Dear Members of the Commission:

This letter is a follow-up to my September 28, 2017, and October 18, 2017 letters.

Members of the Commission, I was extremely disappointed to read the NOTICE OF PUBLIC HEARINGS(publication date of October 22, 2017?)--only the Bardsdale Cemetery District, and El Rancho Simi Cemetery District are being considered. Please note that it was stated in your May 17, 2017 meeting Agenda(Item 10, LAFCo Recommended Final Budget and Work Plan for Fiscal Year(FY) 2017-18) BUDGET MESSAGE(page 45, middle of the page, first bullet point) that:

"Continue municipa1 service reviews and sphere of in£1uence reviews/updates in accordance with the approved 2013-2017 work p1an .. . Though not formally part of the Work Plan, for the current fiscal year, LAFCo has also: ... Begun preparation of 13 municipal service reviews(e.g., for nine cities, three cemetery districts, and one library district)".

Members of the Commission, it is also stated in the BUDGET MESSAGE(page 46, bottom of page, the last sentence) that "For FY 2017-18, the recommended work plan maintains the focus on municipal service reviews and sphere of influence reviews/updates and is otherwise similar to the work plan for this fiscal year". In accordance with the May 17, 2017 BUDGET MESSAGE, the Piru Cemetery District must be included!!!!! I took LAFCo at its word! LAFCo must not

falter on its BUDGET MESSAGE! The public must be assured that in the future the Commission will keep its word!!!!!

Members of the Commission, according to the Simi Valley Acorn's December 23, 2016 "Pioneer Cemetery up for review" article, "The 126-year old El Rancho Simi Pioneer Cemetery, which is funded primarily through plot sales and property taxes, is due for a major municipal service review by the Ventura County Local Agency Formation Commission, or LAFCo, which serves the cemetery district in an advisory capacity." My voluminous evidentiary materials are overwhelming, but they are in line with the August 2003 State of California Governor's Office of Planning and Research's LOCAL AGENCY FORMATION COMMISSION MUNICIPAL SERVICE REVIEW GUIDELINES (Part I, Chapter 2, C; Part II, Chapter 8, E; and Part III, Chapters 10 and 11). They are but a fraction of my work!!!

Members of the Commission, for 2~ years, the El Rancho Simi Cemetery District trustees tried to get me to join the Board on various occasions(for numerous vacated seats). Their pursuit was relentless!!!!!!! In order to have the trustees back off, on a couple of occasions I stated health matters that preclude me from doing the Board, the public, and myself justice!!!!!!! I understand the Board's, and the public's need to have quorums at meetings, but NO must mean NO the very first time around!!!!!!! Training of trustees must be a LAFCo recommendation in the 2017 Municipal Service Review determinations!!!!!! Thank you.

I was extremely disappointed to learn just recently from Mr. Luoma, when I called LAFCo to inquire about the El Rancho Simi Cemetery District's Municipal Service Review(MSR), that one will not be done, and that a public hearing will not take place. Instead the District's Sphere of Influence is being considered.

Members of the Commission, since 2013, I have attended most of the El Rancho Simi Cemetery District Board meetings due to various District and Cemetery problems that I thought had been dealt with in the past(my last Board meeting was in 2004). I have helped the District Board in various ways so that in 2017 the LAFCo Municipal Service Review(MSR) report would counter the scathing May 16, 2007 Municipal Service Review(MSR) report. I know because as a taxpayer and a constituent, I addressed it in a letter with voluminous evidentiary material . While the MSR is useful as an excellent reference document to date and into the future, it is very, very embarrassing to say the least.

A new Municipal Service Review(MSR) report will not be "Based on limited available information"(page 1, May 16, 2007 MSR), or on "lack of information", and the inability of the District to "complete the LAFCo questionnaire" (page 6, May 16, 2007 MSR). The result will be a better understanding of the present and future conditions at the El Rancho Simi Pioneer Cemetery, and of the governance of the El Rancho Simi Cemetery District by its Board of Trustees in order to avoid the egregious problems of the past, and keep the Cemetery District an independent agency.

A new Municipal Service Review(MSR) report will showcase the progress that has been made in the past 10 years by the Cemetery District Board, and at the Cemetery in light of the continuous turnovers of trustees; and settled and pending lawsuits, etc.

While Supervisor Foy has nominated, and the County Board of Supervisors has approved talented and ideal Simi Valley residents to serve as "volunteers" on the District Board, a new Municipal Service Review(MSR) report will showcase current problems that can easily be resolved: inconsistent Board policies, misunderstanding of/lack of knowledge of State public cemetery district, and government laws, etc.

Members of the Commission, the following are my comments on why LAFCo must undertake the comprehensive Municipal Service Review(MSR) report for the El Rancho Simi Cemetery District in 2017. Not doing so will be a disservice to constituents; the District/Cemetery; and the taxpayers. My comments address the 2007 MSR's Determinations(Section IV).

EL RANCHO SIMI CEMETERY DISTRICT

LOCAL ACCOUNTABILITY AND GOVERNANCE

#1 - Board of Trustees:

1. Five(S) members serve at the present time. Quorums are achievable for Agenda Item votes.

#2 - Board Meetings:

1. Violations of the Brown Act - Cemetery matters are discussed by trustees before and after _ meetings in the 4th District Supervisor's .off-ic.e.

2. Warrants - Discussions by Board trustees, and others are disruptive during the Treasurer's report. Warrants' discussions have covered fraud(involved in one case), and questions regarding certain warrants have occurred. Trustees must be attentive, and the public must be able to hear the discussions. The Board approves the Warrants even though the list is available days later. Explanation: their bookkeeper has many other clients!!!

3. Public Comments - Concerns are misunderstood. Example: A lady's mother was believed to be dead by trustees and staff during one Board meeting, but at another Board meeting it turns out that the mother is very much alive. Chairmen inconsistent on when public comments on Agenda items will be allowed, thus my numerous letters to the various Boards .

4. Closed Session reports to the public are not always given.

5 . Adjournment of Board meetings not always done.

6. The Cemetery Managers' reports are not always available to the public.

7. Monthly financial reports' format is not always understood by the trustees. These documents are not available to the public.

8. Board meetings are taped, then not taped, then taped once again.

9. Trustees may be compensating themselves for "volunteer" work with cemetery plots .

#3 - Meetings Agendas :

1 . Staff forwards the information to the trustees via e-mail. The hard copies are not always available when they arrive for the meetings.

2. Closed Session items are not correctly listed . Example: September 13, 2017 Closed Session: Review of Current and Pending Litigation with Attorney Agenda Item stated "Leigh-Anne Harrison-Bigbie, Gavin Fisher v. El Rancho Simi Cemetery District, Wage and Hour Laws vs. Salaries". The two matters were not related. The "Wage and Hour Laws vs. Salaries" should have stated the item involved staff since the Chair reported to the public before adjourning the meeting about a raise.

3 . Items not listed but discussed by trustee and staff are worked into a non "Revised" Agenda.

4. Font size for the items' text is too small.

#4 - Meetings Minutes:

1. Drafts are only available to Board trustees. Textual errors are not corrected in approved documents. Example: A Closed Session: Review of Current and Pending Litigation with Attorney Agenda Item was not included.

2. Staff forwards the information to the trustees via e-mail. The hard copies are not always available when they arrive for the meetings.

INFRASTRUCTURE NEEDS OR DEFICIENCIES

#1 - The District contacted the Rancho Simi Recreation and Park District about a piece of land adjacent to the Cemetery for future plots. This matter will be tabled for now.

#2 - The Board approved Cemetery scattering gardens.

