These documents are elaboratedby the Commission servicesbased upon the results from the

sectors working group on theapplication of the directive.The aim of this guidance will be toclarify certain matters andprocedures referred to in directive87/404/EEC on the harmonisationof the laws of Member States.

Guidance documents will beproduced over a period of time inresponse to the need forclarification of specific items, thewill cover items of generalinterpretation including technicalissues.

The guide has an informal statusand its loose-leaf format permitsthe introduction, updating orwithdrawal of individualdocuments when appropriate.

The guidance contained in thisdocument is not mandatory.

Although it sets out thatinformation on matters relating tothe directive it is for guidanceonly, aimed at helping you,whether you are a manufacturer,notified body or other interestedparties, meet your obligations.You may, if you wish, takealternative effective steps to meetthe requirements of the directive.

Directive 87/404/EEC of 25 June 1987 on the harmonization of the laws of the Member States relating to simple pressure vessels.

Article 1: Field of application

Permanent or removable fittings

a) Problem

Do vessels with permanent or removable fittings fall within the scope of Directive 87/404/EEC?

b) Proposed solution

1) Vessels with permanent or removable fittings fall within the scope of the Directive in as far as the fittings

- do not cause additional stresses nor corrosion problems impairing the safety of the vessels and

- do not render the inspection of the inside impossible.

2) When the volume is calculated for the purpose of determining the risk potential, the volume taken up

- by the permanent fittings may be subtracted from the volume of the vessel;

- by the removable fittings may not be subtracted from the volume of the vessel.

c) Reasons

b1) No fundamental restrictions are placed on fittings by the Directive's requirements.

b2) Permanent fittings are incompressible and therefore lessen the risk potential by reducing the volume. Withremovable fittings there is no guarantee that the vessel will be always operated using these fittings.

- ces accessoires ne causent pas des contraintes supplmentaires, ni des problmes de corrosion pouvantcompromettre la scurit et

- n empchent pas linspection lintrieur.

2) Pour la dtermination du volume en vue d'valuer le potentiel de risque, le volume

- des accessoires fixs de faon permanente peut tre soustrait du volume du rcipient;

- des accessoires dmontables ne peuvent pas tre soustraits du volume du rcipient.

c) Motif

b1) La directive ne prvoit aucune restriction de principe en ce qui concerne les accessoires;

b2) Les accessoires fixs de faon permanente tant incompressibles, la rduction du volume qu'ils motivent diminued'autant le potentiel de risque. Pour les accessoires dmontables il ny a pas de garantie que les rcipientscomporteront toujours ces accessoires au moment de leur utilisation.

Artikel 1: Anwendungsbereich

Feste oder herausnehmbare Einbauten

a) Problemstellung

Fallen Behlter mit festen oder herausnehmbaren Einbauten unter den Anwendungsbereich der Richtlinie87/404/EWG?

b) Lsungsvorschlag

1) Behlter mit festen oder herausnehmbaren Einbauten fallen unter den Anwendungsbereich der Richtlinie, soferndie Einbauten

- weder Zusatzspannungen noch Korrosionsphnomene verursachen die der Betriebssicherheit schaden knnenund

- die Kontrolle der Innenwnde nicht verunmglichen.

2) Bei der Ermittlung des Volumens zur Bestimmung des Gefahrenpotentials darf das Volumen

- der festen Einbauten vom Behltervolumen abgezogen werden;

- der herausnehmbaren Einbauten nicht vom Behltervolumen abgezogen werden.c) Begrndung

b1) Die Richtlinie kennt keine grundstzlichen Einschrnkungen von Einbauten;

b2) Feste Einbauten sind inkompressibel und vermindern damit das Gefahrenpotential durch Reduzierung desVolumens. Bei herausnehmbaren Einbauten ist nicht gewhrleistet, dass der Behlter immer mit diesen Einbautenbetrieben wird.

Fillers

a) Problem

Do vessels containing fillers intended for the treatment of air or nitrogen fall within the scope (Article 1) of Directive87/404/EEC?


1) If the vessels are intended to contain air or nitrogen and the fillers in the vessels

a) serve to treat air or nitrogen,

b) do not attack the vessel wall and

c) guarantee safe operation in conjunction with the transport medium,

the vessels containing these fillers can be treated as simple pressure vessels.

2) When the volume is calculated for the purpose of determining the risk potential, the volume taken up by the fillersmay not be subtracted from the volume of the vessel.

c) Reasons

b1) No fundamental restrictions are placed on fillers provided all of the Directive's requirements are satisfied.

b2) It is not always possible to assume that these vessels will be used only with the planned volume of filler(s).

