(5) In determiningwhat order to be made under subsection (3),theCourtForChildrenshalltreatthebestinterestsofachildasthe paramount consideration.
(6) Notwithstanding paragraph (3)(a), the Board of Visitorsof the place of refuge in which a child is being detained mayreducetheperiodofdetentionofthechildbutnoreductionshallbe made which will have the effect of enabling the child to bereleasedfromtheplaceofrefugewithintwelvemonthsfromthedateofhisadmissionintotheplaceofrefugeasspecifiedinthatparagraph,exceptby theauthority of theMinister.
(7) TheCourtForChildrenshall,whenmakinganorderunderparagraph(3)(a) or (d),ordertheparentorguardianofachildtoexecuteabondforthedurationoftheorderwithsuchconditionswhichmayinclude—
(a) inthecaseofparagraph(3)(a),regularvisitstotheplaceofrefugewherethechildisplaced;and
(b) inthecaseofparagraph(3)(d),ensuringthatthechildremainsindoorswithinstipulatedtimes.
(8) Any personwho—
(a) isorderedtoexecuteabondundersubsection(3)or(7),asthecasemaybe;and
(b) fails to comply with any of the conditions of suchbond,
commits an offence and shall on conviction be liable to a finenotexceeding ten thousand ringgit.
(9) Any child sent to a place of refuge for detention underparagraph (3)(a) shall, on the expiration of the period of his
detentionwhether by—
(a) effluxionoftime;or
(b) reason of any reduction made pursuant to subsection(6),
be placed under the supervision of a SocialWelfare Officer orother person appointedby theProtector for suchpurpose.
( 10) The peri od of super vis ion for t he purpose of
subsection (9) shall be determined by the Board of Visitors ofthe place of refugeon the recommendationof theProtector butshallnotinanycaseexceedoneyearfromthedateofexpirationoftheperiodofdetentionofthechild.

(11) The Minister may on the application of the child orhis parent or guardian exempt the child from the applicationof subsection (9) if he is satisfied that the case warrants such
exemption.
(12) Withoutprejudiceto thepowersof theBoardofVisitorspursuant to subsection (6) the Court For Children may, on theapplication inwritingmade by—
(a) aProtector;
(b) the parent or guardian of the child to whom an ordermadeunderthissectionrelates;or
(c) thechild,
amend,varyorrevokeanyordermadeunderthissection—
(aa) iftheCourtForChildrenissatisfiedthatitisinthebestinterestsofthechildtodoso;and
(bb) uponproofthatthecircumstancesunderwhichtheorderwasmadehavechangedafterthemakingoftheorder.
(13) Anorderunder subsection(3)shallnotbemadewithout
givingtheparentorguardianofthechildanopportunitytoattendandbeheard.
(14 ) Notwi th standing subsect ion (13 ), an o rder undersubsection(3)maybemadeiftheCourtForChildrenissatisfiedoninformationgivenbyaProtectorthattheparentorguardianofthechild,havingbeenrequiredtoattend,hasfailedtodoso,orisnot available or cannotbe foundwithin a reasonable time.
Children in urgent need of protection
41. (1) Any childwho is in urgent need of protection may onhis own application in the prescribed form be received by theProtector intoa place of refuge if theProtector is satisfied thatthe child is inurgentneed of protection.
(2) Achildisinurgentneedofprotectionifthereisreasonablecausetobelievethat—
(a) thechildisbeingthreatenedorintimidatedforpurposesofprostitutionorforpurposesofhavingsexualintercourse
withanotherorforanyimmoralpurpose;

(b) the child is to be confined or detained by another in
contraventionofthisPart;
(c) an offence against this Part is being or likely to be
committedinrespectofthechild;or
(d) if the child is a female, that she is pregnant out ofwedlock.
(3) Subject to subsections (4) and (5), and if circumstanceswarrant it, the person in charge of any place of refuge mayreceive into the placeof refuge anychildwho—
(a) isinurgentneedofprotection;and
(b) makesanapplicationunderthissectiontothepersonincharge.
(4) If the person in charge of a place of refuge receives anychild under subsection (3), that child shall be brought before aProtectorwithintwenty-fourhoursofhisadmissionintotheplaceof refugewitha full report of the circumstances.
(5) Achildadmittedunderthissectionispermittedtoresidein
theplaceofrefugeonlysolongastheProtectorissatisfiedthatthe child is in urgent need of protection under this section.
(6) The Protector—
(a) whoreceivesachildundersubsection(1);or
(b) beforewhomachildisbroughtundersubsection(4),
shallimmediatelyinformtheCourtForChildrenofsuchadmission
withafullreportofthecircumstancesandshallinthelikemannerinformtheCourtofhisdeparture.

42. (1) If the Protector has reasonable cause to believe that achild—
(a) hasbeenbroughtintooristobesentoutofMalaysiaand
thecustodyofthechildhasbeenacquiredeither—
(i) after having been purchased; or

(i) prostitution or for immoral purposes; or
(ii) being sent out of Malaysia for the purposes ofprostitution or for immoralpurposes,
the Protector may order the child to be removed to a place ofrefugeandthechildshallbetemporarilydetainedinsuchplaceofrefuge.
(2) Every childwho istemporarilydetainedunder subsection(1)shallbebroughtbeforeaCourtForChildrenwithintwenty-fourhoursexclusiveofthetimenecessaryforthejourneyfromthe place where the child was so removed to the Court ForChildren.
(3) If it is not possible to bring a child before a Court ForChildren within the time specified in subsection (1), the childshall be brought before a Magistrate who may direct that thechild be placed ina placeof refugeuntil such timeas the childcanbe brought beforeaCourt ForChildren.
(4) The Court For Children before whom a child is broughtshallorderthechildtobedetainedinaplaceofrefugeuntil—
(a) aninquiryintothecircumstancesofthechild’scasehasbeen completed; and
(b) areportoftheinquiryhasbeensubmittedtotheCourtForChildren by theProtectorunder subsection (6).
(5) An inquiry referred to in paragraph (4)(a) shall be madebyaProtector.
(6) The Protector shall complete the inquiry and submit the
report of the inquiry to the Court For Childrenwithin a periodnot exceeding onemonth from thedateof the admissionof thechildtotheplaceofrefuge.

