38. *Rana Sana Ullah Khan: (Deferred during 6th Session)

Will the Minister for Interior be pleased to state:

(a) the terms and conditions of the agreements between theGovernment  and the protesters made on 31-10-2018 and2-11-2018;

(b) the total number of cases registered against the protestors;

(c) the details of damage caused by protestors; and

(d) whether any compensation has been paid to injured and deadand those who sufferred property loss alongwith the details; ifnot, the reasons therefor?

Minister for Interior (Mr. Ijaz Ahmad Shah): (a) The agreementbetween Tehreek-e-Labbaik Pakistan (TLP) and the government wasfacilitated by Government of Punjab at Lahore. The agreement includedfollowing provisions:

(i) A review petition was already filed, being the lawful right of thepetitioners, which was recognized, as per law.

(ii) Legal procedure was to be followed, for inclusion of Asia Masih’sname in ECL, as also prayed in the review petition.

(iii) Necessary legal action was to be taken in case of casualties, if any,during these protests.

(iv) Those arrested, during or after the protests, will be set free.

(v) TLP apologized for hurting the sentiments and causing inconvenienceto the citizens, if any, during these protests.

(b) During the Dharna from 1st to 3rd November, 2018, six (06) criminalcases were registered by the ICT Police against the protestors, who were involvedin the agitation and roads blockades. In all, 44 accused were arrested and sent tojudicial custody. Challans against them were sent by ICT Administration to theconcerned courts where they are facing trial.

(c) No damage caused by the protestors to the public and privateproperty, within Islamabad Capital Territory.

(d) Neither any body was seriously injured nor died. No damage wascaused to the public / private property by the protestors within Islamabad / ICT.Therefore, the question of compensation did not arise.

Note: The reply from provincial governments is awaited, despitereminders. The same will be submitted as and when received.

157. *Mr. Iqbal Muhammad Ali Khan: (Deferred during 9th Session)

Will the Minister for Interior be pleased to state:

(a) the number of times spillway of Rawal Dam opened  during thelast two months alongwith the quantity of water released andthe details thereof;

(b) the head under which the said released water was used; and

(c) whether there is any proposal under consideration of theGovernment to store the releasing water again; if so, the details;if not, the reasons thereof?

(b) Spillway were operated to discharge surplus water after the reservoirlevel of Rawal Dam reached the maximum Storage level.

(b) the time period in which the CDA is bound to issue an NOC, incase the documentation, in respect of the plot, is complete?

Minister for Interior (Mr. Ijaz Ahmad Shah): (a) The procedure forobtaining an NOC (Approval of Building Plans) from CDA in respect ofconstruction on a plots is as under:—

RESIDENTIAL PLOTS

(i) Form A1, A2 duly signed by the allottee / owner and Architect /Engineer

(ii) Six copies of architectural drawings duly signed by CDA licensedArchitect.

(iii) Six copies of structural’ drawings duly signed by CDA licensedStructural, Engineer.

(iv) Attested copy of allotment/transfer letter duly attested

(v) Attested copy of NIC of allottee.

(vi) Indemnity Bond on stamp paper for approval duly signed by the‘owner & witnesses.

(vii) Attested copy of Possession letter.

(viii) Scrutiny fee as applicable.

COMMERCIAL PLOTS

The commercial plot cases are scrutinized checked and approved byDesign Vetting Committee (DVC), further the cases are processed as fellows:

Owner / lessee will submit the building plans for approval on prescribedA-1, A-2 forms dully filled with 6 prints of Architectural and Structuraldrawings, engineer certificate, calculation book, soil report, vettingconsultant certificate and fire fighting drawings as per Fire SafetyPolicy-2016.

(b) 21 days are required for issuance of NOC (Approval ofbuilding plan) for construction on a residential plot.

Will the Minister for Interior be pleased to state whether it is a factthat mobiles are being cleared after scanning the Passports of thePakistanis coming from abroad; if so, the steps, being taken by theGovernment against the officials deputed at the Airports involved insuch criminal activities?

Minister for Interior (Mr. Ijaz Ahmad Shah): FIA Immigration scanspassports only for Immigration process at all notified exit/entry points whereasquery regarding scanning of passports for mobile registration may be soughtfrom PTA and Pakistan Custom.

(a) whether it is a fact that various Cantonments arebeing established in South Waziristan; and

(a) the zone-wise illegal construction, which has been legalized inthe last 5 five years in Islamabad or is being proposed to beregularized;

(b) the zone-wise such illegal construction/structure, which has notbeen regularized in the said period;

(c) whether it is equal to failure of CDA and abetting the illegalconstruction while it was being built; and

(d) if the answer is affirmative, what steps are being taken to makeCDA accountable for its failure to stop illegal construction inIslamabad?