1) Si les rcipients sont destins contenir de l'air ou de l'azote et que les matires de remplissage des rcipients

a) servent au traitement de l'air ou de l'azote

b) n'attaquent pas les parois de rcipients

c) ne compromettent pas la scurit en combinaison avec le produit de chargement

ces rcipients contenant des additifs peuvent tre traits comme des rcipients pression simples.

2) Le volume de matires de remplissage ne peut tre soustrait du volume du rcipient lors de la dtermination duvolume en vue d'valuer le potentiel de risque.

c) Motif

Ad b1) La directive ne prvoit aucune restriction de principe en ce qui concerne les matires de remplissage, dans lamesure o toutes ses exigences sont respectes.

Ad b2) On ne peut pas toujours partir du principe que ces rcipients ne seront utiliss qu'avec les matires de remplissageprvues.

Fllstoffe

a) Problemstellung

Fallen Behlter mit Stoffen zur Behandlung der Luft oder des Stickstoffes unter den Anwendungsbereich (Artikel 1) derRichtlinie 87/404/EWG?

b) Lsungsvorschlag

1) Sofern die Behlter zur Aufnahme von Luft oder Stickstoff bestimmt sind und die Fllstoffe in den Behltern

a) zur Behandlung von Luft oder Stickstoff dienen

b) die Behlterwand nicht angreifen und

c) im Zusammenhang mit dem Beschickungsmedium einen sicheren Betrieb gewhrleisten

knnen diese Behlter mit diesen Fllstoffen als einfache Druckbehlter behandelt werden.

2) Bei der Ermittlung des Volumens zur Bestimmung des Gefahrenpotentials darf das Volumen von Fllstoffen vomBehltervolumen nicht abgezogen werden.

c) Begrndung

Zu b1) Die Richtlinie kennt keine grundstzlichen Einschrnkungen von Fllstoffen, sofern alle Anforderungen derRichtlinie eingehalten werden.

Zu b2) Ein Einsatz dieser Behlter nur mit den vorgesehenen Fllstoffvolumina kann nicht immer vorausgesetzt werden.

Article 11: EC verification

Maximum working pressure

a) Problem

Article 11(3) of the Directive requires a pneumatic test at a pressure P hequal to 1.5 times the

design pressure. EN 286-1 (ratified 1991, title published in O.J. C 104, 24.04.92, p. 4)requires a pneumatic test at a pressure Phequal to 1.5 times the maximum working pressure.

Does the pneumatic test in accordance with EN 286-1 (1991) satisfy the requirements of the

Directive?


The pneumatic test in accordance with EN 286-1 (1991) at a pressure equal to 1.5 times themaximum working pressure satisfies the Directive which requires a pneumatic test at a

pressure equal to 1.5 times the design pressure.

c) Reasons

EN 286-1 permits vessels to be designed with two different design pressures P:

1) Cylindrical shell ring: P = 1.0 PS or P = 1.25 PS

2) Ends: P = 1.0 PS

So as not to exceed the yield strength during the pneumatic test, it is necessary to take P = 1.0PS for the ends into account. This results in Ph= 1.5 PS = 1.5 P.

Note: The proposed revised version of EN 286.1 will correct this anomaly.

a) Problem

A quality assurance system implementing all aspects of Article 13 which complies with EN29 002, fulfils the requirements of Article 13. However additional checking and inspection isrequired, by Article 14, for vessels where PSV is greater than 200 bar.litres.

c) Reasons

When an EN 29002 procedure is drafted to take account of all the elements of Article 13 thenit satisfies Article 13; this includes the Article 13(1)(c) requirement for a hydrostatic or

pneumatic test of each vessel.

In addition for vessels where PSV is greater than 200 bar.litres Article 14.2 requires that thenotified body during manufacture

- ensures that the manufacturer actually checks series-produced vessels in accordance withArticle 13(1)(c),

- takes random samples at the places of manufacture or at the place of storage of vessels forinspection purposes.

Trgt ein EN-29002-Verfahren allen Aspekten von Artikel 13 Rechnung, so gengtes den Vorschriften von Artikel 13; dies gilt auch fr Artikel 13 Absatz 1 Buchstabec), in dem fr jeden Behlter eine Wasser- oder Luftdruckprfung gefordert wird.

Articles 15-16: CE marking

Identification (before/after hydro static/pneumatic test)

a) Problem

Is it permitted to affix the proof of conformity with Directive 87/404/EEC prior to the hydrostatic or pneumatic test on thevessel?


