PREAMBLE
We, the Chemical Engineering students of the University of San Carlos, believing in
the principles and objectives herein set forth, in a united Chemical Engineering studentry as a
strong foundation for academic and social growth, in harmonious relations between students
and educators as the front of intellectual excellence, and further believing that these noble
ideals can best be realized through the instrumentality of an organization that shall instill in
us the merits of intellectual discipline, honor, integrity, social concern, and moral
responsibility hereby constitute the Chemical Engineering Council and in virtue whereof do
hereby ordain and promulgate this Constitution.
ARTICLE I. NAME AND OFFICE
Section 1. Name. This organization shall be known as the “University of San Carlos
Chemical Engineering Council” and may be referred to as the ChE Council.
Section 2. Office. The principal office of the organization shall be anywhere within the
premises of the USC Talamban Campus and that the incumbent Council
President shall determine his own office.
ARTICLE II. COMPOSITION
Section 1. The ChE Council shall be composed of all Chemical Engineering students of
the University of San Carlos.
ARTICLE III. DECLARATION OF PRINCIPLES AND OBJECTIVES
Section 1. The ChE Council believes that quality education should be accessible and
affordable to everyone.
Section 2. The ChE Council shall serve as the forum of expression and representation of
the ChE Students.
Section 3. The ChE Council shall:
a. defend and promote the rights and general welfare of the ChE students;
b. uphold the ideals, objectives and policies of the University of San Carlos
and the College of Engineering;
c. contribute to the general welfare of the school and to help maintain its
christian, academic and moral standards;
d. assist the faculty and the administration in the promotion among the
students of the highest standards of honor and integrity in the conduct of
their affairs.
Section 4. The ChE council shall uphold the Constitution of the Collegiate of
Engineering Council and the Supreme Student Government of the University
of San Carlos.
ARTICLE IV. MEMBERSHIP
Section 1. All bonafide Chemical Engineering Students of the University of San Carlos
automatically become members of the ChE Council.
Section 2. Membership may be lost in any of the following instances;
a. expulsion from the University
b. transfer to another institution;
c. transfer to another course;
d. discontinuance of study.
ARTICLE V. CHE COUNCIL ASSEMBLY
Section 1. Supreme Authority. The ChE Council Assembly shall constitute the supreme
authority of the organization. As the supreme authority, it shall retain all
rights and privileges not specifically assigned to the ChE Executive Board,
the President or any other officer of the ChE Council.
Section 2. Composition. The ChE Council Assembly shall be composed of the ChE
Executive Board and all class officers of the different year levels of the ChE
Department.
Section 3. Powers and Prerogatives. The ChE Council Assembly shall have the
prerogative to vote on any or all of the following matters:
a. general policies;
b. venue of the ChE Council Acquaintance Party;
c. and such other matters as may be necessary and proper to effectively
discharge the principles and objectives of the organization.
Section 4. Quorum and Votes Required. The presence of at least thirty (30) percent of
the officers that compose the assembly shall constitute a quorum provided
that each class organization is represented. A majority shall constitute a valid
act unless otherwise provided herein.
ARTICLE VI. CHE EXECUTIVE BOARD
Section 1. Composition. There shall be a ChE Executive Board composed of the
President of the Chemical Engineering Council, the Internal and External
Vice Presidents, the Secretary and Undersecretary, the Treasurer, the Auditor,
two PROs, committee heads and the presidents of the different year levels.
Section 2. Powers and Duties. The ChE Executive Board shall have the following
powers and duties:
a. enforce this constitution and by-laws;
b. have general supervision and control of the business and affairs of the
organization;
c. establish all policies and make all rules and regulations of the ChE
Council;
d. coordinate the activities of all other officers of the ChE Council;
e. receive reports from all the officers of the board including the standing
committees and other special bodies within the ChE Council;
f. make recommendations to the ChE Council Assembly;
g. act on all matters referred to it by ChE Council Assembly;
h. determine the date and time of the ChE Council Assembly meetings;
i. undertake and carry out such powers, duties, functions and responsibility
as shall be necessary to fulfill the principles and objectives of the ChE
Council.
Section 3. Regular Meeting. The ChE Executive Board shall hold regular meetings at
least twice a month on such date and time as they may determine. Unless
otherwise provided, the regular meetings of the ChE Executive Board shall be
held at the principal office of the ChE Council.
Section 4. Special Meetings. Special meetings of the ChE Executive board may be
called by the ChE Council President as he may deem wise and necessary.
Section 5. Quorum. A majority of the ChE Executive Board officers shall constitute a
quorum for the transaction of business, and every decision of a majority of
the quorum duly assembled as Board shall be valid of the ChE Council unless
otherwise provided.
Section 6. Malfeasance, Misfeasance, or Non-feasance. The ChE Executive Board may
upon petition by any bonafide Chemical Engineering student, inquire into
malfeasance committed by any officer of the ChE Council and after due
hearing, take whatever action it may deem warranted.
