1.Background&IntroductionIn2017,theMonashStudentAssociation(MSA)undertookacompetitivetenderingprocesstoselectaprovidertoconductits2018,2019and2020annualelections.OGLGroupwasappointedthroughthisprocesstoconducttheelections,continuingitsprovisionoftheseservicestoMSAsince2010.ThebriefgiventoOGLGroupwastoruntheMSAAnnualElectionsconsistentwiththerulesandregulationsassetdownbybothMSAandtheNUS,andinadditionrunningaballotandreferendumconcurrentlyregardinganewmulti-membercommittee(TheCreativeandLiveArtsCommittee)andanewOffice-bearerposition(CreativeandLiveArtsOfficer).OGLwastoworkwiththeUniversityandstudentstomakesuretheelectionprocessransmoothly,thatelectionparticipantswerewellinformedandthatgoodstandardsofbehaviourandparticipationwereexpectedandenforced.I,GavinRyan,wastheReturningOfficer(RO)forthe2018MSAElectionsandamtheauthorofthisreport.IamafoundingdirectorofOGLGroupandhavebeenaReturningOfficerforMSAforfiveannualelectionsinadditiontorunningelectionssuccessfullyasanROformanyotherstudentorganisations,businessesandnot-for-profits.ElectiondatesweresetbyresolutionoftheMonashStudentCouncil(MSC)atmeeting6/18heldonThursday28June2018,andthereferendumdatesandcontentweresetbyresolutionoftheMSCatmeeting7/18heldonThursday26July2018.(SeeAppendix1fortheresolutions).

2.ProcessCommunicationThroughoutthisreport,areferencetoanoticebeing‘posted’or‘published’typicallymeansviatheMSAwebsite(asdetailedbelow)andalsophysicallytotheMSAnoticeboardreservedfortheelections.OntheMSAwebsitetherewasadedicatedelectionsection(http://msa.monash.edu/elections)whichcontainedthedetailsoftheelection,rulesoftheelection(ConstitutionandRegulations)andthecontactdetailsoftheRO.Allnotices,forms,rulingsanddeclarationswerepostedinthissectionasdue.TheROcommunicatedfrequentlywithCandidatesandAuthorisedOfficers(AOs)viaemailandoccasionallytextmessageanddirectcontact.Election2018

Aspreviouslyreferredto,electiondatesweresetbyresolutionoftheMSC,andthegoverningdocumentsfortheelectionprocessweretheMSAConstitutionandtheElectionRegulations.AsperRegulation10.1,noticewasgivenonMonday23July2018forAnnualElectionstobeheldfromMonday10SeptembertoThursday13September2018(seeAppendix2–NoticeofElection).InadditiontobeingposteduparoundClaytoncampusandpublishedthroughtheMSA,thiswasputinLot’sWifeandanemailwassentoutbytheUniversitytoallClaytonstudentsalertingthemtotheNoticeofElection.AMSAElectionTimetablewaspublished(withreferencetosupportingregulations)toassiststudentsinmeetingtherequirementsoftheRegulations(seeAppendix3–ElectionTimetable).LockedboxeswereprovidedtoenablestudentstodepositformswithMSAreceptionandintheloungeoftheYulendjIndigenousCentrewhentheROorDeputyReturningOfficer(s)(DROs)werenotpresent.Thisensuredthatdocumentswouldnotbetamperedwith.Candidateswerepermittedtolodgenominationforms,preferenceschedulesandotherformsviathismethodandviaemail.Candidatestatements,photosandpublicityrequiringauthorisationwerelodgedelectronicallythroughouttheelectionprocess.TicketsTicketre-registrationsopened9amMonday23Julyandclosed5pmFriday27July.Alistofre-registeredticketswasthenpublishedonMonday30July(SeeAppendix4–ListofRe-registeredticketnames).TheUniversityfacilitatedverificationofstudenteligibilitytosupportthere-registrationandregistrationoftickets.Registrationsfornewticketnamesopened9amTuesday31Julyandclosed5pmMonday6August.ThelistofnewticketnameregistrationapplicationswasthenpublishedonTuesday7August,includingdetailsofre-registeredticketnames(seeAppendix5–Listofallregisteredticketnames).

