NEW DELHI, APRIL 02 The government has moved the Supreme Court seeking review of its March 17 verdict setting aside a 2014 notification of erstwhile UPA regime to include Jats in the cen- tral list of the Other Backward Classes (OBC) in nine states to accord quota benefits to them. The NDA government moved the apex court days after a meeting a Jat delegation had with Prime Minister Narendra Modi who assured the commu- nity leaders that his dis- pensation would try to find a solution within the legal framework. The Centre, in its review plea, has said "the Centre's power to make available quota for a com- munity is not dependent on the advice of the National Commission for Backward Classes (NCBC). European Union to resumenegotiations for the freetrade pact from the pointwhere they were left in2013, but if EU is "moreambitious", then theremight be "some reserva-tions", a top Indian officialsaid on Thursday.

Lathe had voted against the res-olution to sack Bhushan and Yadavfrom Political Affairs Committee(PAC) on March 4.

Sinha and Lathe slammed the

leadership for taking the punitiveaction against them without givingthem any opportunity to explaintheir position.

Both the National Executive(NE) members were present in apress conference held by Bhushanand Yadav on March 28 after theduo was expelled from the party's

top decision-making body.A senior AAP leader said the

punitive action has been takenagainst the two UP leaders of theparty for attending the press con-ference.

"Based on the complaintreceived by National DisciplinaryCommittee, and the discussion on

it by the members of NE, NE hasdecided to suspend your primarymembership pending disciplinaryproceedings," an e-mail from partysecretary Pankaj Gupta to Lathesaid.

"On March 14, (senior partyleader and UP in-charge) SanjaySingh had come to Moradabad andasked me to vote in favour of reso-lution seeking removal of PrashantBhushan and Yogendra Yadavfrom the National Executive atMarch 28 National Council meet-ing," Lathe said.

The party constitution has theprovisions of having co-optedmembers, who also have votingrights.

Lathe is one of the three co-opted members in the NE, repre-senting Uttar Pradesh, but has onevote. The state has three zones -Rohilkahnd, Bundelkhand andPoorvanchal. Every region has aright to vote, but the majority voteprevails, which is counted as one.

"On March 4, I had votedagainst the resolution seekingexplusion of Prashant Bhushanand Yogendra Yadav from thePAC. At that moment, I knew I hadcommitted a political suicide,"Lathe said.

Sinha, a party leader from UttarPradesh, had also accused the AAPleadership of taking the decisionsto remove Ramdas and Bhushan ina hurry from the two crucial postsand without due consultations ofall members of the NationalExecutive.

In a letter to the party secretaryPankaj Gupta on March 30, Sinhahad questioned the sacking ofBhushan and Yadav from theNational Executive without refer-ring the case to the party's internalLokpal as per norms.

Incidentally, Sinha was notinvited for the emergency NE meeton March 29 called at Delhi ChiefMinister Arvind Kejriwal's resi-dence.

Women and ChildDevelopment Ministry (WCD)has found that nearly 90 percent of around 1400 NGOsseeking financial grant under amajor training and employmentscheme were "fake".

Top officials in the ministrysaid applications were invitedfrom NGOs to impart skilldevelopment training towomen in rural areas under itsSupport to Training andEmployment Programme(STEP) which has a corpus ofRs 30 crore.

"We had received 1400 to1500 applications of which 90per cent are found to be fake.The scrutiny of applicationsrevealed that most of the NGOs

have applied multiple timesgiving false names anddetails," a senior official toldPTI.

STEP is a major programmebeing implemented by WCDMinistry, aimed at providingemployability skills to women.

The official said that the min-istry has decided to upload thenames of all the fake NGOs onits website so that they can be"exposed" and identified" byother ministries as well.

The last date of submissionof project proposals by theNGOs for financial assistanceunder the scheme for 2015-16was March 31.

Applications have beensought by the ministry from theNGOs after the scheme wasrevised by WCD Minister

Maneka Gandhi to improve itsimplementation.

"The names will be uploadedon our website soon. We wantto expose them for trying tocheat the authorities as we havepeople who check each appli-cation and are quick to spotfake ones," the official said.

The ministry had earlier alsoissued an advisory to all NGOswhich had applied for financialgrants under the scheme toimpart training to women insectors like carpentry, plumb-ing, electrical works and evenconstruction and IT.

The STEP scheme hasalready covered 24,037 benefi-ciaries in 2014-15 and 31,478beneficiaries in 2013-14. Thenumber stood at 30,481 in the2012-13.

Aam Aadmi Party government Thursdaywarned discoms of "serious consequences"if they resort to unreasonable excuses forload shedding and directed them to ensureuninterrupted power supply in the nationalcapital.

The government's move comes afterreports of load shedding by discoms in dif-ferent parts of the capital, particularly inslums and JJ clusters.

Power department, on the direction ofpower minister Satyendra Jain, has issued awritten direction to the CEOs of all thethree power distribution companies -- TataPower Delhi Distribution Limited(TPDDL), BSES Rajdhani and BSESYamuna.

"Department has directed discoms toensure uninterrupted electricity supplyacross the city with immediate effect," saida senior official.