ARTICLE VII. OFFICERS, ELECTION, TENURE AND QUALIFICATIONS.
Section 1. Elective Officers. All officers of the ChE Council including those officers of
the class are elective unless otherwise provided.
Section 2. The ChE Executive Board may create such other office as it may deem wise
and necessary for the proper and efficient management of the ChE Council to
be filled by appointment of the President.
Section 3. The Election shall be conducted in the following manner:
a. After the election of the class officers of all year levels, they shall, at a
predesignated date to be determined by the outgoing Council President,
assemble for the purpose of electing the officers of the ChE Executive
Board.
b. The outgoing Council President shall preside over such assembly until a
new Council President shall have been elected.
Section 4. No student shall be elected to the ChE Executive Board unless he/she:
a. is a bonafide Chemical Engineering student of the University of San
Carlos.
b. should have at least one year residency in the Department of Chemical
Engineering.
Section 5. No student shall be elected President unless he/she is a 4th or 5th year student.
Section 6. No officer of the ChE Executive Board may hold the same office twice in the
ChE Council.
Section 7. In the event when no election is held due to a valid cause, the officers
enumerated in this article may remain beyond their tenure of office until their
successors are elected.
Section 8. The election of all class officers shall be held not later than the end of the first
semester.
Section 9. Term of Office. The term of office for all officers of the council shall be for
one school year to commence upon taking oath of office.
ARTICLE VIII. POWERS AND DUTIES OF OFFICERS
Section 1. Council President. The President of the ChE Council shall be the chief
executive officer of the ChE Council and shall have the following duties:
a.) enforce this Constitution and By-laws, as well as all resolutions of
the ChE Executive Board;
b.) preside over all the meetings of the ChE Council Assembly and
the ChE Executive Board;
c.) between board meetings, direct the affairs of the organizations as
provided herein;
d.) appoint officers of the ChE Council as provided in this
constitution and by-laws;
e.) hire, suspend and terminate the services of such members of the
ChE Council as he may deem wise and necessary subject to
confirmation by the Board;
f.) call the special meetings of the Assembly and Board as provided
in this Constitution and By-Laws;
g.) make an annual report in writing of his/her administration to the
members;
h.) perform such other duties and functions as shall be necessary to
fulfill the principles and objectives of the ChE Council subject to
limitations provided herein.
Section 2. Internal Vice President. The ChE Council Internal Vice President shall:
a.) exercise the powers and perform the functions and duties of the
president during the inability of the latter to act and;
b.) shall perform such other function and duties as are assigned to
him by the Council President or the ChE Executive Board.
Section 3. Secretary. The ChE Council Secretary shall:
a.) be the administrative officer of the ChE Council and be
responsible for the operation of the Secretariat;
b.) be the custodian of the official seal and records and properties of
the Council;
c.) keep faithful and permanent record of the minutes such meetings;
d.) answer all inquiries and correspondence from the members and all
persons, firms, and entities;
e.) affix his signature and the official seal of the ChE Council on all
official communications, correspondence, certifications and the
like, emanating from the ChE Council;
f.) perform such other duties and functions as may be delegated to
him by the ChE Executive Board.
Section 4. Treasurer. The ChE Council Treasurer shall:
a.) collect or be the custodian of all funds of the ChE council as a
whole and make a detailed report in writing of the financial
standing of the ChE council at such times as the ChE Executive
board may require; and
b.) perform such other duties and functions as may be delegated to
him by the ChE Executive Board.
Section 5. Auditor. The ChE Council Auditor shall:
a.) examine and audit the books of account of the ChE council;
b.) prepare a semestral audit report of the financial statement of the
ChE Council;
c.) pre-audit disbursement from funds held in trust by this ChE
Council; and
d.) perform such other duties and functions as may be delegated to
him by the ChE Executive Board.
Section 6. Public Relations Officers. The ChE Council Public Relations Officer shall:
a.) attend to the relations of the ChE Council with the ChE
Department, the College of Engineering, the University, the
public and the media so as to promote the principles and
objectives of the ChE Council.
b.) give notices of all meetings to the assembly and the ChE
Executive Board
c.) perform such other duties and functions as may be delegated to
him by the ChE Executive Board.
Section 7. External Vice President. The ChE Council External Vice President shall:
a.) act as the official representative in all ceremonies, affairs,
proceedings and transactions involving the ChE Council subject
to limitations, and;
b.) perform such other functions and duties as may be delegated to
him by the ChE Executive Board.
Section 8. Undersecretary. The ChE Council Undersecretary shall:
a.) assist the ChE Council Secretary in his duties
b.) exercise the powers and perform the functions of the Secretary
during the inability of the latter to act, and;
c.) perform such other functions and duties as may be delegated to
him by the ChE Executive Board.
Section 9. In cases of death, resignation, disability or incapacity of the President to
discharge the duties of the office, he shall be succeeded by the Internal Vice
President.