Allticketre-registrationsandregistrationssubmittedbydeadlinefulfilledtherequirementsassetdownbytheRegulationsandassuchallwereaccepted.NominationsNominationswereopened9amWednesday8Augustandclosed5pmFriday17August.Nominationswerereceivedforallpositions,andtwopositionswereelectedunopposed(IndigenousOfficerandQueerOfficer).AnoticeofnominationsreceivedwaspostedonTuesday21August.TheUniversitythenprovidedanelectronicrolltotheRO,whichenabledthevalidityofthevastmajorityofnominationstobecheckeddirectlybytheRO,withonlystudentsonintermissionneedingtobeverifieddirectlybytheUniversity.Afinallistofnominees,inballotorder,waspostedonThursday23Augustaftertheballotdraw(seeAppendix6–FinalListofNominationsReceivedinBallotOrderandDeclarationofPositionsElectedUnopposed).Alargernumberofnominationswereruledinvalidin2018commensuratewiththelargernumberofnominationsoverall.Thisincreaseinnominationswasinlinewiththecreationofnewoffice-bearingpositionsandseverallargemulti-membercommitteesin2016andthenagainthisyear,whichinturnincreasedthenumberofpositionsstudentscouldstandfor.Insummary,forthe2018MSAelections:

• 239validnominationswerereceived(207in2017and109in2016)• 18nominationssubmittedwereinvalid(5in2017and4in2016)• 48nominationswerewithdrawncomparedto46withdrawalsin2017and27in2016• 28ticketnamesweresuccessfullyregisteredorre-registered(27in2017and16theyearbefore)

CandidateselectedunopposedAsmentionedearlier,atthecloseofnominationsthereweretwooffice-bearerpositionsforwhichonlyonevalid(sharedcandidature)nominationwasreceived.ThesepositionswereIndigenousOfficerandQueerOfficerandconsequently,thesepositionsweredeclaredelectedunopposed(seeAppendix6-ListofNominationsReceivedinBallotOrderandDeclarationofPositionsElectedUnopposed).BallotDrawAsadvisedintheelectiontimelineandbywayofnotice,aballotdrawwasheldonWednesday22AugustatmiddayintheMSAMeetingRoom.Thiswasdonebythedrawingofnumberedballsfromaspinner(asistheprocesstheAECandVECuse)andanumberofstudentsfromalmosteveryticketwerepresenttowitnessthedraw.PreferencesPreferencescheduleformsweredistributedonFriday24August.PreferenceschedulelodgementclosedatmiddayFriday31August.Preferencescheduleswerethendisplayedlaterthatday.

PaperAuthorisedelectionmaterialpaper(watermarkedpaper)wasallocatedasoutlinedintheRegulationsandtheConstitution.ThiswasdistributedonFriday31August.Candidates’photosandstatementswereemailedtoLot’sWifedirectlyaswellastotheROtoallowtheROtoreviewmaterialsandLot’sWifetoproducetheElectionGuide.TheElectionGuidewasavailableonlinewellbeforeelectionweek,aswellasbeingproducedanddistributedinhardcopyforelectionweek,howeverthiswasnotinlinewithRegulation24asLot’sWifedidnotmeetthenecessarydeadlines.PollingThepollingtimesandplaceswereasfollows:

AstherewasnoballotforIndigenousOfficertherewasnoneedforaseparatepollingplacecateringonlyforindigenousstudentsatYulendjIndigenousCentre.CountingCountingstartedat11.30amonthelastdayofvoting(Thursday13September).CountingwasfirstlyheldintheClubResourceRoom(inthebasementoftheCampusCentre)wherescrutineerswerepresentforthe‘lock-in’periodofcountingbetween11.30amandupuntilthecloseofpolling(4.30pm)whichmeanttheywereunabletocommunicatewithanyoneoutsidetheroomuntilthecloseofpolling.Afterthecloseofpolling,countingmovedtotheCampusCentreConferenceRoomandwentthroughuntilmidnight,atwhichtimecountingwaspausedtocontinuethenextday.Allcountsweredeclaredprogressivelyastheywerecompleted–withcountinggoingthroughFriday(10am-10pm),Saturday(10am-7pm)andMonday(10am-11pm).DeclarationsofresultsForallcontestedballots,resultsweredeclaredprogressivelyduringthecount(forfullresultsseeAppendix7–Results).ResultswerepostedontheMSAwebsiteandelectionnoticeboardonTuesday18SeptemberandsenttoAOsandcandidatesontheWednesday19September.RecountsandAppealsNorequestsforrecountorappealsoftheoutcomeoftheelectionwerereceived.

