I. EXECUTIVE SUMMARY

1. Indonesia has one of the lowest coverage rates of conventional off-site urban sewerage in Asia. Only 11 out of its 330 cities have partial sewerage systems, and only 2% of the national urban population is connected to central WWTPs; the remaining urban population depends on poorly constructed and maintained septic tanks and unlined pit latrines, which result in leachates penetrating the aquifers. The present sanitation services are inadequate and unintegrated, due to inadequate and poorly enforced regulations. The project will respond to the needs of urban communities (including low-income households) by constructing new separate sewerage systems and wastewater treatment plants (WWTPs), setting up local wastewater infrastructure management institutions, and strengthening the relevant regional government departments. 2. The project was approved on 31 March 2014 for $120 million ($80 million from the Ordinary Capital Resources and $40 million from the ASEAN Infrastructure Fund). The loan agreements were signed on 13 May 2014, declared effective on 9 July 2014, and scheduled for closing on 31 December 2020. On October 2nd, 2017, the Project Implementation Support Consultant (PISC) for the project - Loan No. 3123/-I8280 (AIF)-INO: Metropolitan Sanitation Management Investment Project was appointed by Directorate General of Housing Settlements (DGHS) to undertake tasks listed under Contract HK.02.03/MSMIP-KONS/X/11/2017. The PISC contract currently applies for the implementation support requirements for the local governments of Makassar, Pekanbaru and Jambi. 3. During the period, the revised draft bidding document for Makassar Package B1 was submitted to CPMU on 27 March 2019. The document was forwarded to ADB and ADB approved the final bidding document by the end of March 2019. The probity audit took place between 10 and 15 June 2019. The response to the results of audit were sent to PPK on 28 June 2019. Strategic issues related to the bidding process were discussed on July 15, 2019 and it was agreed to use Single-Stage: Two-Envelope bidding procedures. The responses to the audit results have been accommodated in the bidding document. The revised bidding document was sent to CPMU on 23 August 2019 and forwarded to ADB on 26 August 2019. An ADB conditional NOL was received on 26 September 2019. A softcopy of the revised bidding document was submitted to ADB on 22 October 2019. The approval of the DG and ADB was received on 29 October 2019. There is an issue regarding the manual bidding process to resolve by the client. It is expected the IFB will be issued on 16 December 2019. The current status for Makassar Package C1 and C2 is re-bidding, while B2 was signed on 14 November 2019. It had previously been agreed that any surplus funds from Pekanbaru WWTP could be reallocated to Makassar sewerage package B3/C3 but poor ground conditions at the former site had caused an increase in the project cost with little surplus available. CPMU have directed during the quarter 2019 Q4 that the package will be funded by the central government and the confirmed reference is Package C3. 4. The conditional approval of the final bidding document from ADB was received on 29 April 2019 for Pekanbaru Package B1, WWTP. The bidding document has been revised and the Probity Audit proceeded between 13 and 30 June 2019. Strategic issues related to the bidding process were discussed on 15 July 2019. It was agreed to use the single-stage: two envelope bidding procedures. Responses to audit results have been accommodated in the revised bidding document which was submitted to the PPK on 29 July 2019. A revised bidding document was sent to CPMU on 23 August 2019 and forwarded to ADB on 26 August 2019. The ADB conditional NOL was received on 26 September 2019. A softcopy of the revised bidding document was submitted to ADB on 22 October 2019. The approval of the DG and ADB was received on 29 October 2019. There is an issue regarding the manual bidding process to be resolved by the client. It is expected that the IFB will be issued on 16 December 2019. The tendering process for NC has been completed and the evaluation results have been declared as a failure. A re-evaluation has been carried out but the results were declared ineligible. The client decided to re-bid and it is expected that the IFB will be issued on 20 December 2019. 5. The final draft of the bidding document for Jambi Package B1, WWTP was sent to CPMU on 9 April 2019. This was reviewed by Satker and sent to ADB on 14 June 2019. Strategic issues related to the bidding process were discussed on 15 July 2019 and it was agreed to use single-stage: two

envelope bidding procedures. The bidding document has been revised and was submitted to CPMU on 26 July 2019 and forwarded to ITJEN for the probity audit. The entry meeting with ITJEN was held on 9 September 2019. PISC have sent initial support documents based on the Pekanbaru response to PPK Jambi in anticipation of the full audit results (LHP). Initial LHP was issued and discussed on 16 October 2019. Updated bidding document was submitted to ITJEN by PISC on 16 October 2019. The Probity audit results report was received on 05 November 2019. Responses were prepared and discussed in Jambi on 18 November 2019. The RPB process is ongoing. Parallel with the manual tender process approval request, the revised bidding document is being prepared and is expected to be issued by 04 December 2019. It is expected that the IFB will be issued on 23 December 2019. For Jambi package B2, the IFB is expected to be issued on 23 December 2019 for Jambi package B2 and Jambi package C. 6. The project is Category B for both environmental and social safeguards. There are no indigenous people that will be affected by it. Land Acquisition and Resettlement Plan1, and Initial Environmental Examination (IEE) for each of the Subprojects were submitted in 2012 and 2013. Due to the changes that had taken since then, it is imperative to update these documents during the detailed engineering phase. 7. Updated LARP for Pekanbaru was submitted to ADB on 27 December 2018. ADB provided the comments on 17 January 2019 stated that the LARP is no longer relevant since all lands for the project have been acquired and there has been no change on the project design for the alignment of the Wastewater Collection System (WCS). The latest payment for pumping station is on 10 December 2018. The supporting documents for WWTP and pumping station have been included in the previous reports. LARP formulation for Makassar was recommended by ADB on 5 October 2018 to address DED changes and impacts specifically on the access road to WWTP and Pump Station B. However, during Review Mission of ADB conducted from 9 November-11 December 2018, it was decided to formulate instead a due diligence report.2 A due diligence report was submitted to ADB on 23 January 2019 and re-submitted on 24 April 2019. After ADB review mission in May 2019, the workshop was held by inviting the local stakeholders on 12 July 2019 for discussing the temporary social impact during construction. During the workshop, ADB requested to include the temporary social impact assessment and management during constructions into the DDR. The Updated DDR was submitted to ADB on 25 July 2019 and it has been approved. During the kickoff meeting for ADB Review Mission on 2 May 2019, it was agreed that updating LARP Jambi is no longer required since all required lands have already been acquired including the access land to the pump station. 8. Full disclosure and public consultation activities on construction design and plans, including temporary impacts and mitigation measures have been conducted in Pekanbaru specifically for work packages SC1 and SC2. Public consultation was also commenced for Makassar (B2). This will be continued for other packages.

