Call to Order The meeting of the NFPA Building Code Technical Correlating Committee was called to order by the Chair, Jim Quiter at 1:00 p.m. (MT) on Wednesday, January 5, 2011 at the Wyndham Phoenix, Arizona. 2. 3. Approval of Minutes The minutes of the March 30, 2010 Building Code Technical Correlating Committee were approved with one amendment: Jake Pauls was not present at the March meeting. 4. Review of Actions To Be Taken Jim Quiter provided an overview of the agenda. (See Attachment A). He reviewed the procedures for discussion of the proposed TCC notes. The Technical Correlating Committee would be asked to accept a standing motion on the draft TCC notes. Each comment will then be called individually, allowing for discussion on any comment and any draft TCC note, to permit new note items to be introduced, or for draft notes to be amended, modified or deleted. A vote is to be taken on each such amendment to the main motion. Robert Solomon noted that Committee Chairs who are not eligible to vote can make motions for this discussion. The remainder of the processing schedule was reviewed leading up to the availability of the new code. 5. Release of NFPA 5000 ROC
A. The TCC had previously received a draft of staff proposed TCC notes. The draft notes were meant to serve as a basis for the TCC to consider. The TCC had the opportunity to accept, reject, modify and add new notes as they elected.
B. A motion was made and seconded to accept the draft notes. Motions to amend were then in order when a TCC member wanted to recommend one of the previously described actions.
C. The TCC actions resulted in the development of 62 TCC notes. (See Attachment B for the notes as balloted).
D. Following a review of all of the comments and draft TCC notes, the main motion, as amended, was agreed to in order to submit the accepted notes and report to a letter ballot.
E. Robert Solomon noted that the TCC ROC ballot will be a two part ballot. The first part will be on the TCC notes, the second on the release of the report as a whole.
Item 6, Overview of New Process NFPA staff reviewed the new code development process that is being implemented by NFPA. The current plan is to apply the new process criteria to all documents that enter the Fall-2013 (and later) revision cycle. The NFPA Standards Council and Board approved the revised procedures in the fall of 2010 outlining the new regulations. In general terms, NFPA TCs will be voting on the revised document -i.e., how the text will look based upon acceptance of the input received and acted on in a favorable manner. TCs will not be voting on rejected input items but will still be providing a reason for the rejection. The new process will also allow those