Minister for Interior (Mr. Ijaz Ahmad Shah): (a) No illegalConstruction in any zone has been regularized in last 5 years.

(b) No data of illegal structures is presently available with CDA.Consultants are being hired for review of Master Plan of Islamabad. They will alsobe tasked to survey the illegal construction / structures.

(c) No.

(d) No.

96. *Ms. Munawara Bibi Baloch:

Will the Minister for Overseas Pakistanis and Human ResourceDevelopment be pleased to state:

(a) the steps, being taken by the Government for welfare ofPakistani Laborers working in the Gulf States, since June, 2013;and

(b) the total number of people, belonging to Balochistan, who areresiding in the said states?

Minister for Overseas Pakistanis and Human ResourceDevelopment: (a) The following steps have been taken by the Government forwelfare of Pakistani laborers working in Gulf Countries since June 2013:

(i) The Community Welfare Attaches (CWAs) posted in PakistanMissions (GCC countries) are providing various welfare services tothe Pakistani workers, which include:

Settlement of disputes of workers with their employers.

Payment of salaries / dues.

Insurance claims in case of accident/diyat cases and issuanceof Emergency Travel Documents (ETDs) etc.

Recovery of passports from employers and renewal of iqama.

End-of-service benefits, settlement of dues of deceasedworkers.

Consular access to Pakistanis detained in various police stations,jails and deportation camps.

Financial assistance to destitute Pakistanis through PakistanCommunity Welfare and Education Fund (PCW&EF), whererequired.

Transportation of dead bodies of deceased workers toPakistan.

(ii) In view of a large number of Pakistani expatriate in GCC, the servicesof prominent overseas Pakistanis and welfare organizations are usedto resolve problems of Overseas Pakistanis, who live-in far-flungareas, which are not accessible by the CWAs.

(iii) Overseas Pakistanis Foundation (OPF), an organization of thisMinistry serves the Overseas Pakistanis through Welfare Servicesranging from outstanding dues to ambulance services and housingand education schemes.

INITIATIVES TAKEN BY THE PRESENT GOVERNMENT

(iv) To redress issues / problems of Overseas Pakistanis and their familiesback at home, following complaints cells are working:

On the directions of the Prime Minister, Pakistan Citizen Portal(PCP) established in the Prime Minister’s Office.

Complaints Management System, namely “Call-SarzameenWeb Portal” established in this Ministry, as well as a ComplaintManagement System also established in Overseas PakistanisFoundation (OPF).

(v) On the directions of the Prime Minister’s Office, a High PoweredCommittee is being constituted for effective resolution & oversightof complaints of Overseas Pakistanis.

(vi) Work has also been initiated to prepare a Manual containing detailsof privileges/incentives already extended and some additionalincentives to be extended to overseas Pakistanis and their familiesback at home along-with facilitation Standard Operating Procedures(SOPs).

(vii) On the direction of the Prime Minister’s office, M/o Law and Justicein consultation with this Ministry is reviewing the existing laws,procedures, enforcement mechanism and necessary amendments inLaws for prompt resolution of property disputes of OverseasPakistanis.

(viii) To decrease the financial burden, the condition of NICOP foremigrant workers has been abolished. Now these workers can beregistered on the basis of CNIC.

(ix) One Window Fee-Collection Desk has been established inProtectorate of Emigrant Offices under Bureau of Emigration andOverseas Employment in coordination with National Bank of Pakistanand other relevant stakeholders.

(x) Registration of intending emigrants via Biometric Verification Systemlinked with NADRA has been established. Resultantly, Bureau of

Emigration & Overseas Employment (BE&OE), FIA and NADRAare connected through a secured link. The details of the emigrantworkers would be shared with the concerned CWA for their receptionin destination country and post arrival orientation, as well as to theOverseas Pakistanis Foundation (OPF) for the welfare of theirfamilies.

(xi) One Window Facilitation Desks have been established at allInternational Airports to facilitate the intending Emigrants to travelabroad.

(xii) Recently, Special Assistant to the Prime Minister on OverseasPakistanis & Human Resource Development visited GCCcountries and met with Pakistani workers in their camps toascertain their problems. He directed the Pakistan Missions toprovide all possible assistance to redress their issues/problems.

(b) Data regarding total number of people currently residing in GCCcountries belonging to Balochistan is not available, as the Ministry only maintainsrecord of workers proceeding for employment. However, a total 114,397workers proceeded to GCC countries from Balochistan since 1981(Annex-A).