9. As there are no vulnerable households found among the APs, income restoration program formulation and implementation for APs/ vulnerable households is not anticipated in the 3 subprojects based on review and monitoring of LARP implementation. However, there is one relocated household in Jambi who need to be given assistance in the form of income restoration program. LG has not provided the assistance to AP yet.

10. Land acquisition activities have been completed for all cities. The access road to WWTP Makassar from developer (PT. GMTD, Tbk) is no longer an issue as agreed during ADB wrap up meeting on 22 November 2019. Makassar City Government owned another access road to WWTP in case developer does not provide the access road. The final verdict for WWTP land in favor of Makassar City Government was issued on 10 July 2019.

II. PROJECT IMPLEMENTATION AND SOCIAL SAFEGUARDS STATUS

1. PROJECT OVERVIEW

11. Indonesia has one of the lowest coverage rates of conventional off-site urban sewerage in Asia. Only 11 out of its 330 cities have partial sewerage systems, and only 2% of the national urban population is connected to central WWTPs; the remaining urban population depends on poorly constructed and maintained septic tanks and unlined pit latrines, which result in leachates penetrating the aquifers. The present sanitation services are inadequate and unintegrated, due to inadequate and poorly enforced regulations. This results in limited desludging of septic tanks, inadequate septage treatment facilities, and fragmented operational responsibility. Improved access to safe water and basic sanitation is part of the Government of Indonesia’s effort to achieve its 2015 Millennium Development Goal (MDG) targets. While the government’s MDG reports suggest that good progress has been achieved with respect to sanitation, in practice the available facilities are substandard, and rely on unsustainable septage removal and treatment facilities. As a result, there is significant environmental pollution, widespread contamination of surface and groundwater with the associated spread of water-related diseases, and high infant mortality. The inadequate sanitation systems and their resulting environmental and health impacts produce economic opportunity losses of about $5.6 billion annually, equivalent to 2.3% of the country’s gross domestic product. These issues can be solved by the introduction of (i) public sewerage and wastewater treatment facilities; (ii) an institutional framework for their effective operation and maintenance (O&M); and (iii) public awareness of good sanitation practices. 12. The project will support the Government of Indonesia in the improvement of urban wastewater services in the cities of Jambi, Makassar, Palembang and Pekanbaru, which currently lack any pipes sewerage and wastewater treatment facilities. The project will respond to the needs of urban communities (including low-income households) by constructing new separate sewerage systems and wastewater treatment plants (WWTPs), setting up local wastewater infrastructure management institutions, and strengthening the relevant regional government departments. 13. The project was approved on 31 March 2014 for $120 million ($80 million from the Ordinary Capital Resources and $40 million from the ASEAN Infrastructure Fund). The loan agreements were signed on 13 May 2014, declared effective on 9 July 2014, and scheduled for closing on 31 December 2020. The Government of Australia, through the Department of Foreign Affairs and Trade (DFAT) provides collaborative financing of $36.37 million grant to finance (i) the preparation of detailed engineering design (DED) for WWTPs and sewerage systems in Makassar, and (ii) the DED and capital costs for WWTP, pump station and construction supervision in Palembang. The central government provides $98.14 million equivalent to finance DED in Jambi and Pekanbaru, collection systems in Jambi, Makassar, Palembang, and Pekanbaru, awareness campaign, taxes and duties, and financial charges. The participating cities provide $55.57 million equivalent to finance land acquisition, involuntary resettlements, property connections and construction of community-based sanitation systems and in Palembang in particular, collection system in the north catchment area.

2. PROJECT PROGRESS

14. Of the six civil works packages financed under OCR/AIF, the Makassar Sewer System B2 was awarded on 14 November 2019 with the commencement of the civil works (COW) were started on 1 December 2019. The remaining civil works packages are currently being processed with the estimation of contract award dates are 6 July 2020 for Makassar WWTP B1, 6 July 2020 for Pekanbaru WWTP B1, 23 March 2020 Pekanbaru Sewer System NC, 7 July 2020 for Jambi WWTP B1, and 5 May 2020 for Jambi Sewer System B2. Following the aforementioned contract award and current procurement progress, the payment of compensation was completed in 2012 for Makassar subproject, December 2018 for Pekanbaru subproject, and December 2018 for Jambi subproject. 15. On the other hand, the progress of the civil works packages financed under State Budget (APBN) is as follows: Contract for Makassar C1 and C2 are scheduled to be awarded in January 2020 and Makassar C3 is on February 2020. Pekanbaru SC1 and SC2 was awarded on 1

November 2018 and COW is on 14 November 2018. For Jambi C, the contract is scheduled to be awarded on 13 June 2020. 16. Location of each package for three subprojects can be seen in Appendix 12. 17. The table below summarizes the status of the project:

The PISC consists of lead Consultant SMEC International Pty Ltd in joint venture with Stantec Australia Pty Ltd (ex-MWH) and in association with the following firms as subconsultants: PT. Infra Tama Yakti (ITY), PT. SMEC Denka Indonesia, PT. Amurwa International and PT. Widya Graha Asana (WGA). For Makassar B2, the contract was awarded on 14 November 2019. Progress of Work: Civil works in Packages SC1 and SC2 of Pekanbaru are on-going (SC1=28.95% and SC2=32.47% based on Consultant Weekly Report-Week Ending 6 December 2019) Status of Safeguard Approvals/Permits/Consents: Updated LARP Pekanbaru and Jambi document are not required; due diligence report and corrective action report for Makassar was re-submitted on 25 July 2019 and it has been approved.