The government also said that a seriousview will be taken by the power departmentin case the discoms resort to unreasonableexcuses for load shedding.

"Discoms should ensure that consumer

helpline numbers are active and theseshould be adequately reinforced to meetadditional calls being received from con-sumers in the current scenario," the powerdepartment has stated.

The discoms have also been directed thatin case there are valid and justifiable rea-sons for load shedding, then "It should beensured that such load shedding at anylevel of shortage does not exceed one hour

at a stretch and should be strictly on rota-tional basis in different areas and not onlyin slums and JJ clusters."

The department has also directed the dis-coms to widely advertise in advance,through different forms of media, in casethey have to resort to load shedding and"any failure to strictly comply with thesedirections will lead to serious conse-quences".

"Considering the certi-fied copies of the chargesheet, evidence of RakeshKumar, I am of the consid-ered view that the accident

had been caused by rashand negligent driving bycar driver..." MACTPresiding Officer AnoopKumar Mendirattasaid.

According to Kumar'spetition, on June 18, 2008,he was going home fromwork on his motorcyclewhen he got hit by therashly and negligentlydriven Tata Sumo of a sub-divisional engineer of atelephone exchange inHaryana.

Kumar, an electrician,was taken to Dr RamManohar Lohia hospitalwhere he was treated forfracture in right leg andsuffered nearly 50 per centpermanent disability in his

leg, it said.Kumar had sought com-

pensation of Rs 11 lakh onthe ground that he earned asalary of Rs 13,000 permonth before the accidentbut he would not be able toearn that much in futuredue to his disability.

During the proceedings,the driver and owner of thecar were proceeded ex-parte as they neitherappeared nor filed anywritten statement in the tri-bunal.

The insurance companyhad contended that thepetition made false claimsand the compensationamount of Rs 11 lakhsought by Kumar wasexcessive and exorbitant.

on the pretext of marriage in2010, has been acquitted by aDelhi court observing that thealleged victim had "enjoyed" hiscompany for fun and had a likingfor him.

Noting that the 18-year-oldgirl had "freely exercised" achoice between resistance andassent, Additional SessionsJudge Sanjiv Jain (ASJ) freedDelhi resident Rocky of thecharge of rape under section 376of the IPC while also saying thatthere were inconsistencies anddiscrepancies in the girl's ver-sion.

"The facts and circumstancesof the present case show thatprosecutrix (girl) had liking forthe accused but not to the extentof marrying him. She hadenjoyed the company of theaccused for fun," the court said.

"So how can it be said thatthere was promise of marriageand on account of this misrepre-sentation, the prosecutrix hadagreed to have physical relationswith the accused," it said, addingthe girl had sufficient intelli-gence to understand the signifi-cance and moral quality of theact she was consenting to.

"Despite that she did not resistthe overtures of the accused andin fact succumbed to it. She thusfreely exercised a choicebetween resistance and assent,"it said.

The court noted that girl hadgiven "different versions"regarding the actual act alleged-ly committed by the accused.

"Inconsistencies and variousdiscrepancies have appeared.Further, there are improvementsin her testimony. It also suffersfrom infirmities. So testimony ofthe prosecutrix cannot be said to

be of sterling quality and noimplicit reliance can be placedon her testimony," it said.

According to the prosecution,the girl complained to the policein November 2010 saying thatthe man was her neighbour andthey were meeting each other.

She alleged that on October 9,2010 when she was returninghome from tuition, Rocky mether and proposed to her for mar-riage. After this he took her to aroom and established physicalrelations with her on the pretextof marriage.

The complainant said she toldher parents about it after whichthe man and his father askedthem not to file a complaint asRocky was ready to marry her.

After the date for their mar-riage was fixed, the accused andhis father told them that hewould not marry her, sheclaimed.

"The truck was stopped on a desertedstretch near Kalindi Kunj by some car-borne miscreants who beat up the driv-er and helper and then held the duo atknife-point before fleeing with thevehicle which was loaded with elec-tronic products," said a police official.

Uber cab rape case: Courtdefers proceedings till April 16NEW DELHI, APRIL 02

A city court hearing the Uber cab rape case todaydeferred the matter for April 16 after beinginformed by Delhi Police that the Supreme Courthas continued the stay on the proceedings till fur-ther orders. Special public prosecutor (SPP) AtulShrivastava placed on record the March 24 order ofapex court which had continued the stay on pro-ceedings pending before the trial court till furtherorders. Shrivastava told Additional Sessions JudgeKaveri Baweja that the appeal filed by the victimand police challenging the Delhi High Court'sorder allowing the accused to recall and re-examine13 prosecution witnesses, including the woman, isscheduled to come up for hearing before apex courton April 8. The court, after hearing the submis-sions of prosecutor, fixed the matter for April 16.

The proceedings of the case in the trial courtwere first stayed by the apex court on March 10.

On March 24, the apex court had also issuednotice to accused Shiv Kumar Yadav seeking hisresponse on the appeals. According to the prosecu-tion, the incident took place on the night ofDecember 5 last year when the 25-year-old victim,a finance executive working in Gurgaon, was head-ing back home. Police had said the woman hadtaken the taxi from Vasant Vihar to return to herhouse in Inderlok area of North Delhi and theaccused, who took another route, allegedly rapedher. Yadav was arrested on December 7, 2014.

