58 September 18, 2008 A Regular Meeting of the Board of Education, Township of Woodbridge, was held on September 18, 2008, at approximately 7:00 p.m. in the Avenel Middle School, Woodbine Avenue, Avenel, New Jersey. The meeting opened with the Salute to the Flag and a moment of silence. The President, Brian Molnar, presided. Board members present: Diane Acquisto, Pat Hardiman, Lewis Huber, Judy Leidner, Lawrence Miloscia, Brian Small, George Yuhasz, Brian Molnar. Thomas “Skip” Garley was absent. Board personnel present: John Crowe, Dennis DeMarino, Viola Lordi, Lois Rotella, Angela Korodan, Rita Miller, Anthony D’Orsi, Jonathan Triebwasser, Barbara DeRollo. Newspaper Reporters Present: Cathy Cheng, The Sentinel Business Administrator/Board Secretary, Dennis DeMarino, read the following statement regarding the Open Public Meetings Law: "The New Jersey Open Public Meetings Law was enacted to insure the right of the public to have advance notice of and to attend the meetings of public bodies at which any business affecting their interest is discussed or acted upon. In accordance with the provisions of this act, the Board of Education had caused notice of these meetings to be published by having the date, time and place, thereof, posted as follows: April 28, 2008: Faxed to Home News Tribune and Star Ledger, Hand delivered to Municipal Clerk, and Posted in Avenel Middle School and the Board of Education Administration Building." On a motion by Ms. Hardiman, seconded by Mr. Yuhasz and carried, the following Minutes were approved: August 21, 2008 - Regular Meeting August 21, 2008 - Closed Session Mr. DeMarino stated there were no Bids to report. Dr. Crowe announced that School #24 has been named a National Blue Ribbon School. Dr. Crowe explained this is the highest level of recognition. He stated this honor has been bestowed on only 320 schools throughout the nation, 9 within the state of New Jersey and School #24 is the only school in Middlesex County to receive this award. Mr. Molnar then called for Committee reports.

The Superintendent of Schools presented the following recommendations:

1. That the Board of Education approve the submission of an Application for Licensure of the School Strep Program, under the provisions of the N.J.S.A. 45:9-42-26 et.seq., to the New Jersey State Department of Health and Senior Services.

2. That the Board of Education approve payment of $100.00 (District license fee) and $800.00 ($50.00 per elementary school) to the New Jersey Department of Health and Senior Services. This is the annual fee for our elementary schools to participate in an acceptable proficiency testing program, as per the Clinical Laboratory Improvement Amendments of 1988 (CLIA’88), N.J.S.A. 45:9-42.26. It allows the elementary school nurses to perform clinical laboratory tests such as the Direct Antigen Tests for strep throat.

3. That the Board of Education approve payment of $3,465.60 to DigitalPT from AccuTest ($153.00 per elementary school and $1,200.00 annual registration fee for district) for CLIA analysis and laboratory proficiency testing as required by the New Jersey Department of Health and Senior Services.

4. That the Board of Education approve the previously submitted agreement between the Woodbridge Township Board of Education and the County of Middlesex for the establishment of an after-school program at Iselin Middle School, which will include the reinforcement of academic standards, recreation, a focus on intensive substance abuse prevention education, gender-specific programming for girls, enhancing good peer relations and violence prevention, conflict resolution, life and vocational skills development.

5. That the Board of Education approve the previously submitted list of Professional Development conferences for staff members, dated September 18, 2008.

6. That the Board of Education approve payment to Lynn’s Speech Therapy Center to provide one hour of speech therapy, as per a student’s IEP, at a cost not to exceed $95/hour. (Payment will be made from the Consultant Account.)

7. That the Board of Education approve payment to Jeanette E. Voight, Certified Realtime Reporter, for providing CART services (Computer Aided Realtime Translation) to a hearing impaired parent of a special education student at Woodbridge Middle School for open house. This parent does not sign. The cost for this service is $100/hour plus 31cents per mile. (Payment will be made from the Consultant Account.)