The moment at which the proof of conformity is affixed is left to the manufacturer under his own responsibility (Articles 12-14)provided that he is entitled to affix a CE marking to the manufactured product on the basis of his design approval either by acertificate of adequacy under Article 8 or a type-examination certificate under Article 10. It must be ensured that non-conforming products are not placed on the market.

c) Reasons

The moment at which the proof of conformity is affixed during the vessel manufacturing process does not release themanufacturer from his responsibility not to place on the market a vessel which fails to satisfy the Directive's requirements (asproved, for example, by the hydrostatic test).

Concerning the moment of affixing the CE marking the Directive specifies nothing. Risks are ruled out by virtue of theprocedure itself. There is a Council Decision on conformity assessment and CE marking (93/465/EEC of 22 July 1993, O.J. L

220, 30.08.93, p. 23). In this Council Decision there is a difference between the English and French versions relating to themoment of affixing the CE marking. This difference has been brought to the attention of the Commission services for reviewand amendment as necessary.

The above guidance conforms to the French language version which permits the affixing of the CE marking during theproduction control phase. The English version is more restrictive; it requires the affixing of the CE marking at the end of theproduction control phase.

Il faut absolument viter que des produits non conformes soient mis sur le march.

c) Motif

Le moment de l'apposition de la preuve de la conformit sur le rcipient pendant le processus de fabrication de celui-ci nedgage pas le fabricant de sa responsabilit de ne pas mettre sur le march un rcipient qui ne satisfait pas aux exigencesde la directive (comme le prouverait, par exemple, l'essai hydraulique).

La directive est muette quant au moment de l'apposition de la marque CE. Les risques sont carts par le droulement de laprocdure elle-mme. Il existe une dcision du Conseil relative aux procdures d'valuation de la conformit et de marquageCE (93/465/CEE du 22 juillet 1993, JO n L 220 du 30/8/93, page 23). Les versions anglaise et franaise de cette dcisioncomportent une diffrence quant au moment de l'apposition de la marque CE, diffrence qui a t signale aux services dela Commission pour qu'ils revoient et amendent le texte, s'il y a lieu.

Les indications qui prcdent s'inspirent de la version en langue franaise qui autorise l'apposition de la marque CE pendantla phase de contrle en cours de production. La version anglaise est plus restrictive; elle prescrit l'apposition de la marqueCE la fin de la phase de contrle en cours de la production.

a) Problemstellung

Darf der Nachweis fr die bereinstimmung mit der Richtlinie 87/404/EWG angebracht werden, bevor die Wasser- oderLuftdruckprfung mit dem Behlter durchgefhrt wurde?

b) Lsungsvorschlag

Der Hersteller kann den Zeitpunkt fr das Anbringen des Beweises fr die bereinstimmung entweder auf eigeneVerantwortung (Art.12-14) anbringen, sofern er auf Grund seiner Bauartzulassung durch eineAngemessenheitsbescheinigung gem Artikel 8 oder eine Baumuster-bescheinigung gem Artikel 10 zum Anbringeneiner CE-Kennzeichnung an dem hergestellten Produkt berechtigt ist. Es mu sichergestellt werden, da keine nicht-konformen Produkte in den Verkehr gebracht werden.

c) Begrndung

Das Anbringen des Konformittsnachweises an dem Behlter entbindet den Hersteller nicht von der Verpflichtung, nurBehlter, die den Anforderungen der Richtlinie entsprechen (wie dies z. B. mit einer Wasserdruckprfung besttigt wird), inden Verkehr zu bringen.

Der Zeitpunkt des Anbringen der EG-Zeichen ist in der Richtlinie nicht festgelegt. Risiken werden durch das Verfahren

vermieden. Ein Beschlu des Rates ber die in den technischen Harmonisierungsrichtlinien zu verwendenden Module frdie verschiedenen Phasen der Konformittsbewertungsverfahren und die Regeln fr die Anbringung und Verwendung derCE-Konformittkennzeichnung (93/465/EWG vom 22. Juli 1933, ABl. L 220 vom 30. 08. 93, Seite 23) ist gefat worden.Zwischen der franzsischen und der englischen Fassung dieses Beschlusses besteht ein Unterschied hinsichtlich desZeitpunkts des Anbringens der CE-Kennzeichnung. Die Dienststellen der Kommission sind hiervon unterrichtet worden undwerden die Sache prfen und ggf. ndern.

Diese Leitlinien lehnen sich an die franzsische Fassung an, die das Anbringen der CE-Kennzeichnung in derProduktionskontrollphase erlaubt. Die englische Fassung ist restriktiver; sie erfordert das Anbringen der CE-Kennzeichnung am Ende der Produktionskontrollphase.