Arya further claimed that theDeputy CM's statement that "thethree corporations failed in finan-cial management and are not ableto pay salary to their employees"was baseless and politically moti-vated.

Delhi BJP Chief and formerStanding Committee Chairmanof the SDMC, Satish Upadhyay,has also dismissed the claims ofthe government as a "childishstatement."

An AAP official had yesterdaysaid that the Delhi government"is planning to write" to the LtGovernor to begin the process ofhanding over of the charge ofEDMC, which is facing a finan-cial crisis, to improve its condi-tion.

Delhi Chief Minister Arvind Kejriwal had earlier onMonday dismissed reports of crisis within the party sayingeverything was 'fine'.

The AAP had earlier on Sunday released a 45-minute videoof Kejriwal's speech, a day after the removal of senior lead-ers Prashant Bhushan, Yogendra Yadav, Anand Kumar andAjit Jha from the national executive.

In the speech, Kejriwal says "he was betrayed" and "knifedin the back", and ends with an appeal to the council to choosebetween them and him.

Delhi seeks...Delhi Health Minister Satyendra Jain asked

that the allotment of 18 sites, estimated to benearly 50 acres across the national capital, becancelled.

An official said in the last 40 years, DelhiDevelopment Authority (DDA) had allotted18 plots to private firms for construction ofhospitals, which were to come up in threeyears of allotment. But no construction hasbeen done till date on these 18 sites.

"DDA is supposed to cancel the lease ifconstruction is not done in stipulated period,"Jain said in the letter.

He further requested Naidu to hand overthe land to Delhi Government for construc-tion of hospitals and dispensaries.

A senior official confirmed that Delhi gov-ernment had earlier sent two letters to DDAin this regard.

"This is a clear case of land-hoarding.Precious land is allotted in prime localities ofDelhi to non serious players. They are wait-ing to sell the land. Citizens of the city aredeprived of health facilities they deserve,"the official said.

axed to death by her brother Santosh Verma(47) and nephew Piyush (25) this afternoon.

Behra border outpost in North 24 Parganasdistrict during a special operation onWednesday night.

"A BSF patrol party ambushed three smug-glers carrying two gunny bags. While theymanaged to escape under the cover of dark-ness, we seized 64 kg of ganja kept in thosebags," a BSF officer said.

In a similar operation near Renu borderoutpost in Murshidabad district, 585 gramsof heroin was seized while it was beingsmuggled into the state.

Acting on specific inputs, a BSF specialteam intercepted a 34-year-old man suspect-ed to be a weapons carrier near Kechariparaborder outpost in Murshidabad. Two locally-made hand guns and a mobile phone wereseized from him.

Meanwhile, Haryana Chief Minister MLKhattar has defended Khemka's transferwhile describing him as an honest officer. Hestressed that officers are transferred and post-ed as per needs.

"He's an honest officer. He has been trans-ferred on administrative grounds, it’s a rou-tine transfer," Khattar said. "Depending onthe need, officers are transferred. It's a rou-tine process," he added.

However, state's Health Minister Anil Vijcame out in Khemka's support, saying he willtalk to the Chief Minister regarding the offi-cer "who had worked to weed out corruptionduring the previous Congress regime".

Vij further told reporters in Ambala, "I willtalk to the Chief Minister regardingKhemka's transfer."

Vij, an outspoken BJP leader and AmbalaCantt MLA, said that he had always stood byKhemka, "who had worked to weed out cor-ruption during the previous Congressregime".

Notably, the government did not mentionany reason for his transfer. Chief MinisterKhattar's OSD Bhupeshwar Dayal termed itas an administrative matter.

Khemka was appointed as transport com-missioner and secretary, Transport depart-ment, last year after Khattar assumed officeas chief minister of the first BJP governmentin Haryana.

At that time, Khemka, who had blown thelid off from the controversial multi-million-rupee land deals of Congress president SoniaGandhi's son-in-law Robert Vadra, was tout-ed to get an important assignment. However,he was posted in the transport department.

However, Haryana's Transport MinisterRam Bilas Sharma maintained that "transferis not a punishment" and stressed that it wasa "routine" matter.

"Transfer is not a punishment, a promotionor demotion. Transfer of senior officers is aroutine matter. There is nothing special orextraordinary about it," he said while reply-ing to queries on the issue.

He said decisions are taken after the ChiefMinister holds consultations with his councilof ministers.

Notably, as Transport Commissioner,Khemka had refused to issue fitness certifi-cates to over-sized trucks and trailers for car-rying automobiles, leading to a truckers'strike in January.

Later, the truckers in Haryana withdrewtheir strike after the state government gavethem one year's time to get their vehiclesmodified as per the Central Motor VehicleRules (CMVR), 1989.

Khemka, in a tweet then, had said that "60percent of road accidents due to overloadedand over-sized transport vehicles. Industrycooperation needed to stop this road men-ace."

The Transport Minister denied that themove to replace Khemka as TransportCommissioner was related to his decisionregarding truckers.