18. This is the 4th Semi-annual Monitoring Report on Involuntary Resettlement covering the period 01 July to 31 December 2019. It is prepared by the CPMU and submitted to ADB in accordance with the safeguard monitoring and reporting requirements set out in the Project Administration Manual, Project Grant Agreement as well as the ADB Safeguard Policy Statement 2009 (SPS). The new internal monitoring format as recommended by ADB in October 2018 has been used in this report.

3. INSTITUTIONAL ARRANGEMENTS FOR INVOLUNTARY RESETTLEMENT IMPLEMENTATION AND MONITORING

19. The institutional arrangements described in the 1st semi-annual monitoring report for the period of January to June 2018 remain basically the same except for two changes – LPMU and LPIU is merged and in the provincial level there is only Satker/PPK (PPIU). 20. Acting on behalf of the City Government, LPMU will: (i) provide adequate budgetary support to carry out the updating and implementation of the LARP; (ii) provide the main workforce in the updating and implementation of the LARP; (iii) advice the Office of the Mayor or Regent to issue a Decree for the organization of LAC; (iv) engage the services of a duly licensed independent property

appraisal firm or land valuation team for the appraisal of affected properties/assets as basis for setting up the unit replacement cost for affected lands and assets; (v) assist in the expeditious and judicious resolution of complaints of APs. The LPMU will coordinate with LAC and work closely with the staff of the PPIU and CPMU; (vi) monitor implementation of LARP and submit required internal monitoring report data on a regular basis to CPMU for incorporation in the monthly/quarterly/semi-annual report; and (vii) assist CPMU in the preparation of semi-annual safeguards monitoring report for submission to ADB. The detailed task of each member of LPMU can be seen in the Mayor decree of Makassar City No. 989/050.05/2018 and Pekanbaru City No. 348/2018 as attached in the Appendix 22 - 23. PPIU tasks are to provide construction contract’s supervision and closely monitors construction progress.

4. UPDATED LARPS, INCORPORATION OF SAFEGUARDS REQUIREMENTS INTO PROJECT CONTRACTUAL ARRANGEMENTS

22. Pekanbaru. The initial LARP of Pekanbaru prepared in 2012 indicated that 5 households of the total affected households (28 AHs) will be losing more than 10% of their income as a result of the land acquisition for the WWTP site. During the updating of the LARP, the incumbent RT and RW and the former RT said that based on their knowledge, all of the affected households have more than recovered the income they anticipated to lose after using and investing the compensation they received on economic endeavors. Actual interviews with some AHs confirmed this information4. The 2013 LARP of Pekanbaru also indicated that there are no vulnerable households affected by the land acquisition for the WWTP site which was validated and confirmed during the updating of the LARP. The latest draft of the updated LARP of Pekanbaru was submitted to ADB by CPMU on 27 December 2018. ADB provided comments on 17 January 2019 stated that the LARP is no longer relevant since all lands for the project have been acquired and there was no change in the project design for the alignment of the Wastewater Collection System (WCS).

23. Makassar. With the change in the treatment process for the WWTP to MBBR, a new route for installation of the pumping main, Pumping Station B to WWTP, has to be designed. On 5 October 2015, ADB advised CPMU and PISC to prepare a LARP for Makassar that will incorporate changes in the DED with new impacts identified that have not been included in the 2013 DDR and CAP. The street vendors that will be affected by the proposed access road to Pump Station B and the potential impacts of the proposed route for the access to WWTP which will be traversing a private land were identified as the focus of the LARP.

24. On 23 January 2019, a short due diligence report focusing on addressing the street vendors was submitted to ADB. On 21 March 2019 along with other comments, ADB asked to prepare the report with the same outline (chapters) as the 2013 due diligence report with necessary modification following the current situation. Responding to that, the revised report was submitted on 24 April 2019. The report included the changes in design which omit the pump station B.

25. Pump Station B at Makassar had previously been included in Contract B1 for ease of design and the rising main therefrom had been originally foreseen to lie 1 metre beneath the bed of the Jongaya Canal. However, the Jongaya Canal Authority (BBWS) will not permit the pipeline to pass through their concrete retaining wall and instead insist that the pipe must be laid beneath the toe of the retaining wall. This had added further 8 metres depth to the pipeline which can now operate as gravity main. Accordingly, pumping station B is no longer required and has been omitted. As the result, no street vendors need to be relocated.

26. After ADB review mission in May 2019, the workshop was held by inviting the local stakeholders on 12 July 2019 for discussing the temporary social impact during construction. During the workshop, ADB requested to include the temporary social impact assessment and management during constructions into the DDR. The Updated DDR has been submitted and approved by ADB. 27. Jambi. Updating LARP is no longer relevant since all the land required for Jambi subproject has been acquired. The proof of payment and land titles can be seen in the previous report. 28. It is important to mention here that at this stage, there are no specific social safeguards staff deployed in the subprojects. Only the PR/Sanitation Marketing Specialists have been deployed in Makassar and Pekanbaru. PISC, through the PR staff, is assisting LPMU in gathering LARP implementation data based on the internal monitoring data format provided by ADB.

