As of 30 November 2007, of the remaining 17 (out of the original 54) cases pilot-tested and heard on continuous trial basis, 3 are deemed submitted for decision, whereas another 3 were already decided against the respective accused. The prosecution is still presenting its evidence in only 4 cases. In all the rest, the accused is set to present his evidence in his respective case. Both the Third and Fourth Division have only one remaining and unresolved case still being heard on continuous trial. To familiarize SB on the Continuous Trial System, ROLE with MCA-PTP invited Federal Prosecutor Cliff Sticklin of Dallas, Texas last 29 June 2007 to lecture on the topic.b.Study on Rule 65 (on Interlocutory Appeals)Not indicated in the WP for CY 2007A series of Roundtable Discussions (RTDs) on Rule 65 with the various stakeholders of the Court were conducted during the 1st semester of 2007. The recommendations therein were presented to the Supreme Court En Banc and resulted to the creation of the Sub-committee on Rule 65 headed by retired Justice Romeo J. Callejo, Sr. On 29 December 2007, the amendments on Rule 41, 45, 58 and 65 were approved by the Court.c.Automated Case Management and Information SystemNot indicated in the WP for CY 2007ROLE has been working with the Sandiganbayan through a series of meetings to enhance the capabilities of its CMIS. Among the enhancements that will be introduced are: ability to generate additional case management and special query reports; improvement of the data security interface; ability to detect data encoding errors; better integration with the Supreme Court and other case management system in the judiciary; ability to connect with the newly established data center of the Supreme Court; integration of an electronic document management system; and migration of the data to Microsoft from Lotus Notes.

As part of the development of the CMIS II, a Seminar-Workshop on IT Project Management was conducted last April 16-18, 2007. Participants consisted of members of the Management Information Systems Division of the Sandiganbayan, representatives from the Records and Management Office, and PHILJA.2THE COURT OF TAX APPEALSa.Automated Case Management and Information Systema. Software developedProject scoping and strategic planning workshops were done in the first quarter of 2007. These planning activities provided a framework and roadmap for the development of an automated case flow and docket management system with the CTA justices and court personnel at its helm.A delegation of justices and clerks of court of the CTA visited the US Administrative Office of the Courts, which is the institution responsible for providing administrative, legal, financial and information technology management support to the federal judiciary in Washington, D.C. The delegates witnessed first hand how the paperless system worked and how the CMIS has evolved to already include the e-filing system.ROLE engaged the services of CPRM to do the inventory and data encoding of cases. To prepare for the activity, CPRM conducted a two-day workshop in July 2007 with the CTA- CMIS TWG to facilitate discussions on management reports to be generated as well as identify data-elements or fields that will be contained on the Case Management Relational Database (CMRD).

As of December 2007, about 925 cases have been extracted from the JRD , which CTA has yet to validate and sign-off. Information gathered by the enumerators will be encoded in the CMRD. CPRM presented the screen shots of the CMRD before the justices en banc in late September.In December 2007, ROLE purchased 8 desktops computers for CTA. These computers will be used for data-encoding of CTA cases. Of the 8 computers, 2 computers will used as servers.To prepare the key officials and personnel of the CA for the roll-out of the CMIS, a series of computer trainings were held last August 29-30 and September 6-7, 2007 in coordination with the Philippine Judicial Academy. .ROLE IT consultant has designed the systems requirements specifications (SRS) which served as the basis of the winning bidder in developing the program. In November/December 2007, ROLE awarded the contract to CPRM taking into consideration the overall soundness of the proposal, CPRMs familiarity with the intricate CA/CTA court process, the established good working relationship with CA/CTA personnel, and their perceived understanding of the CMIS project.Visit to the Sandiganbayan: After the CTAs observational tour to the US courts in Washington, D.C. to witness the benefits of automation in court administration, it was the Sandiganbayans turn to showcase their CMIS to their colleagues in the Court of Tax Appeals.3The ARMMa.Technical Assistance to the ARMMa. Workshops conductedROLE initiated the conduct of dialogues by each of the Presiding Judges of the Regional Trial Courts in the ARMM with the prosecutors, trial lawyers of the Public Attorneys Office and leadership of the Integrated Bar of the Philippines to discern rigidities that affect the just and speedy disposition of criminal cases in their