"No. Nothing like that. It is a routine mat-ter," he said to a query on the issue.

In one of his tweets last week, Khemkawhile quoting Rabindranath Tagore had men-tioned: "If no one responds to your call, thengo your own way alone".

Meanwhile, nine other senior officers were

also transferred by the Haryana government.Among those transferred were SS Dhillon,

a former principal secretary to previous chiefminister Bhupinder Singh Hooda, who hasnow been made additional chief secretary,Transport and Civil Aviation Department.

Additional Principal Secretary to ChiefMinister Khattar, Sumita Misra, has beenposted as Principal Secretary, Tourismdepartment.

Earlier in 2012, when Khemka was postedas Director-General of Land Consolidationand Land Records-cum-Inspector General ofRegistration, he had brought land deals ofbusinessman Robert Vadra, son-in-law ofCongress chief Sonia Gandhi, under thescanner.

During the Bhupinder Singh Hooda-ledCongress government, the official had can-celled the mutation of the multi-crore landdeal between Vadra's company SkylightHospitality Pvt Ltd and DLF, terming it asillegal. However, the previous Hooda gov-ernment gave clean chit to Vadra in the landdeal.

Last week, Khemka in a tweet had said thathis action in Vadra-DLF land-licence dealhas been "vindicated in the CAG report."

The wheat procurement process in Punjaband Haryana, which officially begins onApril 1, is likely to be delayed as the crop hasstill not ripened for harvesting.

In Haryana and Punjab, agriculture expertsfeel that the damage to the crop could be upto 25 percent till mid-March itself. The rain-fall and strong winds in March-end haveadded to the woes of farmers.

"The crop that has been damaged cannot berecovered. The crop, which is still standingwill also not be of much use as it will have ahigher moisture content and procurementagencies will be unwilling to purchase it,"agriculturist Amar Singh Sandhu of Mogadistrict told IANS.

Scientists at the Haryana AgricultureUniversity (HAU), Hisar, and PunjabAgricultural University (PAU), Ludhiana,have said that the quality of grain in thewheat crop this season will be poor.

"The grain will have high moisture content.It will not be good for long-term storage," asenior scientist at HAU told IANS on thephone from Hisar.

Philosopher and poet GeorgeSantayana once said, those whodon’t remember history are

condemned to repeat it. ButSantayana was no historian. Makinghistorical parallels is a fraught exer-cise. How far do we take the compar-isons between history and the pres-ent? And, most importantly, why dowe undertake the exercise in the firstplace? The Aam Aadmi Party today— at least till the stage before therecent internal squabbles — was bestplaced to potentially take over thecentre-left-liberal space in Indianpolitics that was so fully occupied bythe Congress for so many decades. Atone level, it is quite ridiculous tocompare a party created in 2012 withone founded in 1885. It is to theAAP’s credit that we can even con-template such comparisons. But to ahistorian who remains as concernedwith the present and future of Indianpolitics as to its past, the historicalparallels between 1935 and the pres-ent are too glaring to ignore. I amreferring here to the differences thatarose within the Indian NationalCongress in the wake of the promul-gation of the Government of IndiaAct, 1935, by the colonial govern-ment.

A transformation

The split between some of thefounding members of the AamAadmi Party (AAP) has drawn itsshare of historical comparisons in thecommentariat. But these are perhapsnot the right ones. Rather than com-paring this moment with theMahatma Gandhi-Subhash ChandraBose split, or even the JawaharlalNehru-Purushottam Das Tandon dis-pute, we should be looking at one ofthe most important, but often over-looked, dates in modern Indian histo-ry: 1935.

The differences in 1935 wereresolved without a split in the party.Yet, the changes initiated changed thecharacter of the party forever. TheCongress’s decision to participate inthe elections following the 1935 Acttransformed it from an oppositionalmovement to a party that exercisedreal political power. From being the

chief opponents of the British Raj,the Congress, after 1935, became anorganisation that behaved more andmore like the Raj. Are we witnessingthe beginnings of a comparablechange within the AAP? For the firsttime ever, the 1935 Act offered theopportunity for elected members ofProvincial Legislative Assemblies toexercise real power in colonial India.Now, elected members of provincialassemblies would not be outnum-

bered by appointees of the colonialgovernment. It was quite possible foran individual who had recently beenthe victim of a police lathi charge tobecome a cabinet minister and be incharge of the police force at whosemercy he or she had been just a fewmonths earlier. However, theCongress under the leadership ofNehru and Mahatma Gandhi, wascommitted to the ideals of non-coop-eration and civil disobedience. From1929, the party outlined completeindependence, purna swaraj, as itspolitical goal. Idealists in the party,including Nehru, wanted to reject theterms of the 1935 Act, calling it “anew charter of slavery”. Power, theyargued, ultimately remained with thecolonial state, and Bose saw it simplyas a new way for the British to retaintheir power in India.

Idealists versus pragmatists

However, the pragmatists amongthe party leadership disagreed. Intheir opinion, there was a great dealto be achieved by participating in theelections, not the least of which wasreal access to the levers of power.Very surprisingly, Gandhiji, despitehis commitment to non-cooperation,chose not to come out in support ofthe Left. His silence ensured the vic-tory of the pragmatists.