8. That the Board of Education approve payment to The Craig School for speech and language services at the rate of $100/hour for individual services for a special education student. (Payment will be made from the Consultant Account.

9. That the Board of Education approve the previously submitted agreement between the Woodbridge Board of Education and Bayada Nurses for the period Sept. 3, 2008 through August 31, 2009.

10. That the Board of Education approve payment to Middlesex Regional Education Services Commission for the 2008-09 school year for psychological and/or educational evaluations at a rate of $240/evaluation; and for bilingual psychological and/or educational evaluations at a rate of $375/evaluation. (Payment will be made from the Consultant Account.)

11. That the Board of Education approves the nursing services of MidPoint Health Care for the following student, in accordance with the previously submitted agreement between the Board of Education and MidPoint Health Care, dated July 1, 2008:

Ms. Hardiman moved for the adoption of the Superintendent’s recommendations, seconded by Mr. Huber. There were no comments or questions from the Board or public. With all Board members present voting in favor, with the exception of Ms. Leidner who abstained on Item #5 in her name, the foregoing was adopted. Dr. Crowe presented resolutions which appear on the Policy and Planning agenda. Dr. Crowe expressed the importance of perfect attendance and acknowledged the employees who have achieved it. The Policy and Planning Committee, on the recommendation of the Superintendent of Schools, presented the following:

1. That the Board of Education adopt the attached resolution commending American Art Company for their generous donation of ceramic clay for use by the art teachers at Woodbridge High School.

2. That the Board of Education adopt the attached resolution commending Mayco Coloramics, LLC, for their generous donation of ceramic glazes and supplies for use by the art teachers at Woodbridge High School.

3. That the Board of Education adopt the attached resolution commending ninety-six district employees who have achieved perfect attendance for the 2007-2008 school year.

8. That the Board of Education adopt the attached resolution in opposition of the New Jersey State-Mandated School Accountability Regulations which require school districts to take punitive measures against employees who have provided service and dedication.

9. That the Board of Education adopt the attached revised job descriptions as follows:

13. That the Board of Education suspend Bylaw #030, which requires a 30-day interval between policy readings, to permit the second reading of Policy #509, Health Examinations, 28 days after the first reading (August 21, 2008, Policy and Planning, Item #4).

14. That the Board of Education adopt the attached Request to Suspend form which includes all offender, victim and incident detail contained in the Department of Education’s Electronic Violence and Vandalism Reporting System (EVVRS) incident report form for reporting incidents of violence, vandalism and substance abuse (V&V).

Ms. Hardiman moved for the adoption of the Policy and Planning recommendations, seconded by Ms. Leidner. During Board discussion, Ms. Lordi explained in Item #13, the Board is going to waive the 30 day interval, which is what the item accomplishes. Ms. Lordi stated it is her understanding that the Board then wants to do a second reading of Policy #509 this evening. The Board concurred. Ms. Lordi then suggested inserting Item #13a, which reads as follows:

13a. That the Board of Education adopt the attached revised Policy #509, Health Examinations.

Ms. Hardiman moved for the adoption of the Policy and Planning recommendations with the addition of Item #13a, seconded by Ms. Leidner. There was no further discussion by the Board. During public discussion, P. Ballotta, Woodbridge, asked if the job descriptions listed in Item #10 have been replaced with others. Ms. Korodan stated four of the job descriptions listed are not applicable to the job descriptions that the Board currently hold. She explained there is a job description for head coach and assistant coach which is all the district requires. Ms. Korodan stated the district does not employ an occupational therapist. She further stated the other job descriptions listed are revised. With all Board members present voting in favor, the foregoing was adopted. The Athletics and Extra-Curricular Committee, on the recommendation of the Superintendent of Schools and the Assistant Superintendent for Curriculum and Instruction, presented the following: 1. That the Board of Education approve payment, not to exceed $100.00 per day, to Emergency

