Committee Report Nr. LAWS-2015-010 a. 1st Indorsement dated 15 January 2015 of the Office of Hon. City Mayor Mauricio G. Domogan, forwarding for information and appropriate action the amended BLISTT Memorandum of Agreement entered into by and among the BLISTT members and concerned agencies.

b. Letter dated 19 January 2015 of Ms. Milagros A. Rimando, Director, NEDA-CAR, BLISTT Secretariat to Hon. Vice Mayor Edison R. Bilog, requesting that the BLISTT MOA be reviewed and the passage of a resolution confirming the signing by the City Mayor of said MOA.

The Committee on Laws recommends confirmation of the above stated Memorandum of Agreement.

Hon. Elmer O. Datuin, Member of the Committee signified, "the PCL of Benguet & Baguio must be made members of the BLISTT Dev't. Council under Sec. 3.1." (Item 35, 14 September 2015 Agenda)

UNFINISHED BUSINESS – 21 SEPTEMBER 2015 REGULAR SESSION:

Committee Report Nr. WAYSC-2015-014 Ordinance No. 01, series of 2015, of Holy Ghost Proper Barangay entitled, "An ordinance amending Section One of Barangay Ordinance No. 1, series of 2011, otherwise known as an ordinance for one-sided parking spaces along the streets within the territorial jurisdiction of Holy Ghost Proper Barangay and prescribing regulatory fees, extending the coverage thereof to include portions of Sumulong St., Laurel St., Laubach Road and Yangco Road."

(NOTE: Res. No. 403, s. 2011 approved the report and recommendation of the Sangguniang Panlungsod (City Council) Committee on Laws as contained in its 5th indorsement dated 29 September 2011 on Barangay Ordinance no. 01, series of 2011 [an ordinance providing for one [side] parking spaces along the streets within the territorial jurisdiction of Holy Ghost Proper Barangay and prescribing regulatory fees thereof.], of Holy Ghost Proper Barangay, Baguio City.)

In view of the foregoing compliance with Sections 186 and 187 of the Local Government Code mandating that ordinances levying taxes, fees or charges shall be the subject of a public hearing prior to its enactment as could be evidenced by the hereto attached minutes of meetings and attendance to the general assemblies, the Committee on Ways and Means and Finance (Cluster C) recommends FAVORABLE REVIEW of the subject barangay ordinance. Committee Report Nr. WAYSA-2014-044 Proposed Ordinance Nr. PO 0055-14 introduced by Hon. Vice Mayor Edison R. Bilog, Hon. Elaine D. Sembrano, Hon. Joel A. Alangsab, Hon. Fred L. Bagbagen and Hon. Peter C. Fianza entitled, "Appropriating the amount of P10,000,000.00 or so much thereof for the construction of a collapsible parking facility in the City of Baguio." Hon. Faustino A. Olowan signified, "What is this?"

Committee Report Nr. UPLH-2015-002 Letter dated 28 November 2013 of Mr. Sunny G. Isidro to Hon. Leandro B. Yangot Jr., resubmitting his application for transfer of rights over Lot 44, Block 25, Baguio Working's Village, East Bayan Park, Baguio City.

(NOTE: The above matter is related to the letter dated 14 April 2010 of Mr. Sunny G. Isidro to Hon. Isabelo B. Cosalan Jr., withdrawing his application over Lot 44, Block 25, Baguio Workingmen’s Village, East Bayan Park, Aurora Hill Barangay, Baguio City.)

After careful evaluation of the documents submitted by the applicant to support his application over the above-stated parcel of land at the Baguio Workingmen's Village, the committee finds that the applicant substantially complied with all the essential requirements as provided for under City Ordinance Numbered 65, series of 1948, as amended.