There are many ways to understandthe split within the AAP. No doubt,personal equations, suspicions, per-sonality clashes, and the like have allcontributed to the drama in the AAPwe have seen over the last fewweeks. Nor is there any doubt that wecan also see this as a battle betweenthe idealists and the pragmatists inthe party. The idealists wanted theparty to stay true to its stated goals.They were upset when they learntabout back room deals between theAAP’s leaders and the Congress toform a non-BJP government in Delhi.They wanted continued and closescrutiny of donations to the party.They wanted the AAP to remain aparty with a difference. And, they hada point. But then, so do the pragma-tists in the AAP. To stop the Modijuggernaut, they argue, pragmaticsteps needed to be taken. They had to

make deals. They had to bring inproven election-winners to representthe party in the polls. They could notafford to scrutinise each and everydonation that came to the party at atime when funds were desperatelyneeded to fight the good and neces-sary fight. We are still better than themainstream parties, they rightlyargue. We are still a party of differ-ence, they say. Perhaps so. But hereis where some interesting historical

parallels might be useful.

Once the pragmatists in theCongress party won the internal bat-tle after 1935, the party as a wholewas committed to participating in theelections of 1937. We know theresult. It was a huge and somewhatunexpected victory for the Congress.In the short run, it seemed the prag-matists were right. The Congressformed governments in initiallyseven and later eight of the 11provinces of British India. There wasundoubtedly a period of euphoria fol-lowing the electoral victory, forinstance, at seeing the tricolour nowlegitimately hoisted on governmentbuildings. Hundreds of Congress vol-unteers had suffered beatings andbullets in their efforts to do that just afew years before this date. But thepeople and the polity soon had to paya price for this pragmatism. To

“prove” their credentials as effectiveproviders of “good governance”,Congress ministries made use ofcolonial laws of sedition to shutdown free speech. The Congress gov-ernments were praised by imperial-ists for their commitment to “law andorder”. The same Congress that hadhesitated even to participate in theelections and form governments was,within a year, engineering whatSumit Sarkar describes as “sordid

assembly manoeuvres and floorcrossings” to form a government inAssam. In their second term in officein 1946, Congress functionariesplayed a significant role in undermin-ing the General Strike called for inBombay to support the mutinyamong the Indian ratings of theRoyal Indian Navy. The road to darkplaces is often paved with good prag-matism.

The ‘what ifs’

The pragmatism that drove theCongress to participate in the elec-tions and form governments in 1937,also led to the break-up between theCongress and the Muslim League.The rejection of a coalition with theLeague in United Provinces after theelections was typical of the arroganceof the pragmatic victors. Thesereverses also made the League recog-

nise the unviability of contesting theCongress in all-India elections. Theirstrength, they realised, would at bestremain in provinces. A series ofevents transformed the goal ofprovincial autonomy into the demandand realisation of Pakistan over thenext decade. History is about whathappened, rather than what mighthave happened. But a few historianscan help contemplate the “what ifs”of history. What if the idealists hadwon their battle within the Congressin 1935? What if Gandhiji had sup-ported their efforts to persist in notcooperating with the colonial govern-ments and institutions? “What ifs”are not history, but that alternativevision is not one we can afford toabandon altogether. Rather than acommitment to victory in electoralpolitics, and consequent minoritiesand majorities, might we have seen adifferent sort of polity altogether,perhaps one with a different andmore inclusive space for minorities?Perhaps so.

The pragmatists have clearly wonthe day in the battle within the AAPtoday. But what do Arvind Kejriwaland his group wish to achieve withthat pragmatism? The vision of theCongress pragmatists of 1935 ledthem, 12 years later, to take over thepower that the Raj transferred tothem. By that time, the idealists toohad been co-opted into the systems ofpower. In some eyes, the Congresspragmatists were the greatest archi-tects of its political success. Othersmight prefer to commemorate 1935as the beginning of the end of thedream of a different India, the deathknell of an alternative polity and ide-ology that would transcend the trapsof modern politics. Eighty years on,do Arvind Kejriwal and his men havethe ability, the foresight, and the his-torical sense to tread a path differentfrom their historical forebears? And,even more important, do they wantto?

The latest exit from theoffice of the Governor ofMizoram, before the

expiry of his term, is bound torevive the controversy over theinstitution of Governors. Sadly,the debate on the issue, since theNational Democratic Alliance(NDA) government came topower, has generated more noisethan thrown light. It is necessaryto recapitulate.

The Constituent Assemblystarted with the proposition ofelecting Governors but settledfor a process where Governorsare appointed at the pleasureof the President. As in thecase of most other constitu-tional offices, no qualifica-tions other than citizenshipand age were prescribed bythe Constitution for theappointment of Governors.The Justice SarkariaCommission and the JusticeVenkatachaliah Commissionlooked into the matter and laiddown broad guidelines which,however, have not been acceptedby successive Union govern-ments.