3.Voting&ResultsPostalVotesThirteenpostalvoteapplicationsweresubmittedandallwereaccepted,withsevenofthesebeingreturnedbythecloseofpollingtobeincludedintheballotandthestudentsmarkedoffontherollashavingvoted.Withtheclosenatureofthetimelinestheseweresentexpresspostwithreturnexpresspostenvelopes,howeversomeweretostudentswhowereoverseasatthetimewhichmakesitimpossibletobereturnedontimegiventheturnaroundtimerequiredandthelackofflexibilityinthecurrentregulations.

ParticipationParticipationwasinlinewith2018,giventherewasaslightdecreaseintheamountofcampaignersacrosstheboard,andalsogiventhatittooklongertoissuevotesandforvoterstocompletetheballotswiththeincreasednumberofcommitteeballotpapers.Thenumberofvotersoverallwasslightlydownfromlastyearwith3,808comparedto3,903studentsvotingin2017(in2016itwas2,642andin2015itwas2,178).Seebelowforthedaybydaybreakdown:

AffirmativeActionAffirmativeactionwasnotrequiredinanyoftheballotsin2018assufficientnumbersofwomenwereelected.

4.IssuesThissectiondealswithproblemsthatarosewiththeelectionprocessorlogistics,aswellasoverallcommentaryaboutconductandprocess.TherewerenodisputedrulingsmadebytheROduringthepollingperiod.TherewerenoappealstotheTribunalduringtheelectionperiod,norecountsorappealofresults.BehaviourandconductBehaviourandconductwasupanddownduringtheelectionperiodhoweveroverallitwasgenerallygoodthroughoutthepollingperiodwithacoupleofnoticeableexceptions.TheRO,DROsandpollingstaffmonitoredcampaignzonesfrequentlytoensurecampaigningwasfreefromanypoorbehaviour,harassmentorintimidation.Giventhismonitoringitwasunsurprisingthatthemostproblematicincidentswerewherestudentsbehavedpoorlyandthenleftthescenequickly.Thishashappenedinnumerouselections,howevertheseweredownonpreviousyears.Therewereseveralcampaignbanshandeddowntovariousstudentsacrossthepoliticalgroupings,howeverinlinewithmypreviousobservation,thenumberandseverityoftheseweredownonpreviousyears.IreiteratedwithAOsandcampaignersaboutthestandardofbehaviourexpectedfromtheirticketsandalsogaveasummaryofissuesofnote,whattowatchforandanyproblemsidentifiedtoallcampaignersattheendofeachday.Aftertheworkdonein2018clarifyingtheelectionregulationsfurthersurroundingthedefinitionofcampaigningandthatNUSOffice-bearerswerenottocampaign,issuesarosearoundoneparticularNUSOffice-bearerbeinginelectionrelatedspacesandappearingtoengagewithcampaigners.Thispersonwaswarnedthattheyriskedbeingtakenoffcampusbysecurity,withtheticketstheysupportedalsobeingputonnoticethatafailuretocomplywouldresultinsanctionsfortheentireticket.InthatcasetheNUSOffice-bearerwasoncampusforanunrelatedmeeting,howeverthewarningstillstoodfortheelectionperiod.GiventhisisthefirstyearthatthisstricterregulationforNUSOffice-bearershasbeeninplace,itisexpectedthatNUSOBswillknowbetterinfutureandstaywellawayratherthanrisksanctionsforthegroupstheyaresupporting.Iclarifiedduringelectionweekthatscrutineeringisnotregardedascampaigning,whichallowednon-ClaytonstudentsandNUSOffice-bearerstotakepartinscrutineering.Barringsometardyresponsesattimes,electionparticipantscompliedwiththedirectivesgivenbytheRO,DROsandpollingstaffatalltimes.SocialmediacampaigningandpresenceTheelectionregulationswerewrittenlargelybeforesocialmediaplatformstooktheprominentroleincampaigningthattheydonow.Therulesregardingcampaigningonsocialmediadonotreflectthewaycampaigninghappensonapersontopersonbasis,beingmuchmoreheavilyrestricted.ThiswasreflectedinthelargenumberofcomplaintsIreceivedregardingminormatterswhereelectionparticipantsfellfouloftheblanketrulesregardingsocialmedia.Itwouldbeeasierandsimplerforallelectionparticipantsifsocialmediawastreatedinawaythatreflecteditsusebystudents.Ihavemadearecommendationtothiseffectinthenextsection.