Medical Technicians for providing emergency medical coverage for the athletic teams at Colonia High School, John F. Kennedy Memorial High School and Woodbridge High School in the absence of their certified athletic trainer. (Payment will be upon voucher submitted from account # 11-402-100-100-59-Z-AJ-00)

3. That the Board of Education grant permission for Susan McHale, substitute teacher, to accompany

three gymnasts; one representing Colonia High School and two representing John F. Kennedy Memorial High School for competition in the Greater Middlesex Conference Championships at South Brunswick High School on October 23, 2008, and the NJSIAA Gymnastics Championships on November 7 and 8, 2008 (including all qualifying meets at Bishop Ahr High School) – pending certification. The tournament entry fees and qualifying meet fees will be paid through the Athletic Dues and Entry Fees account. Parents will provide transportation to practices and meets and will supply the uniforms.

Mr. Small moved for the adoption of the Athletics and Extracurricular recommendations, seconded by Ms. Acquisto. There were no comments or questions from the Board. During public discussion, Ms. McHale advised the Board the GMC’s are being held on October 22nd at South Brunswick High School. Mr. Miloscia verified that Ms. McHale was referencing Item #3. Ms. McHale stated the Gymnastics Championship sectionals are November 8th and States will be November 15th. Ms. Lordi asked if the Board accepts the revision as presented. Mr. Small moved for the adoption of the Athletics and Extracurricular recommendations with the noted date corrections, seconded by Ms. Acquisto. With all Board members present voting in favor with the exception of Mr. Miloscia who abstained on the name of Michael Barcellona in Item #1, the foregoing was adopted.

Mr. Molnar stated that following the Policy and Planning recommendations he failed to have Ms. Hardiman present the Policy and Planning resolutions. Ms. Hardiman stated Dr. Crowe had taken care of the resolutions following his recommendations.

Mr. Small presented the Athletics and Extracurricular resolution. Ms. Rotella stated Mr. Palumbo came to her office the previous day explaining he has a family commitment and is therefore unable to attend the meeting. She further stated Mr. Palumbo expressed his thanks to the Board for the award.

The Finance and Insurance Committee, on recommendation of the Superintendent of Schools and the Business Administrator/Board Secretary, presented the following:

1. That the Board of Education approves payment of the bills in the amount of $27.284,732.98 and the Food Service Department bills in the amount of $55,459.15.

2. That the amount of district taxes needed to meet the obligations of this Board for the next thirty-one day period, beginning October 1, 2008 is:

Requisition for Taxes for the General Fund in the amount of $11,887,704.00 and for the Debt Service in the amount of $364,937.00; totaling $12,252,641.00,

and that the Township Council is hereby requested to place in the hands of the Treasurer of School Monies that amount by October 10, 2008.

3. That the Board of Education accept the Report of the Secretary for the month of August 2008.

4. That the Board of Education accept the attached Business Administrator/Board Secretary's Monthly Interest and Investment Report for the month of August 2008.

5. That the bookkeeping transfers pertaining to the 2008-09 budgetary accounts be approved as per the attached list.

6. That the Board of Education accept the previously submitted Report of the Treasurer for the month of July 2008, as it agrees with the Report of the Secretary. The August 2008, Treasurer’s Report has not been received.

7. That the members of the Board of Education certify that to the best of their knowledge no major account or fund has been overexpended in violation of N.J.A.C. 6A:23-2.11(a), and that sufficient funds are available to meet the district's financial obligations for the remainder of the fiscal year.

8. That the Board of Education readopt the 2008-09 School Year Budget changing the total from $184,024,698.19 to $186,843,853.68 to reflect the following:

WHEREAS, there exists a need for architectural, engineering and planning services for roofing repairs and/or replacement for all school district facilities; and

WHEREAS, funds are available for this purpose; and

WHEREAS, the Public School Contracts Law (N.J.S.A.18A:18A-5, et seq.) requires that the resolution authorizing the award of contracts for "Professional Services" without competitive bids must be publicly advertised.

