Many people struggle with this very same question day-to-day. It is easy to get stuck in the long term goal setting phase but if you do not put your goals into action, it becomes a waste of time. You may also ask yourself, what can you do to bridge the gap between setting goals and taking the necessary steps to become successful in achieving your goals? The answer is simple: Take action. There is no time like the present moment to start to implement your goals. Here are a few simple steps that I have applied and will be helpful in helping you take action in the present moment. Believing is Achieving Believing in yourself is the first step in taking action and achieving success. Success is attainable to everybody. However, you have to believe in yourself in order to achieve whatever it is you may want to be successful in. A great book on this is “Think and Grow Rich”, by Napoleon Hill. It is a must read for anyone! It will help you with the belief and mindset needed to achieve your goals. Hold yourself accountable for your OWN actions “Develop success from failures. Believing is AchievingBelieving in yourself is the first step in taking actionand achieving success. Success is attainable toeverybody. Sharknado 3: Oh Hell No! I admit it. I’ve watched everySharknado movie and loved every one. They are so silly and sofar out there, how could you not. Now, my wife has anotheropinion – not a fan. Something about a complete waste oftime. The “Oh hell no!” part of the title means somethingtotally different to her. I think mindless entertainment has itsplace and disappearing for 90 minutes to totally decompresscan be a good thing. So, I have refused to delete the recordingof Sharknado 3 and keep trying to get her to watch it. I willsucceed! I almost for-got…there will be aSharknado 4 – can’t wait!

Did you enjoy your vaca-tion? You know what? Ididn’t. I took a month off,but then I worked almostevery day. Sure, I got out ofthe heat and that was reallynice. My routine changedand that was beneficial. But,I didn’t take full advantage ofthe time off. That was stupid.

Vacation redo: I’m going totry again with three weeks off between September and October.This time I’m going further away and will vanish completely. (Ithink)

Electronic meetings & information: AZREIA had a very suc-cessful online meeting in July. 262 investors attended thewebinar where we kept you up-to-date on the market condi-tions and delivered the Haves & Wants. We also had anunprecedented response to the after meeting survey with nearly100 responses. Almost all were very positive and several hadsome very constructive suggestions. Thanks to all who partici-pated and provided their input.

Electronic meetings & information – what’s next? July’sonline meeting opened our eyes and our brains to figuring outwhat and how to offer future enhancements. At our Augustmeeting over 60 people signed in and viewed the MarketUpdate charts on their mobile device. That was about 20% ofthe attendees. It made the number charts easier to read. Weplan on continuing this over the next few months to see if par-ticipation grows. You must have a Facebook account to get thelink. We are experimenting with Periscope, too. We have alsobegun discussions with National REIA about the more remoteareas of Arizona and delivering content electronically to thesemarkets including Flagstaff and Yuma. Stay tuned!

Life happens! An AZREIA member I hadn’t seen in a whileshowed up at our August meeting. It was great to see her back.She experienced a similar experience I had gone through a fewyears ago – losing all four parents in a very short two year peri-od and being a caregiver for an extended period. Unless youexperience this type of thing you have no idea of the mentaland physical challenges. And while we all grieve in our ownway, the grieving process with multiple deaths over a short peri-od seems to take a different path. Being an accomplished

full-time investor helped herbe able to dedicate the timeneeded to the family and her.

Making Money versusSaving Money: My answer?Both! You should focus onthe top line and the expenseline to take care of the bot-tom line. Sometimes it takesvery little effort to reduceexpenses. I think that is whyThe Home Depot rebateProgram has been so success-ful. Once you set it up, otherthan updating your accounts,

you just forget it, and twice a year you get money back if youspent a pretty low qualifying amount. I think the same aboutthe new price saving programs for paint and appliances. It’sridiculously easy to save 20% on paint, so everyone should geton board right away. The Appliance Program takes a smallchange in behavior which for most of us is a little challenging.But, as with most things, once you change (it really is simple)and see the savings, you’ll be hooked. My challenge to you…get started now, don’t wait to change.

I’m out of space. This month’s meetings are really going to bedifferent and special. Interviewing Wendy Patton to understandher success factors will be revealing to everyone. Knowing howshe structures her deals using creative techniques like “leaseoptions” and “subject to” will be practical information to addto your negotiations. There is a bonus part of the Home Depotsavings session. Knowing what paint to buy depending on yourproject. Behr experts will be there and you will learn from themwhat to buy based on need. See you Monday, September 14thin Phoenix and Tuesday, September 15th in Tucson.

At the August AZREIA meeting, I gave twopresentations: one on fair housing and oneaddressing premises liability. Based uponthe conversations I had with people, I sus-pect that many members either think thatfair housing doesn’t apply to them or that it’sjust an issue for large operators and thatmembers won’t run into fair housing prob-lems. Often times, people are wrong onboth premises. There are “testers” out rightnow looking for small operators and tryingto catch those violating fair housing laws.Most testers know that large companies have

policies and procedures to address fair hous-ing matters, but that a small landlord maynot. Therefore, these landlords are an easytarget for a “tester” who will file suit if theythink they found a violation.

