2016 ELECTION WILL IMPACT YOUAND YOUR BUSINESS

The 2016 Presidential election will frame public policy on a number of issues that will have an impact on you and your business:

• Estate Tax

• LIFO

• Obamacare

• Minimum Wage

• Family Leave

• Corporate Tax Rates

• S Corporation Tax Rates

• Depreciation Rules

• Fair Labor Standards Act

• Repatriation Taxes

• Federal Motor Fuel Taxes

• Vehicle Miles Traveled Tax

• Individual Tax Brackets

• Work Opportunity Tax Credits

• Retirement Savings

• Itemized Deductions

These issues will be examined and discussed at the WMDA/CAR Convention and Trade Show, beginning with the Industry Issues Forum, which will be held between 9:30 a.m. and 12:00 noon at the Ocean City Convention Center.

HOUSE REPUBLICAN TAX PROPOSAL

As we previously reported, at the end of June, the Republicans on the House Ways and Means Committee released their tax reform proposal. This “Blueprint” for tax reform is among a handful of issue-based proposals that House Republicans have

released to help frame the party platform in advance of the convention and the November elections. Now that we have had the opportunity to closely review the proposal and monitor various responses to it – we wanted to follow up to provide more details.

The proposal, which is presented in a report-style format and has not yet been reduced to legislative language, asserts that it will do three things – fuel job creation, make the tax code simpler and fairer, and transform the IRS.

The proponents of the plan have stated that it is intended to be revenue neutral. However, the Joint Committee on Taxation has not yet performed an analysis of the proposal. The conservative leaning Tax Foundation has, using dynamic scoring, estimated that the proposal would reduce revenue by $191 billion over ten years. On the other hand, the more liberal Citizen Tax Justice Group has estimated that the proposal would increase the national debt by $4 trillion over 10 years. Needless to say, with many elements of the proposals still in generalities and no legislative language – it is essentially impossible to predict its impact with much certainty.

individual taxation, and the Internal Revenue Service (IRS) as an entity.

Breaking down each of these focus areas, the key elements of the proposal are as follows:

Corporate Tax Reform

• The proposal would reduce the top corporate tax rate to 20% (from the current 35%). This would represent the biggest tax cut in history.

• S corporations and pass through entities would not be subject to the individual tax rate but would rather be subject to their own tax brackets with a top rate of 25%. (This is a change in the right direction, but we don’t see why the rates between pass-through entities and C corps shouldn’t be the same.)

• The proposal would repeal the Alternative Minimum Tax (AMT) for both individuals and corporation.

• The proposal would eliminate the current depreciation rules and instead provide for full immediate write off of investments.

• The proposal would allow interest expenses to be deducted against interest income. Any net interest expense could be carried forward indefi nitely and allowed as a deduction against interest income in future years. The proposal indicates that the Ways and Means Committee would work to prepare special rules for fi nancial services company.

• The proposal would preserve the last in fi rst out (LIFO) accounting method and the Research and Development Credit.

• The proposal would eliminate “special interest deductions and credits.” The proposal is not totally clear as to what is captured by this defi nition but it does indicate that this would include the domestic production deduction (Section 199) which the proposal indicates will no longer be necessary.

• To address corporate inversions, the proposal would move the country to a destination and territorial based tax system under which the location of the consumption rather than the production would be the

relevant factor.

• The proposal would include a one-time repatriation rate of 8.75% for cash or liquid items abroad and a 3.5% rate for other assets. Companies repatriating assets would have eight years to pay these taxes.

• The proposal would provide a 100% exemption for dividends from foreign subsidiaries.

Individuals

• The proposal would consolidate the current seven tax brackets into three at 0/12% (not sure what 0/12% means), 25% and a top rate of 33% (currently top rate is 39.6%).

• The proposal would allow individuals to deduct 50% of net capital gains, dividends and interest income. Any remaining investment income would be taxed at 6%, 12.5% or 16.5% depending on the individual’s tax bracket.

• The proposal would establish simplifi ed “postcard fi ling” for individuals in which the entire tax fi ling would be reduced to a

• The proposal would consolidate the standard deduction, the additional standard deduction and the personal exemptions (including for children and dependents) and instead provide for an infl ation adjusted deduction of $24,000 for married fi ling jointly, $18,000 for single with a child and $12,000 for individuals.

• The proposal would convert the dependent exemption and child tax credits into a $1,500 child tax credit with the fi rst $1,000 being refundable and a $500 credit for non-child dependents. The proposal would also adjust the phase out for married joint fi lers allowing married couples to earn up to $150k before the phase out.