(7) Ifafter considering the report submitted under subsection(6)theCourtForChildrenissatisfiedthatachildbroughtbeforeit is in need of protectionand rehabilitation, theCourtmay—
(a) order the child tobe detained in a place of refuge forsuchperiodnotexceedingthreeyearsfromthedateoftheorderastheCourtmayinthebestinterestsofthechilddeemfit;or
(b) make an order placing the child under the supervisionofaSocialWelfareOfficerappointedbytheCourtforsuchperiodnotexceedingthreeyearsfromthedateoftheorderastheCourtmayintheinterestofsuchchild
deemfit.
(8) Theordermade under subsection (7)mayhave theeffectofextendingtheperiodofsuchdetentionorsupervision,asthecasemaybe,beyondthedateonwhichthechildattainstheageofeighteenyears.
(9) Subsections 40(12) to (14) shall apply in respect of anyordermadeundersubsection(7)astheyapplytoanordermadeunder section 40.
(10) If the Court For Children is not satisfied that the childbroughtbeforeitisinneedofprotectionandrehabilitation,theCourt For Children shall order the child to be returned to thecareandcustody of his parent orguardian.
Chapter 2
OFFENCES
Offences
43. (1) Anypersonwho—
(a) sells, lets forhireorotherwise disposesof, or buys orhires or otherwise obtains possession of, a child withintentthatthechildistobeemployedorusedforthepurposeofprostitution,eitherwithinoroutsideMalaysia,
or knowing or having reason to believe that the childwillbesoemployedorused;

(b) procuresachildforpurposesofprostitutionorforthepurposes of having sexual intercourse with any otherperson, eitherwithin oroutsideMalaysia;
(c) byorunderanyfalsepretence,falserepresentation,orfraudulentordeceitfulmeansmadeorused,eitherwithinoroutsideMalaysia, brings or assists inbringing into,or takes out of or assists in takingout of,Malaysia, achild with intent that the child is to be employed orusedforpurposesofprostitution,eitherwithinoroutsideMalaysia,orknowing or having reason tobelieve thatthechildwillbesoemployedorused;
(d) bringsintoMalaysia,receivesorharboursachildknowing
or having reason to believe that the child has beenprocuredforpurposesofprostitutionorforthepurposesofhavingsexualintercoursewithanyotherperson,eitherwithinoroutsideMalaysia,andwithintenttoaidsuchpurpose;
(e) knowing or having reason to believe that a child hasbeenbroughtintoMalaysiainthecircumstancesassetout in paragraph (c) or has been sold, let for hire, orhired or purchased in the circumstances as set out in
paragraph (a),orincontraventionofanyotherwrittenlaw receives or harbours the child with intent that heis tobe employed orused for purposes of prostitutioneitherwithin oroutsideMalaysia;
(f) detains a child inabrothel against the child’swill;
(g) detainsachildinanyplaceagainstthechild’swillwithintent that the child is to be employed or used forpurposesofprostitutionorforanyunlawfulorimmoral
purpose;
(h) bymeansofanyadvertisementorothernoticepublishedinanymanneror displayed inanyplace offersa childfor purposes of prostitution or seeks information forthat purpose or accepts such advertisement or noticeforpublication ordisplay;
(i) actsasanintermediaryonbehalfofachildorexercisescontrol or influence over the movements of a child in
such amanner as to show that the person is aiding orabetting or controlling theprostitution of that child;

(j) engagesorhires,foranyvaluableconsideration,achildtoprovideservices for that person’s sexualgratification;
(k) attemptstodoanyactincontraventionofthissection,
commits anoffenceand shall onconviction—
(aa) in the case of offences under paragraphs (a) to (h) orparagraph (k), be liable to a fine not exceeding fiftythousand ringgit or to imprisonment for a term notexceedingfifteenyearsortoboth;and
(bb) inthecaseofanoffenceunderparagraph (i) or (j),beliable to a fine not exceeding fifty thousand ringgit
and to imprisonment for a term of not less than threeyearsbutnotmorethanfifteenyearsandshallalsobepunishedwithwhippingofnotmorethansixstrokes.
(2) Any person who is convicted of a second or subsequentoffence—
(a) underparagraphs(1)(a) to(g) orparagraph(1)(k),shallbeliabletowhippingofnotmorethantenstrokes;and
(b) under paragraphs (1)(i) or (j), shall be punished withwhippingofnotlessthansixstrokesbutnotmorethantenstrokes,
in addition to any term of imprisonment imposed in relation tosuchoffence.
(3) Sections 173a and 294 of the Criminal Procedure Codeshall not apply in respect of offences under paragraphs (1)(i)and (j).
Presumptions relating to section 43
44. For the purposes of section 43, it shall be presumed untilthe contrary is proved that aperson—
(a) who takes or causes tobe taken into a brothel a childhasdisposedofthechildwiththeintentorknowledgementioned in paragraph43(1)(a);
(b) whoreceivesachildintoabrothelorharboursachildinabrothelhasobtainedpossessionofthechildwiththeintent orknowledgementioned inparagraph43(1)(a);

(c) hasdetainedachildinanybrothelorinanyplaceagainst
thechild’swillif,withintenttocompelorinducehim
toremaininthebrothelortheplace,thatperson—
(i) withholds from the child anywearing apparel or
anyotherpropertybelongingtothechildorany
wearing apparel commonly or last used by the
child;
(ii) threatens the childwith legal proceedings if the
child takes away any wearing apparel or any
other property which has been lent orhired out
orsuppliedtothechild;
(iii) threatens thechildwithlegalproceedings forthe
recoveryofanydebtorallegeddebtorusesany
otherthreat;or
(iv) without any lawful authority detains the child’s
identity card issued under the law relating to
national registration or thechild’s passport.
Detention pending proceedings
45. (1) AnyCourtinquiringintoor tryinganyoffencespecified
in the Second Schedule (in this Act referred to as “scheduled
offence”)may order a child—
(a) withrespecttowhomascheduledoffenceisallegedto
havebeen committed; and
(b) whomtheCourt considers to be inneed of protection,
tobedetainedtemporarilyinaplaceofsafetyuntilthedetermination
of the proceedings against the person chargedbut thedetention
shall not extend beyond the dateon which the child attains the
age ofeighteenyears.
(2) Notwithstanding thedeterminationof theproceedings,the
Court may, on an applicationmade by the Protector and if the
Courtissatisfiedthatachildisinneedofprotection,orderthe
detention of the child in a place of safety in accordance withparagraph 30(1)(d).

BEYONDCONTROL
Children beyond control
46. (1) If the parent or guardian of a child requests the CourtForChildreninwritingtodetainachildinanapprovedschool,placeofrefuge,probationhostelorcentreonthegroundthattheparentorguardianisunabletoexercisepropercontroloverthechild,theCourtForChildren—
(a) shall immediately inquireinto the circumstancesof thechild’s case;
(b) shall direct the probationofficer to submita probationreporttotheCourtForChildrenfortheCourttodeterminewhetheranorderundersubsection(2)maybemadeinrespectofthechild;and
(c) may order the child to be temporarily detained in anapproved school, place of refuge, probation hostel orcentreifitdeemsitnecessarytodoso.
(2) If after considering the report referred to in paragraph(1)(b) theCourtForChildrenissatisfiedthat—
(a) itisexpedientsotodealwiththechild;and
(b) theparentorguardianunderstandstheresultswhichwillfollow fromand consents to themaking of the order,
the Court For Children may, on the recommendation of theprobationofficer, order that thechild—
(aa) besenttoanapprovedschool,placeofrefuge,probationhostel orcentre, asmaybe appropriate;or
(bb) beplacedforsuchperiodnotexceedingthreeyearsunderthe supervision of—
(i) a probation officer; or
(ii) some other person appointed for the purpose bytheCourt,
andanysuchordermayrequire thechild toresidefora period not exceeding twelve months in a probationhostel.