Due to manual compilation, country specific data prior to October, 2018from Balochistan is not available. The Bio-metric registration of emigrants at theOffice of Protectorate of Emigrants, Quetta has recently been implemented,which would help to compile country as well as Province wise data.

97. *Mr. Saad Waseem:

Will the Minister for Inter-Provincial Coordination be pleased to state:

(a) the details of persons, who were on payroll of Pakistan CricketBoard (PCB) against the post of any nomenclature as on July14th, 2019 alongwith per month pay, perks and other privilegeof each of the above;

(b) the details of persons, whose visits were sponsored by the PCBduring the World Cup, 2015, held in the United Kingdom (UK)other than Cricket Team alongwith expenditure incurred on eachof the above visit;

(c) the rationale behind sponsoring these visits; and

(d) what steps are being taken to bring financial discipline in PCB?

Minister for Inter-Provincial Coordination (Dr. Fehmida Mirza):(a) PCB previously in February 2015 provided delicate and sensitiveinformation with regard to remuneration of its employees, but regrettably theconfidential information ended up with the electronic and print media and thesame information was distorted and used to cast aspersions upon PCB.Resultantly, substantial energy, resources and effort were wasted on respondingto disparaging and slanderous ballyhoo by the media. Thereafter, when againthe same sensitive information was sought in July 2015 PCB, whilst showingits extreme reverence, advised that it would be available to physically showthe relevant record to the relevant Honorable MNA in order to avoid theaforementioned adverse outcome.

(b) & (c) It is intimated that no World Cup took place in UK in2015; hence, no details to this effect can be provided.

(d) PCB is the solitary sports organization which generates all fundsitself and does not take any grant or budget from Federal or any ProvincialGovernments or the Public Exchequer. Further, PCB is the sole sports entitywhich pays income tax and has instilled a robust financial management systemand undergoes annual internal and external audits by renowned charteredaccountancy firms (in the recent past these have included KPMG, Deloitte,EY Ford Rhodes etc.). PCB, on occasion, has also been audited by the AuditorGeneral of Pakistan.

It is important to keep in consideration the fact that International Cricketis regulated by the International Cricket Council (ICC) of which Pakistan is afull member. Under the Charter documents of the ICC, it is a conditionprecedent for every member that there should be no political or governmentinterference in the affairs of the National Cricket Federations, in the instantcase, PCB. It is for this reason that the Government of Pakistan had to formulatea new Constitution of PCB in 2014 which ensured that the PCB remainedfully compliant with the mandatory requirements of ICC. It is noteworthy thatin the recent past ICC has suspended the membership of Zimbabwe and SriLanka due to government interference in the matters of their respective CricketBoards.

98. *Syed Agha Rafiullah:

Will the Minister for Interior be pleased to state:

(a) the number of BS 20-22 officers in the Ministry and its attacheddepartments;

(b) the number of official vehicles, in the Ministry at presentalongwith annual expenditure thereof;

(c) whether it is a fact that despite the policy of monetization oftransport facility, aforesaid vehicles are being misused at largescale, contrary to true spirit of the policy;

(d) if so, whether any inquiry has been held in this regard; if so, thedetails thereof; and if not, is there any proposal to conduct suchan inquiry in order to determine the magnitude of the misuse ofvehicles; if so, when; and

(e) what steps are taken to hold the responsible accountable, if heis detected misusing the official vehicle?

(a) whether the Government has taken steps to improve and ensurethe accountability of various sports federations in the countryfor better and effective utilization of resources;

(b) if so, the details thereof;

(c) if not, the reasons therefor?

Minister for Inter-Provincial Coordination (Dr. Fehmida Mirza):The National Sports Federations submit their audited statement to Pakistan SportsBoard at the end of financial year. Furthermore, on the instruction of Ministry ofIPC, Director General Federal Audit is conducting forensic/ special audit of theNational Sports Federations for the last five years i.e. 2013-14 to 2017-18. Theaudit authorities have conducted forensic audit Pakistan Hockey Federation, Tennisfederation and Pakistan Volleyball Federation. The report is awaited. MeanwhileSenate Sub-Committee has given their report, which will be shared once it is laidin Senate.

(b) The forensic report is awaited. Further action will be taken in thelight of audit report.

(c) As stated above.

101. *Sheikh Fayyaz Ud Din:

Will the Minister for Overseas Pakistanis and Human ResourceDevelopment be pleased to state the number of employees recruited inEmployees Old-Age Benefits Institution (EOBI) during the years 2013-18and the amount paid under the head of their salaries, with details?

