The application of the institution was closed vide office order no. F.NRC/NCTE/F-7/UP-2565/141 Meeting/2009/6742 dated 24.07.2009.

The said institution preferred an appeal dated 23.09.2009 to the NCTE Hqtrs, New Delhi under Section 18 of the NCTE Act, 1993 against the said order. The appeal of the institution was rejected and therefore the said institution filed a writ petition on 437/2010 in the Hon’ble High Court of UP at Allahabad.

The order of the learned single Judge dated 22.02.2010 has been challenged before this court. The learned single Judge has dismissed the writ petition by saying that "No Objection Certificate" granted in favour of the petitioner by National Regional Committee of the National Council for Teachers Education has been correctly rejected.

Learned counsel appearing for the appellant has contended that on the basis of the proviso to sub Section 3 of Section 15 of the National Council for Teacher Education Act, 1993, before refusing permission under sub Section 2, Sub Clause 13, the Regional Committee shall provide a reasonable opportunity to the institution concerned for marking a written representation.

As per order of Hon’ble High Court of UP at Allahabad, the committee considered the case and decided that the Institute be directed to comply with the decisions of the Hon’ble High Court of UP.

We are of the view that since the refusal has been made on the negative response of the State Government, at this stage there is no question of giving opportunity of hearing before the Regional Committee. It will be done when finally all sorts of materials will be available to show that any irregularity is there or rejection has been made on any flimsy ground. Here the case is based on the negative recommendation due to non availability of certain materials by the State Government. Therefore, first of all the appellant has to satisfy the test of reasonableness of the State Government in giving any positive recommendation. Out of other three grounds, the ground that land is in the name of society but not in the name of the institution, seems to be flimsy in nature. When society runs the institution, therefore, such cause can be considered after getting the view of the State Government. Other two points are with regard to the non-submission of application on the proper format to the State Government which is required to be filled up by the appellant itself to avoid any irregularity so as to made out the case of a plan approved by the authority. Therefore, in all, we find that the most of the items, for which the rejection has been made, have to be fulfilled by the appellant and it is required to be done as early as possible within a period of two months so that the State Government may consider the issue and if any positive recommendation is made out in spite of the same, the appellant will of-course get an opportunity of hearing before the authority under the proviso to sub Section 3 of Section 15 of the Act, 1993, but not at this stage.

Therefore, by our explanatory note, we want to clarify the position that there is no necessity to interfere with the order, which is passed by learned single Judge. However, it is open for the appellant to proceed as per the observation of this Court and accordingly instead of dismissing the special appeal we treat it as disposed of without imposing any cost.

3. 2. Waltech College of Education, Vill- Uldepur, Post- Meerut, Tehsil- Meerut, District- Meerut, Uttar Pradesh.

(UP-3014, Course- B.Ed)

The application of the institution was refused vide office order no. F.NRC/NCTE/F-3/UP-3014/155 Meeting/2010/15764-770 dated 01.02.2010.

The said institution preferred an appeal dated 31.03.2010 to the NCTE Hqtrs, New Delhi under Section 18 of the NCTE Act, 1993 against the said order. The appeal of the institution was rejected and therefore the said institution filed a writ petition on 32607/2010 in the Hon’ble High Court of UP at Allahabad.

The petitioners have sought the quashing of the order dated 16th February, 2010 passed by the Northern Regional Committee of the National Council for Teacher Education rejecting the application filed by the petitioner for granting recognition for B.Ed course on the ground that the institution did not allow the visiting team members to visit the infrastructure and the institutional facilities. The petitioners have also sought the quashing of the order dated 05th May, 2010 by which the appeal filed by the petitioners for setting aside the aforesaid order dated 16th February, 2010 was dismissed.

It is stated by learned counsel for the petitioner that pursuant to the Appellate order

dated 8th October, 2009 the Northern Regional Committee issued a notice dated 4th December, 2009 to the petitioner-institution for inspection between 15th to 25th December, 2009 but the petitioner intimated the Committee that inspection may be postponed by one month as the Secretary was suffering from jaundice and fever and had been advised complete bed rest.