30. The following paragraphs give clarifications on the data above: 31. Makassar. Based on the 2013 DDR and CAP of Makassar, there are 4 AHs and 1 private institution-Gowa Makassar Tourism Development Company (PT. GMTD, Tbk) who are affected by land acquisition. During the meeting on 29 August 2018, it was agreed that the access road to the WWTP land will be provided by PT. GMTD, Tbk as it is the responsibility of developer to build public facilities. However, during ADB review mission in Makassar on 13 May 2019, it surfaced that the private institution (PT. GMTD, Tbk) has not responded to the letter sent by Public Works Agency (Dinas PU) on 6 February 2019. The said letter stated that the Director of PT. GMTD, Tbk has agreed to provide the access road to WWTP and Dinas PU requested them to provide this soon. The letter can be seen in Appendix 3. Responding to this situation, during ADB review mission in May 2019 as also stated in the Aide Memoire, ADB requested LG to provide a letter granting the access road to WWTP while the process of transferring the land is in progress. The letter was provided by LG on 17 May 2019 which is attached in Appendix 4. A coordination meeting on the access road to WWTP was conducted on 19 June 2019 wherein a meeting with LG, developer (GMTD) to led by Mayor of Makassar has to be planned and Balai was asked to send the letter to the Mayor to facilitate the meeting. The Minutes of coordination meeting is attached in Appendix 5. On 24 June 2019, Balai sent a letter to Makassar Mayor to request the Mayor to facilitate the meeting with related agencies chiefly with developer (GMTD) to ensure the border of the access to WWTP Losari. The letter is attached in Appendix 6. On 15 July 2019, PU sent a kind of similar letter with letter dated 6 February 2019 to request developer to provide the access road. The letter is shown in Appendix 3. In case developer does not provide the access road, PU informed during a meeting with ADB on 12 July 2019 that LG has another access road as a part of WWTP land. During the wrap up meeting on 22 November 2019, it was agreed that the access road to WWTP from developer is no longer an issue since the availability of another access road. The final verdict for WWTP land in favor of Makassar City Government was issued on 10 July 2019 (Appendix 11). 32. Pekanbaru. 2013 Pekanbaru LARP states: The incomes of the affected households (AHs) are higher than the City’s established poverty threshold. None of the households are reported to have any handicapped members. Based on the vulnerability criteria, none of the AHs are vulnerable and none of them belong to Indigenous peoples.” This information has been validated during consultation meetings with several APs and RT/ RW officials conducted in July 2018, October 2018 and continued in July 2019. Based on the updated data during the site visit in 2018, the compensation for five households with the loss of incomes from trees in excess of 10% of their household incomes is between 11 to 69 times the average incomes from trees. This will ensure restoration of their income and livelihood. Due diligence interviews were conducted with two of the five AHs (Nurhasanah and Nurizah). Info regarding two AHs (Pak Daud and Bu Nurhayati) was received from the Head of RW 8, Kel. Bambu Kuning, Kec. Tenayan Raya (Pak Junaidi) on 26 October 2018. H. Boestami could not be reached since he passed away. Their stories are shown in the box below. Photos and/or attendance list during the interview of these households are attached in Appendix 14.

Bu Nurhasanah (Interview was conducted on 26 October 2018) The compensation was paid in 2012. She is now the head of the household after her husband passed away. She bought a piece of land and built 3 houses which she is currently renting out (2 plot houses and 1 house). She also bought a land (20 x 30 m2) which she planted with coconut, jengkol and lastly, she used her compensation to fund her Mecca pilgrimage. She is now earning Rp 1,400,000/month from house rental and the market value of the other land she bought is estimated at Rp 100,000,000 which she bought in 2012 in the amount of Rp 10,000,000 only. Based on LARP 2013, the total income is IDR 4,800,000 and it is approximately the same in 2018. Overall, Bu Nurhasanah is very happy and grateful to the Local Government for acquiring and buying her land. Bu Nurizah (Interview was conducted in July 2018 and on 10 July 2019) Interview conducted using the due diligence questionnaire to the AP. According to the interview result, the land was used for plantation (coffee, rubber, areca nut). Other than the land acquired by the government; she has about 50,000 m2. She was informed about the purposes of taking the land (the treatment plant that will be established in the village) and consulted by land requesting agency before the land acquisition. She has also been given written information about the Project and the rights in case

she has complaint about the compensation. AP informed that she has no objection during the acquisition of land. She is satisfied with the compensation received and had no complaint concerning the compensation. Regarding the impact on household income after land acquisition, she informed that the land is not the source of her income and the trees planted is only for own consumption. After selling the land, the money received is used for buying other land (less than 1 ha) for investment purpose. Based on the interview conducted in July 2019, currently Nurizah has 4 ha which is planted with rubber. Income from the plantation is about IDR 5,000,000. Her husband income is about IDR 10,000,000. Beside that, Nurizah has rented house. Pak Daud The land acquired for WWTP was not productive land and his livelihood was not affected; Currently he has a mini shop. Bu Nurhayati She is a housewife. Her affected land was not a productive land hence, their income was not affected by land acquisition.

