Under the auspices of His Royal Highness Sheikh Khalifa bin Salman Al Khalifa- Prime Minister, the Bahrain Society of Engineers, in collaboration with Gulf Engineering Union, will organize the 21st Gulf Engineering Forum during the period 21-22 February 2018 in Manama, the capital of the Kingdom of Bahrain. The Forum will be held under the theme “Disputes in Engineering Projects and Resolution Methods”.

This major event is extremely important for enhancing the common GCC Engineering Union goals, from one side, by allowing the GCC engineers to communicate in their annual meetings that have been taking place over the past twenty years. During this period many achievements have been made on the GCC level. And on other side it became a platform, through which a variety of knowledge and experiences related to the engineering profession maybe exchanged. In this Forum we are concerned with developing the means and ways of resolving disputes related to engineering projects in various sectors such as urban development projects, infrastructure projects and various oil projects etc.

The Bahrain Society of Engineers, in cooperation with the Gulf Engineering Union will organize the 21st Gulf Engineering Forum that will be held during the period 21– 22 February 2018 at the capital Manama, Kingdom of Bahrain under the theme “Disputes in Engineering Projects and Resolution Methods”. This is one of the events that the Union intends to organize in line with its objectives and directions that aim to promote the development and construction process in G.C.C countries.

The major challenges resulting from infrastructure projects and from various urban development projects which are represented in the delay in the execution of these projects, increase in their cost, and exhaustion of extensive resources by all parties for the sake of resolving such disputes, require us to develop legislations, laws, and regulations system to enable the GCC institutions to rely on it. This is extremely important to boost the competitive capability of the G.C.C countries on both regional and international levels in order to attract more investments.

Since dispute resolution in engineering projects is a multi-dimensional process, in which engineers take part beside experts in other specializations such as legislators, judges, lawyers and other specialists. This conference will allow the opportunity to the experts in other fields to submit papers related to their acquired expertise, experience and their knowledge to shed further light on various ways of engineering disputes resolution.

This conference is organized and supported by many government and non-government authorities, in addition to Bahrain Society of Engineers and Gulf Engineering Union, including Bahrain Chamber for Dispute Resolution, G.C.C Commercial Arbitration Centre and Federation of GCC Chambers. This is a solid evidence that the aim of this event is to attain the vision of integration between these parties in their efforts for the development of common capabilities in the field of engineering dispute resolution.

Considering the prominent role played by engineers in the developmental projects and accumulation of their experiences in various types of engineering and construction contracts, this requires the GCC authorities to unify their efforts in encouraging research, studies and fields of training and qualification in respect of raising the abilities of arbitrators and expert engineers. This will contribute in building engineering cadres, who are specialized in engineering dispute resolution in different aspects.

The Gulf Engineering Union, while planning to hold this important forum, is looking forward to extensive participation by all arbitrators and engineers who are expert in different disciplines in solving engineering disputes, in addition to the participation of judges, lawyers and non-engineers experts and those who are concerned with resolution of engineering disputes.

Introduction

Various engineering and construction disputes during the different execution stages have emerged due to the developments witnessed by the GCC economies and the accompanying urban renaissance. This included building cities and service facilities such as hospitals, schools, construction of infrastructures like bridges and drainage, building airports and sea harbours, in addition to the establishment of major oil and petrochemicals projects. The disputes are not limited to the projects undertaken by individuals and private sector, but extended to cover the development projects that are undertaken by the government, resulting in major financial and moral damages to the contacting parties, including owners of project, contractors and consultants.

Many engineering and constructional disputes have arisen and continued with different levels of efforts exerted by the G.C.C countries to develop legislations and laws and develop the institutions that are concerned with the resolution of such engineering disputes. This is in addition to the variance in the efforts in adopting legislations brought by models of international contracts organizing the management of engineering projects and solving the disputes arising there-from, and to adopt the same within the national legislations and contracting contracts. Furthermore, there has been a variance in the efforts related to the development of human resources that are specialized in the preparation and implementation of certified training programs and the professional certificates that are recognized nationally, regionally and internationally.

Among all these developments, the 21st Gulf Engineering Forum comes under the theme “Disputes in Engineering Projects and Resolution Methods” to open the door for dialogue through its following four topics:

Objectives

This Forum comes in continuation of the on-going efforts to promote the engineering profession and the scientific, technical and learning abilities of the GCC engineer, through the following:

• Exchange expertise and experience among arbitrators, experts and specialists in the settlement of disputes in the G.C.C countries in the field of engineering projects.

• Identify the status quo of the public and private institutions that undertake the role of arbitration with experience in settlement of disputes in engineering projects and the laws governing them.

• Exchange experiences of the GCC countries in the field of development of legislations and laws regulating the practice of arbitration, experience and dispute resolution.

• Identify the reality of consulting services in the field of dispute settlement in engineering projects and means of their development and cooperation among them.