Supervision by probation officer
47. (1) IfaCourtForChildrenmakesanorderunderparagraph
46(2)(bb) placing a child under the supervision of a probationofficerorofsomeotherperson,thatofficerorotherperson—
(a) shall,whiletheorderremainsinforce,visit,adviseandbefriend the child;and
(b) may,if itappearsnecessarytodoso,atanytimewhilethe order remains in force, bring the child before theSupervisingCourt.
(2) The Supervising Court before whom a child is broughtunder paragraph (1)(b) may, if it deems it expedient to do so,amend the ordermade under section 46 and—
(a) sendthechild,subjecttotheconsentofthechild’sparentor guardian, to an approved school, place of refuge orcentre, whichever is appropriate; or
(b) place the child in the care of a fit and proper person,whether a relative or not,who is willing to undertakethe care of the child, for the unexpired period of theorder.
part VIII
TRAFFICKING INANDABDUCTIONOFCHILDREN
Unlawful transfer of possession, custody or control of child
48. (1) Anypersonwho takespart inany transaction theobjector one of the objects of which is to transfer or confer, whollyor partly, temporarily or permanently, the possession, custodyorcontrolofachildforanyvaluableconsiderationcommitsanoffenceandshallonconvictionbeliabletoafinenotexceedingtenthousandringgitortoimprisonmentforatermnotexceedingfiveyearsortoboth.
(2) Anypersonwhowithoutlawfulauthorityorexcuseharbours
orhasinhispossession,custodyorcontrolachildwithrespecttowhomthetemporaryorpermanentpossession,custodyorcontrolhas been transferred or conferred for valuable consideration by

anyotherpersonwithinoroutsideMalaysiacommitsanoffenceand shall on conviction be liable to a fine not exceeding tenthousand ringgit or to imprisonment for a term not exceeding
fiveyearsortoboth.
(3) Forthepurposesofsubsection (2),ifanypersonharboursorhasinhispossession,custodyorcontrolachildwithoutlawfulauthorityorexcuse,thechildshall,untilthecontraryisproved,be presumed tobe a child with respect towhom the temporaryorpermanentpossession,custodyorcontrolhasbeentransferredor conferred forvaluable consideration.
(4) Itshallbeadefenceinanyprosecutionunderthissection
toprovethat—
(a) thetransfertookplaceincontemplationoforpursuanttoabona fide marriageor adoption; and
(b) at least one of the natural parents of the child or theguardian of the child was a consenting party to themarriageortotheadoptionbytheadoptingparty,
and had expressly consented to the particular marriage oradoption.
Importation of child by false pretences
49. Any personwho—
(a) byorunderanyfalsepretenceorrepresentationmade;or
(b) by fraudulent ordeceitfulmeansused,
eitherwithinoroutsideMalaysia,bringsorassistsinbringingachildintoMalaysiacommitsanoffenceandshallonconvictionbe liable to a fine not exceeding ten thousand ringgit or toimprisonment for a termnot exceeding five years or to both.
Examination of child and person in charge
50. AProtectororanypersonauthorizedinwritingbyaProtectormayrequire—
(a) achildwhohasenteredorbeenbroughtintoMalaysia;and

toappearbeforehim,atanyreasonabletimeandatanyconvenientplace,tobeexaminedpursuanttosection113.
Protector may require security
51. If a Protector has reasonable cause to bel ieve that achild—
(a) hasbeenbroughtintoMalaysiaeither—
(i) a fter having been transferred for valuableconsideration;or
(ii) by fraud, misrepresentation or any falsepretence;
(b) has been transferred to the custody or control of anypersonforvaluableconsiderationeitherwithinoroutsideMalaysia; or
(c) isbeingdetainedagainsthiswillbysomepersonotherthanhisparentorguardian,
the Protectormay—
(aa) require any person in whose custody or under whosecontrolthechildappearstobe—
(i) tofurnishhimwithcopiesofthechild’sandthatperson’s ownphotographs;and
(ii) tofurnishsecuritytothesatisfactionoftheProtectorthatthechild—
(A) will not leave the area or the State in whichhetheniswithoutthepriorwrittenconsentoftheProtector;
(B) willnotbe transferred to thecareorcustodyofanyotherpersonwithoutthepriorwrittenconsent of theProtector; and
(C) willbeproducedbeforetheProtectorwheneverthe Protector requires; or

(bb) inthefirstinstance,orifdefaultbemadeincomplyingwith any order made under paragraph (aa), make anorderthat—
(i) thechildbetakenoutofthecustodyofthepersoninwhosecare,custodyorcontrolthechildisandplacedthechildinaplaceofsafety;or
(ii) on such security and on such conditions as theProtector may require, the child be placed inthecustodyofarelativeorotherfitandproperperson,
until the child attains the age of eighteen years or foranyshorterperiod.
Offence of taking or sending out a child without appropriateconsent of person having lawful custody
52. (1) Anyparentor guardianwho—
(a) doesnothavethelawfulcustodyofachild;and
(b) takes or sends out a child, whether within or outsideMalaysia,
withouttheconsentof thepersonwhohas the lawfulcustodyofthe child commits an offence and shall on conviction be liabletoafinenotexceedingtenthousandringgitortoimprisonmentforatermnotexceedingfiveyearsortoboth.
(2) Apersonhaslawfulcustodyofachildunderthissectionif
hehasbeenconferredcustodyofthechildbyvirtueofanywrittenlaworbyanorderofaCourt,includingaSyariahCourt.
(3) It shall be a defence under this section if a parent orguardiantakesorsendsachildawaywithouttheconsentofthepersonhavinglawfulcustodyofthechildif—
(a) the parentor guardian—
(i) doesitinthebeliefthattheotherpersonconsented,
orwouldhaveconsented,ifhewasawareofalltherelevant circumstances; or

(ii) has taken all reasonable steps to communicatewith the other person but has been unable tocommunicatewithhim;
(b) theparentorguardianhasreasonablegroundstobelievethat thechildis beingabused,neglected, abandonedorexposedinamannerlikelytocausethechildphysicalor emotional injury;or
(c) theotherpersonhasunreasonablyrefusedtoconsentalthoughhewasawareofalltherelevantcircumstances.
Recovery order
53. (1) If itappears totheCourt thatthere isreason tobelievethatachildhadbeentakenorsentawaywithouttheconsentofthe personwho has lawful custody of the child as described insection52,theCourtmaymakearecoveryorder.
(2) ArecoveryordermaybemadebytheCourtonapplicationbeingmade by or on behalf of any person who has the lawfulcustodyofthechild.
(3) For the purposes of this sect ion, a “recovery order”may—
(a) directanypersonwhoisinapositiontodosotoproducethechildonrequesttoanyauthorizedperson;
(b) authorize the removal of the child by any authorizedperson;
(c) requireanypersonwhohasinformationastothechild’s
whereaboutstodisclosethatinformationtotheauthorizedperson;
(d) authorizeanypoliceofficertoenterintoanypremisesspecified in the order and search for the child, usingreasonable force if necessary.
(4) Any person who intentionally obstructs an authorizedpersonfromexercisingthepowersundersubsection(3)commitsanoffenceandshallonconvictionbeliableto imprisonmentfor
atermnotexceedingthreeyearsandtowhippingnotexceedingsixstrokes.

