A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN DIEGO AUTHORIZING YEAR-END AMENDMENTS TO THE FISCAL YEAR 2019 CAPITAL IMPROVEMENTS PROGRAM BUDGET OF THE CITY OF SAN DIEGO.
WHEREAS, on June 25, 2018, the City Council adopted Ordinance No. 0-20952,
entitled “An Ordinance Adopting the Annual Budget for Fiscal Year 2019 and Appropriating the
Necessary Money to Operate the City of San Diego for Fiscal Year 2019” (Appropriation
Ordinance); and
WHEREAS, the 2019 Budget includes the annual budget for the Capital Improvement
Program (CIP Budget); and
WHEREAS, on December 13, 2018, Resolution No. R-312150 was approved by the
Mayor making mid-year amendments to the CIP Budget; and
WHEREAS, on May 22, 2019 the Fiscal Year 2019 Capital Improvements Program
Year-End Budget Monitoring Report was presented to the Infrastructure Committee (Report)
with proposed budget adjustments, appropriation transfers, amendments to the Regional
Transportation Improvement Program (RTIP) to allow for the reallocation of TransNet funding,
and the addition and closing of certain CIP projects; and
WHEREAS, on November 4, 2004, the voters of San Diego County approved the
San Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet
Extension Ordinance); and

WHEREAS, the TransNet Extension Ordinance provides that SAND AG, acting as the
Regional Transportation Commission, shall approve on a biennial basis a multi-year program of
projects submitted by local jurisdictions identifying those transportation projects eligible to use
transportation sales tax (TransNet) funds; and
WHEREAS, the City was provided with an estimate of annual TransNet local street
improvement revenues for fiscal years 2017 through 2021; and
WHEREAS, on June 22, 2016, the City approved its 2016 TransNet Local Street
Improvement Program of Projects (POP) and the City now desires to make adjustments to its
POP; and
WHEREAS, the Council has held a noticed public meeting with an agenda item that
clearly identified the proposed amendments to the POP prior to approval of the projects in
accordance with Section 5(A) of the TransNet Extension Ordinance and Rule 7 and of SAND AG
Board Policy No. 31; and
WHEREAS, Section 16 of the Appropriation Ordinance authorizes the Chief Financial
Officer to modify appropriations upon adopted City Council resolution, provided funding is
available for such action and in accordance with finding source guidelines and applicable grant
agreements; and
WHEREAS, Section 73 of the Charter allows the Council, upon the recommendation of
the Mayor, to transfer all or part of an unencumbered balance of an appropriation to a purpose or
object for which the appropriation for the current year has proved insufficient; and
WHEREAS, the Council desires to approve the proposed budget amendments,
appropriation changes and other actions as described below and in accordance with the Report;
NOW, THEREFORE,

BE IT RESOLVED, by the Council of the City of San Diego that the following
revisions to the 2019 Budget, as detailed in the Fiscal Year 2019 Year-End Budget
Monitoring Report, are approved and the Chief Financial Officer is directed to adjust the
Fiscal Year 2019 Capital Improvement Program (CIP) budget appropriations as follows:

95. Increase the CIP Program Budget in CIP T19002 - CPPS - Phase 1 and
appropriate and expend an amount not to exceed $150,000 from Fund 400265 -
General Fund Contributions to the CIP.
BE IT FURTHER RESOLVED,
1. The Chief Financial Officer is authorized to accept, appropriate and expend an
amount not to exceed $998,200 if the grant funding is secured; and

