C WITH 2#8 AND #10 GROUND, DIRECTIONAL BORED FROM BUILDING 'A' ELECTRICAL PANEL TO GFCI RECEPTACLE FOR AIS SYSTEM. PROVIDE 20 AMP BREAKER IN DISTRIBUTION PANELBOARD TO FEED THIS CIRCUIT.

10. ALTERNATE #6: PROVIDE A GFCI RECEPTACLE WITH A WEATHERPROOF ENCLOSURE (COLE LIGHTING TL3-10 WCS SERIES OR APPROVED ALTERNATE) FOR AIS SYSTEM. INSTALL RECEPTACLE ON PEDESTAL. COORDINATE EXACT LOCATION OF RECEPTACLE WITH OWNER PRIOR TO INSTALLATION.

11. PROVIDE A DEDICATED 20 AMP, 120 VOLT, UNDERGROUND CIRCUIT VIA 1" C WITH 2#10 AND #10 GROUND, DIRECTIONAL BORED FROM BUILDING 'A' TO EXISTING BOAT RAMP LIGHT FIXTURE. RECONNECT NEW CIRCUIT TO LIGHT FIXTURE. PROVIDE ALL WORK REQUIRED TO TIE LIGHT FIXTURE TO TIME CLOCK IN BUILDING 'A' FOR CONTROL OF EXTERIOR LIGHTS.

12. TERMINATE SINGLE PHASE UNDERGROUND ELECTRICAL FEEDERS INTO BUILDING ELECTRICAL PANEL LOCATED IN MECHANICAL ROOM.

13. PROVIDE TWO 24"x24"x36" FLUSH MOUNTED HAND-HOLES WITH GREEN COVERS FOR FUTURE USE. INSTALL HAND-HOLES IN A LOCATION IMMEDIATELY CLEAR OF AND ADJACENT TO THE CONCRETE SIDEWALK THAT SURROUNDS EACH BUILDING. WHERE THERE IS NO SIDEWALK, INSTALL HAND-HOLES 5-FEET FROM THE BUILDING. EXTEND FUTURE POWER AND COMMUNICATIONS CONDUITS INTO HAND HOLES AND TEMPORARY SEAL THE CONDUITS. COORDINATE EXACT LOCATION OF HAND-HOLES WITH ARCHITECT AND OWNER PRIOR TO INSTALLATION.

14. PROVIDE ONE (1) 1-1/4" CONDUIT FOR FUTURE COMMUNICATIONS CABLING AND ONE (1) 2" CONDUIT FUTURE POWER TO HAND-HOLES. TERMINATE ONE CONDUIT PER HAND-HOLE (PLAN NOTE 13 ABOVE). STUB FROM HAND-HOLE INTO MECHANICAL ROOM FOR FUTURE USE.

15. PROVIDE ALL WORK REQUIRED TO RELOCATE EXISTING PUMP CONTROLLER FROM ORIGINAL BOAT HOUSE TO LIFT STATION PUMP LOCATION. PROVIDE (2) 4"x4" TREATED POSTS MOUNTED IN THE GROUND TO 4' DEPTH, SET IN CONCRETE, WITH A 4'x4' TREATED PLYWOOD PANEL FOR INSTALLATION OF PUMP CONTROLLER PANEL. This Agreement is entered into under the authority granted by Three Rivers Park District's Board of Commissioners at its regular meeting on Date, 20__ and after the consideration of sealed bids which were submitted to the Superintendent and Secretary to the Board of Three Rivers Park District at a public opening at 2:00 P.m. on March 5, 2019. 1. In the hiring of common or skilled labor for the performance of any work under any contract or any subcontract, no contractor, material supplier, or vendor, shall

by reason of race, creed, or color, discriminate against the person or persons who are citizens of the United States or resident aliens who are qualified and available to perform the work to which the employment relates;

2. No contractor, material supplier, or vendor, shall, in any manner, discriminate against, or intimidate, or prevent the employment of any person or person identified in the preceding paragraph or on being hired, prevent, or conspire to

prevent, the person or persons from the performance of work under any contract on account of race, creed, or color;

3. A violation of the nondiscrimination article is a misdemeanor;

4. This contract may be canceled or terminated, and all money due, or to become

due under the contract, may be forfeited for a second or any subsequent violation of the terms or conditions of this nondiscrimination article.

Article 3:

The current minimum wage rate per hour to be paid for each classification of work shall be the local prevailing rate, including fringe benefits as defined in Minnesota Statute 177.41-177.44.

Article 4:

The Contractor agrees to commence said work as herein provided at the earliest practicable date and to prosecute the same diligently and without delay. Substantial Completion of Phase 1 shall be no later than September 2, 2019 and Substantial Completion of Phase 2 shall be no later than May 1, 2020. See Drawings for additional requirements.

Article 5:

The Contractor further agrees to make, execute and deliver to the Owner, a Performance Bond and Labor and Material Payment Bond executed by himself and a surety company approved by the Owner, each in the sum of __________________________________________________________________________,

for the use of said Owner and of all persons doing work or furnishing skill, tools, machinery or materials under or for the purpose of this Contract by said Contractor, and this Contract shall not become effective until said Bonds have been received and approved by the Owner.

Article 6: In consideration of the covenants and agreements stated above, the Owner agrees to pay the

Contractor the Contract Sum of $ (with modifications upward or downward,

if any, due to increased or decreased quantities of unit price items if applicable) as mentioned in the Bid of said Contractor which is made a part of this Contract and attached hereto. Installment payments, if any, on account of work done and the materials furnished

by said Contractor under this Contract and actually in place in said project, shall be made in accordance with the provisions of the General Contract Conditions and final payment therefore shall be due and payable on or before thirty (30) days after receipt by the Owner of

a certificate by the Owner's representative that the work has been fully completed and this Contract fully performed by the Contractor and the opinion of the Owner's attorney that the Owner is then obligated to pay the sum contracted for herein.