The applicant submitted the following documents: 1. Sworn Application; 2. Barangay Certification dated December 3, 2014 issued by PB Judge Tomas A. Tolete (Ret), East

Bayan Park, Aurora Hill Barangay, Baguio City certifying that Sunny G. Isidro is the lone applicant of Lot 44, Block 25 of the Baguio Workingmen's Village, further upon ocular inspection no person claiming to have application on the lot was verified and that there was no existing improvement of other claimants except that of Mr. Sunny Isidro on the specified lot;

3. DENR-CAR certification issued by Edgardo S. Flor, OIC, CENR Officer certifying that a parcel of land containing an area of one hundred twenty nine (129) square meters more or less located at Res. Sec. "H" overlaps a portion of creek (3.00-5.00 m wide). However this plan falls within Lot 1, Executive Proclamation No. 358 dated September 17, 1938 of Workingmen's Village and outside Forest/Military Reservation;

4. Barangay Resolution No. 25, series of 2004 of East Bayan Park entitled "A RESOLUTION FOR THE PROPER OFFICE PERMISSION FOR THE EAST BAYAN PARK BARANGAY AURORA HILL, BAGUIO CITY TO WAIVE THE PARCEL OF LAND LOT NO. 44, BLOCK 25 TO MR. SUNNY G. ISIDRO;

5. Joint affidavit of Carolina G. Isidro and Sunny G. Isidro on 24th day of July 2008; 6. East Bayan Park Barangay undated notice to the public that the Council of Barangay East Bayan

Park, Aurora Hill, Baguio City through the Resolution No. 25, series of 2004 has allowed Mr. Sunny G. Isidro to build a house on a public lot between Mr. and Mrs. Noli G. Trinidad and Mr. and Mrs. Paciante Balnges residence signed by Punong Barangay Felipe Gabriz;

7. Certificate of Non-Property; 8. Tax Official receipt as proof payment of real property tax for CY 2014; 9. Pictures of improvements; and 10. Lot Plan.

In view of all the foregoing, the Committee on Urban Planning, Lands and Housing recommends approval of the application of Mr. Sunny G. Isidro for the transfer of rights over Lot 44, Block 25, Baguio Workingmen's Village, Aurora Hill, Baguio City. (Item 8, 21 September 2015 Agenda)

Committee Report Nr. TOURISM-2015-010 Letter dated 24 April 2015 of Mr. Adrian Galang, President, UP Management Association, Inc. to Hon. Isabelo B. Cosalan Jr., seeking partnership with the City Government of Baguio for the conduct of a seminar on sustainable tourism entitled, "Destination Management: A Strategy Towards Sustainability" on May 13, 2015, 1:00 pm at Jack's Grandview, #58 Montinola Subdivision, Kisad Road, Baguio City.

The Committee on Tourism, Special Events, Parks and Playgrounds recommends to regretfully inform the UP Management Association, Inc. through its President, Mr. Adrian Galang that their request could not be granted because there is no immediate available fund for their event. Committee Report Nr. EDUC-2015-002 Proposed Resolution Nr. PR 0059-15 introduced by Hon. Vice Mayor Edison R. Bilog entitled, "Requesting the Commission on Higher Education (CHED), through Secretary Luistro for the immediate release of the educational benefits of the family members of the SAF 44."

The Committee on Education, Culture and Historical Research recommends discussion en banc of the proposed resolution to consider the following observations, to wit:

Luistro was directed by the President to assist in providing the relatives and families of the SAF 44 also with college educational benefits, the program that was identified and coordinated for the purpose is with the Commission on Higher Education (CHED) that the request may have to be directed to CHED Chairperson Dr. Patricia B. Licuanan;

2. The financial assistance that may be extended will be in the form of a scholarship in which dependents may be found to qualify to or a grants-in-aid or "Tulong Dunong" of P12,000.00 each under the Student Financial Assistance Program (STUFAPS);

3. The release of the financial assistance or benefit will therefore be in accordance with the scholarship program to which the dependent may qualify to or with the "Tulong Dunong" program;

4. To avail of the benefits, dependents will have to file their respective applications with the Regional Offices of CHED where they reside which will collate all the applications and transmit the same to the central office of the CHED;

5. In the Cordillera Administrative Region (CAR), eight (8) of the nine (9) applications were transmitted to the central office on May 28, 2015. The last application that was accordingly received recently was likewise transmitted to the CHED, also recently;

6. It will further appear that the processing of the applications will require the applicant to first enroll in a chosen school. His enrolment form and a certification of enrolment will then have to be submitted to the CHED. In short, the financial assistance will be in the nature of a reimbursement;

7. The immediate release of the financial assistance to the dependents of SAF 44 will not therefore be in accordance with the CHED system or program which the Committee finds will be destructive to the cause of SAF 44 for reasons that need not be mentioned;

