Polk gets $15k from White Oak, gives developers 120 more days to answer lawsuitby Leah Justice

Polk County has given White Oak Development Partners, LLC an additional 120 days to answer a lawsuit the county filed against the developers, who have not completed pay-ments for a water line.

Polk County Manager Ryan Whitson told commissioners

Monday that White Oak was given the additional time and in return made another payment of $15,000.

White Oak failed to answer the suit by the most recent deadline of Sept. 8, but now has until sometime in January 2011 to respond to the suit.

velopment in July following failure to receive the remaining $135,752.50 in payments for a water line extension.

make additional payments. Af-ter receiving none, the county filed the suit in Polk County Civil Superior Court.

The suit is over White Oak’s failure to complete paying the county a total of $359,505, which the developers had agreed to pay the county for constructing an approximately two-mile water line extension to the subdivision. The exten-sion was completed last fall.

The county is claiming breach of contract, with dam-ages set at the amount owed. The county is asking that the money owed be paid with eight percent interest from the date of the breach of the contract.

The county sent a letter to White Oak on Jan. 13, 2010 through county attorney Tom Hix saying, “The Polk County Board of Commissioners has instructed me to communicate to you that you have ten (10) working days to pay the amount of $169,752.50 to fulfill your contract obligation for the water line, which is due and owing.”

Previously, White Oak had paid the county the first half of the balance.

Following Hix’s letter, White Oak asked the county to set up

a payment plan, which the county originally decided not to do. The county later agreed for White Oak to pay the county $34,000 per month for five months, with the payments ending in June, 2010. White Oak paid the first installment, but the county had received no further payments until the recent $15,000.

White Oak developer Jus-tin Kinsella said this summer that developers understand the county’s position and White Oak is working to resolve the matter soon. Developers said earlier in the year that the econ-omy has caused difficulties with the project, but that they are still committed to the development, having invested $30 million of their own resources.

Polk County paid for the wa-ter line extension out of its fund balance. The extension comes off the county’s main water line that runs through Polk County, connecting the Broad River Water Authority to the Inman Campobello Water District. White Oak’s water line runs from the Hwy. 14 and Hwy. 9 crossroad, down Sandy Plains Road to the development.

With the additional $15,000 payment made recently, White Oak now owes Polk County approximately $120,752.

Road work to start next week in downtown Columbus

The North Carolina Depart-ment of Transportation (DOT) will begin a construction proj-ect next week to install curbs, gutters and sidewalks on West Mills Street (Hwy. 108) in downtown Columbus.

The project is set to begin Monday, Sept. 27 and finish by Dec. 3. During this time, traf-fic delays can be expected as crews will be working along the shoulder and roadway of both the eastbound and westbound lanes.

The entire project area is from the intersection of West Mills Street and Park Street to the intersection of West Mills Street and Blanton Street. The sidewalk will be constructed on the south side of West Mills Street between Park and Blan-ton streets.

U.S. Justice Department accepting comments on Constitution Amendment

Anyone wishing to make com-ments to the U.S. Justice Depart-ment about a proposed change to the North Carolina Constitution appearing on the November 2 ballot may now do so.

The 2010 General Assembly approved a measure (Session Law 2010-49) that would ban convicted felons from serving as sheriffs in North Carolina.

If approved by voters, the amendment to Article VII, Sec-tion 2 of the North Carolina Constitution would add language stating that individuals convicted of a felony in North Carolina or any other state would be ineli-gible to serve as a sheriff in North Carolina whether or not his or her rights of citizenship have been restored.

The U.S. Justice Department looks at changes to state constitu-tions that could potentially affect voting rights to make sure they do not conflict with federal law. As part of that process, the Justice Department accepts comments from the public on such proposed

Columbus won't pay for Watson’s flood damagesby Leah Justice

The Town of Columbus has decided not to reimburse Wat-son’s Carpet for damages the business experienced during a heavy spring rain this year.

The town announced last week that it would not contrib-ute any funding to reimburse Watson's Carpet's Larry Hill the more than $9,000 of cleaning costs he paid as a result of the flooding.

The town has been discuss-ing Watson's Carpet's request for help for the past several months, receiving input from the town’s insurance company as well as from Hill’s engi-neer.

Columbus Mayor Eric McIn-tyre said last week that the town has spent a lot of time on the issue and it is the unanimous consensus of the board that the town shares no liability.

McIntyre said representa-tives of the N.C. League of Mu-nicipalities insurance, which covers the town, indicated that it felt the flooding was caused by the property own-ers’ negligence in maintaining the drains.