respective courts. There were thirteen BBDs conducted in 2007.While the BBD was court specific and limited to criminal proceedings, five provincial focus group discussions were conducted for the constituent provinces of the ARMM in 2007. The FGD was participated by the RTC Presiding Judges, Provincial and City Prosecutors, PAO Lawyers, and persons from the civil society. It sought to start discussions on the effectiveness, efficiency and affordability of judicial proceedings and identify measures that may be adopted to enhance such effectiveness, efficiency and affordability.ROLE engaged the services of the Bangsamoro Women Solidarity Forum (BMWSF) to review the movement of the 100 last cases disposed of by the 14 RTCs in the ARMM. BWSF examined the case records and recorded each judicial event in a case information sheet. The data is being assembled into a spreadsheet for statistical study to identify mean, median and mode measures of each case incident and identify which events are more prone to delay. The datasheets submitted by BWSF is currently being processed by ROLE ARMM to appreciate the average court speed on each of the key judicial event and relating the same court averages to the regional baseline to determine each courts performance.ROLE also engaged the services of BWSF to assist clerks of courts map out the various court activities and processes from the initiation to the termination of proceedings. Identifying the various steps, the JAM also indicated the usual intervals between various judicial events from the commencement to the termination of the proceedings. The preliminary data submitted on both judicial action mapping and case movement review were presented to a roundtable meeting of ARMM RTC judges participated in by provincial prosecutors and district attorneys of the Public Attorneys Office last August 2007.The ARMM Project Office engaged the assistance of the Computer Science Department of the College of Engineering of the Notre Dame University in the development of the application system. The prototype was presented last 10 January 2007 before the judges and staff of RTC Branches No. 13-15 in Cotabato City.For the first quarter of 2007, the USAID through its Rule of Law Effectiveness (ROLE) Project has delivered and installed computers, furniture and equipments for the ARMM Regional Trial Courts in Basilan, Sulu, Tawi-tawi, Shariff Kabunsuan, Maguindanao and Lanao del Sur.A.4.IN PARTNERSHIP WITH ADB1ADBTA 4832-PHI: Enhancing the Autonomy, Accountability and Efficiency of the Judiciary and Improving the Administration of JusticePilot CCAO,CFMO and RCAO established; 7 business processes detailed and installed;Implementation of Component A was started with a consultation with Region 7 executive judges in November 2006.3 users training conducted;SC En Banc approved the pilot implementation of the decentralized administrative structure in Region 7 through A.M. No. 06-11-09-SC.Position descriptions of core positions in pilot offices submitted to OCA; waiting for designation of key personnel in pilot offices by SC En Banc.Component B will be launched on 18 January 2007.A.5.CONTINUING PROJECTS (in 2007)1Access to Justice for the Poor through Information, Education, and Communication (IEC)The project was launched in 23 August 2006. A MOA was approved by SC on 14 November 2006. Project orientations conduocted in five (5) project sites.36 First Level Clerks of Court designated as Municipal Court Information Officers are continuously performing their functions consistent with the Supreme Court guidelinesOCA Circular No. 16-2007 Designating all Clerks of Court of the Concerned First Level Courts as Municipal Court Information Officers for the Access to Justice for the Poor Project was issued in 21 February 2007.Approval and implementation of the IEC GuidelinesMemorandum Circular No. Circular No. 07-2007 Implementing the Approved Information, Education, and Communication (IEC) Guidelines for Municipal Court Information Officers under the Access to Justice for the Poor Project Funded by the European Commission took effect on 02 April 2007.Procurement and delivery of 36 sets of computers to the project sitesSome 36 sets of computer were distributed to the project sites.Some 50,000 copies of brochures on Stages of Criminal and Civil Actions in Philippine Courts were published; 16,000 copies of whic have already been distributed to the 17 MCTCs of the project sites (Camarines Sur, Oriental Mindoro, Capiz, Lanao del Norte, and Sultan Kudarat), A2J Partner Agencies (DSWD, DOJ, DILG-LGA, DILG-PPSC, and ALG), RTCs/MTCs, MCTCs, MTCCs, MeTCs (Naga City, Leyte, Tacloban City, Rizal, Bulacan, Laguna, NCR), PNP, NBI, Ombudsman, CA, Sandigan, Parole and Probation Administration, Embassies, . Similarly, these information were also produced in 2,000 tarpaulins; 1,600 copies were already distributed in same places mentioned above.Published and distributed the IEC GuidelinesSome 2,000 copies of the IEC Guidelines were published. Initial distribution covered the project sites, court offices, and partner agencies. Full