LogisticallimitsaroundparticipationParticipationisstillupfromlastyear,meaningthattheCampusCentrebecomesextremelyhardtonavigatefortherestoftheuniversitycommunityduringelectionperiod.Alsotheincreaseinthenumberofballotpapersbeingissuedtoeachvoter(duetotheincreaseinmulti-membercommittees)andtherelianceonpaperballotsmeantthatdespiteimprovementsintheprocess,therearelongqueuesandlongwaittimestovote.Givenhowlargeandcomplextheseelectionsare,andthelogisticsofsomanymulti-memberballotpapers,considerationmustbegiventomakingitlesstimeconsumingforstudentstovote.Ihavemadearecommendationtothiseffectinthenextsection.Appeals&TribunalOnlyonemajorrulingwasmadeoverthecourseoftheelectionperiodandasROIdidnotreferanymatterstotheElectionTribunal.Asthisreversesalongstandingdecisionbythe2014ROtorestrictpublicitybytheticket‘420BlazeIt’IhaveattachedtherulinginAppendix8(Rulingregardingtheuseoftheticketname‘420BlazeIt’.

5.RecommendationsArisingfromtheissuesoutlinedintheprevioussection,Imakethefollowingrecommendations:

Recommendation1/2018ThatMSCconsiderchangestopollingplaces,toincreasethenumberofplacesstudentscanvoteduringelectionweek.

ThewaythatelectionsarerunbyOGLgroupinrealtimewithback-updatabasesmeansthatseveralconcurrentpollingboothscanberunratherthanjustoneasusedtobethecasewhentheelectoralrollwasonlyinhardcopy,electionsweresmaller,andmostcampusactivitywaslimitedtotheCampusCentre.Withthestudentactivityacrosscampusandthecurrentproblemsofovercrowdinginthecampuscentreduringelectionweek,considerationshouldbegiventorunningpollingplacesatotherplacesacrosstheuniversity.Itshouldbenotedthatthismayincreasethecostofelectionsduetotheincreaseinstaffingneeded.

Recommendation2/2018ThatMSCconsiderchangestoballotpaperprintingrestrictionstoallowvotingbookletswithfrontpageticketvotingorconsiderinpersonvotingviaelectronicmeans.

Currentlytherearerestrictionsonwhatformballotpapersmusttake,specificallydisallowingseparatemulti-memberballotsfrombeingprintedonasharedpaper.Considerationmustbegiventoallowingtheprintingofavotingbookletonwhichstudentscanvoteforticketsonthefrontcoverorfillintheballotsinside(witheithernoseparateballotpapersoratmostasingleextraballotcoveringtheWomen’sOfficerandWomen’sAffairsCommitteeballotpaper).Thiswouldcutdownthetimetobothissuevotesandforstudentstovote,increasingthenumbersofstudentsabletovoteatpeaktimes.

Anotheroptionthatwouldalsoavoidthecurrentproblemsurroundingtheplethoraofseparateballotpapersisanelectionprocesswherevotingtakesplaceviaatabletinthevotingbooth.Therewouldstillbeelectionstaffpresenttoassistwithcheckingvotereligibility,scanningIDs,assistingwithquestionsandtofacilitatevotingconductascurrentlyoccurs,howevervotingwouldtakeafractionofthetimethanitdoesnow.Thiswouldmakevotingeasierandfasterforstudents,eliminateinformalvoting(asyouwouldnotbeabletoleaveascreenunlessyouindicateapreference)andsavetheMSAintheorderof$20Keachyeargiventhereductioninprintingandreductioninelectionstaffneededforcounting.