He also mentioned that water was able to enter at the front door because it was miss-ing a threshold on the bottom.

“I’m sure that’s not what you wanted to hear,” McIntyre told Hill. “I wish there was a way we could have helped you.”

Hill claimed that the prob-lem was caused after the town completed sidewalk work that left the sidewalk slightly higher than his front door. Hill stated repeatedly that the drains were kept clean by himself or even, at times, his parents, and that prior to the town’s street work, no flooding had ever occurred in the building’s history.

“You’re not doing the right thing,” Hill told council last week. “You’ve forced me to take other action. Thank you for your time.”

Polk adult day care renovations nearly completeby Leah Justice

Polk County’s new adult day care facility is nearing comple-tion with the grand opening just weeks away.

Polk County manager Ryan Whitson told commissioners Monday that the paving, parking spaces and striping are complete, and a circular area has been lev-eled off for landscaping.

Commissioners approved spending up to $1,000 for signage and $1,850 for landscaping.

The Don and Betsy Freeman Adult Day Care Center will need a few signs, with the main one be-

ing placed in front of the building. Other signage is needed at the top of the road directing traffic to either the adult day care facility or the Meeting Place Senior Center, lo-cated in front of the adult day care. Arrows directing traffic around a circle will also be needed.

The labor for the landscaping will be done at no cost to the county by the master gardeners.

The grand opening ceremony for the new facility, located off Skyuka Road near Columbus at the former Carolina Classical School building, is scheduled for Oct. 17 at 2 p.m.

winding mountain roads, and now several local organizations and mu-nicipalities have come together to help visitors navigate them.

A map project designed to help market the Landrum area of northern Spartanburg County in South Caro-lina as well as all of Polk County has been completed. The maps, which will highlight local businesses and attractions, are expected to be avail-able after the first of the year.

“This is really going to depict our entire economic area,” said Madelon Wallace, a local realtor who was the driving force and organizer of the map project. “We’re going to be able to show for the first time the four towns that create our economic anchor.

“It’s something we’ve needed for many, many years. So, we’re very excited.”

The municipalities of Landrum, Tryon and Saluda agreed to help fund the map project along with Polk County, the Carolina Foothills Chamber of Commerce, the Tryon-Polk County Board of Realtors and the Mill Spring Agricultural Devel-opment Center.

The project survived a “no” vote to funding by the Columbus City

Council.Wallace said Columbus will still

be included in the map, but will not receive the premium placement and depth of coverage of the areas that helped fund the project.

The total cost of the project was projected at $12,000 for an initial print run of 10,000, according to Landrum City Administrator Steve Wolochowicz.

“This is going to be a very nice map,” said Wallace. “We’ve never had anything like it, and it’s going to be the official map of the Carolina Foothills Chamber of Commerce.”

The map is being printed through CommunityLink, an Illinois-based company that specializes in the publication of marketing tools for chambers of commerce. Commu-nityLink has also printed maps for cities such as Auburn-Opelika, Ala., Hannibal, Mo., and Dorchester, Md. An online edition of the map will also be included in the purchase price, according to the Communi-tyLink website.

“We wanted a map that gets people from point-A to point-B, first of all,” Wallace said. “But we’ve also added a lot of interesting things with graphics highlighting things to see and do in the area. It’s going to be an attractive map.”

Rutherford Heritage Singers present concert September 26

The Rutherford County Heritage Singers will present a concert of sacred music on Sunday afternoon, September 26, at 3 p.m. at the Ru-therfordton Presbyterian Church, located at 252 N. Washington Street. The musical group is spon-sored by the Rutherford County Historical Society.

The program will include an-thems and other choral numbers written or arranged by musicians with a Rutherford County connec-tion. Featured composers include Austin C. Lovelace, Joseph M. Martin and William Walker.

The choir will be under the direction of Lesley M. Bush of Rutherfordton. Bush is the minis-ter of music at Tryon Presbyterian Church and a board member of the Rutherford County Historical Soci-ety. Principal accompanist will be

Bob Bridges, also of Rutherfordton, pianist at Piedmont Baptist Church. Guest directors include Beth Hef-fner, minister of music at the First Baptist Church of Rutherfordton, and Richard Kennedy, choir direc-tor at Tryon Presbyterian Church.

The Heritage Singers communi-ty chorus was formed in 2009. The group currently includes 44 singers from many areas of Rutherford and surrounding counties, in North and South Carolina. The choir repre-sents the only county-wide choral group presenting a regular schedule of secular and sacred concerts to the public in Rutherford County.