Child who escapes or is removed from place of safety or place
of refuge
56. Anychildwhoescapesorisremovedfromaplaceofsafety
orplaceof refugewithout lawfulauthority—
(a) maybe arrestedwithout awarrant by anyProtector or
policeofficerandshallbebroughtbacktotheplaceof
safetyorplaceofrefuge;and
(b) shall bedetained—
(i) in the case of a place of safety, for such period
which is equal to the unexpired residue of his
stayundertheorderoriginallymadebytheCourtFor Children; and

Offence of removing or helping a child to escape from place
of safety or place of refuge
57. Any personwho—
(a) removesachildfromaplaceofsafetyorplaceofrefuge
without lawfulauthority;
(b) knowinglyassistsorinduces,directlyorindirectly,achild
to escape from a place of safety or a place of refuge;
or
(c) knowingly harbours or conceals a child who has so
escaped, or prevents him from returning to the place
ofsafetyorplaceofrefuge,
commits an offence and shall on conviction be liable to a fine
notexceedingtenthousandringgitortoimprisonmentforaterm
notexceedingfiveyearsortoboth.
Chapter2
PLACESOFDETENTION
Places of detention
58. (1) TheMinistermay,bynotificationintheGazette,establish
or appoint such places of detention as may be required for the
purposes of thisAct.
(2) Achildshallordinarilyberemanded incustody inaplace
ofdetentionestablishedorappointedunderthisActandsituated
inthesameStateinwhichissituatedtheCourtForChildrenbywhichthechildisremanded.

(3) The order or judgment in pursuance of which a child iscommitted tocustody inaplace of detention shall be—
(a) deliveredwiththechildtothepersoninchargeofthe
placeofdetention;and
(b) anauthorityforhisdetentionintheplaceofdetentioninaccordancewiththetermsoftheorderorjudgment.
(4) Achildwhilebeingdetainedandwhilebeingconveyed toandfromtheplaceofdetentionshallbedeemedtobeinlawfulcustody.
(5) TheMinister—
(a) shallcauseplacesofdetentiontobeinspected;and
(b) maymake regulations—
(i) astotheclassification,treatment,employmentandcontrol of children detained in such places ofdetention; and
(ii) to provide for the appointment of fit and properpersons to visit periodically children detained in
suchplacesofdetention.
Child who escapes or is removed from place of detention
59. Anychildwhoescapesorisremovedfromaplaceofdetentionwithout lawfulauthority—
(a) may be arrested without a warrant by any Protectoror police officer and be brought back to the place of
detention; and(b) shallbedetainedintheplaceofdetentionfortheunexpiredresidueofhistermofdetentionundertheorderoriginallyissuedbytheCourtForChildren.
Offence of removing or helping a child to escape from placeof detention
60. Any personwho—
(a) removesachildfromaplaceofdetentionwithoutlawfulauthority;

Chapter 3
PROBATIONHOSTELS
Probation hostels
61. (1) TheMinistermay,bynotificationintheGazette,establishor appoint such probation hostels as may be required for thepurposes of thisAct.
(2) The Minister may make regulations for the regulation,management and inspectionofprobationhostels.
Child under ten years of age not to be sent to probationhostel
62. ACourtForChildrenshallnotmakeanorderrequiringachildundertheageoftenyearstobesenttoaprobationhostel.
Child who escapes or is removed from probation hostel
63. Anychildwhoescapesorisremovedfromaprobationhostelwithout lawful authority—
(a) maybearrestedwithoutawarrantbyanyprobationofficeror policeofficer; and
(b) bebroughtbacktothathostelorbeforetheSupervisingCourt,
andtheSupervisingCourtmaydealwithhimfortheoffencefor
whichhewassentto theprobationhostelin thesamemanner inwhich the Supervising Court could dealwith him if it had justfoundhimguiltyofthatoffence.

64. Any personwho—(a) removesachildfromaprobationhostelwithoutlawfulauthority;
(b) knowingly assists or induces, directly or indirectly, achild toescape fromaprobationhostel;or
(c) knowingly harbours or conceals a child who has soescaped,orpreventshimfromreturningtotheprobationhostel,
commits an offence and shall on conviction be liable to a finenotexceedingtenthousandringgitortoimprisonmentforatermnotexceedingfiveyearsortoboth.
Chapter 4
APPROVEDSCHOOLS
Approved schools
65. (1) TheMinistermay,bynotificationintheGazette,establishor appoint such approved schools as may be required for theeducation,traininganddetentionofchildrentobesentthereinpursuanceof thisAct.
(2) TheMinistermayclassify such approved schools—
(a) accordingto theagesof thepersonsforwhomtheyareintended;and
(b) insuchotherwaysashemaythinkfitsoastoensurethat a child sent to an approved school is sent to aschoolappropriate tohiscase.
Child under ten years of age not to be sent to approvedschool
66. ACourtForChildrenshallnotmakeanorderrequiringachildundertheageoftenyearstobesenttoanapprovedschool.

When a child can be sent to approved school
67. (1) If—
(a) achildisfoundguiltyofanyoffence;
(b) theprobationreportsubmittedtotheCourtForChildren
showsthat—
(i) theparentsorguardianofthechildcannolonger
exerciseorisincapableofexercisinganyproper,
controloverhim;and
(ii) thechildisinneedofinstitutionalrehabilitation;
and
(c) it appears to the Court For Children that although the
offence committed is not serious in nature but it isexpedientthatthechildbesubjecttodetentionforsuch
termandundersuchinstructionanddisciplineasappears
mostconducivetohisreformation,
the Court For Children shall, on the recommendation of the
probationofficer, send thechild to anapproved school.
(2) If a Court For Children orders a child to be sent to an
approvedschool,theordershallbeanauthorityforhisdetention
inthatapprovedschoolforaperiodofthreeyearsfromthedate
of the order.
(3) Notwithstanding subsection (2) the Board of Visitors
of the approved school to which a child is sent may, in their
discretion—
(a) shortentheperiodofdetentionforreasonswhichappear
tothemtobesufficient;or
(b) permitanysuchchildtobereleasedforsuchperiodand
upon such conditionsas theymaydeem fit to impose.
(4) A child shall not be permitted to be released from an
approved school under paragraph (3)(b) during the first twelve
monthsoftheperiodofdetentionwithout theconsent inwritingoftheMinister.