#3 - The Board approved the removal of a Cemetery road to increase the number of plots.

#4 - The Cemetery's office/resident recently underwent extensive improvements, and costs thus this asset's land must not be considered for plots.

EVALUATION OF MANAGEMENT EFFICIENCIES

#1 - The District Board has monthly financial reports at meetings, and approves annual budgets.

#2 - Revenue generating ideas from trustees abound.

FINANCING CONSTRAINTS AND OPPORTUNITIES

#1 - Payments are being made on the 1990 City of Simi Valley loan.

#2 - The Board contacted the City of Simi Valley to possibly have the loan forgiven or reduced.

FINANCING CONSTRAINTS AND OPPORTUNITIES INFRASTRUCTURE NEEDS OR DEFICIENCIES

#1 - The CemSites program is being used to help resolve the issue of the availability of plots in the Cemetery.

#2 - The 2012 Genealogy Report is being compared with the Cemetery records for accuracy; report flawed .

#3 - The Cemetery's plot map is slated for protection .

Chairman Saunders Said to continue both . Trustee Stratton and Mr. Miller Said the Board does not need to have a quorum of those present at those meetings, but

they do have a quorum at today's meeting so they can go ahead with approving the 2 meetings' Minutes. Motion was made on the June 14, 2017 Minutes: Trustee Burdorf first, and Trustee Kitchenmaster second; 3 - Yes, and 1 - Abstain. Approved. Motion was made to approve the July 12, 2017 Minutes: Trustee Burdorf first, and Chairman Saunders second; 2 - Yes, and 2 - Abstain. Approved.

6. TREASURER - Report and Presentation of Current Financial Statement

Trustee Burdorf Reported that the balance is $14,000. The Endowment Fund is $351,000. She mentioned that the Acorn(Simi Valley) misquoted what she had reported in the financial statement(for last month's meeting). She said the financials were misread(by the Simi Valley Acorn's reporter). [NOTE: This is why the public must be given copies of the monthly financial statements, and of the annual budgets!!!!!] She stated that the information was grossly misstated. She reported that the $11,801 liability payment was received; paid 3 months(?). She said that the backhoe payment will pay in October. She mentioned that she worked with Juanice on the budget so that Juanice can take it over!!!!!!! She said this will be covered in the Agenda(Juanice's CMS report?). She mentioned have a Salary and Hourly item on the Agenda . She exclaimed that they have a very high water bill!!!!! She said that they are still very low since it did not put them over the budget?!?!? They have been conserving water, and the rain came. She said they need the Warrants to be addressed!!!!! Trustee Stratton Asked what the Returns and Allowances are. Trustee Burdorf Explained that for more than one item funds had to be reissued!!!!! Trustee Stratton Asked if these were on plot sales!!!!! Trustee Kitchenmaster Asked if the Acorn should be asked to do a Correction/Retraction(on the misquotes). Trustee Burdorf Stated that it is the Chair's job/duty/ responsibility. Chairman Saunders Stated that it may cause problems if they ask them for one.

7. CEMETERY MANAGER - CMS Report for prior Month and Presentation of New Issues

Juanice Stated that the number of plots has changed!!!!! She said that she is researching the Section 5 plots!!! She stated that there is a discrepancy!!!!!!! She brought up documents, Cemsites, and the spreadsheet?!?!? She stated that some plot sales(on the documents) begin at a different number(system?). She said that she has to go through row by row, and do a recount!!!!!!! Some thing about 80 - 150 less than that?!?!? Chairman Saunders Stated not to open up Section 5; only Section 7?!?!? Trustee Burdorf Stated did both!!!!! Juanice Mentioned that Section 7 going down; selling; plot sales were $7,800. She reported had 6 burials(4 full body, and 2 cremations). She said had 1 chair(s) placement (for the burial service). She brought up the monthly installment, phone calls, walk-ins, updates to the Bylaws, the official letterhead, and the logo(copies were given to the Trustees). Chairman Saunders Said the information is the same; the look is different. He said he likes the copy without the square. He said that Juanice(Cemetery Manager) cannot be included with the Board of Directors. Trustee Kitcherunaster, Trustee Burdorf, and Chairman Saunders Discussed how to list the information. Trustee Burdorf Asked about the "Mission" statement on the letterhead. Chairman Saunders Wants it agendized for the next meeting. Trustee Kitcherunaster Wants the information to be "reader friendly". Trustee Burdorf Had to take her glasses off. Juanice Will change the font. Chairman Saunders Said he likes what it reads, but to make the font bigger. Will continue the item and vote, font size, and the "Mission" statement. Juanice Mentioned the size of a cremation in comparison to a full burial is about 1/3. She stated that Cemsites is tremendously effective. She stated that LAFCo was very impressed, and wants the financial module to be purchased. She mentioned she is selling 2 plots a month. Trustee Burdorf Stated that she had a waiting list(of potential plot purchasers) put together by Juanice; they did not get the list that Leigh-Anne had made previously!!!!!!! Juanice Said she got the AT&T bill to go lower; changed from O'Connor Pest Control to Terminix(saving money); changed from Vision Landscaping to Alejo(saving money)! Chairman Saunders Said can cover them under the budget; it is great news!!!!! Trustee Stratton Asked how is it

written down that purchasers are residents when a plot is sold!!!!! Juanice Responded that she makes a copy of the person's driver's license. [NOTE: The discussion on this centered on when a driver's license must be copied, and whose driver's license.]

9. OLD BUSINESS

a) Update of Efforts to obtain New General Liability Policy

[NOTE: Someone said that Fariba could not find them a better price.] Chairman Saunders Stated that they have already gone through 2 people. He said to come back to this item in 3 months. Trustee Stratton Mentioned that it normally takes 3 years for such things to clear!!!!! Trustee Kitcherunaster Brought up the idea of getting a "benefactor" to help offset the cost for the liability policy!!!!! Trustee Burdorf Suggested getting the "benefactor" to pay toward the cost of the backhoe!!!!! Trustee Stratton Inquired about having liability coverage for the Directors!!!!! Juanice Responded and said it includes Workman's Comp. Trustee Stratton Stated they do not have "umbrella" coverage!!!!! Trustee Burdorf Stated the Trustees were not covered before she came on the Board!!!!!

b) LAFCO - Review

Juanice Stated that the review has been completed!!! She mentioned that she met with Mr. Luoma for 2 hours, they toured the Cemetery, she showed him Cemsites, and he suggested they get the accounts module; that the Board has to vote on(LAFCO, or the Cemetery District?); this review will be totally the opposite of the last time(Mr. Luoma, or Juanice conclusion?)!!!!!!! Trustee Stratton Stated what problems?!?!? Mr. Miller Explained the past problems(that the Board has been dealing with)!!!!!!!

c) Election of the Board of Trustees - Vice-Chair

Trustee Kitchenmaster Nominated Greg Stratton. Trustee Stratton Mentioned that in the past he has held the position of Treasurer. Trustee Burdorf Mentioned that she has been Chair before. Motion: Trustee Kitchenmaster first, and Trustee Burdorf second . Approved Trustee Stratton as Vice-Chair.

d) Backhoe Payment with Funding from the Ventura County Endowment Interest/Resolution

Trustee Burdorf Wants to pay off the backhoe payment. Juanice Prepared a Resolution. [NOTE: At the July 12, 2017 meeting, the Board approved paying to the exact penny for what is owed this year($12,000+) . ] Mr. Miller, and Trustees Kitchenmaster, Burdorf, and Stratton Discussed what to do with the extra money that was taken out from the Endowment Fund; if it should be put back!!!!! Trustee Stratton Mentioned that it will go towards the principal; it is better to get a separate Ventura County account for the extra money. Juanice Mentioned something about it being a wire transfer?!?!? The Board approved the Resolution.