33. The information and documentations from the interview to several AHs and/or RT/ RW regarding the compensation payment and their recent status is presented in the Appendix 15. 34. Regarding the land for the pumping station, the payment for 1,688 m2 land was done to Yanti on 10 December 2018. The receipt of payment can be seen in the previous report (January – June 2019). Based on the interview conducted by PR Specialist, Yanti is not categorized as vulnerable and severely affected household. The land acquired by LG is not a productive land. She sells machinery as the source of income. She currently lives out of Pekanbaru City. 35. Jambi. 5.3115 ha affecting four households was acquired for WWTP and 2,111 m2 land that owned by one household was acquired for pumping station. In addition, 411 m2 land was acquired for the access road to the pumping station and this required a land acquisition and resettlement of one household. The land title (SHM) for WWTP was issued by the land agency (BPN) on 12 December 2018 and pumping station was issued on 13 December 2018. Both titles are attached in the previous reporting period (July – December 2018).

36. Due diligence interview with the relocated person (the owner of the access road to the pumping station, Mr. Achmad Sumadi) was conducted on 28 March 2019 revealed that he is now residing at his daughter’s house and does not work. He has three children who all work. He used the compensation money for buying new land and paying health bills. He also plans to open up a business from the compensation money he was paid with. Due diligence interview was also conducted with Sekretariat Daerah Pemerintah Kota Jambi (Bagian Pemerintahan). Based on the interview, negotiation was started on 22 November 2018. The AH was informed about the project and consulted for about five times.

37. There was no LARP prepared for Makassar. Instead, there was a Due Diligence Report and Corrective Action Plan approved by ADB in 2013 which did not cover budget for land acquisition and resettlement. The cumulative funds disbursement was based on the receipts of payment delivered to four affected households in 2011 and 2012. Receipt of payment can be seen in the appendix of 1st semi-annual monitoring report on involuntary resettlement monitoring report (January-June 2018). 38. LARP budget for Pekanbaru city can be seen in the approved June 2013 LARP. The cumulative funds disbursement was calculated from the compensation delivered to 27 affected households for WWTP land and 1 household for the pumping station land. Para 59 of LARP Pekanbaru June 2013 states: “As summarized in Table 6.1, the overall cost of updating and implementing the LARP was estimated at Rp 23.029 billion ($ 2.303 million) for inclusion in the Project investment. The DGHS and/or the City Government of Pekanbaru will ensure the timely provision of funds and will meet any unforeseen obligations in excess of the resettlement budget in order to meet the social safeguards objectives of the Project.”

39. The cumulative funds disbursement for WWTP land of Jambi can be seen in the appendix of 1st semi-annual social safeguards and involuntary resettlement monitoring report (January-June 2018). In addition to this is the compensation delivered to AHs who owned the pumping station land and the access to the pumping station shown in the monitoring report for the period of January to June 2019.

1.1. Issues Affecting Timely Land Handover

40. Due to dispute land process of Makassar WWTP land, the certificate has not been issued by the Land Agency. The final verdict for Makassar WWTP land was finally issued on 10 July 2019 in favor of Makassar Local Government. The issuance of land title is in the process and expected to be issued before WWTP B1 Contract is signed.

3. INCOME RESTORATION PROGRAM

3.1. Status of Income Restoration Program (for each subproject)

42. There are no eligible APs in Makassar and Pekanbaru. The eligible AP in Jambi has been compensated fully for his land and house. However, there is no income restoration program yet for him and his household by LG. PISC informed LG to provide assistance in the form of income restoration program to the relocated household. However, LG insisted that the program cannot be

provided due to the AH is not poor. PISC will conduct the site visit to persuade LG to comply with ADB safeguards policy.

3.2. Consultation with Eligible APs

43. Due diligence interview was conducted with the eligible AP by PISC in March 2019 together with PU Staff. He is now residing at his daughter’s house and does not work. He plans to open up a business from the compensation money he was paid with.

4. DISCLOSURE, CONSULTATION & PARTICIPATION

45. Pekanbaru - Information dissemination and consultation are continuously conducted in SC1 and SC2 (Pekanbaru) per segment before the construction works started. The list of consultations can be seen in Table 11. Information is also posted in Kampung Melayu Urban Village Office (Photos can be seen in Appendix 8) and disclosed in social media such as Facebook and Instagram. During the socialization, LG and Contractors have informed mitigations on social issues during construction. Compensation will be given to the affected persons due to construction activities. Contractor will provide the access to community’s house during construction. If there is complaint, community can submit it to the Contractor, LG, Consultant, etc. 46. Jambi - PU of Jambi City as the responsible agency of the activity in Jambi has disseminated information to the community to provide adequate information about the project. Community also contributed to environmental impact assessment (Amdal) process and submitted suggestions,

opinions and responses (saran, pendapat dan tanggapan/ SPT). An announcement was made in Jambi Independent Media for 10 days from 15 June to 26 June 2019 and socialization was carried out through public consultations on 4 July 2019 at the Hall of PUPR Office of Jambi City.

47. Makassar – Socialization and contract signing for B2 package was conducted on 14 November 2019. The meeting was attended by Mayor of Makassar, Head of Mamajang and Mariso Subdistrict, etc. The attendance list can be seen in the Appendix 7. During socialization, two brochures were distributed namely WWTP Losari profile consists of introduction (background, purpose, target); general description (scope of activity, detail of works, location, scope and area of service, technology used, source of fund, activity schedule, scheme of activity; attachments (sample of pipe installation using open trench, jacking, boring and MBBR technology) and construction of sewerage and wastewater collection system North West Catchment (Makassar Sewerage B2).

5.1. Narrative Summary of Grievances

49. Makassar. On 28 March 2016, a local resident claimed that about 2.3 hectares of the WWTP acquired land is his and he filed a case in the court which has been trialed twice and the court decided in favor of the local Government (16 May and 13 December 2017). The District Court (Pengadilan Negeri) and the High Court (Pengadilan Tinggi) decision can be seen in Appendix 9 and Appendix 10. He appealed his case at the Supreme Court and the final verdict was issued on 10 July 2019 in favor of Makassar Local Government (See Appendix 11). During this reporting period, no grievances recorded in Makassar Subproject.