Approved school order to be delivered to the authority, etc.,who conveys child to the school
68. (1) TheCourtForChildrenwhichmakesanapprovedschoolorder shall cause it to be delivered to the authority or personresponsibleforconveyingthechildtotheschool,andtheauthorityor personwho conveys the child to the school shall deliver theapprovedschoolordertothepersonforthetimebeinginchargeoftheschool.
(2) TheCourtForChildrenwhichmakesan approved schoolorder shall cause all such information in the possession of theCourt with respect to a child as is in the opinion of the Court
shouldbe knownby the person for the timebeing in charge oftheschool,tobetransmittedtothepersonforthetimebeinginchargeoftheschool.
(3) If a child has been ordered to be sent to an approvedschool, any person who knowingly harbours or conceals himafter the timehascome forhim to go totheschoolcommits anoffenceandshallonconvictionbeliabletoafinenotexceedingtenthousandringgitortoimprisonmentforatermnotexceedingfiveyearsortoboth.
(4) Ifapersonauthorizedtotakeachildtoanapprovedschoolis,whenthetimehascomeforhimtogototheschool,unableto—
(a) findthechild;or
(b) obtainpossession of thechild,
theCourtForChildrenmay,ifsatisfiedbyinformationonoath
or affirmation that there is reasonable ground for believing thatsome person named in the information can produce the child,issue a summons requiring the person so named to attend attheCourt on such dayasmaybe specified inthesummonsandproduce the child.
(5) If thepersonreferredto in subsection (4) failsto complywith the requisition under that subsection without reasonableexcuse he shall, in addition to any other liability to which hemay be subject to under thisAct, on conviction be liable to afine notexceeding ten thousand ringgit.

Further detention in approved school beyond period of order
69. If the person for the time being in charge of an approvedschoolissatisfiedthatachild—
(a) whoseperiodofdetentionintheapprovedschoolisabouttoexpireneeds furthercare or training; and
(b) cannotbe placed in suitable employmentwithout suchfurthercareortraining,
hemay, iftheBoardofVisitorsof theapprovedschoolconsent,detainhimforafurtherperiodnotexceedingsixmonthsbutany
suchperiodshallnotextendbeyondthedatethechildattainstheageofeighteenyears.
Aftercare of child released from approved school
70. If a child is sent to an approved school, the Court ForChildrenmakingtheordershall,atthesametime,makeanorderthat after the expiration of the period of his detention he shall,foraperiodofoneyear,beunderthesupervisionof—
(a) a probationofficer; or
(b) suchotherpersonastheChildWelfareCommitteemayappoint.
Escape from approved school, etc., or failure to return toapproved school after expiry of leave, etc.
71. (1) Anychildwho—
(a) escapesfromtheapprovedschoolinwhichheisdetained,or from any hospital, home or place in which he isreceivingmedical attention;
(b) being absent from the approved school on temporaryleaveof absenceorwith permission—
(i) runsawayfromthepersoninwhosechargeheis;or
(ii) fails to return to the approved school upon theexpiration of his leave, or upon the revocationofsuchpermission;or

(c) beingabsentfromtheapprovedschoolundersupervision,fails to return to the approved school upon beingrecalled,
may be arrested without a warrant and be brought before theCourt For Children where the child is found or the approvedschoolissituated.
(2) If a child brought before a Court For Children undersubsection (1) isunder the ageof fourteenyears, theCourt ForChildrenshallorderthechildtobebroughtbacktotheapprovedschoolor tobe sent toanother approved school for—
(a) a periodwhich is equal to the periodduringwhich he
was unlawfully at large;
(b) theremainderofhisperiodofdetention;and
(c) suchperiodnotexceedingsixmonthsastheCourtmaydirect,inadditiontotheperiodsmentionedinparagraphs(a) and (b).
(3) If a child brought before the Court For Children undersubsection (1) has attained the age of fourteen years, the CourtForChildrenmayorderthechild—
(a) tobebroughtbacktotheapprovedschoolor tobesentto another approved school for—
(i) aperiodequaltotheperiodduringwhichhewasunlawfullyatlarge;
(ii) the remainder of his period of detention; and
(iii) such furtherperiodnot exceeding sixmonthsastheCourtmaydirect;or
(b) ifcircumstanceswarrant itandonthe recommendationoftheprobationofficertheCourtthinksitnecessarytodo so, to be sent to a Henry Gurney School for suchperiodastheCourtmaydirect.
Offence of removing or helping a child to escape from approvedschool
72. Any personwho—(a) removesachildfromanapprovedschoolwithoutlawfulauthority;

(c) knowingly harbours or conceals a child who has so

commits an offence and shall on conviction be liable to a finenotexceedingtenthousandringgitortoimprisonmentforatermnotexceedingfiveyearsortoboth.
Chapter 5
HENRYGURNEYSCHOOLS
Henry Gurney Schools
73. TheMinistermay, by notification in theGazette, establishor appoint such Henry Gurney Schools as may be required forthepurposesofthisAct.
Child under fourteen years of age not to be sent to HenryGurney School
74. A Court For Children shall not make an order requiringa child under the age of fourteen years to be sent to a HenryGurneySchool.
When a child can be sent to Henry Gurney School
75. (1) If—
(a) a child is found guilty of any offence punishablewithimprisonment;
(b) theprobationreportsubmittedtotheCourtForChildrenshowsthat—
(i) theparentsorguardianofthechildcannolongerexerciseorisincapableofexercisinganypropercontroloverhim;
(ii) thechild ishabitually in thecompanyofpersonsofbad character;and

(iii) thechild isnot suitable tobe rehabilitated in anapproved school; and
(c) itappearstotheCourtForChildren— (i) that the offence committed is serious in nature;
and
(ii) by reason of the nature of the child’s criminalhabitsandtendenciesitisexpedientthatthechildbe subject todetention for such termandundersuch instruction and discipline as appears mostconducive to his reformationand the repressionofcrime,
the Court For Children shall, on the recommendation of theprobationofficer,sendthechildtoaHenryGurneySchool.
(2) IfaCourtForChildrenordersachildagedfourteenyearsorabovetobesenttoaHenryGurneySchool—
(a) theordershallbe—
(i) anauthorityforhisdetentionforaperiodofthreeyearsfromthedateoftheorder;and
(ii) valid for his detentionup to but not after he hasattainedtheageoftwenty-oneyears;and
(b) sections 68 to 72 shall apply with the fol lowingmodifications:
(i) forthewords“approvedschool”whereverappearingthereshallbesubstitutedthewords“HenryGurneySchool”; and
(ii) insection69,forthewords“theBoardofVisitorsof the approved school consent” there shall besubstituted the words “the Director General ofPrisons in the case of a Henry Gurney Schoolconsents”andtheagereferredtointhatsectionshallbeincreasedbythreeyears.
(3) Notwithstanding subsection (2), the Director General ofPrisonsmay, inhisdiscretion—
(a) shorten the period of detention of a child in a HenryGurney School for reasons which appear to him to besufficient;or

Chapter 6

Power in respect of persons of eighteen years but undertwenty-one years of age
76. Notwithstanding anything in this Act, the High Court, aSessions Court and a Magistrate’s Court shall have the powertoorder thedetention, inaHenryGurneySchool,up tobutnotafterhehasattainedtheageoftwenty-oneyears,ofanypersonwhohas attained the age of eighteenyears but has not attainedthe ageof twenty-one years at the dateofmaking such order.
Power of Minister to remove person undergoing imprisonmentto Henry Gurney School
77. (1) TheMinistermay,bywarrantunderhishand,directanypersonwho—
(a) hasattainedtheageofeighteenyearsbuthasnotattainedtheageoftwenty-oneyears;and
(b) isinprisonunderasentenceofimprisonment,
toberemovedtoaHenryGurneySchool.
(2) If awarrantismadeunder subsection(1)—(a) the unexpired residue of that person’s prison sentenceshallbedeemedtobecancelled;and
(b) suchwarrant shall be an authority for the detentionofthatpersonintheHenryGurneySchoolunderthisActuntil the date when his sentence, less any remissionfor good conduct earnedwhile serving his sentence inprison,would,but for this section, have expired.
(3) A warrant under subsection (1) shall not be made unlessthe ageof the personand the unexpired residueof his sentence