e) Continued Discussion by Trustees to Establish a Grant Committee

Trustee Burdorf Mentioned that she researched the information that I had put in the "green binder"!!!!! She stated that she did not find a particular person or organization to help!!! She said that she contacted the Japanese Cemetery, but got no response! Trustee Stratton Stated will have to look into this! He asked what Cemsites is!!! Trustee Burdorf Stated that she brought this up for grant funding, and responded to Trustee Stratton's inquiry. Trustee Burdorf Said that she contacted Cemsites to ask if Cemsites know anyone that could help!!! Cemsites not know! She stated that she contacted the City of Simi Valley, but was told they do not qualify!!! Trustee Kitchenmaster Mentioned that a couple of months ago she brought up the "Friends of the Cemetery" SOl(or 503?) grants as a source of revenue!!!!! Mr. Miller Mentioned contacting someone like the Rotary, etc.!!! Trustee Kitchenmaster Stated that the accountability

can cause problems. Chairman Saunders Said they need to do more research on this item. Motion made: Chairman Saunders first, and Trustee Burdorf second. Approved 4:0; Trustees Kitchenmaster and Stratton are on the Grant Committee.

f) Cost of Cremation Plots - Discussion With Possible Vote to Raise Price

Trustee Stratton Stated that he feels the amount for the Endowment is very low!!!!! He asked for the cost analysis!!!!! He asked where does this He asked if it is paid when the plot is sold!!!!! He asked how big is a cremation plot!!!!! Juanice Said it is 1/3 the size of a full burial plot . Trustee Burdorf and Juanice Stated they have only one cremation plot(s) section. Mr . Miller Asked how many cremations make up a full plot!!! Trustee Burdorf Said about 3 or 4, but stated that a full size plot is only for the full body burial area(s) ! Mr. Miller Brought up the brick purchase. Chairman Saunders Wants to raise the cost to He stated that when a baby is buried he is sensitive to such a case! Trustee Kitchenmaster Brought up $650, and $1,200. Chairman Saunders Asked when was the last time that the Board increased the cremation plot price!!!!!!! Motion made to increase the price of a single plot to $700, and $1,000 for a double. Trustee Burdorf first, and Trustee Stratton second. Vote: 3 - Yes, and 1 Abstain(Trustee Kitchenmaster). Approved.

g) Continued Discussion by Trustees for Additions and/or Changes to the current 2003 Bylaws

Juanice Read the changes made by the Board. Trustee Kitchenmaster Stated that something was not covered in Juanice's update of the changes!!!!!!! Trustee Stratton Asked if there is a difference between "interment" and "inurnment"!! ! He mentioned that he has read many documents!!!!! Trustee Kitchenmaster Stated that the hours for interment are 8 : 00(AM) to 4:00(PM). Juanice Stated that after 2:00 (PM) it is overtime!!! Chairman Saunders Stated they need to add in the Bylaws a section for the requirements for residency!!!!! Trustee Stratton Mentioned that he has read many State laws!!!!! Mr. Miller Said it must read "within the boundaries

of the District". Trustee Burdorf Stated there is the information in the "green binder"! She said I have put together useful information!!! Chairman Saunders Said to carry the item to the next time.

10.NEW BUSINESS

a) Wage and Hour Laws vs . Salaries With a Possible Vote

Trustee Burdorf Said that State requirements change. She mentioned that they have looked at this issue in the past!!!!! She said had asked the Cemetery Manager to keep a time sheet. She mentioned that even though the Cemetery Manager was asked to do so it was not done. She said that Juanice has been compliant. Keeping time sheets helps with salary vs hourly!!! Chairman Saunders Stated that it will go up every year for hourly until reach $15 an hour! Juanice Stated but not for part-time!!! Chairman Saunders Stated that businesses are going to the part-time, and hourly system!!! He asked what the District have to do and keep Juanice happy!!!!!!! Trustee Burdorf Stated to increase Juanice's salary!!!!!!! As of the next check run it will be $13,020(?); it is $10 an hour!!!!!!! Trustee Burdorf and Chairman Saunders Said $10.50 as of September!!!!!!! [NOTE: Someone said why not change it now!!!!!!!] Trustee Burdorf Wait for her annual day of hire!!!!! Chairman Saunders Stated that Juanice has done a tremendous job. Trustee Burdorf Said Juanice's salary a month is $1200 ; 132 hours(?) Trustee Stratton Said the housing allowance enters in. Trustee Burdorf Felt the house and utilities were the biggest(benefit). She said that the lawyers feel that the housing should or not be included!!!!!!! Trustee Kitchenmaster Said that what Juanice does is not She said that the quality of what she(Juanice) does supersedes what the house is(value?). Juanice Stated that will all be settled; the lawsuit!!! She said that the house is being considered as part of her salary. She said part-time is 32 hours and below. How it works, you are in a sticky space. She has to be available for phones 8:00(AM) to 5 : 00(PM). At her previous employment she had to be available. Trustee Burdorf Said there's an answering

machine. Chairman Saunders Asked if on break or off the clock! Trustee Stratton Said that he wrestled with this! Part-time on call manager, need to straighten this out!!! Trustee Burdorf Said that Juanice does get overtime!!!!! She said that she had Lisa(bookkeeper) take care of this!!! She said she is trying to tighten this up!!!!!!! Chairman Saunders Continue to next month. [NOTE: Someone said hopes that Juanice feels the love, but need to be in compliance!!!!! Someone asked if Juanice can predict from week to week the number of burials!!!!!] Chairman Saunders Said they need to research. This is a W2 job!!!!! Trustee Burdorf Said and she(Juanice) does not get paid in cash!!! Trustee Kitchenmaster Asked if Juanice's contract read the same as the previous cemetery managers. Board members Yes!!!!!!!

b) Josephine Garces/Burial in Pioneer Section/Two Family Members - Discussion and Possible Vote

Juanice Said that Scroggins(the former cemetery manager, under investigation by the Ventura County District Attorney's office; possible embezzlement) did not allow burial in the Pioneer section so the husband was buried in a different section. LeighAnne(former cemetery manager hired after Scroggins' contract was not renewed) allowed the son to be buried. Now the person wants the problem solved!!! She and Saul probed the area, there's Chairman Saunders Asked if there is documentation that the person was told could not be buried in the Pioneer section. Juanice Said no!!!!!!! She stated they have a family plot in the Pioneer section!!!!! Trustee Stratton and Chairman Saunders Discussed the disinterment! Juanice Broke down the costs for it! Trustee Stratton Asked about the cost of the backhoe! Trustee Burdorf Stated that the City took the backhoe(old equipment, needed repairs, would cause damage to the plots when used, etc.). Mr. Miller Stated this is a negotiation!!!!! Juanice Said that the Cemetery is in(a fix)!!!!! [NOTE: The Board is concerned that it will cost more if lawyers are involved!!!!!!! Juanice can say that the casket crumbled, etc . !!!!!] Chairman Saunders Made Motion to propose that the District pay for the disinterment and re - internment, and the person pay the other costs!!!!!!! Trustee Stratton Second . Approved 3:l(Trustee Kitchenmaster Abstained). Trustee Burdorf Requested a BREAK. Chairman Saunders Called for a 5 minutes BREAK(3 : 35 PM to 3:40 PM).