Minister for Overseas Pakistanis and Human ResourceDevelopment: During the years 2013-2018, Employees’ Old-Age BenefitsInstitution (EOBI) has recruited total 202 candidates in various scales andcadres. Whereas, a total of Rs. 545,267,197/- has been paid under the headof salaries to them. Details are attached at Annex-A.

B. 4th Men’s Asian Champions Trophy at Kuantan/Malaysia from 20thto 30th October 2016 and won Silver medal.

JUNIOR HOCKEY TEAM YEAR 2016

A. 4-Nation Hockey Tournament at Hannover/Germany from 21st to24th July 2016.

B. Test Series against Spain Junior Terrassa/SPAIN from 29th Augustto 1st September 2016 and won the series.

C. 6th Sultan of Johor Cup at Johor Bahru/Malaysia from 31st Octoberto 6 November 2016 and won Silver medal.

U-18 BOYS HOCKEY TEAM YEAR 2016

A. Pak - Oman Test Series at Lahore/Pakistan from 16th to20thSeptember 2016 and won the series.

Minister for Interior (Mr. Ijaz Ahmad Shah): (a) The CooperativeSocieties Department, ICT, Islamabad deals with the Cooperative HousingSocieties registered under Section 10 of the Cooperative Societies Act, 1925.There are 41 Cooperative Housing Societies registered with CooperativeSocieties Department, ICT, Islamabad. In the light of directions of theHonourable Supreme Court of Pakistan and subsequent meetings held in FIAHQ Islamabad on 21-06-2017 and 18-07-2017, this office has alreadyordered Forensic Audits of all Cooperative Housing Societies registered withCooperative Societies Department, ICT, Islamabad. The Forensic Audit is tobe completed as per TOR’s prepared by FIA Islamabad. Out of 41 societiesthe forensic audit of 06 societies has been completed. The remaining auditsare in progress, many are near completion. This department is pressing hardfor early completion of all forensic audits.

(b) The Registrar Cooperative Societies will take legal action underSection 43 of the Cooperative Societies Act, 1925 where applicable. Atpresent forensic audits of 06 societies has been completed. The same hasbeen forwarded to FIA as per TOR. FIA will examine the forensic audit reportsin light of the orders of the Honourable Supreme Court of Pakistan dated08-05-2017 passed in CPL No. 1331 of 2017 and will take necessary actionas per said orders of the court. The complete report shall be submitted aftercompletion of forensic audit of all cooperative societies.

Minister for Defence Production (Ms. Zubaida Jalal): (a) Ex-PrimeMinister of Pakistan, during his visit to POF on 6th February, 2017 announcedgrant of 2 x advance increments and 25% special allowance to POF employees.To give effect to the decision of the Prime Minister a Govt. letter duly endorsed byMinistry of Finance was issued on 18 August 2018. Ministry of Finance declaredthat said increments and allowances will be admissible as personal allowance whichwill not be reckoned towards emoluments for purpose of calculation of pension/gratuity.

In line with the said announcement proposals received from HIT and PACBoards were processed accordingly for the approval of competent authority.However the same were not approved.

(b) Each organization has been established under a separate status withdistinctly different responsibilites and mandate. POFs is madated to work on“commercial lines” as per section 6(1) of POFs Ordinance whereas HIT BoardOrdinance does not envisage any commercial mandate at present. Accordingly,there is no cogent reason for employees of one organization to claim discriminationagainst employees of another organization.

However, Forensic Audit of the IBECHS isunder process as per directions of the Honorable Supreme Court of Pakistan.After receipt of the said report, further action will be taken against the concernedpersons as per recommendations of the Auditor.

Minister for Interior (Mr. Ijaz Ahmad Shah): (a) Two (02) pairs ofuniform once in a year are being distributed to the officers/officials of ICT Policefrom the Rank of Constable to Sub-Inspector. Further, Officers of the Rank ofInspectors and above are getting uniform allowance Rs. 1200/- per month in theirmonthly salary, therefore, they are not given the uniform.

(b) For payment of honorarium recommendations on the basis ofperformance are invited from all Units of Capital Territory Police and payment isapproved according to the availability of budget. Payment is sanctioned as andwhen recommendations are consolidated. There are no restrictions for paymentof honorarium in June. During current year, this Office has paid honorarium inApril, 2019.

Strict enforcement/operation is under active process against illegal/wrong parking at main markets i.e. Jinnah Super, Super Market,Blue Area, Karachi Company, Aabpara, Sector F-8, F-10, F-11,G-8, G-9, G-10, G-11, 1-8, 1-9 etc.

Education Campaigns: During the year 2019, the education teameducated 556736 road users in its different activities. The 1030 drivershave been appreciated during the year 2019 for good traffic disciplineby Islamabad Traffic Police.