78. (1) TheMinister may, by warrant under his hand, direct achild who is in prison under an order of imprisonment to beremovedtoanapprovedschooloraHenryGurneySchool.
(2) If awarrantismadeunder subsection (1)—
(a) theunexpired residue of that child’s prisonorder shallbedeemedtobecancelled;and
(b) suchwarrant shall be an authority for the detention ofthatchildintheapprovedschoolortheHenryGurneySchool, as the case may be, under this Act until thedatewhenhisprisonorder,lessanyremissionforgoodconductearnedwhileservinghistermofimprisonment,would,butforthissection,haveexpired.
(3) TheMinister may, at any time for reasonswhich appeartohimtobesufficient,byorderinwritingdirecttheremovalofanychildfrom—
(a) anapprovedschooltoanyotherapprovedschoolortoaHenryGurneySchool;or
(b) aHenryGurneySchooltoanyotherHenryGurneySchoolortoanapprovedschool,
asmaybespecifiedintheorder.
Power to subst i tute term of detent ion to term of imprisonment
79. IfitismadetoappeartoanyCourtForChildrenupontheapplication of the person in charge of any approved school orHenry Gurney School that any child detained in the approvedschoolorHenryGurneySchoolunderthisAct—
(a) hasbeenguiltyofaseriousandwilfulbreachoftherulesoftheapprovedschoolorHenryGurneySchool;

theCourtForChildrenmaysubstitutefortheunexpiredresidueofthetermofdetentionofthatchildsuchtermofimprisonmentnotexceeding theunexpired residue as the Courtmay determine.
Transfer of child from one place of safety or place of refuge
to another place of safety or place of refuge
80. Withoutprejudicetoanywrittenlawrelatingtoimmigration,wheneveranorderhasbeenmadeunderthisActforthedetentionofachildinaplaceofsafetyorplaceofrefugeanditappearsto the Director General that in the best interests of the child itis expedient that he be transferred from that place of safety orplace of refuge to another place of safety or place of refugewithin Malaysia, it shall be lawful for the Director General toissue an order that the child shall be so transferred.

MISCELLANEOUS
Child or person detained to be subject to regulations
81. Everychilddetainedinanyplaceofsafetyorplaceofrefuge,
place of detention, probation hostel, approved school orHenryGurneySchool,oreverypersondetainedinaHenryGurneySchoolunderthisActshallduringtheperiodofthechild’sorperson’sdetention,be subject to such regulations asmay beprescribed.
Board of Visitors
82. TheMinistermayappointforeachplaceofsafety,placeof
refugeandapprovedschoolaBoardofVisitorstoperformsuchdutiesand functionsas theMinistermay prescribe.

Chapter 1
CHARGE,BAIL, ETC .
Trials of children to be in conformity with this Act
83. (1) Notwithstanding anything contained in anywritten lawrelating to the arrest, detention and trial of persons committingany offence but subject to subsections (3) and (4), a child whois alleged to have committed an offence shall not be arrested,detainedortriedexceptinaccordancewiththisAct.
(2) WhenachildischargedwithanoffencebeforeaCourtForChildrenandduringthependencyofthecaseheattainstheageof eighteen years theCourt ForChildren shall, notwithstandingany provisions of thisAct, continue to hear the charge againstthechildandmay—
(a) exercisethepowerundersection76;(b) exercisethepowerunderparagraph91(1)(a),(b),(c),(d)or (g);or
(c) iftheoffenceispunishablewithimprisonment,imposeany termof imprisonmentwhich could be awarded byaSessionsCourt.
(3) When an offence is committed by a child but a charge
inrespectof thatoffence ismade against the child after he hasattainedtheageofeighteenyears,thechargeshallbeheardbyaCourtotherthanaCourtForChildrenandthatotherCourtmayexercise the powermentioned in paragraph (2)(a), (b) or (c).
(4) A charge made jointly against a child and a person whohasattainedtheageofeighteenyearsshallbeheardbyaCourtother thanaCourt ForChildren and that other Court shall—
(a) exerciseinrespectofthechildallthepowerswhichmay
be exercised under this Act by a Court For Children;and

(b) beforeexercisingthepowersreferredtoinparagraph(a),consider the probation report.
Bail
84. (1) Ifachildisarrestedwithorwithoutawarrant,thechildshallbebroughtbefore aCourtForChildrenwithintwenty-fourhours exclusive of the time necessary for the journey from theplaceofarresttotheCourtForChildren.
(2) If it is not possible to bring a child before a Court ForChildren within the time specified in subsection (1), the childshall be brought before a Magistrate who may direct that thechildberemandedinaplaceofdetentionuntilsuchtimeasthechildcanbebroughtbeforetheCourtForChildren.
(3) The Court For Children before whom a child is broughtshallinquireintothecaseandunless—
(a) thechargeisoneofmurderorothergravecrime;
(b) itisnecessary inthebest interestsof thechildarrestedto remove him from association with any undesirable
person;or
(c) the Court For Children has reason to believe that therelease of the childwould defeat the ends of justice,
theCourtForChildrenshallreleasethechildonabond,withorwithout sureties, for such amount as will, in the opinion of theCourtForChildren,securetheattendanceofthatchilduponthehearingofthecharge,beingexecutedbyhisparentorguardianorother responsible person.
(4) Nothing in this section shall be deemed to affect thepowers of a police officer to release the child arrested on bailin accordancewith theCriminal ProcedureCode.
Separation of child from adult in police stations or Courts
85. Appropriate arrangements shall bemade—
(a) topreventachildwhile— (i) being detained in a police station;

(ii) being conveyed to or from anyCourt; or
(iii) waitingbeforeor after attendance in anyCourt,
fromassociatingwithanadultwho ischargedwithanoffence;
(b) toensurethatachild,ifagirl,whilebeingsodetainedorconveyed,orwaiting,isunderthecareofawoman;and
(c) topreventthepictureofachildwhile—
(i) being detained in a police station;
(ii) being conveyed to or from anyCourt; or
(iii) waitingbefore or after attendance in anyCourt,
frombeing recorded in anymanner on tapeor f ilmorbyany electronicmedium.
Custody of child not discharged on bail after arrest
86. (1) If a child havingbeen arrested andwhile awaiting trial
beforeaCourtForChildrenisnotreleasedundersection84,theCourtForChildrenbeforewhomthechildisbroughtshallcausehim to be detained in a place of detention provided under thisActuntilhecanbebroughtbeforetheCourthavingjurisdictionunless the CourtForChildren certifies that—
(a) itisimpracticabletodoso;
(b) heisofsounrulyordepravedacharacterthathecannotbesafelysodetained;or
(c) byreasonofhisstateofhealthorofhismentalorbodilycondition it is inadvisableso todetainhim.
(2) Under the circumstances referred to in paragraph (1)(a),(b) or (c),theCourtForChildrenshallhavethepowertoorderthechildtobedetained—
(a) inapolicestation,policecellorpolicelock-up,separateorapartfromadultoffenders;or
(b) inamentalhospital,
asthecasemayrequire.