c) 2017/18 Budget - Presentation-Discussion and Possible Vote

Trustee Burdorf Said that she had a lot of difficulty to get it right this year!!!!!!! She said that the 2015/16 information mentioned the She stated that this year they need to sell more!!!!! Chairman Saunders Had a question on "Other"!!!!!!! Asked why are budgeting only $100!!! ! ! Trustee Burdorf Mentioned the filming permit cost in the past!!!!! Trustee Stratton Asked what did they get before! Trustee Burdorf Responded nothing?!?!? She said that the Grant Committee can include it!!!!!!! Chairman Saunders Said to leave $100 . Stated had no plot sales, and now are open for plot sales; he feels the budget is realistic and he feels they will sell more this year!!!!! Trustee Burdorf Stated they changed the prices, and opened up a new section!!!!! She spoke on the full body, and cremation plots . Mr. Miller Asked why it does not include the backhoe's extra money!!!!! Trustee Burdorf Stated that she did not include it because the money is an asset?!?!? She mentioned the ossuary vault money for the scattering garden. Trustee Kitchenmaster Asked if they are only going to do 1 and not 2! !!!! Trustee Burdorf Responded just 1 for now. She said it is a pretty safe projection. She is tightening a number of things; no assessment fee, the bank fee to be reversed(?), computer budget for $2,000 . She said that she wants a tablet for Juanice. She will look at getting a free tablet!!!!! [NOTE: Discussions by

the Board and Juanice centered on the coverage area in the Cemetery; the wireless reach.] Trustee Stratton Asked if there is a computer in the office! [NOTE: Someone said the software $800; depreciation is the same.] Trustee Stratton Asked what they are depreciating!!!!! Trustee Burdorf Responded, the backhoe and the lifting device!!! She mentioned the cost for the domain. Trustee Kitchenmaster Stated that the hosting fee is separate from the domain!!! Trustee Burdorf Said they can include this under the computer account!!! She mentioned $50 was for Saul's mileage; when he goes from the Cemetery to Rainmaker or Home Depot!!! Trustee Kitchenmaster Asked about the $700!!! Trustee Burdorf Said is for office supplies!!! Chairman Saunders Asked where are they buying ink!!! Juanice Said ; they have an account!!! Chairman Saunders Stated that he gets for less; he will give Juanice the contact information!!! Trustee Burdorf Stated that Juanice is making many copies!!! Chairman Saunders Asked what does Juanice need the machine to copy!!!!!!! [NOTE: Discussion between the Board and Juanice centered on the type of machine, the ink, and the process. Money was budgeted for the lawsuits. If they did not have the insurance pay from all of the lawsuits they would have no problem. The amount of $17,000 was mentioned. In 2015-16 it was $27,000 for Vision, and Gavin for~ the year!!!!!!! Saul's labor was $9,000: irrigation repair, and grading.] Juanice Stated that she is picking up trash in the Cemetery! Trustee Stratton Asked about the diesel fuel that was discussed at the last meeting! Juanice Said that she has negotiated with the new landscaper; they do not have to pay for it anymore!!!!! Mr. Miller Asked about the maintenance of the lawn mower!!! Trustee Burdorf Stated that she budgeted for it. She mentioned the general repairs to the house/office. She mentioned that tree maintenance was only $3,000 for the year!!!!! She said to have volunteers do this(work) to lessen the costs!!!!! Trustee Kitchenmaster Asked if the insurance covers the "volunteers"!!!!! Trustee Burdorf Responded NO!!!!! Juanice Mentioned that she has the name of someone to do the tree work!!!!! Trustee Burdorf Said that the cost for Juanice is $1,200 a month, and that she has already included the increase(WHAT???) if the Board votes!!!!! Juanice Clarified her salary!!!!!

Trustee Burdorf Stated that Gavin(Leigh-Anne's son) was paid differently from Saul!!!!! Trustee Stratton Asked who the landscaper is!!!!! Trustee Burdorf Stated that he(Gavin) abandoned; that he never came back!!!!!!! She stated that Gavin was an employee for less than a year!!!!!!! She stated that Saul's is a different kind of employment!!!!!!! She stated they have 2 employees: Juanice and Saul!!!!!!! She stated that the work done by Saul involves opening and closing, probing, irrigation repair, and the leveling of the ground. Chairman Saunders Stated that they are actually making money!!!!!!! Trustee Burdorf Mentioned the appropriations limit!!!!!!! She said that it is set by the State! She said that the expenditures are allowed to only increase by a certain percentage!!!!! She stated that she has done 5 budgets now; they do not have an appropriation limit done!!!!!!! She said that the District's 16.5% would be unacceptable if this is placed on the District!!!!!!! She mentioned that they were not given one(a percentage?) by the County!!!!!!! Trustee Stratton Stated that it only covers what the property taxes cover!!!!!!! He said that in the future they need to see what part is the business part, and what part is the ! ! ! ! ! Trustee Burdorf Stated that the budget has to be approved by the Board in July; are late this year!!! She mentioned that she is training Juanice! ! !! ! !! Trustee Kitchenmaster Mentioned the employee salary in the budget. She stated to give a bonus for Juanice's extra work!!!!!!! Trustee Burdorf Said that she wants to give her a plot!!!!!!! Cherie Jackson Said that Honsinger(former cemetery manager) had set up the sale!!!!! She said that the next cemetery manager says something else!!!!!!! She said then Barbara Scroggins(former cemetery manager) released her plots: #37 and #38 twice!!!!!!! She exclaimed that there are already bodies in the plots!!!!!!! She said that she wants to resume what have to pay off, and have her and her husband get plots!!!!!!! Trustee Burdorf Asked how long she not

make payments on the plan!!!!!!! Cherie Jackson Said the last payment was in 2006! !! ! !!! The payments were not made because of circumstances

such as brain surgery, cancer in the family!!!!!!! Trustees Stratton and Burdorf Exclaimed the plots were abandoned!!!!!!! Trustee Stratton Stated that he wants $2,000 times(x) 4(plots); $8,000! !! ! !! ! Cherie Jackson Exclaimed WOW!!!!!!! Not honor the original!!!!!!! Trustee Kitchenmaster Stated that in the spirit of good will and sensitivity, she wants to honor the number of plots, and the price, and to create a new contract!!!!!!! She said that she (Cherie Jackson?) would pay the difference!!!!!!! Chairman Saunders Asked Cherie Jackson what brought her back to the Cemetery!!!!!!! Cherie Jackson Said that she and her husband got raises!!!!!!! Chairman Saunders Said that it is tough to have had the situations she mentioned!!!!! He stated that there are ramifications for non-payment!!!!!!! He said that since she is not in agreement with the Board he has a problem rectifying this matter!!!!!!! He said that he has been on the Board a year and a half!!!!! He mentioned that for 12 years she has not paid!!!!! He exclaimed that nowhere else can one go and try to do what she is asking!!!!!!! Trustee Burdorf Stated that she agrees with Chairman Saunders!!!!!!! She said that she will not honor the new plots!!!!!!! Mr. Miller Exclaimed that this is taxpayer money!!!!! Chairman Saunders Stated this sets precedent!!!!!!! He stated that he does not want to do this!!!!!!! He stated that they do not do payment plans anymore! Trustee Stratton Asked if she needs the plots now!!! Cherie Jackson Responded NO!!!!!!! Cherie Jackson Said that she only has enough to pay off(WHAT?) ! ! ! ! ! Trustee Stratton Exclaimed have to pay by the rules! Chairman Saunders Stated that he is willing to honor 4 plots, and the pay off!!!!!!! Cherie Jackson Said she pays the $90(pay off amount?)!!!!! She can make a check for the $90!! ! !!! ! Chairman Saunders Said 8 plots were purchased; 4 go back to inventory!!!!! Motion was made on the pay off of the 4 plots that were purchased in 1991, and 4 out of the 6 go back to inventory: Chairman Saunders first, and Trustee Stratton second. Approved 4:0. Trustee Stratton Stated that he wants new deeds issued!!!!!!! Juanice Said that there is no pay off so no deeds; are not needed!!!!!!!