distribution is still in the planning stage.At least 6 out of 10 existing SC publications are translated into Tagalog.Existing IEC materials were already translated in Tagalog. These are the following: (1) Kasaysayan ng Korte Suprema; (2) Mga Hakbang sa Pagsasampa ng Kasong Kriminal sa Hukuman ng Pilipinas; (3) Mga Hakbang sa Pagsasampa ng Kasong Sibil sa Hukuman ng Pilipinas; (4) Mga Hukom ng Korte Suprema; (5) Sistema ng Hudikatura ng Pilipinas; at (6) Action Program for Judicial Reform.At least 70% of the judges and court personnel in the target project areas sensitized according to the training program; At least 75% of the MCIOs participated in the IEC Skills training.There are 127 out of 146 (86.98%) judges and court personnel of the project sites who have undertaken the sensitization workshop on access to justice and laws on women and children from July -September 2007. Fifteen out of 17 MCIOs have undertaken the IEC Skills Training in October 2007.2Enhanced Case Flow Management (CFM): Development and Pilot Implementation for the 1st and 2nd Level CourtsNot indicated in the WP for CY 2007The CFM pilot project in Pasay City was assessed in April 2006 by a team of judges and court personnel. The assessors emphasized the need to enhance the CFM system and software to include more case tracking features and generation of data for the Case Administration Management Information System (CAMIS) of the Office of the Court Administrator (OCA), among others. Based on the recommendations, the Supreme Court implemented the Development and Pilot Implementation of an Enhanced Case Flow Management (CFM) System for the First and Second Level Courts. The project that involves the design, development, testing, pilot implementation, and process and system documentation of the Enhanced CFM System that is integrated with the existing CAMIS of the OCA and other application systems that may be developed later.The project was awarded to Softrigger Interactive Incorporated on 31 August 2006. Development of the core functionalities of the system is ongoing; set-up of development servers is completed and available on-line for preliminary testing; modular framework for transactions have been created and programming for report modules have begun; and prototype developed and pilot-tested on the first week of December 2006.Softrigger Interactive finished with the eCFM software development in August 2007. The eCFM system is now web-based and developed using Microsoft Solutions Framework of .Net Framework. Additional features of the eCFM system include electronic raffling, e-calendaring and the ability to be integrated with the ePayment system and CAMIS.On September 2007, the eCFM system was pilot tested in Pasay City RTCs and MTCs. Callejo, Sr. On 29 December 2007, the amendments on Rule 41, 45, 58 and 65 were approved by the Court.c.Automated Case Management and Information SystemAutomated Case Management and Information System operationalized.ROLE has been working with the Sandiganbayan through a series of meetings to enhance the capabilities of its CMIS. Among the enhancements that will be introduced are: ability to generate additional case management and special query reports; improvement of the data security interface; ability to detect data encoding errors; better integration with the Supreme Court and other case management system in the judiciary; ability to connect with the newly established data center of the Supreme Court; integration of an electronic document management system; and migration of the data to Microsoft from Lotus Notes.

As part of the development of the CMIS II, a Seminar-Workshop on IT Project Management was conducted last April 16-18, 2007. Participants consisted of members of the Management Information Systems Division of the Sandiganbayan, representatives from the Records and Management Office, and PHILJA.2.THE COURT OF TAX APPEALSa.Automated Case Management and Information SystemAutomated Case Management and Information System developed and operationalized.Project scoping and strategic planning workshops were done in the first quarter of 2007. These planning activities provided a framework and roadmap for the development of an automated case flow and docket management system with the CTA justices and court personnel at its helm.A delegation of justices and clerks of court of the CTA visited the US Administrative Office of the Courts, which is the institution responsible for providing administrative, legal, financial and information technology management support to the federal judiciary in Washington, D.C. The delegates witnessed first hand how the paperless system worked and how the CMIS has evolved to already include the e-filing system.ROLE engaged the services of CPRM to do the inventory and data encoding of cases. To prepare for the activity, CPRM conducted a two-day workshop in July 2007 with the CTA- CMIS TWG to facilitate discussions on management reports to be generated as well as identify data-elements or fields that will be contained on the Case Management Relational Database (CMRD).

