Notes from Standing Orders

Disorderly conduct

No person shall obstruct the transaction of business at a meeting or behave offensively or improperly. If, in the opinion of the Chairman, there has been a breach of standing order 10(a) above, the Chairman shall express that opinion and thereafter any councillor (including the Chairman) may move that the person be silenced or excluded from the meeting, and the motion, if seconded, shall be put forthwith and without discussion. If a resolution made in accordance with standing order 10(b) above, is disobeyed, the Chairman may take such further steps as may reasonably be necessary to enforce it and/or he may adjourn the meeting.

Confidential business

Councillors shall not disclose information given in confidence or which they believe, or ought to be aware is of a confidential nature. A councillor in breach of the provisions of standing order 24(a) above may be removed from a committee or a sub-committee by a resolution of the Council. Rescission of previous resolutions

A resolution (whether affirmative or negative) of the Council shall not be reversed within 6 months

except either by a special motion, the written notice whereof bears the names of at least 5

councillors of the Council, or by a motion moved in pursuance of the report or recommendation of a

committee.

When a special motion or any other motion moved pursuant to standing order 11(a) above has been

disposed of, no similar motion may be moved within a further 6 months.

Request for motions to be included in Agenda

In accordance with standing order above, no motion may be moved at a meeting unless it is included in the agenda and the 10 clear days before the next meeting. The Proper Officer may, before including a motion in the agenda received in accordance with standing order 4(a) above, correct obvious grammatical or typographical errors in the wording of the motion. If the Proper Officer considers the wording of a motion received in accordance with standing order 4(a) above is not clear in meaning, the motion shall be rejected until the mover of the motion resubmits it in writing to the Proper Officer in clear and certain language at least 7 clear days before the meeting. If the wording or nature of a proposed motion is considered unlawful or improper, the Proper Officer shall consult with the Chairman of the forthcoming meeting or, as the case may be, the Councillors who have convened the meeting, to consider whether the motion shall be included or rejected in the agenda. Having consulted the Chairman or councillors pursuant to standing order 4(d) above, the decision of the Proper Officer as to whether or not to include the motion in the agenda shall be final. Declaration of interests: The Code of Conduct adopted by this Council in July 2012 states any matter on an agenda of the Council where a person should declare an interest falling within Appendix A (pecurinary), means that person should not take part in any discussion or vote on that matter. Standing Orders 7d state that where members of the public are permitted to make representations, answer questions, and give evidence relating to the business transacted during the public session, so Councillors with a prejudicial interest may do the same but must thereafter leave the room or chamber.

Minutes of the Meeting of Bishop’s Cleeve Parish Council on the 6th February 2014 at

the Parish Council Offices at 7.30pm-

1. Councillors were invited to make a Declaration of interests of matters on the agenda. Councillors are advised to take note of the Code of Conduct advice made available to them. Councillor C Benfield declared a pecurinary interest

2. Public Session - Members of the public were invited to speak to the Council and Councillors who declare an interest in matters on the agenda may wish to address the Council at this time. A new resident attended to observe. Cllr Richmond spoke re the Javelin Park enquiry.

3. 5. Council agreed that the application for the vacancy in Cleeve West Ward meets the criteria for co-option and agreed to co-opt Paul Benfield. There was a short break to allow papers to be signed.

6. Crime Report noted and Councillors were advised to email Clerk with any specific queries. Concern was expressed regarding the recent child safety concerns and the fact that this was not part of the submitted report.

13. Council approved Cheque payment list 14. Council noted that a full Employment policy document will be presented in

time for the new Council year: a) Council agreed to formally delegate to the Employment & Finance Committee

the authority to appoint new employees within the agreed job specification and budget as agreed by Full Council, to be responsible for the disciplinary and

grievance procedures for the Clerk and to be responsible for hearing any appeals on disciplinary and grievance procedures for other staff members. Agreed 11, 2 against, 1 abstention.

b) Council agreed to formally delegate to the Clerk the responsibility for the disciplinary and grievance procedures for other staff members. Amendment proposal was made that any grievance made concerning the Clerk will be referred straight to E & F Committee- agreed. A Policy workshop was requested to be arranged for April. At 8.20 Clerk left the room as Council discussed how the policy workshop was to be run. At the next Council meeting an agenda item will be put to discuss the Policy Workshop. Clerk returned at 8.22pm.