Learned counsel for the petitioner submits that in such circumstances the inspection can now be carried out by Northern Regional Committee and the Appellate Authority and the Northern Regional Committee were not justified in rejecting in the application filed by the petitioners on the ground that the petitioner did not permit the visiting team to carry out the inspections, since intimation had been sent regarding illness of the Secretary.

Sri R.A. Akhtar, learned counsel appears for respondent’s states that it is not necessary to file a counter affidavit and the petition may be disposed of at this stage. He however, submits that there is no infirmity in the impugned order.

I have carefully considered the submissions advanced by learned counsel for the parties. The Appellate Authority while passing the order dated 08.10.2009 had remanded the case back to the Northern Regional Committee for causing inspection of the Institution within thirty days to ascertain the availability of the inspection and the institutional facilities as per the norms fixed by the National Council for Teacher Education. The Northern Regional Committee intimated the petitioner-institution that inspection will be carried

out between 15th to 25th December, 2009 but the petitioner-institution intimated the Committee that its Secretary is ill and the inspection may be postponed.

Learned counsel for the petitioner has stated that a fresh inspection of the Institution may now be carried out and the petitioners are ready to deposit fee for the said purpose.

In view of the peculiar facts and circumstances of the case, it is ordered that the Northern Regional Committee may consider the desirability of causing inspection of the Institution provided it deposits the requisite fee in accordance with the regulations within a period of three weeks from today.

The orders impugned in the present petition shall abide by the final order that may be passed after the inspection is carried out.

The writ petition is disposed of with the aforesaid observations.

4. 3. Hari Institute of Technology, Vill- Podam Nogoli, Post- Nakur, Tehsil- Nakur, District- Saharanpur, Uttar Pradesh.

(UP-3457, Course- M.Ed.)

The application of the institution was closed vide office order no. F.NRC/NCTE/F-3/UP-3457/157 Meeting/2010/19970-19971 dated 13.04.2010.

The said institution filed a writ petition on 30660/2010 in the Hon’ble High Court of UP at Allahabad.

The petitioners have sought the quashing of the order dated 13th April, 2010 passed by the Northern Regional Committee of the National Council for Teacher Education by which the

application submitted by the petitioners for grant of recognition/permission for conducting M.Ed. Course for one year duration with an annual intake of 25 students has been rejected for the reason that no reply had been submitted to the letter dated 1st February, 2010 sent by the Northern Regional Committee.

Sri Neeraj Tiwari, learned counsel appearing for the petitioners submitted that the letter dated 1st February, 2010 sent by the Northern Regional Committee was duly replied to by the petitioners by the letter dated 17th February, 2010 which was sent by Speed Post and also personally received on 22nd February, 2010 and in this connection he has placed before the Court the said letters which have been annexed as Annexure-9 to the writ petition.

Sri R.A. Akhtar, learned counsel appearing for the respondents states that the petitioners may now apprise to the Northern Regional Committee of the aforesaid facts and in case such an application is moved, it shall be decided expeditiously.

In view of the aforesaid, this petition is disposed of with a direction that in the event the petitioners file an application before the Northern Regional Committee, an appropriate decision shall be taken expeditiously, preferably within a period of one month from the date the representation is filed by the petitioners along with a certified copy of this order before the Northern Regional Committee.

It is made clear that this Court has not adjudicated upon the merits of the case, which

shall be considered by the Northern Regional Committee in accordance with law.

The order impugned in the present petition shall abide by the final orders to by the Northern Regional Committee.

5. 4. G.I.P.T.S., Vill- Nagla Sher Khan Jaipur, Post- Partapur, Tehsil- Meerut, District- Meerut, Uttar Pradesh.

The institution was recognized vide office order no. F.NRC/NCTE/F-7/UP-2809/2008/19170-76 dated 13.05.2008.

The said institution filed a writ petition on 353/2010 in the Hon’ble High Court Allahabad.