Section 10. In cases of vacancy of the office of the Internal Vice President, the latter shall
be filled by the election from among the members of the ChE Council.
Section 11. In cases of vacancy resignation or expulsion of an Executive Board member,
the position shall be replaced by a member of the Council who is to be
determined by the ChE Executive Board.
ARTICLE IX. STANDING COMMITTEES
Section 1. There shall be standing committees of the ChE Council in order to facilitate
the achievement of its principles and objectives.
Section 2. The standing committees shall be as follows:
a.) Intellectual Committee – They shall administer events that cultivate the
logical aspect of the student body through activities involving academics
and self-improvement creating an impact on productivity and efficiency
both individually and as a team.
b.) Spiritual Committee- They shall facilitate the spiritual and religious
neccessities of the ChE Student Body by promoting activities which
promote and encourage values in accordance with the University's
mission to create Witnesses to the Word
c.) Physical Committee- They shall be the governing body who shall take
charge of the Physical Development of the ChE Studentry by promoting
activties aimed at developing Physical Fitness. The Committee shall also
take charge of the Physical Arrangements and Venue Acquisition for
events organized by the Council
d.) Community Extension Service Committee- The Community Extension
Committee shall act as the helping hand of the Council by conducting
activities that shall impart the knowledge learned in the four walls of the
classroom through tech transfers and service to our brothers and sisters
outside the University.
e.) Socio-Cultural Committee- They shall function as the body who aims to
create a people-oriented and socially responsible ChE studentry in order
to achieve solidarity and unity.
f.) Environmental Committee- They shall aim to increase the awareness of
the ChE students with the current environmental issues and shall facilitate
activities that will help preserve the environment.
g.) Virtual Committee- They shall be responsible for all the phenomena in
the Council's official Facebook page. They shall make sure that the
content created in the page is factual and engages interactivity among
students. They shall also be responsible for circulating online
advertisements.
h.) Fundraising Committee- They shall lead the Council in planning and
executing revenue-generating strategies necessary to carry out the
organization's missions.
i.) Creative Committee- The Creative Committe shall produce creative
promotional opportunities for the Council.
Section 3. The ChE Executive Board may create ad-hoc committees as it may deem
necessary to realize and achieve the principles and objectives of the ChE
Council.
Section 4. The President shall appoint a Committee Head for each standing committee
with the approval of the ChE Executive Board.
Section 5. Each ChE Class Organization shall elect their representatives to the standing
committees.
Section 6. There shall be one committee member per class organization for each of the
standing committees. The powers, duties and functions of the standing
committees shall be prescribed in a policy manual to be prepared committees
shall be prescribed by the ChE Executive Board. The board shall revise such
manual from time to time as it may deem necessary.
ARTICLE X. CLASS ORGANIZATION
Section 1. There shall be a class organization for each year level of the ChE Department.
Section 2. It shall be referred to by their respective year level.
Section 3. In the management of their own internal affairs and activities the class
organization shall be autonomous.
Section 4. Policies, rules , guidelines, programs and projects adopted and approved by
the respective class organization shall uphold and conform with this such
policies, rules, guidelines, and activities run contrary to the provisions of this
Constitution, the shall prevail.
ARTICLE XI. GENERAL PROVISIONS
Section 1. The official seal of the ChE Council shall include the shield of the official
seal of USC.
Section 2. No character of any class organization shall contravene with this constitution.
Section 3. ChE Acquaintance Party. This semestral meeting of all bonafide ChE
students shall be known as the ChE Acquaintance Party. The Acquaintance
Party shall be held at any place that the ChE Executive Board may designate.
The Acquaintance Party shall have, as special order, the summary report on
all activities of the ChE Council any other important matter affecting all ChE
students. The ChE Council President shall be the presiding officer of the
party; however, he may delegate it to any other officer subject to approval of
the ChE Executive Board.
ARTICLE XII. BOARD OF ADVISERS
Section 1. There shall be a Board of Advisers composed of the Chairman of the ChE
Department and two other faculty members from the University of San
Carlos.
Section 2. The Chairman of the ChE Department shall act as the over-all adviser to the
ChE Council. The ChE department shall have the final say on matters
affecting the academic life or the general discipline of the ChE Council.
ARTICLE XIII. AMENDMENT
Section 1. This Constitution and By-Laws may be amended by a Constitutional
Commission whose members shall be appointed by the ChE Council
Assembly. No amendment to this Constitution and By-Laws shall be
authorized within 12 months following its approval nor oftener than 12
months thereafter.
Section 2. Any amendment or revisions to this Constitution shall be valid upon
ratification by a majority vote cast by all members of the ChE Council in a
plebiscite for that purpose.
ARTICLE XIV. TRANSITORY PROVISIONS
Section 1. Upon the approval of this constitution and by-laws, ARTICLE VII shall
temporarily be suspended and shall take effect next school year, 1990-1991.
Section 2. Instead, the present officers of the ChE Council shall continue in office until
their term shall expire.