• The proposal retains the Earned Income Tax Credit (EITC) but directs the Ways and Means Committee to look into ways to reduce fraud.

• The proposal states that the Ways and Means Committee will work to develop a proposal to consolidate the higher education benefi ts to make them more effective.

• Under the proposal, health insurance will continue to be excluded from income. (We have heard, however, from a very reliable source, that they expect the legislation to have a 75% cap on the tax exclusion for health care on the individual side but retain the 100% deduction for health insurance on the employer side.)

• Under the proposal, retirement savings incentives will be retained and the Ways and Means Committee states that it will be examining options to make retirement savings more effi cient. (We’ll need to monitor this carefully since often making retirement savings more effi cient is a euphemism for cutting back on available options and contribution levels.)

• The proposal would eliminate all itemized deductions except for the mortgage interest deduction and the charitable deduction. (The loss of the deduction for state income taxes could hit some taxpayers very hard.)

• Finally, the proposal would repeal the estate and gift tax. (Note that there is no mention of retaining the step-up in basis in the proposal. Thus, the repeal of the estate tax without a retention of the step-up in basis would be, for the vast majority of small business owners, a tax increase.)

Internal Revenue Service (IRS)

• The proposal states that it would streamline the IRS by moving it towards a “service fi rst” mission and creating separate individual and business units.

• The proposal would create an independent small claims court independent of the IRS, to resolve routine tax disputes.

• The Proposal would create an IRS Administrator appointed by the President with the advice and consent of the Senate.

Overall the proposal retains most of the big ticket items, like the home mortgage deduction and the earned income tax credit, the repeal of which would make the proposal more controversial. The proposal would provide more favorable treatment to S corporations and pass through entities but still does not place them on a level playing fi eld with C corporations. We are also concerned by the fact that, in repealing the estate tax and GST tax, the proposal does not mention the step-up in basis (which, as we have discussed in prior alerts, could prove problematic for small businesses and their owners).

The bottom line is that, because it is not in legislative form, the proposal lacks the level of specifi city that will be necessary to identify how many of these proposals will impact small businesses and their owners. Moreover, it is unclear how this proposal would be revenue neutral and, if it is, what the revenue raisers would be.

RESPONSES TO THE PLAN

As can be expected, the response t o the proposal has been divided largely along party lines.

Congressman Sander Levin (D-MI), the ranking member on Ways and Means, criticized the proposal as being overly broad and lacking details. Others on the left have criticized the proposal as helping the rich by shifting the tax burden more towards

compensation and away from investment income.

Reports have been that Republican Presidential Nominee Donald Trump has reacted positively to the proposal after staff level talks. Trump’s own tax proposal would reduce tax revenue (10.1 trillion over 10 years as estimated by the Tax Foundation) far more severely than the House proposal. However, this proposal and budget number have raised concerns from both sides of the aisle. Obviously, the outcome of the election, including which party wins the White House and which party controls each chamber will largely determine the future of the proposal and whether it will get consideration next year. ◆

Is it just me, or has going to D.C. become an all-day event?

With the metro system continuing to experience delays while dealing with service and repair issues, the roadways in the Nation’s Capital have fi lled up.

Even during non-rush hour times, traffi c continues to gridlock the city. I travel to Washington a few times a week for legislative issues and it has not been uncommon lately for it to take me 1-2 hours to get home or back to the offi ce in Bowie. While talking with dealers and repair shop owners, I am fi nding that they are experiencing the same delays.

Wallethub recently did a survey of 100 of the most populated cities in the United States to fi nd out which have the best and worst commutes for drivers. The survey looked at 21 different metrics in determining the rankings including average gas prices, vehicle costs, car thefts, time spent in traffi c, weather, and even

the number of car washes among other things.

After compiling the results, the evidence was clear, D.C. has the worst traffi c in the nation. With Baltimore following closely behind with the 95th rank.

According to Richie Bernardo who conducted the survey, “Each year in the Nation’s Capital, those who drive spend an average of about 200 hours on the road, plus another 41 hours in gridlock. For a full-time worker, 241 hours is the equivalent of a six-week vacation.”

He adds that as a nation we spend about $124 billion annually on wasted time and fuel due to traffi c congestion which comes out to $1,700 per household.

The good news for service station dealers is that this means for gas for consumers and for repair shop owners, it means

more cars in the shops. That’s because the average household spends an additional $515 a year on car maintenance when living or working in highly congested areas.

Another reason for continual repair work is because of the poor road conditions in Washington and the surrounding states. America’s roads are currently ranked number 14 out of 140 for economically developed nations according to the World Economic Forum and graded a “D” by the American Society of Civil Engineers. The recent highway bill has spurred some construction but we remain way behind on maintenance and improvements for infrastructure.