who submit public input during the process to copy and paste text from the appropriate NFPA document and to easily modify it using legislative text. Training, forums and information sessions on the new process are expected to be rolled out in the coming months. Item 7, New Business
A discussion was held on the need to have NFPA 5000 catch up with some of the “new construction” provisions that are contained within NFPA 101. Examples of this are some of the newly introduced provisions for healthcare care occupancies concerning corridor use. Three options for dealing with this coordination effort were discussed and a straw poll was taken of everyone present on the preferred method to achieve this goal. The results were:
- Use NFPA extract policy/approach to update the provisions: 4
- Have NFPA staff look for new construction topics that are not included in NFPA 5000 but that are included in NFPA 101: 24
- Keep status-quo: 0
Robert Solomon will work with editors and staff liaisons to compare and identify subjects that need to be in both codes as they pertain to new construction. This information will be provided to the TCs for the next revision cycle.
TCC members were asked to think about future agenda items for TCs to consider. Several topics are being “Held for Further Study” and will be retained on future agendas.
Item 8, Future Meetings and Revision Schedule Update The ROC ballot will be issued in the coming days. It is possible that the TCC will be asked to review any amendment ballots that arise as a result of the membership action following the Annual Technical Meeting in Boston this June. It is anticipated that the TCC-in conjunction with the Life Safety Code TCC-will have a planning meeting in the spring of 2012 to establish topics and schedules for processing of the 2015 edition of the code. 3. Approval of Minutes.
The minutes of the March 31, 2010 meeting were approved with the correction that the attendance record be revised to show that Jake Pauls was absent.
4. Liaison Reports.
Shane Clary reported on the Signaling Systems project. NFPA 72 is in the Annual 2012 revision cycle. Approximately 800 proposals were received. ROP meetings are scheduled for late January in San Diego. Pre-ROP meetings were held in Fall 2010. Further work is expected on the chapter on Emergency Communications (mass notification) that was added to the 2010 edition. A new chapter is expected on Documentation. NFPA 720 is processing a Tentative Interim Amendment to address carbon monoxide detection in other than 1- and 2-family dwellings. Bill Koffel reported on the Automatic Sprinkler project. NFPA 13, 13D and 13R are in the Annual 2012 revision cycle. ROP meetings are scheduled for February. Two issues related to NFPA 101/5000 will be addressed by the Installation Criteria TC: (1) exempting sprinklers from elevator machine rooms where elevators are used for occupant-controlled evacuation, and (2) exempting sprinklers from health care in-patient room clothes closets (not storage closets) where the room sprinkler discharge can reach the back wall of the closet where the closet door is open. TIAs regulating antifreeze solutions in residential sprinkler systems will be considered by the Standards Council at its February 28 – March 1 meeting and address (1) limits on percentage of antifreeze such that propylene glycol will not be effective in deep freeze climates, (2) antifreeze solutions will need to be purchased premixed, and (3) test requirements will be added to NFPA 25 for measuring percentage concentration. Jim Lathrop reported that NFPA 99 for Health Care Facilities is being revised on the same Annual 2011 cycle as NFPA 101/5000. NFPA 99 is expected to extract from NFPA 101 the exemption for sprinklers from health care in-patient room clothes closets (not storage closets) where the room sprinkler discharge can reach the back wall of the closet where the closet door is open.

5. Review of Actions TCC Can Take.
Staff reviewed the actions that the TCC could take at the ROC stage.
6. Generation of TCC Notes and Release of NFPA 101 ROC. Each of the 365 comments on NFPA 101 received consideration. TCC Notes were generated on 66 of the comments. A letter ballot on the TCC notes and on the release of the ROC was to be distributed within a day or two of the meeting.
7. NFPA 101A Revision Cycle Update. NFPA 101A, Guide on Alternative Approaches to Life Safety is in the Annual 2012 revision cycle. It is processed one year after NFPA 101 so that it can reflect the current requirements of NFPA 101 in the NFPA 101A Fire Safety Evaluation Systems (FSES) chapters. The more significant changes being processed include expanding the Board and Care (B&C) Occupancy FSES to measure equivalency for existing, large, impractical evacuation capability facilities. Prior to the 2012 edition of NFPA 101, Code users of Chapter 33 for existing B&C occupancies were directed to (1) the health care occupancy chapter for existing limited care facilities, or (2) to Chapter 32 for new B&C occupancies to address existing, large, impractical evacuation capability facilities. The 2012 edition of NFPA 101 will address existing, large, impractical evacuation capability facilities in Chapter 33.

9. Other Business.
Processing of 2015 Editions of NFPA 101 and NFPA 5000. It is expected that the processing of the 2015 editions of NFPA 101 and NFPA 5000 will be done under the new revision process that uses “input” (rather than public comments), first draft (rather than ROP), second draft (rather than ROC), and all changes are made to the “living document” such that only changes are balloted. Divergence in Requirements of NFPA 101 and NFPA 5000. Many changes have been made to NFPA 101 that were not made to NFPA 5000 because no proposals/comments were received on the issue for NFPA 5000. The TCC favors a process where staff generates “draft TC proposals” for NFPA 5000 on subjects raised by public proposals on only NFPA 101. Similarly staff would generate “draft public comments” for NFPA 5000 on subjects raised by public comments on only NFPA 101 but for which the subject had been raised on NFPA 5000 at the ROP stage. It was agreed to wait to see what effect the new revision process will have on the subject. Retail Sale of Fireworks. The issue was addressed during this revision cycle by the Means of Egress TC. Subject removed from agenda. Health Care Summit Issues. Issues to be addressed during next revision cycle by the Health Care Occupancies TC. ASME Elevator Symposium. Issue will be further addressed during the next revision cycle by the Means of Egress TC. The material on occupant-controlled

