The Committee noted the recent G.O. issued by EFS&T Dept. Govt of A.P. –

G.O.Rt.No.3, dated 04.01.2016. The Committee recommended for collecting the

processing charges from the Project proponents applied /applying online for EC from

4th

January 2016 onwards only.


The Processing charges collected from the Project Proponents shall be deposited in

the “ANDHRA BANK, A.P.Sectariat Branch, Hyderabad” and to be reconciled every

month.

Financial approval: upto Rs.25,000/- by the MS, SEAC; for > Rs.25,000/- to

Rs.1,00,000/- by the MS, SEIAA and for more than Rs.1,00,000/- by Chairman,

SEIAA, with signature in CHEQUEs by MS,SEAC only upto Rs.25,000/- and by

MS,SEAC & MS,SEIAA for more than Rs.25,000/-.

MoEF&CC,GOI, New Delhi Notifications on DEIAA and DEAC


The Committee discussed the recent notifications issued by the MoEF&CC

No.S.O.141 (E), dated 15.01.2016 and S.O.190 (E), dated 20.01.2016. The Committee

recommended to process the applications applied for EC ( mining projects < 5 ha)

received as on 15.01.2016 by SEAC.A.P. Further applications received /filed online

will be processed until formation of DEIAA and DEAC and applications received

after formation of DEIAA and DEAC shall be forwarded to the concerned DEIAA for

further processing.

Decision of SEIAA: The MoEF&CC , GOI, New Delhi on 15th January

2016(S.O.141(E)) issued amendments in the EIA Notification 2006 with formation of

District Environment Impact Assessment Authority (DEIAA) with District Level

Expert Appraisal Committee (DEAC) for processing the EC Proposal of (i) Sand

Mining and other Minor Mineral Mining on the basis of individual mine lease less

than 5 hectares(ha) and EC Proposal of Sand Mining and other Minor Mineral Mining

in cluster situation - (ii) Cluster area of mine leases up to 5 ha and (iii) Cluster area of

Mine leases > 5 ha and < 25 ha with no individual lease > 5 ha., under Category ‘B2’.

Also constituted the DEIAA and DEAC on 20th January 2016 (S.O.No.190 (E)).

In view of the above, the EC Proposals of Sand Mining and other Minor Mineral Mining

on the basis of individual mine lease less than 5 hectares(ha), received by SEIAA,A.P

on or after 20th January 2016, shall be forwarded to the concerned District

Collectors(i.e., DEIAAs) of the Andhra Pradesh for further processing.

Mining Atlas

a. The issue was examined by the SEAC in its meeting held on 23.01.2016.

In view of the latest MoEF&CC, Govt of India Notification S.O. No. 141 (E), dated

15th

January 2016 , the SEAC, A.P, in its meeting held on 22nd

January 2016 resolved

to request the following from the Director , Mines & Geology , A.P :

1. To prepare and submit the mining Atlas (i.e. village maps marked with all

existing mine leases and already issued mine leases/ cadastral maps ) to

identify the cluster formation.

2. While issuing lease to a new mine / expansion of mine , the applicability of

cluster mining as per S.O. No.141 (E), dated 15th

January 2016 shall be

specifically mentioned in the mine lease issued by the Dept. of Mines &

Geology., A.P.

The above procedure will help the entrepreneur to understand the regulatory

requirements related to cluster mining in the initial stage itself enabling him to plan

whether the mine project is required to prepare cluster EIA/EMP.

Decision of SEIAA: Agreed with the recommendations of theSEAC. Further address

a letter to the Director of Mines, Mines & Geology Dept, A.P. to prepare EIA and

EMP for mines clusters by Mining Dept or any relevant state government agency to

facilitate speedy processing EC applications in the clusters.

b. Violation Cases:

The Authority discussed the issues pertaining to the violation cases. In the earlier

SEIAA meetings, the Authority has rejected the EC proposals for those projects

which are operating without EC. The Authority decided to refer these earlier Rejected

cases to the Government of A.P for taking the credible action against them and report

to SEIAA for further processing.

District - Environmental Clearance – EIA Report along with Public Hearing

Minutes Submitted – SEIAA refer back to SEAC - Reg.

Recommendations of the SEAC on 28.11.2015: The item was examined by the

SEAC in its meeting held on 28.11.2015. The representative of the proponent

attended the meeting.The Committee noted that the TOR is valid for 4 years as

per the latest act from MOEF. The Committee recommended to issue of EC by

stipulating condition that the Project Proponent shall not use explosives in the

mining operations as the mine is nearer to the village, <0.5 km.

The issue was examined by the SEIAA in its meeting held on 03.12.2015. The

Authority decided to get clarification from MOEF&CC. In this meeting the

Authority again discussed this item.

Decision of SEIAA: After detailed discussion , the Authority agreed with the

recommendations of SEAC and decided to issue of EC by stipulating condition that

the Project Proponent shall not use explosives in the mining operations as the mine is

nearer to the village.i.e., <0.5 km.

applicable only in the case of mining area of more than 25 Ha. The Authority

decided to issue EC as total mining area is less than 25 Ha.

conditions.