We have heard Sri U.N. Sharma, learned Senior Counsel assisted by Sri Neeraj Tiwari, learned counsel appearing on behalf of the appellants, learned Standing counsel for the respondent no. 1, Sri Anurag Khanna, learned counsel for the University and Sri R. A. Akhtar, learned counsel for respondent no. 2.

The present special appeal has been filed against the judgment and order dated 18.01.2010 passed by the Hon'ble Single Judge by which petitioners' writ petition, the appellants herein, has been dismissed on the ground that it is premature. It is admitted between the parties that similar order was passed in Special appeal no. 299 of 2010 (Savita Devi Mahavidyalaya vs. State of U.P & others) and a Division Bench of this court vide order dated 09th March, 2010 passed by a Division Bench is reproduced below.

“The order impugned under challenge is the order passed by the learned Singh Judge on 18.01.2010 by which the writ petition of the writ petitioner-institution was dismissed holding that

the writ petition is premature in nature and the petitioners can seek appropriate remedy when an order against the petitioners is passed.

Mr. U.N. Sharma, learned Senior Advocate, appearing for the appellant, has contended before us that though the Inspection Team was formed for the purpose of inspection but the same has been made under Section 17(1) of the National Council for Teachers Education Act, 1993 (for the sake of convenience hereinafter referred to as 'Act.'). According to him there is no scope of inspection under Section 17 of the said Act and no opportunity has been provided by such authority before holding an opinion there should be an inspection.

On the other hand, Mr. Anurag Khanna, learned counsel appearing for the respondent-University and Mr. R.A. Akhtar, learned counsel appearing for Nation Council for Teacher Education, both have contended before us that the inspection can be made under section 13 of the act. Therefore, at this stage the appellants cannot be said to be aggrieved, hence the order impugned is correct.

We are of the view that there should not be any necessity of interference in the order passed by learned Single Judge until a decision is taken by the authority on the basis of the information provided to it by the institution no cause of action may arise. It appear to us that under Section 17(1) of the Act, an inspection has been initiated by the authority. However, such authority is not legally expert to say under which section inspection will be mode. Perhaps they found that there is

contravention of the provisions of the Act, therefore they decide to make an inspection. Passing any order to inspect the institution may lead to violation of principles of natural justice because at no pint of time, the Regional Committee called upon the petitioners to explain the position.

Mr. Anurag Khanna, on the other hand, has contended before us that under Section 17 proviso 1 of the Act, no order of withdrawal of recognition can be passed unless a reasonable opportunity of hearing and making representation against the proposed order has been given to such recognized institution.

According to us, there should not be a mechanical application of such proviso. We are of the view that the minutes, though it is written and shown to be under Section 17 of the Act, should not be construed in the matter as if a decision has been taken about the institution concerned without giving an opportunity of hearing to it to represent the case before passing an appropriate of hearing to represent the case before passing an appropriate order. If the appellants are aggrieved by any such order, they can prefer an appeal under Section 18 of the Act any even thereafter if they are aggrieved, they can proceed further in accordance with law. Therefore, at this stage, though it is written that the notice has been given under Section 17 of the Act, it cannot be construed to be under Section 17 alone but it is on the basis of such subjective value and procedure under Section 13 of the Act also.

The special appeal is accordingly disposed of

without imposing any cost.”

As the controversy involved is the same, the present special appeal is also disposed of in the same terms.

6. 5. Gandhi Institute of Professional & Technical Studies, Nangla Sher Khan Urf Jaipur, (Hapur Bye Pass), Meerut, Uttar Pradesh.

(UP-689, Course- B.Ed)

The institution was recognized vide office order no. F.NRC/NCTE/F-3/UP-689/2002/7983-7990 dated 16.10.2002.

The said institution filed a writ petition on 360/2010 in the Hon’ble High Court Allahabad.

We have heard Sri U.N. Sharma, learned Senior Counsel assisted by Sri Neeraj Tiwari, learned counsel appearing on behalf of the appellants, learned Standing counsel for the respondent no. 1, Sri Anurag Khanna, learned counsel for the University and Sri R. The institution was recognized vide office order no. F.NRC/NCTE/F-7/UP-7/UP-2943/2008/58564-70 dated 23.08.2008.