As of December 2007, about 925 cases have been extracted from the JRD , which CTA has yet to validate and sign-off. Information gathered by the enumerators will be encoded in the CMRD. CPRM presented the screen shots of the CMRD before the justices en banc in late September.To facilitate a better understanding of the bottlenecks that are causing undue delay in case processing, ROLE commissioned a study of closed cases in the CTA. About 98 closed cases were studied for the duration of one year from November 2005 to 2006. The result, which was presented before the justices en banc on September 24, 2007, revealed that it takes an average of about 3.5 to 4 years to complete a case at the CTAIn December 2007, ROLE purchased 8 desktops computers for CTA. These computers will be used for data-encoding of CTA cases. Of the 8 computers, 2 computers will used as servers.To prepare the key officials and personnel of the CA for the roll-out of the CMIS, a series of computer trainings were held last August 29-30 and September 6-7, 2007 in coordination with the Philippine Judicial Academy. .ROLE IT consultant has designed the systems requirements specifications (SRS) which served as the basis of the winning bidder in developing the program. In November/December 2007, ROLE awarded the contract to CPRM taking into consideration the overall soundness of the proposal, CPRMs familiarity with the intricate CA/CTA court process, the established good working relationship with CA/CTA personnel, and their perceived understanding of the CMIS project.Visit to the Sandiganbayan: After the CTAs observational tour to the US courts in Washington, D.C. to witness the benefits of automation in court administration, it was the Sandiganbayans turn to showcase their CMIS to their colleagues in the Court of Tax Appeals.3.The ARMMa.Technical Assistance to the ARMMARMM RTCs provided with technical assistance.ROLE initiated the conduct of dialogues by each of the Presiding Judges of the Regional Trial Courts in the ARMM with the prosecutors, trial lawyers of the Public Attorneys Office and leadership of the Integrated Bar of the Philippines to discern rigidities that affect the just and speedy disposition of criminal cases in their respective courts. There were thirteen BBDs conducted in 2007.While the BBD was court specific and limited to criminal proceedings, five provincial focus group discussions were conducted for the constituent provinces of the ARMM in 2007. The FGD was participated by the RTC Presiding Judges, Provincial and City Prosecutors, PAO Lawyers, and persons from the civil society. It sought to start discussions on the effectiveness, efficiency and affordability of judicial proceedings and identify measures that may be adopted to enhance such effectiveness, efficiency and affordability.ROLE engaged the services of the Bangsamoro Women Solidarity Forum (BMWSF) to review the movement of the 100 last cases disposed of by the 14 RTCs in the ARMM. BWSF examined the case records and recorded each judicial event in a case information sheet. The data is being assembled into a spreadsheet for statistical study to identify mean, median and mode measures of each case incident and identify which events are more prone to delay. The datasheets submitted by BWSF is currently being processed by ROLE ARMM to appreciate the average court speed on each of the key judicial event and relating the same court averages to the regional baseline to determine each courts performance.ROLE also engaged the services of BWSF to assist clerks of courts map out the various court activities and processes from the initiation to the termination of proceedings. Identifying the various steps, the JAM also indicated the usual intervals between various judicial events from the commencement to the termination of the proceedings. The preliminary data submitted on both judicial action mapping and case movement review were presented to a roundtable meeting of ARMM RTC judges participated in by provincial prosecutors and district attorneys of the Public Attorneys Office last August 2007.The ARMM Project Office engaged the assistance of the Computer Science Department of the College of Engineering of the Notre Dame University in the development of the application system. The prototype was presented last 10 January 2007 before the judges and staff of RTC Branches No. 13-15 in Cotabato City.For the first quarter of 2007, the USAID through its Rule of Law Effectiveness (ROLE) Project has delivered and installed computers, furniture and equipments for the ARMM Regional Trial Courts in Basilan, Sulu, Tawi-tawi, Shariff Kabunsuan, Maguindanao and Lanao del Sur.A.4.IN PARTNERSHIP WITH ADB1.ADBTA 4832-PHI: Enhancing the Autonomy, Accountability and Efficiency of the Judiciary and Improving the Administration of JusticeFor Component A, RCAO was launched in Lapulapu City on 5 December 2007 and the screening of applicants for designation to RCAO positions was undertaken by OCA.For Component B, a stakeholder consultations on the Long-Term Justice Reform Program were conducted in Manila (December 6) and Cebu (December 11). The outputs of the thematic group discussions were used in the finalization of the SWAp report.Five (5) units of desktop computers were donated to Lapulapu City HOJ for use of e-register to facilitate case data management and for data back capturing in preparation for eCFM rollout. Fifteen out of 17 MCIOs have undertaken the IEC2.Enhanced Case Flow Management (CFM): Development and Pilot Implementation for the 1st and 2nd Level CourtsOne Enhanced Plan developed and implemented for the 1st and 2nd level courts before end of project.The CFM pilot project in Pasay City was assessed in April 2006 by a team of judges and court personnel. The assessors emphasized the need to enhance the CFM system and software to include more case tracking features and generation of data for the Case Administration Management Information System (CAMIS) of the Office of the Court Administrator (OCA), among others. Based on the recommendations, the Supreme Court implemented the Development and Pilot Implementation of an Enhanced Case Flow Management (CFM) System for the First and Second Level Courts. The project that involves the design, development, testing, pilot implementation, and process and system documentation of the Enhanced CFM System that is integrated with the existing CAMIS of the OCA and other application systems that may be developed later.The project was awarded to Softrigger Interactive Incorporated on 31 August 2006. Development of the core functionalities of the system is ongoing; set-up of development servers is completed and available on-line for preliminary testing; modular framework for transactions have been created and programming for report modules have begun; and prototype developed and pilot-tested on the first week of December 2006.Softrigger Interactive finished with the eCFM software development in August 2007. The eCFM system is now web-based and developed using Microsoft Solutions Framework of .Net Framework. Additional features of the eCFM system include electronic raffling, e-calendaring and the ability to be integrated with the ePayment system and CAMIS.On September 2007, the eCFM system was pilot tested in Pasay City RTCs and MTCs.