Fair housing is incredibly broad and itshould be assumed that when you are deal-ing with residential property, that fairhousing laws apply. Many clients tell methat they aren’t covered by fair housing, andtherefore they don’t worry about it. First, Itry to explain that all people should complywith fair housing, even if they do fall withina narrow exception. Further, if they do notintend on complying, they should be 100%sure that they are protected under an excep-tion to the law.

For AZREIA members, the most commonexceptions which may apply and allow aninvestor to not be bound by fair housinginclude: (1) Owner-occupied properties con-taining four or less units (this is known asthe Mrs. Murphy Exception); (2) singlefamily home sold or rented without the use

of a broker if the landlord/seller does notown more than three such single familyhomes at one time. An important cut out,however, provides that these exceptions donot apply if the investor advertises the resi-dential property. Therefore, even where theperson may be able to discriminate and limitthe persons to whom they rent, they cannotuse discriminatory advertising. This is likelywhere all AZREIA members become boundby fair housing.

I promote and support fair housing laws andstrongly suggest to clients that they not playthe “exception game” by trying to avoid theapplication of fair housing laws. The excep-tions should be used only for those narrowinstances where you are living in a propertywith four or less units, and you want torestrict the tenants that are living with you.Beyond that, I would always suggest follow-ing fair housing rules. Remember, the bestway to avoid fair housing problems is tohave an objective application standardand accept any applicants who qualify.

Arizona real estate investors and entre-preneurs received great news recentlywith the new Arizona intrastate crowd-funding law which became effective onJuly 3, 2015. The Arizona-focusedchanges made improvements to thecrowdfunding benefits promised by thefederal Jumpstart Our Business StartupsAct, commonly known as the JOBSAct. Arizona business owners no longerhave to wait until federal rules areissued under the JOBS Act, which hasbeen a thorn on investment sponsorsside who are seeking to raise capital tofund opportunistic ventures.The new Arizona law will have thebiggest positive impact on those seekingto raise smaller amounts of capital anddo not expect to raise a larger amountfrom angel investors, venture capitalistsor private equity firms in the nearfuture. Why? Because these types ofgroups don’t have an appetite to funddeals in which there are a large group ofsmall balance or unsophisticatedinvestors. Many AZREIA membersdesire to raise capital to fund multipledeals and/or higher priced investmentopportunities but don’t want to gothrough the complex and costly processof creating a private security. Well, nowyou don’t!

Summary of Pros• Process available to all Arizona

investors. Non-accredited investorsare limited to $10,000 each butthere is no investment limitation foraccredited investors

• General public solicitation is allow-able by simply directing potentialinvestors to a website hosted by anArizona third party

• Private placement memorandum(PPM) filings and notices with thestate of Arizona regulators will notinvolve burdensome review

• Company insiders such as officers,directors, 10% owners and partner’sinvestment amounts will not becounted towards the cap of $1M(without audited financials) or$2.5M (with audited financials) onthe total offering sizes

Keep in mind that these changes wereimplemented in an effort to help theeconomy and create jobs in Arizona.Therefore, any entrepreneurs that arenot truly “Arizona-based” and cannotprove that at least 80% of the compa-ny’s gross revenues in the most recentfiscal year are derived in Arizona willnot benefit from the new law.Investment offers and sales must also bemade to Arizona residents only, as wellas, any resales in the secondary marketduring the offering period and ninemonths after. Overall, however, thenews is certainly positive and real estateinvestors seeking capital should certain-ly rejoice that regulations are looseningin their state and opening the flood-gates of opportunity to get theirventures funded more easily. Weencourage you to speak to a knowledge-able attorney that specializes in securitylaw to help you navigate the new lawand get you set up for success!

As you might have already experienced fromjust walking outside, summer is upon us.And with that, brings the incredible heat ofArizona. This also brings one our biggestmaintenance emergencies that we deal withduring this time and that is the A/C unitsgoing out.

The main concern as a landlord inmaintenance emergencies is your responsetime and I don’t mean when you get theissue taken care of. I mean making sure thetenant hears your voice and knows you areworking on it. That is half the battle. Ifthey get your voice mail with several hoursgoing by then the problem grows bigger intheir head. Obviously getting someone outto the property to handle the situation is alarge part as well but not nearly as much asthe first communication with the tenant.Of course depending on the emergencycould mean how much more damage isbeing done to your property by not gettingsomeone out there to take care of it such asa water leak or structural damage.