9. Continued

NOW, THEREFORE, BE IT RESOLVED, by the Board of Education of the Township of Woodbridge, County of Middlesex, State of New Jersey, as follows:

a. The President and the Secretary of said Board are hereby authorized and directed to execute an agreement with Thomas C. Rienzi, RA, 88 Liberty Drive, Bensalem, PA 19020, in accordance with the provisions of the firm's proposal dated July 27, 2008.

b. Services provided shall be professional architectural services for inspection, analysis/recommendations and design for roofing repairs and/or replacement at all school district facilities.

c. Thomas C. Rienzi, RA shall receive payment for services at an hourly rate of $100.00.

d. This contract is awarded without competitive bidding in a fair and open process as a "Professional Service" under the provisions of the Public Schools contract Law (N.J.S.A. 18A:18A-5, et seq.)

e. Thomas C. Rienzi, RA shall agree to the following conditions:

GOODS, PROFESSIONAL SERVICE AND GENERAL SERVICE CONTRACTS

During the performance of this contract, the contractor agrees as follows:

The contractor or subcontractor, where applicable, will not discriminate against any employee or applicant for employment because of age, race, creed, color, national origin, ancestry, marital status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex. Except with respect to affectional or sexual orientation and gender identity or expression, the contractor will take affirmative action to ensure that such applicants are recruited and employed, and that employees are treated during employment, without regard to their age, race, creed, color, national origin, ancestry, marital status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex. Such action shall include, but not be limited to the following: employment, upgrading, demotion, or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. The contractor agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided by the Public Agency Compliance Officer setting forth provisions of this nondiscrimination clause.

The contractor or subcontractor, where applicable will, in all solicitations or advertisements for employees placed by or on behalf of the contractor, state that all qualified applicants will receive consideration for employment without regard to age, race, creed, color, national origin, ancestry, marital status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex.

The contractor or subcontractor where applicable, will send to each labor union or representative or workers with which it has a collective bargaining agreement or other contract or understanding, a notice, to be provided by the agency contracting officer advising the labor union or workers’ representative of the contractor’s commitments under this act and shall post copies of the notice in conspicuous places available to employees and applicants for employment.

The contractor or subcontractor, where applicable, agrees to comply with any regulations promulgated by the Treasurer pursuant to N.J.S.A. 10:5-31 et seq., as amended and supplemented from time to time and the Americans with Disabilities Act.

The contractor or subcontractor agrees to make good faith efforts to employ minority and women workers consistent with the applicable county employment goals established in accordance with N.J.A.C. 17:27-5.2, or a binding determination of the applicable county employment goals determined by the Division, pursuant to N.J.A.C. 17:27-5.2

In conforming with the applicable employment goals, the contractor or subcontractor agrees to review all procedures relating to transfer, upgrading, downgrading and layoff to ensure that all such actions are

Ms. Rotella presented the NJASK scores for grades 5, 6, 7 and 8. Ms. Rotella explained the results came in very late this year. Ms. Rotella stated she has received several telephone calls from parents regarding the scores. She explained that after the test was given in May and graded in June, the Commissioner of Education decided to raise the bar, changing the scoring procedures. Ms. Rotella stated under normal circumstances she supports the change, however, she stated the issue is that the changes were made after the test was administered. She explained the students mastered what the administration felt would be tested. Ms. Rotella stated in some areas the bar was raised 26%. Ms. Rotella gave an overview of what the scores were prior to the change as well as the actual test scores reflecting the change in scoring procedures.