50. Pekanbaru. The grievance cases are recorded well in Pekanbaru. Complaints can be delivered through the call center, stakeholder, LG or through social media such as Facebook. There were seven grievance cases recorded during period of January to June 2019. All grievances have been addressed. A complaint in Jl. KH. Ahmad Dahlan was received due to the owner’s place is cracked. Checking and repairing was done by Contractor in May 2019. The complainant from Kelurahan Rejosari asked not to close the road (Jalan Bunga Harum) simultaneously, so that it will not disturb the community’s economy. The grievance received through call center and has been addressed as requested. Another grievance was informed by Stakeholder related to a complaint from the owner of the house in Jalan Bunga Kertas. The owner had a complaint due to the manhole position were located in front of her gate and near to her well. The complaint was forwarded to the technical team of PISC and SC2. After checking the location, a meeting was held among the technical team and it was decided to move the manhole position. The detail can be seen in Appendix 19. During this reporting period, there are 21 grievances. 20 cases have been solved and one case is still pending (Appendix 13).

6. OTHER ISSUES

6.1. Resolution of Issues

51. The land acquisition and compensation issues reported in the first semi-annual monitoring report have been addressed as discussed in previous sections of this report. Progress report on the issues related to resettlement and income restoration aspects specifically for Jambi will be made in the next semi-annual report.

6.2. New Issues

52. There are no issues encountered during this period.

6.3. Institutional Matters and Capacity Training

53. The developments on institutional matters and training for this period for Makassar, Pekanbaru and Jambi are as follows:

(i) Deployment of safeguards-related staff within PMUs. Key activities conducted by PMU safeguards staff during reporting period. The head of CPMU appointed 2 of her staff in July 2019 to be the counterpart of PISC on Environment and Social Safeguards aspects

(ii) Capacity development training provided: type and number of trainings, number of staff/officers trained (disaggregated by gender).

(iii) Activities of community based organizations (CBOs)/ mass organizations (as applicable) Not applicable

(iv) Adequacy of resources for PMU staff and consultants.

PISC’s National Environmental cum Social Safeguards Specialist has been replaced in March and November 2019. However, there has been no specific Social Safeguards Staff at City level hired yet. Specifically, for Jambi, even the Public Relations and Sanitation Market Specialist is not deployed yet along with the technical team. This is hampering timely conduct of information disclosure and consultation meetings on construction implementation and temporary impacts.

(v) Issues in undertaking roles/ responsibilities of different agencies.

Functionality of LPIU as a unit has not been fully achieved in Makassar, Pekanbaru and Jambi.

6.4. Temporary Impacts during Civil Works

54. Makassar. Excavation works to install sewerage pipes along some streets that are narrow will hamper entry to and from residential homes and shops/ markets, parking, loading and unloading and also traffic movement. Beside temporary impact in Market Senggol that was mentioned in the 3rd semi-annual monitoring report (Photo of Senggol Markert is in Appendix 17), inventory of the potential impacts is still on-going. PISC will conduct a site visit in January 2020 to brief the Contractor on social and environmental temporary impact during construction. Contractor will be asked to prepare a more detailed inventory of the temporary impacts and will be reported in the next report. 55. Pekanbaru. As mentioned in the 2nd semi-annual report, the sewerage pipeline construction activities will be carried out along the 109 streets and road medians. The activities will not displace households or people nor will they have any permanent adverse socioeconomic impacts on the residences, shops and other commercial establishments along the project roads. However, small roads and narrow streets, particularly with clear road width of about 6.0 m and below may face some problem of traffic movement at the time of civil works. In Pekanbaru of the 103 roads/streets covered under the WCS component, only three roads: Jl. Sumber Sari, Jl. Kampar, and Jl. Tanjung - Jl. Setia Budi have clear road width of less than 6m. During the construction phase the access to houses, shops, and other commercial establishments may be temporarily affected. However, there is not likely to be any loss of incomes to the road-side commercial establishments as temporary access to road-side businesses will be provided by the contractor. All the other roads are much wider, more than 6m ROW. PISC team conducted ocular survey of 3 streets (Jl. Sumber Sari, Jl. Tanjung Datuk and Jl. Sudirman) during its visit in 26 October 2018. There are 969 different structures/ buildings along the pipe alignment in these streets and 66% are commercial stores/ shops while about 13% are residential buildings/houses.9 Details of the ocular survey conducted in the 3 streets are shown in the Appendix 18. 56. During this reporting period, no shops affected by construction activity. Trench and bridge for access to the house in SC1 are cracked and Contractor has restored it to the original condition. More actions taken by Contractors can be seen in the Appendix 13. 57. During ADB review mission in November 2019, PISC found some temporary impacts in Jalan Belibis, Jalan Ketitiran, Jalan Kuau and Jalan Cut Nyak Dien. The findings can be seen below. PISC will conduct a site visit to Pekanbaru in January 2020 to check these findings and brief the Contractor on social temporary impact during construction. A more detailed inventory of the temporary impacts with the corresponding mitigation measures and compensation/ assistance will be reported in the next report.

58. Jambi. Similar to Makassar and Pekanbaru, entry to and from residential and commercial establishments will be hampered along the roads where excavation works will be done during construction. However, this will not result to loss of income to the commercial establishments as temporary access can be provided by the contractor. Like in the case of Makassar, a market (Pasar Angso Duo) will be temporarily impacted during construction but no major negative impact

is expected. Construction work schedules need to be consulted with the vendors prior to start of excavation works.

