ACTIVITY 1: EXPLORING THE RULE OF LAW PRINCIPLES (25 mins) လႈ ရားမႈ ၁ - တရားဥေဒစ းမ းေရး မအား ေလလာျခငး (၂၅ မ နစ) Purpose of Activity: To increase participant knowledge of the 13 rule of law principles identified in previous sessions. လႈ ရားမႈ၏ရညရြယခက - ၿ းခြသည အစအစဥမားတြင ေဖာထတေလလာခြေသာ တရားဥေဒစ းမ းေရးမ (၁၃) ခက အား မ သ ရ လာေစရန။ Methodology: Group discussions, presentations. သငၾကားေရးနညးစနစ - အစလ ကေဆြးောႏြးျခငးမား၊ တငျျခငးမား။ Materials: Whiteboard/flip chart and markers, 13 pieces of A4 paper, each one with a different rule of law principle written on. x Divide participants into groups of 3-4. Each group takes turns to take a piece of paper with a rule of law principle written on it. When participants are making their selection, the paper should be turned over so that they cannot see what rule of law principle they are taking. Repeat until all the principles have been selected (each group will have several).

Notes to facilitators သငတနးနညးျမားအတြက မတစမား Explain to participants that this session will focus on the 13 rule of law principles that we identified in the previous session. Explain that rule of law is a system of governance which protects human rights and is an important foundation of democracy. Rule of law is particularly important in contexts that have been affected by conflict or have undergone political transitions. In these environments, people often lack trust in the government and in officials such as police, judges and civil servants. By building strong rule of law and by integrating rule of law principles into laws, institutions and procedures, we can start to rebuild trust and to repair broken relationships between those who govern (the government, officials) and those who are governed (the public). Rule of law helps to establish fairer systems of governance that work for everybody, and not just for the interests of elites. ACTIVITY 2: RULE OF LAW V RULE BY LAW (30 mins) လႈ ရားမႈ ၂ - တရားဥေဒစ းမ းေရး v ဥေဒျဖင အ ခ ျခငး (၃၀ မ နစ) Purpose of Activity: To ensure that participants understand the difference between rule of law and rule by law. လႈ ရားမႈ၏ရညရြယခက - တရားဥေဒစ းမ းေရးာႏငဥေဒမားျဖငအခ ျခငး၏ကြြျားက နားလညလာေစရန။ Methodology: Discussion, sharing knowledge, critical thinking. သငၾကားေရးနညးစနစ - ေဆြးောႏြးျခငး၊ အသ ညာ မေဝျခငး၊ ေဝဖန ငးျခား ေတြးေတာျခငး Materials: Flipchart, marker pens, large post-it notes. On the flipchart, facilitators should split the page into two columns, one column titled rule by law and the other rule of law.

x Invite participants to take turns in taking one of the cut-up sentences from Handout 8.1.3. Each participant reads the note out loud and then places it in the column they think is correct.

Once the chart has been completed, facilitators should ask participants to focus on the statements under the heading ‘Rule BY Law’. How can we change the rule BY law statements into rule OF law principles? Facilitators should encourage participants to focus on how it is possible (what mechanisms, policies, laws, procedures etc.) to transform rule BY law into rule OF law. Eg. we can address the issue of people being afraid to voice their political views openly by ensuring that laws do not impose unnecessary restrictions on freedom of speech; by creating safe environments for open and respectful discussion (like the Rule of Law Centres); by ensuring that courts are empowered to protect the right to freedom of expression. (10 mins)

There is no universal definition of ‘rule of law’. Definitions should encompass the principles and values that we discuss in this workshop. One example of a good definition of rule of law is that of the former UN Secretary-General, Kofi Annan, who described rule of law as “a principle of governance in which all persons, institutions and entities, public and private, including the State itself, are accountable to laws that are publicly promulgated, equally enforced and independently adjudicated, and which are consistent with international human rights norms and standards. This approach enables survivors to make informed decisions about how the situation will be addressed. Different actors need to work together in the provision of SGBV responses, so it is important for lawyers, paralegals and CSOs to be aware of the services that are available for survivors and how to refer the survivor to them. Non-legal actors include doctors, social workers and counsellors. Often, for survivors, the process of seeing many different people and having to explain their situation repeatedly is traumatic. A survivor-centred approach should be efficient and streamlined wherever possible in order to minimise the trauma to the survivor. ေဒၚပ ပ ဝငး ႏင သဇာအ

Daw Pyo Pyo Win has been working all day on a local farm close to her village. She has returned home to find her 19-year-old daughter very upset. Her daughter, Thuzar Ei, tells her mother that she has been raped. She explains that one of the neighbours, a local man of around 20 years old, came to the house and asked for her help to fix something in his home. When Thuzar Ei went with him to his house, he became very aggressive to Thuzar Ei and when she tried to leave, he locked the door and raped her.

Daw Pyo Pyo is very upset and doesn’t know where to go for help. First of all, she goes to the wife of the 10 Household Head, and Thuzar Ei explains what has happened. The wife tells Daw Pyo Pyo that she should take her daughter to the head of the pagoda where the family worship. Thuzar Ei explains what has happened. The assistant tells them to wait for the Administrator who is in a meeting but will be finished soon. After a few minutes, the VTA arrives and Daw Pyo Pyo Win explains what has happened to her daughter. The VTA is sympathetic but explains that he does not have the power to deal with such a serious case. He advises Pyo Pyo Win to take her daughter to the local police station so that the police can take formal action. He makes a phone call and arranges for a female police officer to meet with them at the police station.

The next day, Daw Pyo Pyo Win takes her daughter to the police station. The police officer listens to Thuzar Ei’s account and is very kind to them but explains that in order to take a formal statement, she will need to see a medical certificate from a doctor. She arranges for them to meet with a doctor at the hospital later that day. They attend the hospital and explain to the doctor what has happened. The doctor carries out an examination and provides the certificate they need, and they return to the police to provide full statements.

Emphasize the importance of information: without taking and recording accurate first accounts, it is impossible to implement effective referral processes for SGBV survivors. In addition, in SGBV response, it is essential that caseworkers are aware of the availability of services and the procedures for accessing them. a camp for internally displaced persons (IDPs) where we fled too when the conflict reached our village.
