All temporary or permanent line markings shall be placed at the end of each workday accordingly. Where the 1.5” overlay of the right shoulder is called for, the pavement drop-off at the face of guardrail shall not be located any closer than 2’-0” in front of the face of guardrail. The drop-off shall be limited to a range of 1½” in height with a 4:1 or flatter wedge to minimize the effect of the drop-off on a vehicle. Any drop-off that should happen to fall within 2’-0” of the face of guardrail shall be corrected by the Contractor with a method suitable to the VDOT engineer and shall be at no additional cost to the Department. The " PHASE 1: Inside Shoulder Patching for Maintenance of Traffic" located elsewhere in this contract is to note the details for the spot patching in left side shoulder on I-81 NB county Milepost 15.98 to 20.21 in Montgomery Co. The "Patching Detail" located elsewhere in this contract is to note the locations and details for the patching on I-81 NB county Milepost 15.98 to 20.21 in Montgomery Co. If excavation is used in lieu of milling for pavement demolition of the asphalt layers, the asphalt shall be sawcut around the perimeter of the excavation and the price for sawcutting shall be included in the price for pavement demolition (24430 – Demolition of Pavement). The bottom of the patches shall be graded as shown in the "Patching Detail" to properly drain to UD-7s. The cost for grading shall be included in the base bid line item for "24430 – Demolition of Pavement". After placement of the No. 1 Aggregate (10065 – AGGR. MATL. NO. 1), a method of compaction consisting of at least three passes with a steel drum vibratory roller weighing no less than 10 tons shall be used. The Milling and Overlay Detail located elsewhere in this contract is to note the detail of milling and overlay on I-81 NB county Milepost 15.98 to 20.21 in Montgomery Co. Intermediate layer shall be placed (over/through the patches) as soon as possible following completion of the patching. Base Asphalt (BM-25.0) shall be subject to traffic for no more than 14 calendar days. UD-7s are required on the right side only and shall be placed outside of the rumble strips approximately 2 feet from the right edge line. Outlets shall be supplied approximately every 200 feet and in all sag locations. When excavating for the UD-7 adjacent to the base patches, the UD-7 and backfill shall be placed immediately in a continuous operation as to not impact the integrity of the base patches. The Guardrail Schedule located elsewhere in this contract is to note the locations for the installation and removal of guardrail items on I-81 NB county Milepost 15.98 to 20.21 in Montgomery Co. Detour signs on northbound Route 11/eastbound Route 460 will be left in place after construction is complete and will become property of the Department. All remaining detour signs will be removed with the project.

(c211hg0-1209) POLISHING AGGREGATE IN ASPHALT CONCRETE - Section 211—Asphalt Concrete of the Specifications is amended as follows:
Section 211.02—Materials is amended by replacing (e) with the following:
Fine or coarse aggregate that tend to polish under traffic will not be permitted in any final surface exposed to traffic except as permitted within the limits of Section 211.04(a) and (b) of the Specifications and as designated by the Engineer or as permitted elsewhere in these Specifications.
Section 211.04—Asphalt Concrete Mixtures is amended by replacing (a) and (b) with the following:
Asphalt concrete mixtures shall conform to the requirements of Table II-14 and the following:
(a) Types SM-9.0A, SM-9.0D, SM-9.0E, SM-9.5A, SM-9.5D and SM-9.5E asphalt concrete shall consist of crushed stone, crushed slag, or crushed gravel and fine aggregate, slag or stone screenings or a combination thereof combined with asphalt cement. NOTE: For all surface mixes, except where otherwise noted, no more than 5 percent of all aggregate retained on the No. 4 sieve and no more than 20 percent of the total aggregate may be polish susceptible. At the discretion of the Engineer, a SM-9.5AL may be specified and polish susceptible aggregates may be used (without percentage limits).
(b) Types SM-12.5A, SM-12.5D, SM-12.5E, IM-19.0A, IM-19.0D,
and IM-19.0E asphalt concrete shall consist of crushed stone, crushed slag, or crushed gravel and fine aggregate, slag or stone screenings or a combination thereof combined with asphalt cement. NOTE: At the discretion of the Engineer, an intermediate mix may be designated as either a SM-19.0A or SM-19.0D. For SM-12.5 and SM-19.0 surface mixes, no more than 5 percent of the aggregate retained on the No. 4 sieve may be polish susceptible. All material passing the No. 4 sieve may be polish susceptible. No more than 35 percent of the total aggregate composition (polish and non-polish susceptible) shall be passing the No. 8 sieve. At the discretion of the Engineer, a SM-12.5AL may be specified and polish susceptible aggregates may be used (without percentage limits).

