Virginia Online Advertising
Is your online advertising compliant with VREB
regulations?
"Advertising" means all forms of representation,
promotion and solicitation disseminated in any manner
and by any means of communication to consumers for
any purpose related to licensed real estate activity.
This includes your personal facebook page if you write about a listing you just received or
the long day you spent with buyers schlepping them around in the rain. This includes emails
that indicate that you are a real estate licensee. Anything that promotes that you are a real
estate licensee or could be perceived as an inducement for business could be construed as
advertising.
"Disclosure" in the context of online advertising means .... (ii) advertising that contains the
licensee name, the name of the firm with which the licensee is active, the city and state in
which the licensee's office is located and the jurisdiction in which the licensee holds a
license.
The disclosure must be viewable on the home "landing" page or identified by a link that is
just one click away.
When in doubt, disclose! As a reminder, all advertising must be approved by your broker.

Maryland Open Houses
The Commission has become aware that licensees, other than the listing agent, are
volunteering to conduct an open house on behalf of a listing agent for the primary purpose
of recruiting prospective buyer clients.
There seems to be a misconception by the licensee conducting the open house that the law
of agency is different for them than it would be with respect to the listing agent.
Both the listing agent and the licensee conducting the open house are affiliated with the
listing broker and, therefore, the duties owed at the open house are exclusively to the
seller.

There is no distinction between a listing agent conducting the open house and a licensee
affiliated with the listing broker acting as the selling agent at such open house.
Any agent affiliated with the listing broker who holds an open house is at the open house to
represent the seller's interest exclusively and to act as the seller's agent.
The Commission advises that it is improper to solicit that buyer as a client or customer
while attending the open house.
Furthermore, the licensee attending the open house and representing the seller exclusively,
should not have any substantive discussions with a prospective buyer concerning other
properties, or buyer representation, while at the open house.
Such discussion may occur at a different time and place. For example, the selling agent
could arrange to meet with a prospective buyer at another location after the open house is
completed. The selling agent of the open house is also permitted to contact prospective
buyers from the sign-in sheet after the open house has been completed.

Member Spotlight: Helen Malakoff, SVP of Finance
Helen Malakoff was named Senior Vice President of Finance effective March 2010. As Senior
Vice President of Finance, she manages the corporate accounting functions with an
emphasis on the accounting software interface and systems, as well as ledger creation,
internal controls, financial reporting, and all facets of the accounting operations
management.
Helen joined RE/MAX Allegiance in September 2003 as a Management Accountant, she was
promoted to Controller in March 2005 and assisted with the process of establishing the
consolidated central accounting office for the newly merged Allegiance operations. She was
promoted to Vice President in February 2009.
Prior to joining RE/MAX Allegiance, Helen was a Financial Accountant at Bioglan Pharma
PLC, a British pharmaceutical company based Hitchin, UK. There she supervised the
accounting staff, administered all the international company’s accounting activities including
financial statements, budget/variance analysis and forecasting.
With over eighteen years of accounting and finance experience in industries such as Real
Estate, Pharmaceutical, Manufacturing, and Government, Helen has a large base of industry
knowledge. She has specialized in systems accounting, budget/variance analysis, and
developing process and internal controls.
Helen has a Bachelor of Science degree in Accounting. She is a member of the American
Institute of Certified Public Accountants.
She currently lives in Tampa, Florida with her husband Dave, and their two children.
