Laws and Executive Orders

1. The Energy Policy Act of 2005 (EPAct 05): 30% Energy Savings below ASHRAE 90.1 2004

2. Executive Order 13423 (2007): All new and 15% of existing buildings by 2015 must meet Guiding Principles

3. The Energy Independence & Security Act of 2007 (EISA 07): Expands and Strengthens EPAct 05 and requires a Green Rating System to reflect The Guiding Principles

4. Executive Order 13514 (2009): Reinforces EA 13423 and requires all new Federal Buildings to be Net Zero by 2030.

NAVFAC Wash LEED Policy

• In Spring of 2011, Secretary of the Navy Ray Mabus announced at the Federal USGBC Summit that in keeping with the Navy’s goals for sustainability and energy savings that new Navy buildings would be LEED Gold.

•The Defense Authorization Act passed in January 2012 (FY-12 NDAA, sec. 2830) makes it illegal to spend additional money for DoD buildings to get LEED Gold or Platinum. An exception exists (LEED Gold at no additional cost), but NAVFAC considers this unattainable.

•Bottom Line: NAVFAC Washington will not consider LEED Gold or higher (Platinum) for selection on any FY-12 MCON projects. LEED Silver will continue to be the NAVFAC Washington standard for FY12 MCON projects.