• Identify the reality of national expertise in the field of dispute resolution in the engineering projects.

• Shed light on the technical difficulties and challenges facing arbitration, experience and engineering dispute resolution in the engineering projects.

• Highlight the challenges and difficulties faced by those working in the field of arbitration, experience and engineering dispute resolution areas.

• Raising awareness of engineers and the parties to the contracts regarding the best possible ways in solving disputes.

Hassan Ali Radhi, Senior Partner of Hassan Radhi & Associates, LLB from University of Mohammed V. Rabat, Morocco and PhD in Law from University of London. Dr. Majed M. Garoub

Mr. Garoub is the Chairman of the Law Firm of Majed M. Garoub (LFMG) in Jeddah and Riyadh, and is the Head of the Saudi Law Training Center (SLTC). Mr. Garoub is a member of many international and local legal entities such as the Union Internationale des Avocats (UIA)-Consular to the President, member of the Scientific Committee for Reconciliation and Arbitration of the Arab French Chamber of Commerce, former member of FIFA Legal Committee, member of UAFA Appellant Committee, American Bar Association (ABA), member of ICC Arab Arbitration Group and ICC-CIB.Additionally, Mr. Garoub is contributing to spreading the knowledge of law and legal rights awareness in the community through conducting several courses, seminars and conferences to support the spread of legal culture on a national and international level;

and for his continuous global efforts he has been awarded the Chevalier de l’Ordre National du Merite in 2015 by the French government. Moreover, Mr. Garoub is a member of the Scientific Committee of Reconciliation and Arbitration at the Arab-French Chamber of Commerce, and is the Deputy President of the Arab Chamber of Arbitration and Reconciliation. Therefore, he was appointed as an arbitrator and representative of several governmental agencies and international commercial companies. He was known as “The Youngest Arab Arbitrator, specialized in International Commercial Arbitration”. For all the aforementioned expertise in arbitration, he has been selected to join the Arbitration Consulting Committee at the Saudi Ministry of Justice. Mr. Garoub was awarded a Bachelor Degree in Law by King Abdul-Aziz University in 1989. He also got the Certificate of the Best Legal Negotiator from the American University in Paris in the Year 1994. Also, he is a member of several international and Arab organizations and arbitration centers and the Saudi Law Training Center which is affiliated with prominent academies such as the Sorbonne University and Roma Tre University, National Kapodistrian University of Athens. In recognition for his unprecedented efforts to serve justice and the legal culture locally and his CSR initiative for pro-bono legal aid which is considered to be the largest of its kind worldwide, he has been awarded an unprecedented Certificate of Appreciation from the Saudi Supreme Council of Justice. He is fluent in both Arabic and English.

Mr. Qays H. Zu’bi

Qays H. Zu’bi, Qays read law at the University of Cambridge in the United Kingdom achieving a Master of Arts degree. Prior to that he achieved a Bachelor of Arts degree in Economics, Public Policy and Political Science from Duke University in the United States. He commenced his legal career in Bahrain in 1981 and is a licensed litigator and arbitrator. He is qualified to appear before the Court of Cassation in Bahrain and holds a legal consultancy licence in Dubai, UAE.

Moving on in his career, Qays established his own law firm Qays H. Zu’bi Attorneys & Legal Consultants in Bahrain in 2000 having spent a few years in the early 90’s in Montreal, Canada as a Middle East Advisor to Stikeman Elliott. To gain international experience and exposure, his firm associated itself between the years 2000 to 2005, for an interim

period, with the international law firms of White & Case LLP and Clifford Chance LLP. Having built the law firm into a market leader both in Bahrain and throughout the Gulf region, recognized by many international legal publications, Qays is the Senior Partner of the merged firm Zu’bi & Partners.

درس قيس حامت الزعيب القانون يف جامعة كامربيدج باململكة املتحدة وحصل منها على ماجستري يف اآلداب. وقبل ذلك حصل على البكالوريوس يف االقتصاد، والسياسة العامة والعلوم السياسية من جامعة ديوك يف الواليات املتحدة. بدأ مشواره يف اجملال القانوين يف البحرين يف عام 1981 كمرتافع أمام القضاء وحمّكم قانوين مرخص له وهو جماز للرتافع أمام حمكمة التمييز يف البحرين. كما حيمل

أيضا ترخيصا لتقدمي اإلستشارات القانونية يف ديب باإلمارات العربية املتحدة.وبالعودة إىل حياته املهنية، فقد قام قيس حامت الزعيب بتأسيس شركته القانونية اخلاصة به حتت أن أمضى بعد 2000 البحرين يف عام الزعيب - حمامون ومستشارون قانونيون يف اسم قيس حامت بضع سنوات خالل فرتة التسعينات يف مونرتيال يف كندا كمستشار ملنطقة لشرق األوسط لشركة لفرتة ارتبطت شركته الشهرة، فقد و الدولية اكتساب اخلربة و حرصا منه على إليوت. ستايكمان مؤقتة مع شركة متخصصة يف القانون الدويل هي وايت أند كيس ش.م.م وشركة كليفورد ش.م.م