SECTION 108.02 LIMITATION OF OPERATIONS of the Specifications is amended to include the following: The Contractor may close a single lane on I-81 five days a week, Sunday to Thursday, between 10:00 PM and 6:00 AM the following morning. In the event that the allocated time limits are exceeded and the Contractor fails to restore all traffic for any lane a User Fee will be assessed. The User Fees for failure to restore all lanes to traffic by the designated time will be assessed at the rate of $1,400 per 15 minutes, and prorated for any portion thereof, and calculated in accordance with the following example. These fees will be deducted from the next monthly progress estimate. User Fee’s Calculation Example # 1: If Lane Closure remains in place until 7:40 AM, the resulting fee will be calculated as follows: 6:00 AM to 7:30 AM = (6 fifteen minute periods) x $1,400.00 = $8,400.00 7:30 AM to 7:40 AM = 10/15 minutes x $1,400.00 = $933.33 Total User Fee = $8,400.00 + $933.33 = $9,333.33 The Contractor may close one lane on I-81 from Sunday at 7:00 PM to Monday of the following week at 6:00 AM for 179 consecutive hours to perform full depth patching (Phase 2) operation. During this period, a full closure of the interstate will be allowed Sunday to Sunday of the following week daily, between 10:00 PM and 6:00 AM the following morning. These closures will only be allowed during one of the following weeks:
March 23 to March 31 April 6 to April 14 April 27 to May 5
During the full closure of the interstate, if the Contractor fails to restore one of the two lanes of traffic by 6:00 AM, a User Fee will be assessed. The User Fees for failure to restore at least one lane to traffic by the designated time will be assessed at the rate of $3800 per 15 minutes, and prorated for any portion thereof, and calculated in accordance with the following example. These fees will be deducted from the next monthly progress estimate. User Fee’s Calculation Example # 2: If both lane closures remain in place until 7:40 AM, the resulting fee will be calculated as follows: 6 to 7:30 AM = (6 fifteen minute periods) x $3,800.00 = $22,800.00 7:30 AM to 7:40 AM = 10/15 minutes x $3,800.00 = $2,533.33 Total User Fee = $22,800.00 + $2,533.33 = $25,333.33 In the event that the Contractor fails to restore traffic for the second lane within the 179 hours from First Sunday at 7:00 PM, a User Fee will be assessed at the rate of $1400 per 15 minutes, and prorated for any portion thereof, and calculated in accordance with Example #1. If the full depth patching (Phase 2) is completed and both lanes of traffic are restored in less than 179 consecutive hours an incentive will be awarded to the contractor in the amount of $1400 per 15 minutes, and prorated for any portion thereof, and calculated in accordance with the following example. Incentive Calculation Example: If all full depth patches are completed and both lanes of traffic are open at 11:40 PM on Saturday, the resulting incentive will be calculated as follows: Saturday 11:45 PM to Monday 6:00 AM = (120 fifteen minute periods) x $1400.00 = $168,000.00 Saturday 11:40 PM to Saturday 11:45 PM = 5/15 minutes x $1400.00 = $466.67 Total Incentive = $168,000.00 + $466.67 = $168,466.67 The maximum possible incentive is $270,000.00. If rain, snow, natural disaster or other event beyond the control of the Contractor requires work on the full depth patches to cease prior to 6:00 AM on the second Monday, the Contractor will be allowed to restore both lanes and open to traffic. Personnel, equipment, material supply, and material production are all being considered to be within the control of the Contractor. The Contractor shall then provide a work plan for completing full depth patching (Phase 2) within the remainder of the 179 hours. The lane closures can then be resumed for the remainder of the 179 hours once the Engineer reviews and approves the Contractor’s plan. No incentive will be awarded in this scenario and the user fee for not restoring one lane of traffic at 6:00 AM of $3800 per 15 minutes will still apply. Once the 179 hours are exceeded, no further full closure of the interstate will be allowed and the general user fee of $1400 per 15 minute period will apply for hours outside of Sunday to Thursday between 10:00 PM and 6:00 AM the following morning. No lane closures are allowed on I-81 beginning on Thursday April 17, 2014 through Monday April 21, 2014 (Easter Holiday). No lane closures are allowed on I-81 on the weeks of Virginia Tech and Radford University Graduations, from Wednesday May 07, 2014 to Saturday May 17, 2014. No lane closures are allowed on I-81 beginning on Thursday May 22, 2014 through Tuesday May 27, 2014 (Memorial Day Holiday). No lane closures are allowed on I-81 from the Wednesday prior to, until the Monday after Virginia Tech and Radford Student move in dates. No lane closures are allowed on I-81 on Fridays of the weekend of any Virginia Tech Home Football Game and on Thursdays of weeks that Virginia Tech plays a home football game on Thursday night, unless otherwise approved by the Engineer. For the purpose of this provision restoration of traffic shall mean placing back an asphalt surface meeting the requirements of the specifications with less than a 2” drop off in the open lane with center line and edge line pavement markings, the opening of the lane to traffic, the removal or relocation of work zone traffic control devices and signs to their approved site as determined by the Engineer, and removal of all workers, materials and equipment from the opened lane of traffic. The fees are imposed, not as a penalty, but in order to minimize the impact of lane closures and construction operations on roadway users. The fee amount is based on daily road user costs, which are defined as representing the average daily cost of interference and inconvenience to the road user. The Contractor waives any defense as to the validity of any fees stated in the Contract, the Contract Documents or these Specifications and assessed by the Department against the Contractor on the grounds that such fees are void as penalties or are not reasonably related to actual damages.