Thistechnologyishardlyneworradical–ithasbeentriedandtestedmanytimesandisinusebymanyorganisationsyearin,yearout.Organisationsareusingthistechnologyforenterprisebargainingballotsandmultimemberelectionssuchasboardballots,andtherearestrongsafeguardsinplace.Thereareanumberofwaysintegritycanbemonitored(mostlyinthesamewayasnow,ensuringthenumbersarecorrectandthatproperprocessisfollowedthroughscrutinyandanelectroniclogofvotesandback-upfilesforscrutinyofneeded).IndeedstudentorganisationsareadoptingdifferentvariantsofelectronicvotingacrossAustraliaandithasworkedsuccessfully.Iftakingthesecondoption,thefirststepMSCshouldconsideristoundertakeresearchforCouncilmembersandgetbriefingsfromthoseusingsimilarsystemsandfromprovidersofthesesystems.

Recommendation3/2018ThatMSCconsiderreviewingtherestrictionsaroundsocialmediauseinelections

Currentlythereareblanketrestrictionssetdownintheelectionregulationswhichlimitanycommentaryordiscussiononlineduringtheelectionperiodbycandidatesorcampaigners.Giventhatthisdoesnotsitwellwiththewaythatsocialmediaisusedforcommentaryanddiscussionbystudentsasevidencedbythedozensof(minor)complaintsIgeteveryelectioncycleregardingthis,thecurrentframeworkfortheuseofsocialmediainelectionperiodsbyelectionparticipantsshouldbereviewedwithaviewtoenablingapositiveuseoftheplatformsinlinewithotherexistingelectionregulations.

6.ConclusionInthe2018election,stronglevelsofelectoralparticipationcontinuedonfromthelevelsseenin2017andstudentsgotinvolvedintheelectionprocessfromavarietyofbackgroundsandthroughdifferentpathways.WiththeincreasednumberofstudentrepresentativesandcommitteesmeaningmoreballotpapersandmoreOBpositions,thislevelofparticipationmeansthatconsiderationmustbegiventomakingtheprocessmoreefficientforvotersorelectionweekatthecampuscentrewillbecomeincreasinglyplaguedbystudentandstaffcomplaints,longerwaitingandvotingtimesforstudents.ThisisthechallengeconfrontingMSAinrunningitssinglebiggestgovernanceevent.MonashClaytonstudentsagainparticipated(mostly)witharespectfortheprocessandacommitmenttobringcompetingvisionstoMSAandthestudentbody.Thanksgotoallthe2018MSAOBsandstafffordeftlyorganisinganyinformationrequiredfromtheMSAendwhenitcametosettingupandoverseeingtheelectionandreferendumprocess.TheMSAhasmanystaffwhogoaboveandbeyond–andthisyearitwasnodifferent.FromthedeependoftheMSAstaffpoolourwarmthanksgotoLowanSist,RanyToma,ElizavetaDilanyan,DamianPetrov,AddisonHungandthewholefinanceteam.UniversitystaffwhoalsodeserveaspecialmentionfortheirtremendousabilitytoassistwhereneededareCandisseJoseph,RebeccaJames,AnnaCaruselloandGianfrancoPaduano.AsalwaysyouwereanexcellentexampleofskilledandhelpfulMonashstaffmembers,andareinvaluablehelpintheelectionprocess.ThanksalsogotoallthecommittedOGLstaffinvolvedinrunningtheelections,includingmyefficientandcapableDROsLindaAndonopoulosandAlisonO’Hara,aswellasourpollingandcountingstaffwhohandledafreneticelectionweek(andresultinglonghoursofcounting)withaplomb.2018againprovedtobealargeelection,howeveritisalwaysapleasuretoworkinanelectionprocesswithstudentswhohavesuchresilienceandcommitmentacrossallthevariouspoliticalgroupings.Ithankeveryonewhotookpartandwishthesuccessfulcandidatesanenjoyableandsuccessful2019intheirpositionsasstudentleadersinMSA.GavinRyanReturningOfficerMSAElection2018