IV. CONCLUSION

59. Land acquisition activities in Makassar, Pekanbaru and Jambi have been completed. Land certificate for WWTP land in Makassar is in process in BPN. It is expected to be issued before July 2020. Written agreement for the access road from GMTD is expected to be received in May 2020. Land certificate for WWTP and pumping station land in Pekanbaru is expected to be issued in April 2020. A relocated household in Jambi will be provided assistance in the form of income restoration program in July 2020. 60. Full disclosure and public consultation activities on construction design/ plans including temporary impacts and mitigation measures have been conducted in Pekanbaru specifically for work package SC1 and SC2. Public consultation was also commenced for Makassar (B2). It is anticipated that more intensive consultation and disclosure will follow prior to start of civil works in the three cities. 61. Actual physical displacement or actual resettlement impacts are not anticipated in Makassar, Pekanbaru. In Jambi, one AP has lost both land and house for the access to the transfer pump station and has to relocate. The local government compensated fully the cost of land and house but has not provided additional assistance as per compensation and entitlement designed for this subproject that is incorporated in the LARP e.g. moving and transitional allowance and income restoration program.

62. It is anticipated that other land acquisition and resettlement activities consistent with the LARPs including due diligence reports and corrective action reports will be concluded prior to the commencement of construction activities in the three sub-projects.

PPK has requested assistance from PISC Jakarta to revise

the UKL UPL pipeline which is planned to be completed in

December 2019. While the UKL UPL IPAL is in the process

and planned to be completed in January 2020.

The UPTD had previously existed, the current problem for

its inauguration was hampered by other inaugurations, it

would likely be done at once and the structure changed.

The number of communal WWTPs in Pekanbaru is 58.

The health office submitted a complaint related to dust on

Jalan Dahlia (Jalan Dahlia had not been watered after the

work was done) so that people complained of respiratory

problems. In addition, there are some workers who do not

use PPE. This needs to be monitored more optimally.

Response: Contractor HK Rosa SC2 explained that there are

still some roads that are watering for 1 (one) day late, but

they have prepared water trucks and water torren. The

contractor said it would tighten the watering and PPE

issues.

The PUPR Office said that there is still a distance between

the asphalt road and the concrete slab on Jalan Dahlia,

which is quite dangerous. The contractor has an obligation

to restore the condition of the road to normal.

Response:

- WIKA (SC1) = Restoration of road conditions until

asphalting will be carried out. The location that has

been restored to its original condition is Jalan

Ketitiran.

- HK (SC2) = The road will be returned to its original

condition (Asphalt road will be returned to the

asphalt. If sandy it will be returned also as before).

Now it has entered the asphalting and manhole

stages. The process is rather slow because there is a

problem that the PDAM pipes are fragile and easily

broken so they must be repeated again.

The local government has requested a letter from CPMU to

show the mayor the urgency of establishing the UPTD.

Summary:

APBD for connection in 2022-2025 is expected according to

plan and target.

Summary

ADB Social Safeguard recalls that related to land access from

the developer that has been there for 1 year, there needs to

be a follow up; Regarding land access from the developer, it

will be processed by Bappeda within 2 weeks;

ADB Environmental Safeguard said that construction can

only begin if an environmental permit has been obtained, so

before the physical construction begins, it is expected that

an environmental permit from DLH has been obtained;

At the end of November, the AMDAL review is targeted to

be completed with assistance from the Hassanudin

University Team;

Regarding Losari IPAL certificate, all certificates required for

land acquisition have been submitted by Bappeda for a long

time to MPW and have been delivered to the assets section,

but its development needs to be checked now;

Institutionally related, the plan in the Master Plan for this

system will be managed through UPT PAL which was formed

in 2011 and the main function of this UPT PAL is to desludge

and manage IPLT, as well as socialization to the community.

Relevant parties have regulations to support UPT PAL, and

guardians to support, currently in the process of drafting

legislation related to public retribution, and will also be

applied to the MSMIP WWTP as well;

Pak Evry proposed that the implementation of the UPTD will

begin in late 2020, it is better for the existing team (UPT PAL)

to be activated first. Because, if it has been formed later only

participate in training, etc. When the operation will start,

then it will be determined to fill an empty position;

The jurisdiction of the Sector Police that will be the most

traveled by the pipeline are the following 6 (six) districts:

finished, 16000 m3 / day can be processed in 2027, in 2022

there are 1050 SR, 2023 there are 2625 SR, 2024 there are

and 2027 there are 14000 SR.

ADB requests info on WWTP B1 packages. The document has

been discussed together and currently waiting for the

submission of the latest version. In parallel, the director

general's approval is in the process to start advertising or

For Package B1, the ICB auction will be done manually, as

2.0 Progres and Issues from each city

2.1 JAMBI

Kadis PU Jambi said that:

• Maturation of the land is already going

around 70%

• For residents who have businesses and

are affected by the project, if necessary

they can be given the MSME program,

training / coaching

• For business replacement, the Jambi

regional government is willing to help

find a new trading location

• Reimbursement of income cannot be

done in the form of cash but in the form

of training, and others.

• The Jambi local government has a public

complaints service application that can

be accessed publicly under the name

SiKesal which will be responded to

within 24 hours by the relevant

agencies.

• Management of Temporary Impact

During Construction: Based on the

mechanism for other projects before

this, usually if there is a complaint or the

need for replacement, the contractor

gives a choice whether in the form of

replacement of goods (for example if the

fence is exposed, the fence will be

repaired) or the form of compensation

so that affected can do the replacement

alone

PISC Social and Environmental Coordinator

said that:

• During a field visit in March, the house

2.2 MAKASSAR

Makassar Public Works Agency said that:

• The 2.3 hectares of Makassar WWTP

received a community lawsuit, but the

results of the Supreme Court's hearing

stated that the land dispute case was

won by the Makassar Local Government.