(3) Ifanorderfordetentioninamentalhospitalismadeundersubsection (2),ChapterXXXIIIoftheCriminalProcedureCodeshall applywith suchmodificationsasmay benecessary.
Submission of information by police officer after arrest
87. Afterthearrestofachild, thepoliceofficerorotherpersonmaking thearrest shall—
(a) immediately informa probation officer and thechild’sparentorguardianofthearrest;and
(b) if the child is charged with any offence, cause to be
transmittedtotheprobationofficeracopyofthechargeandotherinformationnecessarytoenabletheprobationofficertotakesuchactionasmaybenecessarytoprepareorobtain,asthecasemaybe,aprobationreport.
Chapter 2
TRIALS
Parent or guardian required to attend
88. (1) If a child is charged with any offence, the Court ForChildren shall require the child’s parents or guardian to attendat the Court For Children before which the case is heard ordetermined during all the stages of the proceedings, unless theCourtForChildrenissatisfiedthatitwouldbeunreasonabletorequire theattendance of theparents orguardian.
(2) Anyparent or guardian of a childwho fails to attend theCourtForChildrenwhenrequiredtodosoundersubsection(1)commits an offence and shall on conviction be liable to a finenotexceedingfivethousandringgitortoimprisonmentforatermnotexceedingtwoyearsortoboth.
Parents or guardian may be required to withdraw
89. Ifin anycasetheCourtForChildrenconsidersit necessaryinthebestinterestsofthechild,theCourtmayrequirehisparentsorguardian,asthecasemaybe,towithdrawfromtheCourt.

Procedure in Court For Children
90. (1) IfachildisbroughtbeforeaCourtForChildrenforany
offence, it shall be the duty of the Court to explain to him insimple languagesuitable tohisage,maturity and understandingthesubstance of the alleged offence.
(2) Theduty referredto insubsection (1)maybeundertaken,underthesupervisionoftheCourtby—
(a) thedefencecounselactingforthechild;or
(b) any other responsible person as determined by theCourt.
(3) Afterthesubstanceoftheallegedoffencehasbeenexplainedtothechild,theCourtshallaskthechildwhetherheadmitsthefactsconstitutingtheoffence.
(4) If the child admits the facts constituting the offence, theCourt shall—
(a) ascertain that the child understands the nature andconsequences ofhisadmission;and
(b) recordafindingofguilt.
(5) Ifthechilddoesnotadmitthefactsconstitutingtheoffence,theCourtshallthenheartheevidenceofthewitnessesinsupportthereof.
(6) At thecloseof theevidencein chiefof eachwitness, thewitnessmaybe cross-examined by or on behalf of the child.
(7) TheCourtForChildrenshall,exceptifthechildislegallyrepresented,allowthechild’sparentsorguardianoranyrelativeor other responsible person to assist him in conducting hisdefence.
(8) If in any case where the child is not legally representedorassisted inhis defence as provided for in subsection (7), thechild, instead of askingquestionsbyway of cross-examination,makesassertions, theCourtForChildren—
(a) mayputtothechildsuchquestionsasmaybenecessaryinordertobringout,orexplainanythingin,theassertionsofthechild;and

(9) If it appears to theCourtthata prima facie caseismadeout—
(a) theCourtshallexplaintothechildthesubstanceoftheevidence against him and, in particular, any points intheevidencewhichspeciallytellagainsthimorrequirehis explanation;
(b) thechildshallbeallowedto—
(i) give evidence upon oath or affirmation; or
(ii) make any statement if he so desires; and
(c) the evidence of any witness for the defence shall beheard.
(10) If the Court For Children finds the child is not guilty,theCourt shall record an order of acquittal.
(11) If—
(a) afindingofguilthasbeenrecorded;or
(b) theCourtissatisfiedthattheoffenceisproved,
thechildandthechild’sparentorguardianorotherresponsibleperson,ifpresent,shallthenbeaskediftheydesiretosayanythinginextenuationormitigationofthepenaltyorotherwise.
(12) TheCourtForChildrenshall,beforedecidinghowtodeal
with the child, consider theprobation report.
(13) Aprobationreportreferred to insubsection (12)shallbepreparedbyaprobationofficerandthereport—
(a) shallcontain such information asto the child’sgeneralconduct,homesurroundings,schoolrecordandmedicalhistory as may enable the Court For Children to dealwiththecaseinthebestinterestsofthechild;andmayput to him any question arising out of the probation
report;and(b) mayincludeanywrittenreportofaSocialWelfareOfficer,

a registered medical practitioner or any other personwhom the Court For Children thinks fit to provide areportonthechild.
(14) Forthepurposeofobtainingaprobationreport,theCourtForChildrenmayfromtimetotimereleasethechildonbailorremandhiminaplaceofdetention.
(15) If the Court For Children has considered the probationreport,theCourtshallexplainto—
(a) thechildthesubstanceofanypartofthereportbearingonhischaracterorconductwhichtheCourtconsidersto
bematerialtothemannerinwhichheshouldbedealtwith;and
(b) theparentorguardian,ifpresent,thesubstanceofanypartof the report which the Court considers tobematerialto themanner inwhich the child shouldbe dealt withandwhichhasreferencetothecharacter,conduct,homesurroundings,orhealthof thechild.
(16) Ifthechildorhisparentorguardian,havingbeenexplained
the substance of any part of any such probation report undersubsection (15), desires to produce information with respect tothe report, the Court shall, if it thinks that the information ismaterial—
(a) adjournthehearingfortheproductionoffurtherinformation;and
(b) ifnecessary, require thepersonwhomadethe reporttoattend thehearingwhen it resumes.
(17) Before deciding on the order to be imposed, the Courtshallascertainfromeachoftheadvisershisopinionandallsuchopinions shall be recorded.
(18) Afterhavingrecordedandconsideredtheopinionsoftheadvisers,theCourtshalldecideontheordertobeimposed,butinsodoingtheCourt—
(a) shall not be bound to conform to the opinions of theadvisersoreitherofthem;and
(b) shall record its reasons for dissenting from suchopinions.