Mr. Yuhasz thanked Ms. Rotella for the extensive report. He asked Ms. Rotella to reiterate why the change in scoring was made and who is responsible for the change. Ms. Rotella stated the Commissioner of Education, after seeing the scores, felt it was the time to raise the passing score on the test. Ms. Rotella stated the Commissioner acknowledged that by raising the bar, there would be significantly more children who are not proficient this year as compared to last year. Mr. Yuhasz clarified that this change was made last minute. Ms. Rotella stated all the tests were scored in June, the information was sent to Dr. Crowe and then the change occurred in July.

Ms. Hardiman thanked Ms. Rotella and Ms. Miller for reporting the test scores. Ms. Hardiman stated although the State has implemented last minute changes to the scoring, she is confident that the students will continue to excel. Ms. Rotella stated the children worked very hard and it is important that the parents, although feeling frustration, need to understand that it was not necessarily the children but how the tests were scored. Mr. Miloscia asked if the AYP data on the web-site reflects the 2007 or 2008 data. Ms. Rotella responded 2007, stating the AYP scores are just beginning to come in. Dr. Crowe stated it is dubious to change the rules after the tests have been taken. Dr. Crowe stated there is no doubt that the scores presented do not accurately reflect the students’ achievement from last year. Dr. Crowe stated the scores are unfair, however, the district will make “no excuses” and will see significant achievement in the future.

Mr. Molnar thanked the Administration for all their hard work on the testing issue. Mr. Molnar reminded the public that a Town Hall style meeting is being held on October 2, 2008 and an invitation has been extended to Commissioner of Education, Lucille Davy. Mr. Molnar stated he is hopeful she can attend so the issue of changing the scoring of the tests can be addressed directly with her.

Board Attorney, Viola Lordi, had nothing to bring before the Board for open session. Under "Old Business," Ms. Hardiman thanked Dr, Crowe for keeping the Board abreast of issues through the e-mail system. Ms. Leidner asked how block scheduling is going at Avenel Middle School. Ms. Rotella stated the teachers love block scheduling. She stated Mr. Kuzniak and her are in contact with each other regularly to discuss how block scheduling is working out in his school. Dr. Crowe stated the most important aspect of block scheduling is it lends to much greater flexibility. He stated the Administration will be looking to see if that is being accomplished as the school year progresses. Ms. Hardiman stated she feels block scheduling at the middle school level is wonderful because at this age level it prepares them better for high school. Mr. Miloscia stated he and Ms. Leidner attended many Open Houses where there was standing room only which is a tribute to the PTO’s the parents and students. Mr. Miloscia commented on the Mayor’s race held on August 31st. Ms. Rotella stated she agrees with Mr. Miloscia that the Open Houses were excellent. Ms. Rotella further stated that the local YMCA is offering free membership for the district’s 7th grade students. She stated tables were set up at the Open Houses for registration. Ms. Rotella stated that Dr. Crowe, Ms, Korodan, Ms. Miller and she visited the YMCA which has tremendous application for the children and is a completely supervised and healthy environment for children to be in. Mr. Small asked for an update on the athletic trainer at Woodbridge High School. Ms. Rotella stated many parents have expressed concern that the district has not been able, to date, to contract a trainer at Woodbridge High School. She stated every effort has been made to employ a trainer for the high school. Ms. Korodan explained the procedure to procure an athletic trainer. She stated the position has been advertised for almost a year for a trainer at Woodbridge High School through the NATA web-site, through the district’s web-site, through the New Jersey Hire, which is a free web-site offered to DOE participants and through the Star Ledger. Ms. Korodan stated there have been several applicants who are interested with approximately ten interviews, however, after offering a promise of employment, no one accepted the position. Ms. Korodan stated the position continues to be advertised. Ms. Rotella stated every effort is being made to assure the safety of the students, noting that on the Athletic and Extracurricular agenda and item was approved to have EMT’s at every game. Ms. Rotella commended Mr. Small for finding additional people who will cover the varsity games and any other games deemed necessary. Mr. Molnar asked for an update on the acquisition of solar panels. Mr. DeMarino explained the Governor recently signed the law approving the extension of agreements from 5 years to 15 years. He stated the Board of Public Utilities need to set their rates so it appears to be a few more months before that is settled. Mr. DeMarino stated he is working with a company who is willing to do a few schools on a 5 year contract. He is awaiting Board Attorney review of that agreement. He stated the schools to be completed are Colonia High School, Iselin Middle School, Indiana Avenue and Menlo Park Terrace. Mr. DeMarino stated he is hoping to have something to bring forward to the Board by October or November. He stated the savings will be tremendous. Mr. Molnar stated many people are concerned that the solar panels will damage the schools’ roofs. Mr. DeMarino stated it is a weighted system with no penetration of the roof. Mr. Molnar asked how much the district budgets for electric. Mr. DeMarino stated roughly over $1,000,000.00 in utilities, a large portion of that being for electric. Mr. Molnar thanked Mr. DeMarino for his continued work on the project. Under “New Business," Mr. Yuhasz acknowledged several completed projects which were handled through the Buildings and Grounds department. Mr. Yuhasz thanked Mr. D’Orsi and all Buildings and Grounds staff members for their diligence in completing the projects.