2. The Chief Financial Officer is authorized to establish a special interest-bearing
account for the grant, if required; and
3. The Chief Financial Officer is authorized to increase the Capital Improvement
Program Budget in in CIP Annual Allocation AIE00002 - Guard Rails, and to
appropriate and expend an amount not to exceed $998,200, fi'om fund 600000,
Grant Fund-Federal, Earmark Repurposing grant funding, contingent upon receipt
of a fully executed grant agreement.
BE IT FURTHER RESOLVED,
1. The Chief Financial Officer is authorized to accept, appropriate and expend an
amount not to exceed $3,000,000 if the grant funding is secured; and
2. The Chief Financial Officer is authorized to establish a special interest-bearing
account for the grant, if required; and
3. The Chief Financial Officer is authorized to increase the Capital Improvement
Program Budget in CIP Annual Allocation AIEOOOOl, Bridge Rehabilitation, and
to appropriate and expend an amount not to exceed $3,000,000, from fund
600000, Grant Fund-Federal, contingent upon receipt of a fully executed grant
agreement.
BE IT FURTHER RESOLVED, the Chief Financial officer is authorized to:
1. Decrease the CIP Program Budget and deappropriate an amount not to exceed
$182,287.00 from AAA00002, Brown Field, fund 710000, Grant Fund -
Enterprise-Federal, Grant 1000518-2015; and

2. Decrease the CIP Program Budget and deappropriate an amount not to exceed
$14,793.90 from AAA00002, Brown Field, fund 710001, Grant Fund -
Enterprise-State, Grant 1000523-2015.
BE IT FURTHER RESOLVED, that the City of San Diego requests that SAND AG make
the following changes to its 2018 POP (Amendment):
1. That the Mayor, or his designee, is authorized to approve adjustments to TransNet
funded projects, according to Attachment I, in compliance with SAND AG Board
Policy No. 31, Rule #7 and Rule #17; and
2. That pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City
of San Diego certifies that no more than 30 percent of its annual revenues shall be
spent on local street and road maintenance-related projects as a result of the
Amendment; and
3. That pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of
San Diego certifies that all new or changed projects, or major reconstruction
projects, included in the Amendment and funded by TransNet revenues shall
accommodate travel by pedestrians and bicyclists, and that any exception to this
requirement permitted under the Ordinanee and proposed, shall be clearly noticed
as part of the City of San Diego’s public hearing process for the Amendment; and
4. That pursuant to Section 8 of the TransNet Extension Ordinance, the City of
San Diego certifies that the required minimum annual level of local discretionary
funds to be expended for street and road purposes will be met throughout the 5-
year period consistent with the most recent Maintenance of Effort Requirements
adopted by SANDAG; and

5. That pursuant to Section 9A of the TransNet Extension Ordinance, the City of
San Diego certifies that it will exact $2,483.48, plus all applicable annual
increases, from the private sector for each newly constructed residential housing
unit in that jurisdiction (unless exempted under the TransNet Extension
Ordinance,) and shall contribute such exactions to the Regional Transportation
Congestion Improvement Program (RTCIP).
6. That pursuant to Section 13 of the TransNet Extension Ordinance, the City of
San Diego certifies that it has established a separate Transportation Improvement
Account for TransNet revenues with interest earned expended only for those
purposes for which the funds were allocated.
7. That pursuant to Section 18 of the TransNet Extension Ordinance, the City of
San Diego certifies that each project of $250,000 or more will be clearly
designated during construction with TransNet project funding identification signs.
8. The City of San Diego does hereby certify that all other applicable provisions of
the TransNet Extension Ordinance and SANDAG Board Policy No. 31 have been
met.
9. That the City of San Diego continues to agree to indemnify, hold harmless, and
defend SANDAG, the San Diego County Regional Transportation Commission,
and all officers and employees thereof against all causes of action or claims to
local TransNet funded projects.
BE IT FURTHER RESOLVED, that the Chief Financial Officer is authorized to close:
1. SI0065, Mission Trails Reg Pk Cowles Mtn T1 Reh; and
2. SI0066, Mission Trails Reg Pk Trail Realignments; and

BE IT FURTHER RESOLVED, that the Chief Financial Officer is authorized to:
1. Transfer up to $758,086.57 in appropriations, expenditures, and encumbrances
from CIP ABP00003, Annual Allocation - Pump Station 64, 65 Penasquitos, E
Mission Gorge into CIP ABPOOOOl, Annual Allocation - Pump Station
Restorations.