Criticism about selections

In the initial rounds ofappointment of Governors, thechoices were largely unexcep-tional and fell on persons whoserved the country with distinc-tion in one walk of life or theother. Even so, a major propor-tion of these appointments wentto veterans of the political partyin office at the Centre, therebyinviting the sly comment that theoffice of the Governor was beingused to put retiring politicians topasture. From the 1970s, theselections became increasinglyvulnerable to criticism ongrounds of political partisanship,favouritism, patronage andcronyism.

The misuse of the office of theGovernor for political purposes

started as early as in 1952, whenthe Governor of Madras took itupon himself the task of frustrat-ing the prospect of a governmentdominated by the CommunistParty of India. He persuaded thePrime Minister to agree to hisproposal of nominating thewould-be Chief Minister to theLegislative Council and pro-ceeded accordingly toinstall a Congressgovernmenti n

o f f i c e .Then came1957, when theCommunist governmentin Kerala was deposed by invok-ing Article 356 (President’sRule). Such misuse of office wassubsequently compounded ingrowing measure, by abuse ofpower by errant Governors, thusbringing the office into contemptand public ridicule.

In the absence of clearly laiddown criteria for selection, theprocess of appointment ofGovernors has been from thebeginning, political, and rightlyso, because of the politicalnature of the office. The quest isnot for the best person availablefor the post. The test is whetherthe person chosen has a publicrecord that is without blemishand above reproach. Necessarily,he or she has to be one known tothe powers who are responsiblefor the choice, and acceptable to

them, as also the State govern-ment which is in office in theparticular State.

The recent Supreme Courtverdict on the appointment ofGovernors does not impose anyrestrictions on the government’schoice of Governors. It onlyc a u t i o n s

that the pleasure of the Presidentcannot be withdrawn on groundsof political incompatibility orany arbitrary grounds. It doesnot provide any pre-emptiverelief, but only asserts the juris-diction of the court to look intothe matter post-facto if theaggrieved were to approach thecourt.

In my view, it will be beneaththe self-respect and dignity ofany Governor to go to court.Besides, such a course of actiondamagingly detracts from thehigh constitutional status of theoffice itself. In fact, the situationshould never reach the point ofthe President withdrawing hispleasure. At the slightest hint ofthe Union government’s discom-fiture with a Governor’s contin-

uance, he or she should offer toresign, particularly when there isa change of government. Aneven healthier convention couldbe that incumbent Governorsshould offer to resign automati-cally when the Union govern-ment changes, as happens in thecase of the Attorney General andother Law Officers. Mutual con-

fidence is the crux of thematter. Such a

c o n v e n -t i o n

c o u l deven be legis-

lated as an addition toArticle 156 Clause 3 of theConstitution.

I may be accused of preachingwhat I did not follow in my owncase. Therefore, a few facts mayneed to be stated. When theUnion government changed in2004, my immediate inclinationwas to offer to resign. But I wasdissuaded by all those whom Ihad consulted on the ground thatit would mean my admission ofa political affiliation in spite ofbeing a retired civil servant. Fivemonths later, when the intentionof the Union government totransfer me to a North-EasternState was conveyed to me, I con-strued it as loss of confidenceand offered to resign. I acted onthe offer as soon as the govern-ment made up its mind.

Judges as governors

The office of the Governor isnot employment under govern-ment. Thus, the Constitution hasno bar on retired judges of HighCourts or the Supreme Courtbeing appointed as Governors.The only constitutional restric-tion on them relates to theirpractising law after retirement.As it is, they are being appointedto positions that have the charac-ter of employment under thegovernment. By a 1969 Act ofParliament, the Chief Justice ofIndia is designated to act as

President of India in the eventof vacancies arising in boththe offices of the Presidentand Vice-President simul-taneously. There has alsobeen the convention ofChief Justices of HighCourts filling casual

vacancies of Governors.Where it was intended that

constitutional functionariesshould not accept employment

under the government afterretirement, the Constitution stat-ed so explicitly. It is forParliament to decide if superiorjudges should be excluded fromconsideration for appointment toany office, as it is for individualjudges to decide if it is consis-tent with their dignity and self-respect to occupy such office.

Finally, a poser on the transferof Governors within the pre-scribed five-year tenure. Article156(3) of the Constitution doesnot contemplate such transfersunlike Article 217(1) (proviso3), which provides for transfersof High Court judges includingChief Justices. Therefore, is itconstitutional to transfer aGovernor from one State toanother for the remainder of thefive-year term instead of a freshfive-year tenure? That is a legalconundrum.