15. Council noted report from January 2013 Roof top housing meeting. In future report will be sent to Com Eng Committee.

16. Council discussed Circular walk crossing our sports field land as attached letter. Noting there are no PRW’s on this land. Consideration was given to logistical considerations and route to be designated by Council avoiding all football pitches, ensuring no clash of bookings, CALO policy recharge –com engagement committee etc. Council decision was that it could not give permission as field has “a no dogs are allowed on field policy” but made alternative suggestion of Cheltenham Road to Read Way footpath, Crown Drive out on to Kayte Lane. Clerk was instructed to ask what % of income was going to charity

17. Council were asked for any other business for information purposes at the discretion of the Chair.- Council may wish to invite a representative from Western Power Distribution following the Chair of Council attending the seminar in February. Councillors were asked to email Clerk if an agenda item is required.

Criteria to be applied when considering Co-option of Parish Councillors

Bishop’s Cleeve Parish Council agreed to adopt the following criteria in July 2011:

A Parish Councillor

must be aged 18 or over, be a British subject or citizen of the Irish Republic

a local government elector of the parish; or

a person who (a) has, during the whole of the twelve months before he/she was

nominated as a candidate, occupied land or other premises as owner or tenant in the

parish, or (b) has, during the same period, resided in that area or within three miles

thereof, or (c) has, during the same period had his principal or only place of work in

that area.

Have experience of, or aspirations to, work in voluntary capacity

Be able to demonstrate a wish to take an active role in the Community

Able to attend weekly meetings, normally on a Thursday evening between 7 and 10pm

Be willing to participate in the work of the Council by serving on one or more

committee

Bishops Cleeve Parish Crime Report –January 2014 Bishops Cleeve overall has experienced low level crime and incidents during January 2014. (report 27/1/14)

There were 4 reports of assault or violence against a person:

Meadoway-2x domestic related common assault

Church road-confrontation resulting in the victim being hit over the head with a bottle- slight injury

Brockhampton lane- domestic related common assault. There were 3 burglaries:

Priory lane- Offender/s have smashed a rear window untidy search nothing taken

Courtiers drive-offender/s have entered via insecure rear door – handbag and contents stolen along with jewellery.

Moreton close -offender/s have smashed rear patio door untidy search Jewellery stolen There was 1 attempt burglary:

Pine bank-Offender/s have smashed glass in front door to reach door handle entry was unsuccessful nothing taken

There was 1 non dwelling burglary reported:

Oldacre drive-bird stolen from within bird cage located in insecure garage. There were 6 thefts including 1 shoplifting:

Tobyfield road- theft of coat and skipping rope from within school

Tescos-shoplifting £137 of meat and other groceries

Kingswood service station- make off without payment for fuel

Tobyfield road/Tesco purse stolen from within handbag either while at the school or in Tesco

Millham road-Theft of scrap from driveway

Farriers Reach-theft from vehicle rear doors on van prised open items stolen from within. There were 5 report of Criminal damage:

Two hedges road- smashed rear window

Tithe barn- automatic door damaged

Harpfield close -glass in front door smashed

Hardy road- brakes and electrics damaged on vehicle

West Way-window and flower pot smashed There were no Drug offences

In comparison to January 2013 there was an overall reduction in reported crime reducing to 20 reports this

January from 23 reports in January 2013.

There type of crime reported has altered slightly; there has been an increase in the reports of Criminal damage

within the home and a reduction in non dwelling burglaries compared to the same period last year.

With regard to anti-social behaviour there were 23 incidents reported through January, these have been broken

down into the 3 categories below

10x Personal ASB. Which range from in considerate parking to threatening language on facebook.

13 x Nuisance ASB. Which in which range from Youths at the Tithe Barn/Tescos to climbing on the primary school roof.

0x Environmental ASB

There was no ASB reported in the recreational/park areas. An Anti-Burglary Operation has been run in Bishops Cleeve

during January 2014

Report from Chair of Council for January 2014

20/01/14 Cleeve Common Conservators

Meeting to agree priorities for education, publicity and events. Education facilities (base + toilet facilities) and tutor packs are all in place. Will formally roll out to local schools over next couple of months. Seeking to publicise our memorial wall through local funeral directors.