e) Review and Discussion Cemetery Filming Procedure with Possible Vote

Chairman Saunders Mentioned that he asked to have this on the Agenda. He said this was one of the requirements of a former Chair. He stated that his experience is that students do not have the time span for waiting for the Board meeting to approve the student filming!!!!! Juanice Mentioned that the City has permit(requirement) for filming!!! Trustee Stratton Asked how much the City charges for the permit!!!!! Juanice Responded $800 plus other fees! Chairman Saunders Stated they need to separate the for profit, and the student filming!!!!! Juanice Mentioned that Paramount wants to do the "Shooter" filming that is about $4,000!!!! ! She said that they want to film in 2 weeks. She stated that they have lost 2 such calls for profit filming since they have to wait for the Board meeting!!!!!!! Trustee Stratton Asked how long it takes to get the City permit! Juanice Responded 1 day!!!!! Trustee Stratton Made a Motion to make Chairman Saunders the go to person!!!!! [NOTE: Someone said this is a filming policy so it does not go in the Bylaws!!!!!] Trustee Burdorf Second. Approved 4:0.

11.WARRANTS - Review and Vote for Approval

Trustee Burdorf Went through the payments for LAFCo, USPS, Rainmakers. She said that Vision was $1,900(?) with a late fee of $25(?). Trustee Kitchenmaster Asked if she wants to challenge this!!!!! Trustee Burdorf Said they have to give a 30-day notice to notify them of change of company!!!!! She mentioned Juanice's 2 paychecks for August 16(?) and 31. Saul's paycheck; she stated that he did a lot of work. She mentioned checks for Lisa(bookkeeper), the Ventura County Endowment Fund, the sales tax paid for vaults and vases, online payments for White(?), the water bill (is on a payment plan), the new grass in front of the house/office, the Edison check for $250 was high(it is based on the size of the unit; can save money), and Staples. She wants a statement from Staples(former Chairperson Pandolfi wanted this done)!!! She said that she is trying to do their own things instead of having Lisa(bookkeeper) do things; costs the District

money!!!!!!! She mentioned that a second signer is needed; Lisa(bookkeeper) is 1, and need another Board member besides herself!!!!!!! Chairman Saunders Stated that he cannot be the other signer?!?!? Trustee Burdorf Mentioned that the Reconciliation Summary for the auditors needs to sign on!!!!! She said that on the Deposits and Credits they are what Juanice said in her report! She stated that Lisa's item must equal what deposits were listed! She stated that everything must be posted at the same time because there's a problem!!!!!!! She stated that Juanice and Lisa will have to get together to iron this situation out!!!!!!!

Trustee Kitchenmaster Stated that the filming has to be in good taste. She mentioned the Arts Council and the Ghost Tour. Chairman Saunders Asked if the Board has to hear(vote?) on this subject!!! Said to agendize for next month. Trustee Kitchenmaster Stated that Juanice does a great job; is unbelievable; and she cannot be thanked enough!!!!! Trustee Stratton Stated on the Agendas, he gets the reports just before the meeting; he wants them 3 days before the meeting!!!!! Juanice Mentioned that she had brought it up before but was told not needed to be done!!!!! Chairman Saunders Mentioned speeding up the process!!!!! He said that he wants shorter meetings as a goal(no wonder he was pushing through the items)!!!!!!! Cherie Jackson, and I were the only members of the public present . Ms . Jackson brought up the August 9, 2017 Board meeting. She had stayed until Agenda Item lOd(dealt with a plot(s) situation) was undertaken by the Board . I pointed out on my Agenda for today where in the Board's discussions it was listed and gave her my copy(I had 2) . I mentioned to her that under today's meeting's Public Comments section (number 5 on the Agenda) she can ask the Board if Item lOc(her plots matter once again) could be moved to be discussed sooner . I told her that it is up to the Board to say yes or no. I told her that it is worth a try.

Juanice Said that she researched the file. She said there appears that only 2 plots are left. She said plots were marked out?!?!? Trustee Stratton Stated that he does not understand what this means!!!!! Juanice Explained that of the 8 plots that were involved only 4 were paid on(?), and the other 4

Cherie Jackson Said that she wants to know if her father's(plot) is still next to her mother's plot. Juanice Said that on the 2 available plots she will need to research further. She stated that this is still a new issue her(Cherie's) mother. She said she(Cherie's mother) is already buried. Cherie Jackson Stated emphatically no, she's alive!!!!!!! She stated that she never received a certificate for her mother's plot(paid $400 when bought?). Trustee Burdorf Asked Cherie if her receipt for the plots shows Trustee Stratton Brought up that 2 of the plots have been sold, and 2 plots are available. He said that 4 more plots were sold, so 6 of the 8 have been sold. Mr. Miller

Said that her(Cherie's) father is buried, and that she wants to make sure of Trustee Stratton Said so she(Cherie) bought 10 plots. Juanice Said that this is a new issue that it does not involve the Agenda Item. Trustee Kitchenmaster Said then the issue is reassignment. Cherie Jackson Asked if they have 4 plots available elsewhere. [NOTE: The Board members did not understand what is happening with the plots situation!!!!! They had understood it involved one thing, but it turns out to be something else . ] Trustee Kitchenmaster Asked if they have to agendize the issue . Board members Said they do not have to. Juanice Said she will bring the item back to the Board once she and Cherie agree on the 4 plots. [NOTE: The other 4 plots will be vacated!!!!! I thought the Board had to follow a particular Health and Safety Code to do this!!!!!] Motion was made: Trustee Kitchenmaster first, and Trustee Burdorf second . Approved. Cherie Jackson Asked if she has to come back to the meeting on the issue of her mother ' s plot . Juanice Said that the paperwork needs to be done on the separate payment .


Trustee Burdorf Stated big revenue month. Mentioned that Lisa(bookkeeper) is out on vacation . Trustee Stratton Stated again ; do not have a report . Trustee Burdorf Stated that Lisa does not type the report she only gives it. Trustee Stratton and the Other Board Members Stated they want the report before the meetings . Trustee Burdorf Said that they now get bank statement copies. She said that Marla(former bookkeeper) and Lisa see the information . She asked Juanice if she received the bank statements for the new and old bank accounts. Trustee Kitchenmaster Expressed concern that the previous cemetery managers can still look at the bank statements. Trustee Burdorf Assured the Board this is not possible!!!!! Trustee Stratton Said the more the merrier with regards to the "checks and balances" in place. Trustee Burdorf Brought up the matter of a "Tablet" device for Juanice . She said that there is a problem; there is not enough Wifi range. She gave Juanice a copy of an article on how she can extend

the range(Sounded complicated to me, then I'm not tech savvy.) Chairman Saunders Said that there are a lot of Tablets(in the market place). He brought up something about if Juanice gets it through a carrier this is an option, but Mr. Miller and others on the Board said she would have to purchase a carrier's plan. Chairman Saunders Stated that his 5 year old has a plan. He said it is only $10 a month to add the service . Trustee Burdorf Mentioned that her's is free since she got it through Amazon's bonuses. She said that this is to help Juanice with Cemsites access when she is out on the Cemetery grounds!!!!! [NOTE: The conversation continued on who has the best website that is mobile compatible.] Chairman Saunders Said this needs to be researched further.