تنظم مجعية املهندسني البحرينية بالتعاون مع االحتاد اهلندسي اخلليجي الدورة احلادية والعشرين للملتقى اهلندسي اخلليجي الذي سيعقد خالل الفرتة 21 -22 فرباير 2018 بالعاصمة البحرينية املنامة، حتت عنوان :»“املنازعات يف املشاريع اهلندسية وسبل حلها”« ، وهو إحدى الفعاليات اليت يسعى دول يف والبناء التنمية عجلة دفع إىل الرامية وتوجهاته ألهدافه وترمجة جتسيدًا إلقامتها االحتاد

جملس التعاون اخلليجي.إن التحديات اجلمة الناجتة عن النزاعات يف مشاريع البىن التحتية ومشاريع التطوير العمراين اخملتلفة واملتمثلة يف تأخر إجناز هذه املشاريع وارتفاع كلفها، واستنزاف الكثري من املوارد من مجيع األطراف يف سبيل حل هذه النزاعات األمر الذي يدعونا لضرورة تطوير منظومة التشريعيات والقوانني واألنظمة رفع يف أهمية من ذلك يف ملا اخلليجي؛ التعاون جملس دول يف عليها القائمة واملؤسسات القدرة التنافسية لدول اجمللس على املستويني اإلقليمي والدويل ومبا يساعد على جذب املزيد من

اهلندسية العقود أنواع مبختلف خرباتهم ولرتاكم والتطويرية التنموية املشاريع يف املهندسون به يضطلع الذي البارز للدور ونظرًا والتأهيل التدريب وجماالت والدراسات البحوث تشجيع يف جهودها اخلليجية اهلندسية اهليئات توحد بأن يستوجب مما واإلنشائية، والتصنيف املتعلقة برفع قدرات احملكمني واخلرباء من املهندسني، ما يساهم يف بناء كوادر هندسية متخصصة يف خمتلف طرق حل

املنازعات اهلندسية إن االحتاد اهلندسي اخلليجي وهو يتجه لعقد هذا امللتقى اهلام فإنه، ليتطلع إىل مشاركة واسعة من كافة احملكمني واخلرباء وأصحاب االختصاص من املهندسني يف حل املنازعات اهلندسية، باإلضافة إىل مشاركة السادة القضاة واحملامني واخلرباء من غري املهندسني

حتت رعاية كرمية من لدن صاحب السمو امللكي األمري خليفة بن سلمان آل خليفة - رئيس جملس بالتعاون مع االحتاد اهلندسي اخلليجي امللتقى البحرينية الوزراء املوقر، تنظم مجعية املهندسني اهلندسي اخلليجي يف دورة انعقاده احلادية والعشرون وذلك خالل الفرتة 21 -22 فرباير 2018 بالعاصمة

البحرينية املنامة، حيث سيعقد حتت شعار: »“املنازعات يف املشاريع اهلندسية وسبل حلها”. اخلليجي اهلندسي العمل مسرية تعزيز صعيد على بالغة أهمية اهلام احلدث هذا انعقاد يشكل مدى على امتدت اليت السنوية لقاءاتهم يف اخلليجيني املهندسني تواصل خالل من املشرتك ومن جهة، من هذا اخلليجي، املستوى على اإلجنازات من العديد حتقيق خالهلا مت عامًا عشرين بأمور املتعلقة واخلربات والتجارب املعارف خمتلف تبادل خالهلا من يتم أرضية يشكل أخرى جهة مهنة اهلندسة. ويف هذا امللتقى فإننا معنيون بتطوير طرائق وسبل حل املنازعات يف املشاريع واملشاريع التحتية البنية ومشاريع العمراين التطوير كمشاريع القطاعات خمتلف يف اهلندسية

مقدمـــــــــة

لقد نشأت و استمرت الكثري من املنازعات اهلندسية واإلنشائية يف ظل تفاوت اجلهود املبذولة من قبل دول جملس التعاون اخلليجي لتطوير التشريعات والقوانني، و تطوير املؤسسات اليت ُتعىن حبل تلك املنازعات اهلندسية. عدا عن التفاوت يف تبين التشريعات اليت أتت بها مناذج العقود الدولية املنظمة إلدارة املشاريع اهلندسية وحل النزاعات اليت تنشأ عنها، و تكييفها ضمن التشريعات الوطنية وعقود املقاوالت، إىل جانب التفاوت يف اجلهود املتعلقة بتطوير الكوادر البشرية املتخصصة عرب إعداد وتنفيذ الربامج التدريبية املعتمدة، والشهادات االحرتافية املعرتف بها وطنيًا وإقليميًا