The issue that we usually run into and Ihave heard as well from other managementcompanies, is the tenant wanting to be putup in a hotel or to be reimbursed forfood/groceries. Although some of ourowners have agreed to that, you are notrequired by law to take care of that for thetenant. However, per the Landlord TenantAct, the tenant can submit a 10 day noticein writing if there are health and safetyissues at risk. I put the actual verbiagebelow to help clarify. This is known as“Noncompliance by the Landlord”.

“If the landlord fails to comply with the leasein a material way, the tenant can deliver a

written notice to the landlord explaining thefailure and stating that the lease will terminatein 10 days. If the landlord’s noncompliance ismaterially affecting the tenant’s health andsafety, then the same notice can state that thelease will end in 5 days. There are twoexceptions. First, if the problem can be fixedbefore the date specified on the notice, then thelease will continue. Second, the problemcannot have been caused by the tenant or hisguest.”

If you’re a little confused on whatconstitutes a legitimate emergency, here aresome issues that landlords should respond toas quickly as possible. And remember, ifyou’re not sure, err on the side of theemergency being important and pick up thephone and call. If you can, it would also beworth getting a separate emergency line justfor these issues and you can leave a detailedmessage on there in the event you can’t pickup the first time.

• Major leaks, including both stormrelated damages, or issues such as a toiletor sink overflowing from an upstairsunit.

• Lack of heat or cool air. This is an issuethat needs to be addressed immediately,

particularly in extreme cold and hotclimates.

• Any structural issues. This can includeanything from collapsing balconies,stairways, carports, or ceilings that couldcause liability issues if someone gets hurt.

• Any gas smells. While hopefully tenantshave been instructed to call the local gascompany in the event of a gas smell, thisis an issue that managers need to addresspromptly as well.

• Lack of running water. Again, this is anissue that constitutes an emergency, andproperty managers should respondaccordingly.

• A break in. This could include anythingfrom a broken lock to a shattered frontdoor where the property might not besecured for a tenant

While landlords should never be expected torespond to every issue that arises after hours,it’s important for tenants to know thatshould an emergency arise outside normalbusiness hours, you’re only a phone callaway.

Cyber crime is on the rise and it is quicklybecoming a real issue in today’s businesspractice. Most real estate investors handleprivate, none public information on adaily basis. With smart phones and tabletsbecoming our most common mode ofcommunication, we are now faced with anadded layer of liability that we have nothad to deal with much in the past…Cyber Criminals.

For you “kitchen table” investors, youneed to be cautious when gathering andstoring your client’s non-public informa-tion. Should ahacker get theirhands on youremail any num-ber of crimescould be com-mitted againstyou and yourclients. Anexample we havebeen seeing onthe rise: Youremail getshacked by acyber-criminalwho sends an e-mail to the titlecompany han-dling yourtransactioninstructing themwith new wireinstructions forthe sale pro-ceeds. It appearsthat the e-mail

has been sent by you. If the TitleCompany you are working with does nothave practices and procedures in place toverify the wire information with you ver-bally, your proceeds are at risk for beingredirected to the cyber-criminal. Youshould check in advance that you and any-one you are working with has the abilityto send all correspondence via e-mail in asecure fashion. The potential for loss doesnot stop at theft if you send nonpublicinformation from an unsecured device andthe identity of one of your clients is stolen.It could mean a hefty lawsuit for you andyour company if your client’s private infor-mation lands in the wrong hands.

A big no-no that I have seen in the past iswhen you take pictures of documents withprivate information and then email or textthem. This is not a secure way to transmitprivate non-public client information. Agreat rule of thumb is to protect yourclient’s information as you would yourown. With cybercriminals using so many

techniques to attack users’ data, multi-layer defenses are a necessity. Anti-malwaresolutions that combine signature-baseddetection and cloud-assisted technologiescan do more to defend your devices anddata against new threats. It is also impor-tant to make sure all of your software is upto date on all of your devices. There aregreat resources on how to make sure youare protected available on the FBI websiteat www.FBI.gov.

Q: Can I force my tenant to get renter’s insurance andwhat do I do if they don’t provide me proof that theyhave it?

A: Under the Arizona Residential Landlord and TenantAct, your lease can have any lease provisions youwant as long as they don’t violate the Act. See A.R.S.§ 33-1315. There is nothing in the Act prohibiting alandlord from mandating that a tenant maintaininsurance, and there are good reasons why a landlordwould want to. Renter’s insurance is designed tocover the tenant’s loss of personal property and to

protect the tenant in the event that the tenant is responsiblefor injury to, or property damages of, others. The leaseshould specify that (1) the appropriate insurance must beobtained prior to the lease commencement and maintainedduring the lease term; and (2) the tenant must provide proofof insurance at lease commencement and upon request fromthe landlord. If a tenant fails to give proof of validinsurance, the landlord’s remedy is to serve a 10 day noticefor non-compliance with the lease.