Currently awaiting a letter regarding the

Supreme Court's decision to own the

IPAL Makassar land.

• The Prosecutors' Office requested 40%

of the developer land for public

facilities/social facilities, and is currently

being processed by the local

government for road access to the

WWTP. Makassar Local Government has

requested GMTD by mail but has not yet

received a response. The current status

is still waiting for a response from PT

GMTD regarding the access road.

• If GMTD does not provide access to the

road, the LG has another access to the

east. A budget of 3.5 billion has been

allocated.

• Regarding wastewater piping network,

there is no problem

• Makassar City Government is

cooperating with the police and

prosecutors for outreach when the

construction process will begin

• In Makassar there are regulations

relating to compensation for tree felling

(the logging process is coordinated with

• Makassar proposes that the contractor

should survey together with MPW

before carrying out excavations related

to excavation volumes, sections of roads

to be affected by excavations, and

others.

• For handling temporary impacts, it is

hoped that the Damija team will work

closely with the consultant team

2.4 MSMHP MEDAN

• For pumping stations, replacements to

the plants that have been affected there

have been carried out by contractors

and residents voluntarily helping to clear

the land;

• The replacement of the use of residents'

houses for the access road for

contractors has been completed in June

2019;

• Routine socialization has been carried

out during construction;

• Stalls at the pumping house location

have received compensation and have

gotten a new location for trading;

• The Medan City Government has

established a mechanism for complaints

against the public, namely the telephone

line or call center of the contractor;

• There are no potential social safeguards

problems in Medan.

• ADB requests that the CAP document

identify the temporary impact during

construction project (in the DDR / CAP

document currently under revision)

• The Ressetlement Framework and Plans

were approved in 2009

WWTP in each city; organic waste water load (0.303

tons/day) and the requirement of the project that must

have Amdal based on Permen LH No. 5 Tahun 2012 (area

is ≥ 3 ha; organic waste load ≥ 2,4 ton/hari).

CPMU is requested to submit the environmental

documents:

- Revised Pekanbaru IEE

- Semi-annual environmental safeguard

monitoring report (Jan-June 2019)

Comments received in September 2019 stated

that all revisions are accepted. However, ADB

Social Safeguards

During the meeting, Social Safeguards Officer requested

some activities to be taken as stated below:

• Leaflet/ Project Information Booklet to the

community has to be given in Makassar and

Jambi (2 months prior to construction). For

Pekanbaru, record of the distribution of leaflet is

needed.

• Submit temporary impact during construction

which has been checked by Contractor and

Engineers in the field for all cities by 4 November

2019.

• Notes regarding the status of External

Monitoring Agency in Pekanbaru have to be

included in the monitoring report. External

monitoring agency has to be mobilized in the

project.

• ADB has additional input to DDR Makassar

submitted in July 2019. If CPMU agreed with the

input, ADB will submit the NOL for the report.

The input will be sent by ADB to CPMU.

• Deputy Team Leader of MSMIP informed the

status of access road to WWTP that the

developer has given the access informally.

Setting out of the area is being conducted among

PU and developer. The formal letter from the

developer will be given together will other fasum

(public facilities). Responding to this, ADB

requested the developer to release the letter

safeguards.

• Income Restoration Program to one relocated

household in Jambi has to be given during this

The meeting was opened by Mr. Evry Biaktama as the Head of

CPMU, before then entering into the discussion.

IFB for the Makassar and Pekanbaru WWTP B1 Package is

better separated and only uses a few points to reduce costs,

CPMU will give an example from a previous project.

Regarding Bidding Document, CPMU asks to delete

substantially completely because of its focus on the functioning

or performance of the output.

Regarding subcon, landscape is omitted and SCADA is still

written because it refers to ADB guidelines so that without SBU,

SCADA can also be used.

Regarding bidders, CPMU asks PISC to make an exercise against

OPEX and CAPEX calculation to get the most optimum figure as

the award winning in financial proposal.

AMDAL Study for the Pekanbaru B1 package has not yet been

done, currently there are only UKL-UPL for SC-1 and SC-2, and

are in the process of permitting NC network package

environment licenses. Will be discussed during the Review

ADB's Gender Specialist Request for procurement of social

safeguard training was conducted by PU in Bali in the early

week of November.

Regarding ADB's Social Safeguard Specialist request to provide

compensation for homeowners in Jambi who must settled,

CPMU will confirm to ADB that the compensation has been

carried out without problems and there is no need for further

action.

PISC informed that a relocated household in Jambi must be

provided with livelihood restoration program that are available

in Jambi Local Government.

PISC informed that the project is categorized as B, however

there is a request from ADB for External Monitoring Agency

(EMA) in Pekanabru. CPMU cannot mobilize EMA.

PISC requests land’s certificates for BPN for Makassar and Pekanbaru.

Regarding website development, CPMU has received 3

quotations from the proposed subcon and 1 CV & Company

Profile.

For Subcon selection, PISC is asked to evaluate and an

evaluation sheet is submitted to CPMU for approval. The

but it turns out that the recommendations issued

were missed than discussed. End of withdrawal limit

before 6 December 2019.

ADB asks PISC to examine the number of House

Connections (HC) and up to what year, because

there is a minimum debit limit for processing.

For NC contracts, a delivery letter is needed because

it is still substantially completed, so ADB sees that

the NC has received a positive response and changes

to the Working Group are also approved by ADB.

Related to Pusdatin storage restrictions: when

bidders are interested, when registering bidders

must provide a valid email address. CPMU proposes

to invite all P2JK Balai to discuss strategies / systems

If the loan extension is approved later the PAM is

renewed, the change in the Procurement Plan

changes the contract value per package.

Please make a realistic schedule by PISC for WWTP