Mr. Yuhasz announced on Saturday evening, September 20th, Principal, Arthur Lee Warren, of Woodbridge High School, will be honored by the NAACP with the Educator Leadership Award at the Woodbridge Community Center. Mr. Molnar congratulated Mr. Warren on his accomplishment. Mr. Molnar also commended the Buildings and Grounds staff. Ms. Leidner advised the public of a new program entitled New Horizons Band of Woodbridge. Ms. Leidner explained New Horizons is a nationwide program that provides musical training and opportunities for adults who would like to learn how to play an instrument. Mr. Small stated that during the athletics meeting there was concern over the hockey times with the Community Center. He asked if that issue has been resolved. Ms. Rotella stated a year ago the Mayor stated the district would be allowed ice time at the Community Center at no charge. Ms. Rotella stated this year, without the Mayor’s involvement, USA Skates has not delivered the same schedule. Ms. Rotella stated, under the direction of the Committee, she will reach out to the Mayor to seek resolve to the scheduling. Ms. Rotella explained that other districts are paying for ice time resulting in the Community Center moving the ice time for the district. Mr. Small asked Ms. Rotella to keep him advised of the outcome of her meeting with the Mayor. Mr. Miloscia announced on Sunday, October 5th Colonia will be holding their Colonia Day parade beginning at 1:00 p.m. at School #21. Mr. Molnar asked for an update on the new hot lunch program instituted at the elementary schools. Mr. DeMarino explained a new how lunch program through Preferred Meals was implemented at the 16 elementary schools. He further explained the meals are being heated and served at each location as compared to being prepared in the morning and driven to the elementary schools at 11:00 a.m. Mr. DeMarino stated the reviews have been excellent. He stressed the most important feature is the meals are heated and served on site. Mr. DeMarino commended the Board for implementation of this program. Mr. Molnar reiterated that the meals continue to be served by our district employees. Mr. DeMarino stated the district employees have been trained to use the convection ovens and continue to serve the meals as they did with the satellite program. Mr. Molnar stated he realizes it was a lot of work for the cafeteria staff and Buildings and Grounds staff to get the program started but the reward is seeing the children enjoy the meals. Ms. Rotella stated there are many children who qualify for free lunch but do not submit the paperwork. Ms. Rotella stated she hopes anyone listening who isn’t sure if they qualify for free lunch will contact the building principal for assistance in completing the form. Mr. Molnar announced that on October 18th from 9:00 a.m. to 12:00 noon, the Mayor’s Health Expo will be held at the Club at Woodbridge. Mr. Molnar also announced the Town Hall-Style meeting will be held on Thursday, October 2nd at 7:00 p.m. at Matthew Jago School #28. The Board President opened the meeting to the public. During this portion, P. Ballotta, Woodbridge asked if any additional bond reimbursement money has been received. Mr. DeMarino advised that money should be wired tomorrow in an amount of approximately $1,000,000. Mr. DeMarino stated he is in constant contact with Senator Vitale for assistance in expediting reimbursement. Mr. Ballotta asked if any additional inspections were done. Mr. DeMarino stated the State waived some inspections because they were falling so far behind. He stated there are two inspectors for the entire state. Mr. DeMarino commended the Board and Spiezle on a job well done. Mr. Ballotta stated the test scoring is not only confusing and upsetting to the parents but also difficult because you need to work with two different books when comparing to previous years. Mr. Ballotta also stated that children, maybe 2 or 3 years apart, will now be dramatically different with their test scores. Mr. Ballotta agrees that the scoring probably should have been changed, however, feels there should have been a 9 month lead time. Dr. Crowe stated the comparison that the State has made in the past has never been with the same cohort. Dr. Crowe stated the comparison is with the same grade level the