8. The financial assistance being provided by the CHED is in addition to educational aids or grants being provided the dependents of the SAF 44, including from funds being administered by the NAPOLCOM. (Item 11, 21 September 2015 Agenda)

Committee Report Nr. MARKET-2015-011 Matters raised by the Honorable Members and the resource persons during the 01 June 2015 Regular Session in relation to the conditions of public safety and public welfare of boarding houses, apartments and dormitories in the City of Baguio. Based on the summary findings and action s taken as a result of the joint inspection, the Committee on Market, Trade and Commerce recommends APPROVAL of the committee findings embodied in this report and the adoption of the following recommendations:

1. The enactment of a resolution enjoining the Task Force on Boarding Houses and Dormitory Buildings as organized under Administrative Order No. 092, series of 2014 to:

a. convene and interact with boarding house and dormitory building owners/administrators and with the end in view of instilling greater and swifter compliance with regulatory standards set under existing laws, ordinances, and administrative issuances on public order and safety, public health and sanitation, and peace and order; including the immediate installation of highly essential fire safety systems and equipment found to be lacking or deficient in erring establishments;

b. conduct regular quarterly inspection of dormitories and boarding houses by the Task Force.

2. A separate resolution requesting the Bureau of Fire Protection - Baguio Fire Station to submit report on compliance to recommended or directed measures on inspected boarding houses and dormitories.

3. A separate resolution requesting the PNP-Baguio City Police Office to give special attention to boarding houses or dormitories in the intensified nightly patrol activities throughout the city where boarding houses and dormitory buildings are situated so as to enhance police protection and safety measures to tenants and boarders therein.

Tabanda entitled, "Honoring Centenarian Apolonia Duno Uda - Ellinger of Irisan Barangay who was born on March 22, 1915." The Committee on Education, Culture and Historical Research recommends that the proposed resolution be DISCUSSED EN BANC to consider the legislative intent of Ordinance Numbered 45, series of 2013, known as the Centenarian Awards Ordinance of the City of Baguio which to the committee will appear to have institutionalized the award and has provided the system of recognizing or honoring qualified centenarians that the approval of the proposed resolution will make the said system of no use, taking note of said effect in an earlier resolution (Resolution Numbered 034, series of 2015) which the committee recommended for approval much attention to the said ordinance. Committee Report Nr. UPLH-2014-019 Letter dated 18 June 2014 of Ms. Georgie Galera Romero, requesting transfer of rights over Lot 32, Block No. 21, Bayan Park Village, Aurora Hill, Baguio City from the late Ms. Carmen S. Galera in her favor.

After careful evaluation of the documents submitted by the applicant to support his application over the above stated parcel of land at the Baguio Workingmen's Village, the committee finds that the applicant substantially complied with all the essential requirements as provided for under City Ordinance Numbered 65, series of 1948, as amended.

The applicant submitted the following documents: 1. Sworn Application; 2. Barangay Certification dated September 3, 2014 issued by PB Melvin Cortez, Bayan Park

Village Barangay, Baguio City certifying that the lot application of Georgie G. Romero was posted at the barangay hall for three (3) months and no body opposed to the request of Ms. Romero.

3. DENR Certification issued by Edgardo S. Flor, OIC, CENR Officer certifying that Ms. Carmen Galera is an applicant-holder of MS No. V-55197 covering a parcel of land particularly described as Lot 32, Block 21, BCS-2032-D situated at Res. Sec. "H", Baguio Workingmen's Village, Baguio City with an area of 250 square meters;

4. Certificate of Non-Property; 5. Tax Declaration of the subject lot; 6. Official receipt as proof of payment of real property tax for CY 2014; 7. Waiver and Quitclaim executed by Romeo S. Galera, Percival S. Galera and Juliet Galera-

Lim, all siblings of Georgie Galera Romero waiving and quitclaiming the rights over the said property to Georgie Galera Romero;

8. Waiver and Quitclaim executed by Letty P. Galera, Solomon P. Galera Jr., Jennifer P. Galera-Casil, Lerriza P. Galera-Abad and Jonathan P. Galera, all heirs of Carmen S. Galera, waiving and quitclaiming their rights over the said property in favor of Georgie Galera-Romero;