22/01/14 Police Community Meeting

This overlapped with the Wingmoor Forum so I was only able to attend the first part. Cllrs Shakespeare, A Lightfoot, MacKinnon and Richmond were also present. Unfortunately, there was only a few members of the public attended – all of whom had very specific issues / concerns which may not have been representative of the wider community. Feedback from others was that the council was strongly criticised by the PCSO for lack of youth provision, lack of publicity (nobody knows about it) and inappropriate location (too far out of village centre). This was challenged by councillors at the meeting but, on advice from our Community Engagement Committee, I have written to the police with factual information on scope, cost and reasons for selecting the locations we have. A copy has been circulated to all councillors.

22/01/14 Wingmoor Liaison Forum

Shortest meeting I have ever attended. Only issues of note were a complete rebuild of one of the generators which will result in flaring of some methane for a few days and improvements to fire protection at Printwaste. This is as the result of an Environment Agency initiative to visit, together with the local fire brigade, all local waste treatment premises with large volumes of combustible material. The dust monitor is being removed following completion of 6 months of sampling. Expectation is that the health impact analysis will be available at the next meeting.

29/01/14 Cleeve Conservators

Executive meeting. Main topic was a review of finances going forward. We made a small surplus this year on cash flow but will be a deficit after allowing for depreciation. This year was not typical and we expect to have a small cash flow deficit next year. Current funding is secure until the end of 2016. We have been lobbying hard to regain single farm payment in new funding regime but advice is that this is unlikely. Only the holders of grazing rights can claim but only one of the many rights holders grazes stock on the Common and none contribute to its upkeep. Rather than reduce our conservation and education activities, our focus on raising our profile as a charity so as to attract donations / bequests. We will also look to market our memorial wall plaques more actively.

16. Council noted correspondence from GAPTC and agreed they wish to nominate J Beattie for his work at the Tithe Barn. Council noted that Cllr Badham had requested that he be considered.

17. Council approved the appointment of Ian Selkirk as independent auditor 2013/14

18. Councillors noted that from 15th January 2014 an individual email address for Councillors will be available. Each Councillor will be given a log in operational information sheet during January. Councillors may only use this account for Council business. Council reserve the right to monitor such emails and Councillors were reminded that such correspondence does fall under the Freedom of Information Act.

Deferred until further information is available. Facebook, website, Glos Echo, notice boards, newsletters and other organisations such as Church, British Legion etc to be used to explore information.

8. Committee considered if they wish to remove or re-site the browning seat based on H & S concerns ( re surfacing, infrastructure and traffic conditions) deferred.

9. Committee noted that based on advice from playground maintenance contractor and risk assessment carried out by BCPC staff it was decided to close the enclosed play areas for two weeks to allow the ground to dry out before remedial in-filling could take place

Roof top housing meeting report Meeting held on Monday 20th January at the Parish office

There was a complaint from a member of the public with regards to the owners of 67/69 Tobyfield Road leaving 7

waste bins in the front of their property. Councillor Hillier-Richardson will speak to Tewkesbury council to see if there

is anything they can do. I was also asked to find out if we can do anything?

There have been complaints about the way Severn Trent has left the Road and Verge in Woodmans Way. Roof tops

will look at it and contact Severn Trent if it is required.

It was reported that when a building in Minetts Avenue was vacated the lights had been left on upstairs. Rooftop will

look into this matter.

The junction of Minetts avenue and Linworth has people driving across the grass Rooftop will look at putting bollards

up.

There have been reports that cars are being parked in the entrance to Courters Drive garages so that he garage

owners cannot get their cars in and out. Sue will speak to Highways.

A Request was made to Rooftops for the green in Jesson Road to have parking bays put in. Rooftops said that they only

have 2 houses in this road so it was unlikely to happen, but they would look into the price of doing so.

There is a tree in Tobyfield Road where the roots are getting to close to number 43. Rooftop will look into this matter.

The parking area on the green opposite the barracks square is being put out to tender. I reminded them that we had

asked at planning for them to put bollards at the end of the bays to stop large Vans/vehicles with large overhangs

from blocking the pavement access. They will take this on-board.

The new building that they had decided to sell may now be kept for renting out.

They have some money that they are looking at using for improving facilities in Bishops Cleeve 1 of the ideas is to see if

the Play Rangers require any additional equipment for when they entertain the children in our playing fields. I said

they should contact Belinda.

They have a large number of trees coming for planting around the village as some of these will grow to a very large

size that they will have to be very careful, or in the future there will be more complaints like we already receive as to

the roots etc.