With this growing problem impacting so many other legislative issues, please attend the 2016 WMDA/CAR Industry Issues Forum (Friday, September 9, 2016 from 9:30 a.m. - 12:00 p.m. at the Ocean City Convention Center) so we can discuss it!

CAR TALKLooking Forward to the WMDA/CAR Convention

While speaking with a few members of the CAR committee, I realized the Convention means different things to different people. To us at British American Auto Care, it was about celebrating the year and rewarding our employees with a weekend in Ocean City.

We attend the Harry T. Murphy Customer Service Award Breakfast, learn something during the training sessions, and have a dinner with employees and their families.

For some members, it’s a weekend away from the shop to play golf, socialize with fellow shop owner friends, and see what’s new this year at the Trade Show. To others, it’s a weekend to learn, share opinions, and help the industry any way they can.

These are all reasons to attend the Convention and Trade Show. What really excites me this year is getting a sneak peek at what’s taking place this year. Our shop has been a member of the

WMDA for more years than I can count, but this is MY fi rst year to experience the whole long weekend of CAR everything – and here’s what I’m looking forward to:

Oil Made Easy – This session is going to knock your socks off with how easy Castrol has made it to fi nd the right oil for any car… fast. I mean, enter the license plate number and bam, there it is. What oil the car calls for, what would be a better oil for that car, and the best oil possible for that car. Not just engine oil, but transmission and power steering fl uid too! (Friday, September 9, at the Ocean City Convention Center, from 1:00 p.m. - 2:00 p.m.)

Next, the CAR Roundtable for Repair – I was amazed when I attended the roundtable discussion at the Auto Repair Summit this spring. This discussion is what made me want to do more for WMDA/CAR. Knowing there are people willing to do more than just talk about their problems, but people willing to put in the time to help everyone deal with the common issues we all have. Finding good techs, starting a tool share program, buying the right equipment, and so much more.

Did you know the committee is working on hosting a job fair next year? They’re still working out the details and would love to hear what you would want in a job fair.

Oh, and the tool share program, yup, that’s in the works too. To make all these programs successful, we need you to attend the Roundtable discussion. We want to hear what would help you with your business and what ideas you have to make things easier for other repair shop owners. (Saturday, September 10, at the Ocean City Convention Center, from 10:00 a.m. - 11:15 a.m.)

And fi nally, the Trade Show. I’ll admit, I always liked the giveaways and seeing what cool new things vendors had, but last year, I learned what these trade shows are all about. Having most of our technicians with us, made it great picking out a new alignment machine.

They got to see it and touch it and learn a little more about it before it shows up to be installed. While writing this, our new alignment machine is being delivered! Yes, the same one we checked out at the trade show last year.

So whether you are attending by yourself, with your spouse, or the whole shop, there is something for everyone. ◆

KIRK’S KORNERMurf’s Turf – What Is the Future of the Independent Dealer?

What is an Independent Dealer? Do they lease or franchise from a supplier? Do they own their property and have a supply contract for fuel? Are they a single station owner or a multi station owner? Are they a commissioned agent?

In truth, they are all Independent Dealers, and as business owners, they each have a considerable investment and are looking for a return on that investment, and equity.

Over the years our members have been through many changes, and they are not likely to stop now. Your business model might also need adjusting.

No one can predict the future, but I think we have something that is much better than speculation or reading Tarot Cards.

At Murf’s Turf (Friday, September 9, from 2:00 p.m. - 4:00 p.m. at the Ocean City Convention Center) we will have a panel of experts on this subject. The panel will consist of:

• Blackie Bowen of Ewing Oil

• Abdol Ejtemai of PMG

• John Phelps of Carroll Motor Fuel and

• Mel Strine of SMO/PEH

This is a “must attend” event if you are in the fuel selling business.

Questions that will be addressed include:

• Who will survive lease or own?

• What can we expect when supply contracts to fl y a major fl ag are up?

• How much more will the big box stations expand?

• Is the 3-bay station a thing of the past or maybe a model for the future?

• We see major rebuilds and NTI’s going up at a pace we have not seen since the 60’s – how will this affect the legacy stations?

• In the last three months we have seen concerns over tank age and other issues related to UST’s. Both the insurance industry and MDE have put limits on, or have explored, the age issue. How big of a problem will that become for a small lot owner, or a small leased property?

• Could the cost outweigh the profi t potential for suppler owned sites? Or a dealer owned site?

Clearly these are just a few of the questionsthat will be addressed at Murf’s Turf Town Hall Meeting. Each one of our panel members will tell you what their vision of the future is for independent dealers.