Piper Kevin Brode rounds out Rogers Park concert series Sept. 24

This Friday, Sep-tember 24 at 7 p.m. in Rogers Park, the sea-son’s last scheduled free concert will be held as piper Kevin Brode presents a listener’s guide to the bagpipe.

Playing what is ar-guably the most diffi-cult woodwind instru-ment in the world, the Great Highland Bag-pipe, Kevin Brode has reached a level of pro-ficiency rarely heard from this instrument. Brode has played for audiences across the country, entertaining them by combining solid techni-cal proficiency with musical ad-venture, while providing insight into the development of this most unique wind instrument. From the kilt that he wears to the silver inlaid instrument that he plays, his performances entertain and inform.

Drawn to the Great Highland Bagpipe in the late 90s, after having viewed a performance of Riverdance, Brode has been unstoppable in his pursuit of pro-ficiency on the instrument. While the bagpipe is not an instrument that everyone desires to play, it is an instrument that demands attention when played well.

Developed in the second cen-tury AD, the bagpipe has slowly

evolved into the complex in-strument that Brode now plays. Earlier in the past century, for example, one could expect to see a bagpipe on the field of battle, providing troop “direction” and motivation through specifically chosen songs.

In more peaceful times, the bagpipe was used to play “re-treats” near sundown to announce the closing of the city gates. Throughout his performance this Friday, Brode will relay a history of the instrument, its songs and their ancient uses.

As per usual, bring a friend, a picnic and a beverage on this Friday, September 24, beginning at 7 p.m. in Tryon’s Rogers Park. Donations are encouraged.

tain of his own charter sailboat in the Bahamas. Each week during charter season, which runs from March through Au-gust, Captain Bruce runs one-week charter voyages out of his base in Nas-sau. The groups that charter the Bahama Star, his fifty-three-foot sloop, run the gamut from church youth groups to corporate execu-tives. The accommodations are less than luxurious (sort of like camping at sea), and the food, while tasty and plenti-ful, is by no means five-star cuisine.

Bruce and his wife Sheila share a so-called double bunk – which is about as wide as a twin bed. The bunk is located within five feet of the two heads– marine toilets – mak-ing for a less-than-fragrant resting place. That’s okay, because Bruce doesn’t get

much sleep anyway. In ad-dition to running the boat, he cooks the meals, maintains the boat and its diesel engine, and charts the daily course – all while closely monitoring the safety and enjoyment of his passengers.

Clearly, this is not the job for everyone. But Captain Bruce tackles it with a joy that is hard to resist. He ob-

viously loves his life and en-joys every moment. He almost always has a smile on his face – not just a friendly smile, but a huge grin that comes from deep down inside.

He makes his passengers feel like family, because that’s how he truly feels about them. His favorite expression of de-light or surprise is a loud and hearty “AAARRRGGGGHH-HHH!” that sends sympathetic vibrations to the top of the mast. on June 16, the tryon Kiwanis Club took a “field trip” to the smith Phayer hospice house in landrum. diane nelson talked to the club members about how the building of the house was a community effort involving individuals, families, businesses, churches, and of course, hospice of the Carolina foothills. Kiwanian Bob scruggs presented several quilted throws made by a family member in grateful appreciation of the care his father-in-law received there during the last days of his life. the group split up for tours by nelson. the picture above shows Bob reeves, diane nelson, audrey and ed Klatte, and ed Komorous in the reception area. Dark Corner folklore exhibit begins Oct. 5 at Landrum Library

“The Dark Corner: Docu-menting the Oral Tradition” was a 1983 project to preserve the rich folklore of the moun-tainous region, sponsored by Limestone College and The South Carolina Committee for the Humanities. Dr. Bernard Zaidman, Limestone professor of English at that time, was director for the project, funded in part by the South Carolina Committee, a state-based agent of the National Endowment for the Humanities.

Research and interviews were conducted with 39 residents of

Dark Corner during the summer. Audio tapes and transcripts of in-terviews, black-and-white pho-tographs and color slides were gathered and displayed during some 30 lectures in state and national venues, before copies of the materials were deposited in eight libraries and archives.

Landrum Library will begin an exhibit of the vintage pho-tographs by David Green of documentation participants and scenes at 6:30 p.m. on Tuesday, October 5. Dean Campbell, ombudsman for the project, will be in the gallery to provide

background information on the undertaking and answer any questions concerning it.

Long-time residents of up-per Greenville and Spartanburg Counties will recognize most of the pictured individuals, many of whom have died in the inter-vening years. New residents of the area will be able to put faces to names they may have heard mentioned in discussions of the area’s heritage.

The photographs will remain on exhibit at the library through October.