The legal process in India can be needlessly tortuousand complicated. Nothing exemplifies this morethan the Babri Masjid demolition case in which

pre-trial proceedings are bogged down in technicalitieseven though 22 years have elapsed since the structure atAyodhya was brought down by Hindu chauvinists on aquest for medieval revenge, demanding in its stead a Ramtemple. The Central Bureau of Investigation filed a jointcharge sheet in respect of various offences that took placeon December 6, 1992 but the higher judiciary is still grap-pling with the question whether the principal actors whoplanned the demolition and unleashed tens of thousandsof kar sevaks on the 16th century mosque ought to be triedfor criminal conspiracy. The Supreme Court has soughtthe response of former BJP president L.K. Advani andothers in a fresh petition that wants them to be tried forconspiracy to demolish the mosque at Ayodhya. The CBIhas been given time to explain the delay in pursuing itsappeal against an Allahabad High Court order of May 20,2010, discharging Mr. Advani, Bal Thackeray and others.The CBI filed its appeal over three years ago, but this ison a fresh plea by Haji Mahboob Ahmad, a petitioner inthe original dispute, expressing fears that the CBI may notmake adequate efforts to pursue the case as the BJP is nowin power. The apprehension may not be misplaced as theagency did not include Section 120B (conspiracy) of theIPC while filing a supplementary charge sheet in 2003,when the BJP headed the Central government. At thattime, the High Court had quashed an Uttar Pradesh gov-ernment notification transferring to Lucknow a case per-taining to those who instigated the demolition. The U.P.government had failed to issue a fresh notification to rec-tify the infirmity in the earlier one, while the CBI used theopportunity to file a charge sheet that invoked only provi-sions relating to rioting, provoking enmity between reli-gious groups and acting against national integration.Many in the party’s old guard were prominent participantsin the communal frenzy that brought down the mosque.However, representing a new dispensation and backed bya new generation, the Narendra Modi government doeshave an opportunity to expedite the legal process. Ratherthan letting the case lapse into irrelevance, the CBI shouldseek to convince the court to order a quick and completecriminal trial. It is not enough if the case comes up fromtime to time as a news story without recording anyprogress. After all, the legacy of communal bitterness as aresult of the demolition remains, and there can never beclosure to the collective hurt India suffered, without thecurators of the abominable crime being brought to justice.

Parivar could announce their decision tomerge into one on Sunday following a meet-ing in which the name of the new politicalentity and its symbol will be decided.

The new socialist entity will have a'Samajwadi' tag, said sources in JD-U.

"All the leaders of the Janata Parivar con-stituents will meet at Samajwadi Party chiefMulayam Singh Yadav's residence on April 5,where the name of the new party, its symbol

and programmes will be decided," sourcessaid.

The meeting is expected to be attended byBihar Chief Minister Nitish Kumar, JD-Uchief Sharad Yadav, RJD President LaluPrasad and representatives from IndianNational Lok Dal and Samajwadi JanataParty.

Mulayam, whose SP has the largest numberof MPs among the parties which have

planned the proposed merger, will be thechairman of the new umbrella entity.

The April 5 meeting will decide as to whatwould be the election symbol of the new enti-ty. Currently each of the six constituents ofthe erstwhile Janata Parivar has a separatesymbol.

were injured in anencounter with Maoists inChhattisgarh's insurgency-hit Kanker district onThursday, police saidhere.

The incident took place ata valley near Khadaigodravillage under Antagarhpolice station limits, wheresecurity personnel weredeployed to ensure securityto road construction work,Kanker Superintendent ofPolice Jitendra SinghMeena said.

A joint team of theChhattisgarh Armed Force(CAF) and district forcewas carrying out combingin Khadaigodra region,located around 250 kmaway from the state capital,during their task to providesecurity to the constructionwork.

"As they were cordoningoff a valley ina the region,a Maoist triggered a land-mine blast followed byindiscriminate firing onthem injured two districtpolice force constables," hesaid.

However, Maoists fledfrom the spot after securitypersonnel launched a retal-iatory attack, he said. Theinjured police constableshave been evacuated to alocal hospital where theyare being treated, the SPsaid, adding that their con-dition is stated to be out ofdanger.

"Reinforcements wererushed to the spot soonafter being informed aboutthe incident and a combingoperation is underway inthe region to nab the attack-ers," the SP said.

"The contractual doctors(about 1600 in Bihar) will beregularised soon for which thestate government will do theneedful to remove obstacles atthe earliest," he said at theNalanda Medical College-cum-Hospital (NMCH) afterinaugurating a function tomark its 45th foundationday.

Appearing to be disappoint-ed with the contractual doc-tors for agitating frequently to

press for regularization amongother demands, Kumar ques-tioned them for doing so andcounselled those medicos tofocus on discharging theirduties.

The doctors should not gethassled by the behaviour ofkin of patients, he said refer-ring to frequent scufflebetween doctors and relativesof patients in various govern-ment hospitals in Bihar, hesaid.

Stating that the state gov-ernment was committed to putin place quality medical infra-structure and recruit doctorsby creating required posts, thechief minister expressed dis-may for delay in execution ofongoing medical infrastruc-ture projects.

Kumar further announcedthat the Medical Council of

India (MCI) had sanctioned astrength of 100 medical stu-dents at the NMCH as against50 earlier and said that hewould take up with the apexbody to allow in-take capacityat 250.

The Chief Minister alsotook note of lack of adequatenumber of medical colleges inthe state which forced the stu-dents from the state to go outof the state for medical studiesand said that his governmenthad increased the number ofmedical colleges, but moresuch infrastructure wasrequired.

On this occasion, heannounced construction of atrauma -cum-emergency cen-tre at the cost of 31 crore anda 100-seat ward among otherinfrastructures at the premiermedical institution.

Pacheco, who heads theGoa Vikas Party, wassworn-in as a minister dur-ing a cabinet expansion inNovember last year afterthen chief minister ManoharParrikar was elevated to theunion cabinet.