The said institution filed a writ petition on 354/2010 in the Hon’ble High Court Allahabad.

We have heard Sri U.N. Sharma, learned Senior Counsel assisted by Sri Neeraj Tiwari, learned counsel appearing on behalf of the appellants, learned Standing counsel for the respondent no. 1, Sri Anurag Khanna, learned counsel for the University and Sri R. As per decision of the 155th Meeting the recognition of the recognition of the Institution was withdrawn vide order dated 23.02.2010 which inter-alia confirmed vide appeal order dated 05.05.2010. The institution filed a Writ Petition 7276/2010 in the High Court of Rajasthan and the Court has passed an order dated 27.05.2010 which is as under:-

The Northern Regional Committee of the NCTE in its meetings held on 13th and 14th September, 2009 took the following decision:-

“The original file of the institution, Reply of the Institution along with all other related documents, Act of NCTE, 1993, Regulations and Guidelines of NCTE published from time to time were considered by the committee and the committee decides to issue letter under clause 7 (11) of Regulation 2007, The case may be referred to HQs regarding the academic session from which the recognition is to be granted, and the letter under clause 7(9) of Regulation 2007 was issued before 31st August, 2009.”

Subsequently, an order dated 7th October, 2009 was issued by the Northern Regional Committee of the NCTE that the recognition shall be granted to the M.Ed Course for the academic session 2009-10. It is the submission of the learned counsel for the petitioner that despite the resolution of the Northern Regional Committee of the NCTE taken in the meeting held on 13th and 14th September, 2009, the order was passed without waiting for the directions from the Head Quarters.

There is nothing in the order dated 7th October, 2009 which may indicate that pursuant to the decision taken by the Northern Regional Committee of the NCTE in its meeting held on 13th

and 14th September, 2009, the Head Quarters had given directions.

Sri Rajeev Joshi, learned counsel appearing for respondent Nos.1 and 2 states that the petitioner may now file a representation before the Northern Regional Committee of the NCTE regarding the aforesaid grievance on which an appropriate decision shall be taken expeditiously.

In view of the aforesaid, this petition is disposed of with a direction that in the event the petitioner files a representation before the Northern Regional Committee of the NCTE, the Committee shall take an appropriate decision in the next meeting. This contempt petition has been filed with the allegation that in spite of an order dated 21.11.09 passed by this Court in Writ petition no. 62828 of 2009 the opposite party has not decided the representations of the applications through the stipulated time has elapsed.

The opposite party is bounded by the order of this Court and in case he does not decide the representations of the applicants within a month of receipt of this order. Without any reasonable cause, the Court would have not option except to punish him under section 12 of the Contempt Act and other allied powers.

Hon’ble High Court Chandigarh, the committee considered the case and decided to communicate to the Institution that the fresh application will be considered for B.Ed. course as an when the ban is lifted by the NCTE.

The said institution filed a writ petition No 3836(M/B) of 2010 in the Hon’ble High Court of UP at Allahabad.

We though have taken notice of the anomaly in granting affiliation on the basis of the additional recognition under Regulation 7(11) by the Universities till date, but looking to the interest of the institutions and the students, we provide that even in the cases, where affiliation has been granted on the basis of the aforesaid additional recognition, they will not be affected by this order but in future it shall be ensured that affiliation is granted only after formal order of recognition is issued under Regulation 7(12).

Such anomalies occur apparently because in the absence of any recognition being granted to the institution under Regulation 7(12), the entire process of granting affiliation is made on mere decision to grant recognition under Regulation 7 (11).

Further, since the impugned order has been passed without affording any opportunity to the petitioner, the same cannot be sustained even on this ground.

We therefore, allow this writ petition and set aside the impugned order with the direction that the Regional Committee shall take a fresh decision in the matter after affording an opportunity to the petitioner within a maximum period of one month from the date of receipt of a certified copy of this order.