Juanice Said had a low month. Ranged from $3,000 to $13,000 before sales. Last month $22,000 . Had 0 burials, 1 pre-need, 2 marker settings, etc . Had $180 in filming, 1 plot transfer. Did probings . Had walk-ins. She said that next month she has to go through all of the "A" through "Z" files which will take time. She said she can get through 1 letter a week. She said that she hopes it takes 23 weeks to do the work as a projection!!!!! She said that Section 7 is ready for the Ossuary; cost $1,700(each ?) . She said that she needs Board approval for their purchase(are buying 2 eventually, but just 1 for now due to tight budget). She said that Saul needs the backhoe to do the work. She said that Saul is putting an itemized(report) for the Section 7 work(irrigation?). She said that Saul donated $700?!?!? Purchase of 2 heads was over $1,000! !! ! ! She said that Saul did a lot of work. She said that Saul is so honest!!!!! She said that it took 2~ weeks to do the work . Trustee Burdorf Asked if on the Ossuary if they can get Community Development Block Grant(CDBG) funding. ! Brought up point of order to Chairman Saunders. I mentioned the City of Simi Valley's Waste Management $100,000(?) agreement program . Juanice Mentioned that the plot plugs(?) in Section~have been located by her and Saul. Trustee Stratton Asked who sets the Endowment Care Fund . [NOTE: The response from someone was the Board does.] Chairman

Saunders Said that he wants to take care of our community since the taxpayers support them. He said they have to be very strict. Mr. Miller Mentioned former Trustee Pandolfi had received a call from someone who was from out of town that wanted to purchase many plots at once. He mentioned that the residency requirement was not included in the Bylaws. He doe not know how the Board wants to handle this. Trustee Stratton and Mr. Miller Want to put this in as a reference . Trustee Stratton Asked about the Board's marketing(strategy?). [NOTE: Someone from the Board said they are marketing through funeral services organizations.] Chairman Saunders Said to agendize marketing strategy. Trustee Stratton Said they need to speak(make presentations). Mr. Miller Mentioned that the District had paid for Jack(former Chairman Parfitt) to speak. Chairman Saunders Wants the item agendized.

Juanice Said they are getting statements from everyone! Trustee Burdorf Said with regards to one of the items that it took her a year to get this accomplished!?!?! She said they can hand this information to the auditors.

a) Continued Discussion by Trustees for Additions and/or Changes to the current 2003 Bylaws

[NOTE: Someone said that the "checks" section was changed to "one signature".] Trustee Burdorf Said that she was not finished(on the Correspondence item)!!!!! She said that a letter is to be given by Juanice to the auditor. [NOTE: The discussions then returned to item 9a. Someone said that they updated having a "website"(former Chair Pandolfi had informed them that the City of Simi Valley had a problem with them posting the Agenda at City Hall; with the website available the change was made.

Three changes were made on pages 3, 4 and 8.] Trustee Stratton Said that he does not know what the Bylaws are?!?!? Chairman Saunders Asked if they are done with the Bylaws. Trustee Stratton Stated that he is not done reading them!!!!! Chairman Saunders Said to

continue them to the next meeting to vote to approve.

b) Letterhead Creation - Review/Discussion With Possible Vote

[NOTE: Discussion took place regarding their Logo Mission Statement.] Chairman Saunders Asked if they give an invoice when they do a sale. Juanice Said she can do this in the future!!!!! Chairman Saunders Brought up the "seal" on the certificates . Juanice Said she can add this to the COBRS(?). Trustee Kitchenmaster Said they need to work on the Mission Statement. Chairman Saunders Asked if they can talk on the Mission Statement since it is not agendized. Trustee Kitchenmaster Expressed concerns over using the photograph from a "Pioneer" family on the letterhead. Chairman Saunders Continue the item to the next meeting.

a) Audit - Findings & Recommendations - Discussion

Chairman Saunders Asked if this is LAFCo ' s audit!!!!! Trustee Burdorf Said no, and stated that this is the auditor's audit(that has been going on for a couple of years)!!!!! Trustee Stratton Stated that they need to have a letter from whoever was involved with the audit and the auditor!!!!! He said that he has many questions!!!!! He asked who signs the deed (certificate) when a plot is sold. Board member Said the Chairman does. Trustee Stratton Exclaimed then how did they get in trouble on the graves/plots if this was always done!!!!! He asked who does a copy go to. Trustee Burdorf Responded the bookkeeper!!! Juanice Explained the process that they have in place. [NOTE: Copies of the audit had already been distributed to the Board members . ]

b) Audit Cycle - Annual or Five Year - Discussion With Possible Vote

Trustee Burdorf Stated that she has handled the last 2 audits, the previous one was done by and auditing business, and before that the County was involved!!! She mentioned that the cost to have an auditing firm

do the work varies from a few thousand dollars to a very expensive price. She stated that it is hard for them to cover the amount. Chairman Saunders Stated that it is cost effective to do 5 years audit . Trustee Burdorf Stated that Collins(auditor) can do an annual audit for $6,000 a year!!!!! She said they cannot go to an annual audit. Chairman Saunders Said that if money was not an issue they can be on track . Trustee Burdorf Said that the County had reached out to the Board. Mr . Miller Stated that the County had not been receiving copies of the audits. The Cemetery/District history enters into the picture . Chairman Saunders Asked if the County will subsidize us. Mr. Miller Mentioned a law that can allow certain things . [NOTE: Discussions centered on the $6,000 for an annual audit, and $7,000+(?) for a bi-annual audit.] Trustee Stratton Stated that 5 years is a long time. Juanice Said that an organization(for cemeteries?) she contacted said they do not have to audit?!?!? Mr. Miller Said adds a level of complexity!!!!! Juanice Said it is not an approval of expenditures!!!!! Chairman Saunders Said they need to have audits more than 5 years because of the history?!?!? Mr. Miller Said he can have the Ventura County Auditor at the next meeting. Trustee Burdorf Said that the audit is a huge amount of work for her and Juanice on top of each others work schedule if they audit annually (but this is part of Juanice's contracted job responsibilities as cemetery manager)!!!!! Trustee Kitchenmaster Stated that they are "volunteers" so they do not get compensated. Trustee Stratton Stated that if the audit is done every year they do not have a lot of documents to go through!!!!!!! Chairman Saunders Said to continue to next month.

this!!!!!!! She said that the Board approved!!!!!!! [NOTE: I do not recall this taking place!!!!!!! Had the subject been agendized I would have opposed it vehemently!!!!!!! And why just her?!?!?] She mentioned all of the work that she has done!!!!! She informed the Board that she was physically threatened by a former employee!!!!!!! [NOTE: I had called Mr. Miller days after one of the Board meetings to tell him about an incident!!!!! Then, there was the time when she and former Trustee Pandolfi had left a Board meeting because the police was called!!!!!!!] She mentioned that another chairperson said that she deserved to be awarded a plot!!!!!!! She said that in lieu of the $100 a month this was an option!!!!!!! Chairman Saunders Stated that it is not a foregone conclusion that whoever signs up(in reference to my letter's comments on the item) gets a plot. He said there were good questions. He mentioned they serve 2 year terms. Mr. Miller Stated 4 year!!! Mr. Miller or Chairman Saunders Said to discuss this, but to continue the item in order to have a full Board. Chairman Saunders Stated that he has received many calls!!!!! He stated that this item has caused concern!!!!!!! Trustee Kitchenmaster Brought up my letter's $100 comment, and she asked if it is a stipend!!!!! Juanice Stated that she has read the Health and Safety Code 9041(?). Chairman Saunders Said entertain the thought; it is if trustees go the full 4 years term!!!!! He feels it is fair if the amount of the plot is~ the amount of the $100 per meeting!!!!! Trustee Kitchenmaster Spoke about the State law allowing the money(compensation for Trustees). Chairman Saunders Stated the Cemetery is strapped(but the Board is going to vote on paying themselves!!!!!!!). Trustee Stratton Stated then they need to get to the point when they are not strapped!!!!!!! Mr. Miller Stated that he wants to run whatever the Board approves with the County Counsel!!!!!!! Chairman Saunders Stated that he understands that the members(trustees) put out!!!!!!! ! Brought up to Chairman Saunders 2 points of order. I mentioned the genealogist who got a plot for the genealogy report(on the Cemetery). Trustee Burdorf Said that she(the genealogist) had not been paid. I Informed the Board that California law had been violated when the Board allowed the removal of the records from the Cemetery office for this work!!!!!!!