following year. Dr. Crowe stated if the comparison was made between the 5th grade students in 2006 to the 6th grade students in 2007, the district would be able to monitor the improvement of the students. Mr. Miloscia thanked the technology crew for improving the sound system at the Board meeting. Mr. Small then presented to the Board for its consideration, a resolution for a Closed Session to discuss subjects exempted from the public portion of the meeting. The discussion to be held in Closed Session will be about personnel matters which include: resignations; retirements; leaves of absences; level movements; salary adjustments; approval of employee salaries paid from grant funds; transfer of certified and non-certified staff; appointments of certified and non-certified staff; appointments and changes for summer work, coaches, and home instructors; professional development and committee appointments for the 2008-2009 school year; appointments of Family Writing and Family Science Instructors; appointment of advisors which include Clubs, Extra-curricular, and After-School Activities; appointments of substitutes as follows: teachers, school aides, paraprofessionals, cafeteria, secretarial, bus attendants, bus drivers, custodians; and approval of employee agreements for Central Office Administrators: Lois Rotella, Angela Korodan, Dennis DeMarino, Rita Miller. Any information regarding the Closed Session discussion will be released to the public when the reasons for discussing these matters in Closed Session no longer exist. On motion by Mr. Small, seconded by Ms. Hardiman and carried, the Board retired into Closed Session at approximately 8:05 p.m.

That the Board of Education retroactively approve the previously submitted employment agreement between the Board and Assistant Superintendent for Curriculum and Instruction Lois Rotella for the period from July 1, 2008 through June 30, 2009, and authorize the Board President, and the Board Secretary as the attesting witness, to execute the agreement on the Board’s behalf.

41. That the Board of Education retroactively approve the previously submitted employment agreement

between the Board and Director of Personnel Services Angela M. Korodan for the period from July 1, 2008 through September 21, 2008, and authorize the Board President, and the Board Secretary as the attesting witness, to execute the agreement on the Board’s behalf.

42. That the Board of Education approve the transfer of Angela M. Korodan from the position of

Director of Personnel Services to the position of Assistant Superintendent for Personnel Services, effective September 22, 2008 through June 30, 2009.

43. That the Board of Education approve the previously submitted employment agreement between the

Board and Angela M. Korodan for the position of Assistant Superintendent for Personnel Services, for the period from September 22, 2008 through June 30, 2009, and authorize the Board President, and the Board Secretary as the attesting witness, to execute the agreement on the Board’s behalf.

44. That the Board of Education retroactively approve the previously submitted employment agreement

between the Board and Business Administrator/Board Secretary Dennis DeMarino for the period from July 1, 2008 through June 30, 2009, and authorize the Board President, and the Superintendent of Schools as the attesting witness, to execute the agreement on the Board’s behalf.

45. That the Board of Education retroactively approve the previously submitted employment agreement

between the Board and Staff Director of Special Services Rita Miller for the period from July 1, 2008 through June 30, 2009, and authorize the Board President, and the Board Secretary as the attesting witness, to execute the agreement on the Board’s behalf.