Special Campaigns: A special campaign has been initiated w.e.f.09-05-2019 and strict action has been taken against traffic violatorsand issued following violation tickets for smooth flow of traffic inIslamabad: -

Minister for Interior (Mr. Ijaz Ahmad Shah): (a) Yes, unfortunatelyit is a fact that many people travel abroad illegally through agents who are oftenarrested or killed. Human Trafficking is a global problem and Pakistan is noexception. Illegal emigration is observed on a larger scale through unfrequentedparts of the bordering in districts connecting Iran and Afghanistan where no FIAsetup is available. As we know that Balochistan is a transit place to connect Iranand then to European countries. This is the main reason that the illegal emigrantsbelonging to other provinces come to Balochistan with the connivance of localagents, facilitators and transporters and reach the unfrequented portion of PAK-IRAN border without having any travelling documents where FIA is not available.

(b) To control Human Trafficking following measures have been takenby the Government of Pakistan:

Inter-Agency Task Force (IATE) was established in 2005 for thepurpose of prevention of smuggling and illegal immigration. Itsmembers include Ministry of Interior. Ministry of Foreign Affairs,FIA, NADRA, ISI, MI, IB, Pakistan Coast Guard, MaritimeSecurity Agency, FC Balochistan, FC KPK, Pakistan Rangers, Policedepartments of all the provinces, NADRA and representative ofBureau of Emigration & Overseas Employment.

Integrated border management System (IBMS) at All immigrationFIA Check Posts (Entry/ Exit Points).

Publication of Red book of Most Wanted Human Traffickers/Smugglers by FIA Every year for their arrest through specialcampaigns.

Minister for Interior (Mr. Ijaz Ahmad Shah): Due to noncomplianceof formalities required to announce the project, the then Assistant Commissioner(Pothohar)/ Administrator of the Society, vide an advertisement in the newspapers on March 30, 2018, had prohibited the transactions in Phase-II of theSociety due to non-availability of permissions from the CDA (i.e. approvedLayout Plan and NOC )and the permission from the Registrar. The current Managing Committee was elected in August 2018. This MCis taking keen interest to develop the Phase-II. A letter was personally deliveredto the Registrar on June 25, 2019. Copy enclosed at Annexure­A. It containedthe present status of the Phase-II. MC had asked for permission from the RegistrarCooperative Societies to start the Project.

On June 28, 2019, the Islamabad Cooperative Housing Society hasrequested us vide their letter No. ICHS/CECHS-I-2019 to mutually exchange280 kanals of land for compaction / consolidation of land of both Societies(Annexure-B). This proposal was also discussed in a joint meeting of the twoSocieties with the Circle Registrar.

Will the Minister for Interior be pleased to state the time by which theissue of missing persons would be solved?

Minister for Interior (Mr. Ijaz Ahmad Shah): The Commission ofInquiry on Enforced Disappearances was established in March 2011 by theFederal Government in exercise of the powers conferred upon it under PakistanCommissions of Inquiry Act 1956 (Repealed by the Act 2017). At that time,Ministry of Interior transferred 136 cases of alleged enforced disappearancesto this Commission. With the passage of time the number of cases received bythe Commission from Hon’ble Supreme Court of Pakistan, Human RightsOrganizations, families of Missing Persons and United Nation Working Groupon Enforced or Involuntary. Disappearances, Geneva, the number of casesincreased gradually. Consequently, the tenure of the Commission, which wasinitially six months, was extended from time to time. According to last extension,the tenure of the Commission will expire on 14 September 2020. A chartshowing Month-wise Receipt and Disposal of cases by the Commission fromJanuary 2015 onwards is attached at Annex-A, which indicates that it is acontinuous process and the number of cases has been on increase mainly dueto success of the Commission in tracing the whereabouts of Missing Persons

and awareness amongst the public the Commission where dispensation ofjustice is absolutely free of cost. The Commission, since its inception hasreceived 6277 cases from various quarters, out of which 4020 cases havebeen disposed of and 2257 cases are under investigation as on 31-7-2019.

2. The mandate of the Commission is to trace the whereabouts ofthe disappeared persons falling under the domain of Enforced Disappearances.The Commission is doing its job as per mandate and disposing of cases afterthorough investigation and in most of cases tracing whereabouts of the MissingPersons. It is not possible for this Commission to intimate the time by whichissue of Missing Persons would be solved, without elimination of numerouscauses including (i) Afghan War (ii) De-stability in Balochistan (iii) Role ofneighboring countries and (iv) Role of hostile Intelligence Agencies whichculminated into phenomena of “Missing Persons”.

(d) what steps are being taken, at the forum of IBCC, in this regard?