Chairman Saunders Said that he does not want this discussed outside of the meeting. He said they do not need innuendos that they(the Board of Trustees) are paying themselves!!!!!!! He said that his official statement on the meeting is that the item has been agendized for the next meeting!!!!!!! Trustee Kitchenmaster Said to include as criteria, for being awarded a plot, the number of years served!!!!!!! Chairman Saunders Stated that he does not want to put compensation on the Agenda!!!!!!! Mr. Miller Said that they need to compensate Trustee Burdorf's efforts!!!!!!!

e) Halloween Ghost Tour - Discussion With a Possible Vote

Trustee Kitchenmaster Mentioned that she contacted the group that puts on a certain yearly event. She stated that the group feels that it is too soon to do this, even though it does not have a place to do what they did before at a certain location. She said that there would be a fee charged. She said that the fee(proceeds) would be split between the District and the group!!!!! She said that the group does not feel they can do this now(it takes a lot of preparation, permits, etc . ). Chairman Saunders Asked what other cemeteries have allowed this. [NOTE: During the discussions it was said that a tour done properly can be a good thing; that they are here for the public; that public perception is important; problem if the public does not perceive this is a good idea; that they have been a reactive Board; the Board needs to be proactive!!!!!] Mr. Miller Brought up the idea of movie night .


Trustee Stratton Asked why the Members do not get a copy of the Warrants. Trustee Burdorf Stated that they are in Lisa(bookkeeper)'s report. Trustee Stratton Stated that he has approved thousands of warrants(when he served on the City of Simi Valley City Council). He stated that the purpose(of the Warrants) is for the public to know!!!!!!! Trustee Burdorf Said that Lisa sends her the information the day before the meeting!!! She then sends the information to the Board members!!!

Juanice Stated the list is sent to the Board after the meeting!!!!!!! Trustee Stratton Stated that he has not received the information!!!!!!! Trustee Burdorf Mentioned that she gets 6 or 7(?) reports from Lisa!!! Trustee Stratton and/or Mr. Miller Said that the reconciliation reports are part of the Staff Report!!!!! Trustee Burdorf Mentioned that instead of bank statements get Quickbooks from Lisa!!!!! She stated that the information used to get to the Board members in the past before the meeting. [NOTE: During the discussions, it was brought up that the Board members are approving checks; that they are primarily liable for the signed checks!!!!!!!] Juanice Mentioned that the checks are submitted to Lisa to cut the checks. [NOTE: During the discussions it was mentioned that Lisa(bookkeeper) works for several companies; she does not have the time; she fits the Cemetery/District in!!!] Trustee Stratton Asked if the checks or the statements are given to Lisa!!!!! ! Brought up point of order to Chairman Saunders. I asked if they are going to go through the Warrants. Trustee Burdorf Mentioned check for $312.50(?) for and Associates. Check for the Workman's Compensation State Fund. Trustee Stratton Asked if this was quarterly. Trustee Burdorf Mentioned check for $170 for O'Connor. Check for Angels Memorial(markers) for $300. Check for Rainmaker is $391.97. Juanice Said this is the final payment. Trustee Burdorf Mentioned check of for Vision Landscaping. Juanice Said this is~ of the payment in full. Trustee Burdorf Asked what the amount of is for. She mentioned check of $251 for Saul. Two(2) checks for Juanice. She stated she forgot a check for Juanice that she will do under the Closed Session?!?!? Motion to approve as discussed was made: Trustee Stratton first, and second. Approved.


Trustee Burdorf Asked for a BREAK. Trustee Stratton Said he followed up on the City of Simi Valley's Community Development Block Grant(CDBG). It is important to look at where the Cemetery is located in a bigger map to see if it is in a lower income zone; if it is then might be eligible for some things under the program!!! He, Juanice, and Trustee Kitchenmaster will attend the

City of Simi Valley meeting! He stated that the project needs to have matching funds from the District! [NOTE: During the discussions it was brought up that a sign is needed for the Cemetery!!!] Chairman Saunders Mentioned there is a sign!!! Trustee Burdorf Said the sign is on Royal(Avenue). She said that it would be wonderful to get help from the City of Simi Valley. Trustee Kitchenrnaster Stated that bullet points are needed on the Closed Session items, and she brought up my "aggressive" letter's comments!!!!! ! Mentioned a couple of incidents that took place at meetings in the past. Chairman Saunders Stated that there is a decorum that needs to be followed!!!!! He stated that he has his own comments on my letter's "aggression" comments!!! He called for a 5 minutes RECESS. He said then they will go into the Closed Session, and then report to the public.

Re : THE 2017 MUNICIPAL SERVICE REVIEW REPORT FOR THE EL RANCHO SIMI CEMETERY DISTRICT, AND SPHERE OF INFLUENCE.


I was extremely disappointed to learn just recently from Mr. Luoma, when I called LAFCo to inquire about the El Rancho Simi Cemetery District's Municipal Service Review(MSR), that one will not be done, and that a public hearing will not take place. Instead the District's Sphere of Influence is being considered.

Members of the Commission, since 2013, I have attended most of the El Rancho Simi Cemetery District Board meetings due to various District and Cemetery problems that I thought had been dealt with in the past(my last Board meeting was in 2004). I have helped the District Board in various ways so that in 2017 the LAFCo Municipal Service Review(MSR) report would counter the scathing May 16, 2007 Municipal Service Review(MSR) report. I know because as a taxpayer and a constituent, I addressed it in a letter with voluminous evidentiary material . While the MSR is useful as an excellent reference document to date and into the future, it is very, very embarrassing to say the least.

A new Municipal Service Review(MSR) report will not be "Based on limited available information"(page 1, May 16, 2007 MSR), or on "lack of information", and the inability of the District to "complete the LAFCo questionnaire" (page 6, May 16, 2007 MSR). The result will be a better understanding of the present and future conditions at the El Rancho Simi Pioneer Cemetery, and of the governance of the El Rancho Simi Cemetery District by its Board of Trustees in order to avoid the egregious problems of the past, and keep the Cemetery District an independent agency.

A new Municipal Service Review(MSR) report will showcase the progress that has been made in the past 10 years by the Cemetery District Board, and at the Cemetery in light of the continuous turnovers of trustees; and settled and pending lawsuits, etc.

While Supervisor Foy has nominated, and the County Board of Supervisors has approved talented and ideal Simi Valley residents to serve as "volunteers" on the District Board, a new Municipal Service Review(MSR) report will showcase current problems that can easily be resolved: inconsistent Board policies, misunderstanding of/lack of knowledge of State public cemetery district, and government laws, etc.