Mr. Small moved for the adoption of the Personnel recommendations, Items #1 through #37, seconded by Ms. Hardiman. With all Board members present voting in favor with the exception of Ms. Acquisto who abstained on Items #12 and #36 on the name of Scott Acquisto and Mr. Huber who abstained on Item #34 in the name of Stacey Huber, the foregoing was adopted.

Mr. Small moved for the adoption of the Personnel recommendations, Items #38, 39, 44 and 45, seconded by Ms. Acquisto. With all Board members present voting in favor with the exception of Mr. Huber who abstained on Item #45 and Mr. Miloscia who abstained on Item #44, the foregoing was adopted.

Ms. Lordi explained the Board is going to be asked to invoke the Doctrine of Necessity prior to Mr. Small moving Items #40 through #43. Ms. Lordi presented to the Board the Doctrine of Necessity.

WHEREAS, the School Ethics Act, N.J.S.A. 18A:12-21, et seq., was enacted by the New Jersey State Legislature to ensure and preserve public confidence in School Board Members and School Administrators and to provide specific ethical standards to guide their conduct; and

WHEREAS, the School Ethics Commission has provided guidance regarding how a board of education should invoke the Doctrine of Necessity when a quorum of a board of education has conflicts of interest on a matter required to be voted upon; and

WHEREAS, the Woodbridge Township Board of Education (sometimes “Board”) will, upon the recommendation of the Superintendent of Schools, consider the following:

1. Retroactively approving the employment agreement between the Board and Assistant Superintendent for Curriculum and Instruction Lois Rotella, for the period from July 1, 2008 through June 30, 2009;

2. Retroactively approving the employment agreement between the Board and Director of Personnel Services Angela M. Korodan, for the period from July 1, 2008 through September 21, 2008;

3. Approving the transfer of Angela M. Korodan from the position of Director of Personnel Services to the position of Assistant Superintendent for Personnel Services; and

4. Approving the employment agreement between the Board and Angela M. Korodan for the position of Assistant Superintendent for Personnel Services, for the period from September 22, 2008 through June 30, 2009.

WHEREAS, a majority of the members of the Board have conflicts of interest which would prevent their participation in and voting on personnel matters impacting the aforementioned administrators as follows:

1. Diane C. Acquisto’s son and nephew are teachers and niece-in-law is a substitute teacher;

2. Lewis C. Huber’s daughter is a teacher;

3. Judy Leidner’s son is a technology employee;

4. Lawrence Miloscia’s wife, step-daughter and step-granddaughter are secretaries, step- son-in-law is a supervising custodian, and step-granddaughter is a substitute teacher/ paraprofessional; and

5. George Yuhasz’s wife is a substitute secretary/paraprofessional.

WHEREAS, as a result of the foregoing, the Board does not have a quorum available to vote on the agenda items relating to such personnel matters, and the Board has determined that it is necessary to invoke the Doctrine of Necessity.

NOW, THEREFORE, BE IT RESOLVED by the Woodbridge Township Board of Education that the Doctrine of Necessity is hereby invoked with respect to each of the agenda items relating to the personnel matters referenced above.

BE IT FURTHER RESOLVED that a copy of this Resolution, having been read at a public meeting of the Board on September 18, 2008, be posted in accordance with the Board’s standard procedures for not less than 30 days and that the Board Secretary reflect the same in the minutes of the meeting.

Ms. Hardiman moved to invoke the Doctrine of Necessity, seconded by Ms. Acquisto. With all Board members present voting in favor, the Doctrine of Necessity was invoked for Items #40 through #43 of the Personnel agenda.

Mr. Small moved for the adoption of the Personnel recommendations, Items #40 through #43, seconded by Mr. Yuhasz. With all Board members present voting in favor the foregoing was adopted. There being no further business, and on a motion by Ms. Hardiman, seconded by Ms. Acquisto and carried, the meeting adjourned at approximately 9:20 p.m.