evacuation elevators is being moved from Annex B to the end of Chapter 7 – Means of Egress for the 2012 edition. International Conference on Stairway Usability and Safety. 10. Future Meetings and Revision Schedule Update.
The TCC asked to meet in a joint teleconference with the NFPA 5000 TCC in March 2012 for the purposes of a kick-off for the 2015 revision cycle and direction setting for the TCs. The TCC will meet in a face-to-face meeting in March of 2013 to address the ROP (which might at that time be called the “first draft”).

D#11-15/DECISION: At its meeting of August 9-10, 2011, the Standards Council considered an appeal from Joseph T. Holland of Hoover Treated Wood Products, Inc. The appeal requests that the 2012 edition of NFPA 101®, Life Safety Code®, be issued with the acceptance of Certified Amending Motion (CAM) 101-7. This motion sought to Return a Portion of a Report in the form of Proposals 101-221 and 101-222 and related Comments 101-144c and 101-145. The effect of this motion would be to return Sections 10.2.6.1 through 10.2.6.3 to previous edition text. Section 10.2.6.2 would be deleted since there was no comparable text in the previous edition. As background, the Technical Committee on Furnishings and Contents (TC) accepted Proposal 101-221 to change “flame spread” to “flame spread index” and “smoke development classification” to “smoke developed index”. Proposal 101-222 suggested additional modifications and was rejected. Comment 101-144c was accepted by the TC and incorporated the changes from the accepted Proposal 101-221 and was a comment on the rejected Proposal 101-222. Comment 101-144c modified 10.2.6.1, proposed a new 10.2.6.2 and a modified 10.2.6.3. Comment 101-45 was Accepted in Principle and the Committee Statement referred back to Comment 101-144c. A Certified Amending Motion seeking to Return the Portion of a Report in the form of the aforementioned Proposals and related Comments was made at the 2011 Association Technical Meeting (Tech Session). The motion failed. The appeal requests that the Council overturn the action that was recommended by the codes and standards development process. This recommendation represents the consensus judgment of the responsible TC and the Technical Correlating Committee on Safety to Life (TCC), a judgment that was also supported by a vote of the NFPA membership at the 2011 Tech Session. The appellant has failed to achieve acceptance of his position either in the consensus committees or during the Tech Session. On appeal, the Council accords great respect and deference to the NFPA codes and standards development process. In conducting its review, the Council will overturn the result recommended through that process only where a clear and substantial basis for doing so is demonstrated. The Council has reviewed the entire record concerning this matter and has considered all the arguments put forth in this appeal. In the view of the Council, this appeal does not present any clear and substantial basis on which to overturn the results yielded by the NFPA codes and standards development process. Accordingly, the Council has voted to deny the appeal. The effect of this action is that the proposed new and modified text

of Sections 10.2.6.1 through 10.2.6.3 shown in Comment 101-144c will appear in the 2012 edition of NFPA 101. Without reviewing all of the arguments made by the appellant, the Council wishes to comment on the appellant’s assertion that interior finish was not within the jurisdiction of the TC on Furnishings and Contents. While the TC’s title and scope might be more explicit on this point, there is no question that the TC was responsible for the subject of interior finish. No other committee within the Life Safety Code project has interior finish included in its scope statement, and interior finish is expressly assigned to the TC on Furnishings and Contents by the TCC in the Supplemental Operating Procedures. The TC, therefore, clearly acted within its authority. Going forward, however, the Council is requesting the TCC to review the title and scope statement for the TC and recommend appropriate revisions to insure that the TC’s jurisdiction is clear.