Members of the Commission, the following are my comments on why LAFCo must undertake the comprehensive Municipal Service Review(MSR) report for the El Rancho Simi Cemetery District in 2017. Not doing so will be a disservice to constituents; the District/Cemetery; and the taxpayers. My comments address the 2007 MSR's Determinations(Section IV).

EL RANCHO SIMI CEMETERY DISTRICT

LOCAL ACCOUNTABILITY AND GOVERNANCE

#1 - Board of Trustees:

1. Five(S) members serve at the present time. Quorums are achievable for Agenda Item votes.

#2 - Board Meetings:

1. Violations of the Brown Act - Cemetery matters are discussed by trustees before and after _ meetings in the 4th District Supervisor's .off-ic.e.

2. Warrants - Discussions by Board trustees, and others are disruptive during the Treasurer's report. Warrants' discussions have covered fraud(involved in one case), and questions regarding certain warrants have occurred. Trustees must be attentive, and the public must be able to hear the discussions. The Board approves the Warrants even though the list is available days later. Explanation: their bookkeeper has many other clients!!!

3. Public Comments - Concerns are misunderstood. Example: A lady's mother was believed to be dead by trustees and staff during one Board meeting, but at another Board meeting it turns out that the mother is very much alive. Chairmen inconsistent on when public comments on Agenda items will be allowed, thus my numerous letters to the various Boards .

4. Closed Session reports to the public are not always given.

5 . Adjournment of Board meetings not always done.

6. The Cemetery Managers' reports are not always available to the public.

7. Monthly financial reports' format is not always understood by the trustees. These documents are not available to the public.

8. Board meetings are taped, then not taped, then taped once again.

9. Trustees may be compensating themselves for "volunteer" work with cemetery plots .

#3 - Meetings Agendas :

1 . Staff forwards the information to the trustees via e-mail. The hard copies are not always available when they arrive for the meetings.

2. Closed Session items are not correctly listed . Example: September 13, 2017 Closed Session: Review of Current and Pending Litigation with Attorney Agenda Item stated "Leigh-Anne Harrison-Bigbie, Gavin Fisher v. El Rancho Simi Cemetery District, Wage and Hour Laws vs. Salaries". The two matters were not related. The "Wage and Hour Laws vs. Salaries" should have stated the item involved staff since the Chair reported to the public before adjourning the meeting about a raise.

3 . Items not listed but discussed by trustee and staff are worked into a non "Revised" Agenda.

4. Font size for the items' text is too small.

#4 - Meetings Minutes:

1. Drafts are only available to Board trustees. Textual errors are not corrected in approved documents. Example: A Closed Session: Review of Current and Pending Litigation with Attorney Agenda Item was not included.

2. Staff forwards the information to the trustees via e-mail. The hard copies are not always available when they arrive for the meetings.

INFRASTRUCTURE NEEDS OR DEFICIENCIES

#1 - The District contacted the Rancho Simi Recreation and Park District about a piece of land adjacent to the Cemetery for future plots. This matter will be tabled for now.

#2 - The Board approved Cemetery scattering gardens.

#3 - The Board approved the removal of a Cemetery road to increase the number of plots.

#4 - The Cemetery's office/resident recently underwent extensive improvements, and costs thus this asset's land must not be considered for plots.

EVALUATION OF MANAGEMENT EFFICIENCIES

#1 - The District Board has monthly financial reports at meetings, and approves annual budgets.

#2 - Revenue generating ideas from trustees abound.

FINANCING CONSTRAINTS AND OPPORTUNITIES

#1 - Payments are being made on the 1990 City of Simi Valley loan.

#2 - The Board contacted the City of Simi Valley to possibly have the loan forgiven or reduced.

FINANCING CONSTRAINTS AND OPPORTUNITIES INFRASTRUCTURE NEEDS OR DEFICIENCIES

#1 - The CemSites program is being used to help resolve the issue of the availability of plots in the Cemetery.

#2 - The 2012 Genealogy Report is being compared with the Cemetery records for accuracy; report flawed .

#3 - The Cemetery's plot map is slated for protection .

they do have a quorum at today's meeting so they can go ahead with approving the 2 meetings' Minutes. Trustee Burdorf Reported that the balance is $14,000. The Endowment Fund is $351,000. She mentioned that the Acorn(Simi Valley) misquoted what she had reported in the financial statement(for last month's meeting). She said the financials were misread(by the Simi Valley Acorn's reporter). [NOTE: This is why the public must be given copies of the monthly financial statements, and of the annual budgets!!!!!] She stated that the information was grossly misstated. She reported that the $11,801 liability payment was received; paid 3 months(?). She said that the backhoe payment will pay in October. She mentioned that she worked with Juanice on the budget so that Juanice can take it over!!!!!!! She said this will be covered in the Agenda(Juanice's CMS report?). She mentioned have a Salary and Hourly item on the Agenda . She exclaimed that they have a very high water bill!!!!! She said that they are still very low since it did not put them over the budget?!?!? They have been conserving water, and the rain came. She said they need the Warrants to be addressed!!!!! Trustee Stratton Asked what the Returns and Allowances are. Trustee Burdorf Explained that for more than one item funds had to be reissued!!!!! Trustee Stratton Asked if these were on plot sales!!!!! Trustee Kitchenmaster Asked if the Acorn should be asked to do a Correction/Retraction(on the misquotes). Trustee Burdorf Stated that it is the Chair's job/duty/ responsibility. Chairman Saunders Stated that it may cause problems if they ask them for one.

Juanice Stated that the number of plots has changed!!!!! She said that she is researching the Section 5 plots!!! She stated that there is a discrepancy!!!!!!! She brought up documents, Cemsites, and the spreadsheet?!?!? She stated that some plot sales(on the documents) begin at a different number(system?). She said that she has to go through row by row, and do a recount!!!!!!! Some thing about 80 - 150 less than that?!?!? Chairman Saunders Stated not to open up Section 5; only Section 7?!?!? Trustee Burdorf Stated did both!!!!! Juanice Mentioned that Section 7 going down; selling; plot sales were $7,800. She reported had 6 burials(4 full body, and 2 cremations). She said had 1 chair(s) placement (for the burial service). She brought up the monthly installment, phone calls, walk-ins, updates to the Bylaws, the official letterhead, and the logo(copies were given to the Trustees). Chairman Saunders Said the information is the same; the look is different. He said he likes the copy without the square. He said that Juanice(Cemetery Manager) cannot be included with the Board of Directors. Trustee Kitcherunaster, Trustee Burdorf, and Chairman Saunders Discussed how to list the information. Trustee Burdorf Asked about the "Mission" statement on the letterhead. Chairman Saunders Wants it agendized for the next meeting. Trustee Kitcherunaster Wants the information to be "reader friendly". Trustee Burdorf Had to take her glasses off. Juanice Will change the font. Chairman Saunders Said he likes what it reads, but to make the font bigger. Will continue the item and vote, font size, and the "Mission" statement. Juanice Mentioned the size of a cremation in comparison to a full burial is about 1/3. She stated that Cemsites is tremendously effective. She stated that LAFCo was very impressed, and wants the financial module to be purchased. She mentioned she is selling 2 plots a month. Trustee Burdorf Stated that she had a waiting list(of potential plot purchasers) put together by Juanice; they did not get the list that Leigh-Anne had made previously!!!!!!! Juanice Said she got the AT&T bill to go lower; changed from O'Connor Pest Control to Terminix(saving money); changed from Vision Landscaping to Alejo(saving money)! Chairman Saunders Said can cover them under the budget; it is great news!!!!! Trustee Stratton Asked how is it