On Wednesday, Parsekarhinted at dropping Pacheco,claiming that it was embar-rassing to have a convictedminister in his 12-membercabinet.

Parsekar also said the finaldecision to drop Pachecowould be taken after theminister returns from Delhi.

The court onWednesday refused to

stay collection of the MVtax per se, but in a reliefto the petitioners, direct-ed the Telangana govern-ment to accept theirindemnity bond for thetax till it pronouncesinterim orders on April 7.

The court also askedTelangana to file a count-er-affidavit.

The movement of pas-sengers and commoditiesfrom Andhra toTelangana was hit asmany private operatorssuspended their services.Some operators paid tem-porary tax for a week asthey hope for relief from

the court.Telangana has catego-

The Supreme Court benchof Justices F M I Kalifulla andShiva Kirti Singh this weekdismissed Pacheco's specialleave petition. The ministerhas been sentenced to six-month imprisonment. An FIRwas lodged against Pachecoin July 2006 by Kapil

Natekar, a junior engineer ofelectrical department, alleg-ing that Pacheco (who was aminister then too) abused andslapped him in his chamber.

People also blocked traffic near BristolChowk, and said the girl's condition deteri-orated as proper care was not being given atthe hospital. Gurgaon DeputyCommissioner T.L. Satyaprakash, who vis-ited the spot, assured the angry people thatthe girl would be shifted to Medanta theMedicity hospital in the city. The protestersdemanded the suspension of Gurgaon'schief medical officer, who referred the girlto Delhi.

They also demanded the removal ofinquiry officer Assistant Commissioner ofPolice Dharna Yadav, who allegedly misledthe girl's family saying that the arrestedaccused was a mentally disturbed person.

While details on the device's inbuiltstorage are not yet known, Acer will beoffering 100GB of Google Drive cloudstorage for 2 years. Connectivity optionsof the Chromebase include USB 3.0 and

USB 2.0 ports, Bluetooth 4.0, and Wi-Fi a/b/g/n. An HD webcam is also included

with integrated 3W stereo speakers.Acer adds that its Chromebase boots up

in 10 seconds and "has multiple layers ofsecurity built-in with automatic systemupdates."

Centre Working on ITAct Law Along theLines of Section 66A:Fadnavis

Maharashtra Chief MinisterDevendra Fadnavis said that theCentre is working on formulat-

ing a new law under the IT Act, on the

lines of Section 66A that was struck downrecently by the Supreme Court.

Fadnavis was replying to Shiv SenaMLC Neelam Gorhe, who asked whetherthe state will frame a new law in place ofSection 66A that would compensate forthe repercussions on the Supreme Courtorder.

"Under the previous law, an accusedcould be put behind bars if he made objec-tionable comments on somebody. Afterthis law was struck down, these miscre-ants will now get teeth to continue doingthis. Will the state government formulate a

law in line with the previous law?" Gorheasked.

Fadnavis said that there is no need forthe state government to frame a new lawas the central government is already work-ing on it.

"The Centre is working on formulating anew law on the lines of Section 66A thatwas struck down by the Supreme Court.There was no conviction in the previouslaw and thus a law is being formulated thatwill be strong and which will result in con-victions," the chief minister said.

While there were 937 registered cases

under the IT Act in 2013, the number roseto 2,696 in 2014, he said.

Replying to a question by Hemant Takle(NCP), who pointed out that merely train-ing 1,000 policemen will not help and thatall police stations should be trained in han-dling cases of cybercrime, Fadnavis saidthat his suggestion will beconsidered.

He also said that while 1,000 policemenare being trained to tackle cybercrimecases, Nasscom and DSCI are also impart-ing training to 4,416 officials and 5,972low-level officers.

The West Indies CricketBoard (WICB) is hoping tonegotiate a deal with theBoard of Control forCricket in India (BCCI) tohave the controversial $42million claim repaid inmatches and not cash.

WICB chief executiveMichael Muirhead said onTuesday the board wouldsend a delegation to Indiawith the main objective ofnegotiating a settlementwhich would be amicable,and would satisfy all par-ties, reports CMC.

"It could be that theycould ask that instead ofplaying the Test matchesthat they play some moreODIs...it’s a matter ofnegotiations," Muirheadsaid.

"We have not gotten tosit down with them but weare planning for a delega-tion to go...and not just behigh-handed and go in say-ing this is who we arebringing, sort of amenableto sitting down and lettingus have reasonable negoti-ations.”

Muirhead said no talkshave yet been initiatedlargely because of theBCCI’s recent electionswhich left the body with-out major positions, suchas CEO and secretary, inplace.

However, with that nowsorted, the Jamaican saidthe WICB would be look-ing to set up a meeting todiscuss the issue of settle-ment. “They (new BCCIboard) had their first meet-ing last weekend and Ithink this would have beenan agenda item. And out ofthat, we are going to thenext stage where they havepromised that we are goingto have a meeting,”Muirhead noted.

"The resolution is simplethat we will have the pay-off repaid in matches,cricket - not the numbers Ihear being bandied about."