D#11-17/DECISION: At its meeting of August 9-10, 2011, the Standards Council considered an appeal from Jake Pauls of Jake Pauls Consulting Services. The appeal requests that the 2012 edition of NFPA 5000®, Building Construction and Safety Code®, be issued with the acceptance of Certified Amending Motion (CAM) 5000-4. This motion sought the acceptance of Comment 5000-137, which proposed to accept Proposal 5000-164. The effect of this motion would be to modify 22.1.7 and 22.1.7.1 to include new provisions on accessibility as follows: 22.1.7 Accessibility (No requirements.) 22.1.7.1 All new buildings or portions thereof used as a one- or two-family dwelling shall comply with ICC/ANSI A117.1, section 1006 Type C Units (Visitability) unless: (1) they comply with the requirements in ICC/ANSI A117.1 for Type A or Type B units, (2) they are a dwelling unit located above another dwelling unit or (3) they meet the site impracticability test set out in Section 12.33.3.2.4 or the base flood elevation conditions set out in Section 12.33.3.2.5 The background on these proposed new provisions (the accessibility provisions), is as follows. As indicated above the accessibility provisions were proposed initially through Proposal 5000-164. The Technical Committee on Residential Occupancies (BLD-RES) rejected Proposal 5000-164 based in part on the fact that that ICC/ANSI A117.1-2009, Accessible and Usable Buildings and Facilities Standard, which was referenced in the provisions, was not yet available. Concurrently, the Technical Committee on Building Systems (BLD-BSY) considered the same material in Proposal 5000-165 and Accepted in Principle, noting this action was subject to the new edition of ICC/ANSI A117.1 being available for review and confirmation at the Comment phase of the revision process. The Technical Correlating Committee on the Building Code (TCC), in its action on these two proposals, requested that both TCs review the recommendations made in the proposals during the Comment phase once ICC/ANSI A117.1-2009 was available, and the TCC also requested that input be sought from the NFPA’s Disability Access Review and Advisory Committee (DARAC). The new edition of ICC/ANSI A117.1-2009 did not, in the end, become available during the Comment phase. For this and other reasons, when the accessibility provisions were again proposed through Comment 5000-137, BLD-RES rejected the comment along with a related Comment 5000-139. Concurrently, the accessibility provisions were considered by BLD-BSY in Comment 5000-140a. Although the initial action by BLD-BSY was to accept in principle, the action conflicted with that of BLD-RES and the TCC, in accordance with its correlation authority, revised that action to reject

stressing that acceptance of the Comment was not appropriate since the 2009 edition of the ICC/ANSI A117.1 standard was not yet available. A Certified Amending Motion seeking to Accept Comment 5000-137 was made at the 2011 Association Technical Meeting (Tech Session). The motion failed. The accessibility provisions, therefore, did not achieve acceptance through the codes and standards process. On appeal, the Council accords great respect and deference to the NFPA codes and standards development process. In conducting its review, the Council will overturn the result recommended through that process only where a clear and substantial basis for doing so is demonstrated. The Council has reviewed the entire record concerning this matter and has considered all the arguments put forth in this appeal. Accordingly, the Council has voted to deny the appeal. The effect of this action is that NFPA 5000 will not contain the accessibility provisions proposed for Sections 22.1.7 and 22.1.7.1. The appellant also requested Council to clarify which NFPA 5000 TC has jurisdiction over scoping of the ICC/ANSI A117.1 standard within NFPA 5000. Going forward, the Council directs that the following actions be completed prior to the start of the next revision cycle, and the findings reported back to Council. The TCC is to review the scope of BLD-BSY to determine if that committee has sufficiently broad scope authority over all aspects of accessibility within NFPA 5000 and to determine the extent, if any, that the respective technical committees within the project have the ability or authority to modify recommendations of BLD-BSY for the subject of accessibility in their respective chapters. The TCC should recommend any changes to the scope of BLD-BSY as well as other TCs within the project if it is determined that such changes are in order. As part of this review process, the TCC should consider the input of BLD-BSY, BLD-RES and other TCs within the project, as appropriate. Additionally, the perspective of the NFPA DARAC should also be considered. Committee Member Shane Clary recused himself during the deliberation and vote on this issue.
