be free, that your organization does not profit financially from sharing their works.

• Page 57: “The only requirement is that the copyright owner must share with the other co-owners any profits derived from the use of the work.” (This is why it is important to let copyright holder/s know that no funds are being created from the digital project).

NERF Process

• May take several meetings

• Text should represent the mission of institution

• Several forms before final is ready

• “This agreement grants a non-exclusive, royalty-free, perpetual, world-wide license to the Colorado School of Mines (“CSM”) to place a copy of your copyrighted works listed above on CSM’s digital repository. This publication in digitized form is a way for your works to be used and cited more often. If the articles were commissioned by another person or organization or were written as part of the duties of an employee, an authorized representative of the commissioning organization or employer should sign. (See page 4 for explanation of conditions.)”

• Create a table at top to list multiple works of an author or contact.

• Give definitions throughout the form

• Give area for additional authors to sign if needed.

NERF Process• The United States copyright laws require CSM to obtain

specific rights to articles published. This legal requirement does not alter in any way the long-standing relationship between CSM and its authors, nor does it change the philosophy behind CSM’s practice of copyrighting its journals and books.

• CSM’s philosophy recognizes the need to ensure that authors have a say in how their works are used and the necessity to foster broad dissemination of scientific literature while protecting the viability of the publication system.

• Authors still retain all proprietary rights in their works but, by this license, have granted CSM the non-exclusive perpetual ability to create a copy of the full work and to publish such work in CSM’s digital repository and libraries and to make such work available for use by those with access to the repository and libraries.

• As technology changes, this license will allow CSM to continue to make the work available for public use through its library systems via other media. You are still entitled to use the work for your own purposes and to grant additional non-exclusive licenses to third parties to use your work.