CONCLUSIONOFTHETRIAL
Powers of Court For Children on proof of offence
91. (1) If aCourt For Children is satisfied that an offence hasbeen proved the Court shall, in addition to any other powersexercisablebyvirtueofthisAct,havepowerto—
(a) admonish and discharge the child;
(b) dischargethechilduponhisexecutingabondtobeof
goodbehaviourandtocomplywithsuchconditionsasmaybeimposedbytheCourt;
(c) order thechild to beplaced in the care of arelativeorotherfitandproperperson—
(i) for such period to be specified by the Court;and
(ii) with such conditions asmay be imposed by theCourt;
(d) order the child topaya fine, compensationorcosts;
(e) makeaprobationorderundersection98;
(f) order the child to be sent to an approved school or aHenryGurneySchool;
(g) orderthechild,ifamale,tobewhippedwithnotmorethantenstrokesofalightcane—
(i) within the Court premises; and
(ii) inthepresence,ifhedesirestobepresent,oftheparentorguardianofthechild;
(h) imposeonthechild,ifheisagedfourteenyearsandaboveand the offence is punishable with imprisonment andsubject to subsection 96(2), any term of imprisonmentwhichcouldbeawardedbyaSessionsCourt.
(2) Thewords“conviction”and“sentence”shallnotbeusedinrelationtoachilddealtwithbytheCourtForChildrenandany

referenceinanywrittenlawtoapersonconvicted,aconviction
and a sentence shall, in the case of a child, be construed as a
child foundguilty, a finding of guilt andan ordermade upon a
finding of guilt respectively.
(3) A finding of guilt of a child shall be disregarded for thepurposesofanywrittenlawwhich—
(a) imposesanydisqualificationordisabilityuponaconvictedperson;or
(b) authorizes or requires the imposition of any suchdisqualification or disability.
Manner of executing whipping
92. The followingprovisionsshallbefollowedwhenexecuting
theorderofwhipping:
(a) beforeexecutingthewhipping,thechildshallbeexamined
byamedicalofficertocertifythatthechildisinafit
stateofhealthtoundergothewhipping;
(b) thepersonshallusealightcanewithaverageforcewithout
liftinghishandoverhisheadsothatthechild’sskinis
notcut;
(c) afterinflictingastroke,heshallliftthecaneupwardand
notpullit;
(d) whippingmaybeinflictedonanypartofthebodyexcept
theface,head,stomach,chestorprivateparts;
(e) thechildshallwearclothes;and
(f) ifduringtheexecutionofthewhippingthemedicalofficer
certifiesthatthechildisnotinafitstateofhealthto
undergo the remainder of the whipping, the whipping
shall be finallystopped.
Parent or guardian to execute bond
93. (1) TheCourt For Children shall, in addition to exercisingany of the powers provided for in subsection 91(1), order the

parentorguardianofthechildtoexecuteabondforthechild’sgood behaviour with orwithout security andwith one ormoreof thefollowingconditions:
(a) that the parent or guardian accompanied by the childshall report at regular intervals to be determined bythe Court, at the welfare department or police stationsituated nearest to the parent’s or guardian’s place ofresidence;
(b) thattheparentorguardianaccompaniedbythechildshallattend interactive workshops organized at designatedcentres established for such purpose;
(c) ifthechildisinaneducationalinstitution,thattheparentor guardian shall consult with the child’s teacher andheadteacherorprincipalonceamonthforthedurationofthebond;
(d) if the child is sent to an approved school or a HenryGurney School, that the parent or guardian shall visitthe child on a regular basis to be determined by theCourt;or
(e) anyother condition as the Court thinks fit.
(2) If anyparent or guardian fails to complywith anyof theconditionsofthebondreferredtoinsubsection(1)—
(a) theparentorguardiancommitsanoffenceandshallonconvictionbeliabletoafinenotexceedingfivethousandringgit;and
(b) theCourtmayorderthesecurity,ifany,tobeforfeited;and the provisions of the Criminal Procedure Code
relatingtotheforfeitureofbondsshallapplyinrelationto the security.
(3) An order under subsection (1) shall not be made againsta parent or guardian without giving the parent or guardian anopportunity tobeheard.
(4) Notwithstandingsubsection(3),anorderundersubsection(1)maybemadeiftheCourtForChildrenissatisfiedoninformation
given by a probation officer that the parent or guardian of thechild, having been required to attend,has failed to do so, or isnotavailableorcannotbefoundwithinareasonabletime.

Power to order parent or guardian to pay fine, etc., insteadof child
94. (1) If—
(a) achildischargedbeforeaCourtForChildrenwithanyoffence for thecommissionofwhich—
(i) a finemay be imposed; and
(ii) compensationor costs or both compensation andcostsmaybeawarded;and
(b) theCourtisoftheopinionthatthecasewouldbebestmetbytheimpositionofalloranyofthosepenalties,whetherwithorwithoutanyotherpunishment,
the Court shall order that the fine imposed and compensationorcostsawardedbepaidbytheparentorguardianofthechildinstead of by the child, unless the Court is satisfied that theparentorguardian—
(aa) isnotavailableorcannotbefoundwithinareasonabletime;or
(bb) hasnot conduced to the commission of the offencebyneglectingtoexerciseduecareofthechild.
(2) If—
(a) aCourtForChildrenthinksthatachargeagainstachildisproved;or
(b) a child admits the facts constituting the offence in thecharge,
t he Cour t may make an or der requi ri ng t he par ent orguardian—
(aa) topaycompensationorcosts;or
(bb) togive security for the good behaviourof the child,
without proceeding to record a finding of guilt against thechild.
(3) When the Court requires the parent or guardian to givesecurityforthegoodbehaviourofachildundersubsection(2),oneormoreoftheconditionsmentionedinsubsection93(1)shallbe imposed on the parentorguardian.

(4) Iftheparentorguardianfailstocomplywiththeconditionsofthesecurity,theCourtmayorderthesecuritytobeforfeited.
(5) An order under this section shall not be made againstthe parent orguardian of the childwithoutgiving the parent orguardian anopportunity tobeheard.
(6) Notwithstandingsubsection(4),anorderunderthissectionmaybemadeiftheCourtForChildrenissatisfiedoninformationgiven by a probation officer that the parent or guardian of thechild, having been required to attend, has failed to do so or isnotavailableorcannotbefoundwithinareasonabletime.
(7) Any sum imposed and ordered to be paid by a parent orguardianofachildunderthissectionoronforfeitureofanysuchsecurity may be recovered from the parent or guardian in themannerprovidedbytheCriminalProcedureCodeinlikemannerasiftheorderhadbeenmadeontheconvictionoftheparentorguardianoftheoffencewithwhichthechildwascharged.
Appeals
95. (1) The Public Prosecutor or any child or his parent orguardian, if aggrieved by any finding or order of a Court ForChildren, may appeal to the High Court against such findingor order in accordance with the provisions of the CriminalProcedure Code relating to criminal appeals to the High CourtfromMagistrate’sCourt.
(2) Except in the case of whipping, the execution of whichshallbestayedpendingappeal,noappealshalloperateasa stayof execution, but the Court For Children may stay executionon any judgment or order pending appeal, on such terms as tosecurity for the payment of any money or the performance ornon-performance of any act or the sufferingof any punishmentorderedbyorinsuchjudgmentororderastheCourtForChildrenmaydeemreasonable.
(3) TheHigh Court shall, in all criminal appeals originatingfromaCourtForChildren,makeitsfinaldecisionwithintwelvemonthsafter the noticeof appealhasbeen filed.
(4) Any appeal under this section shall, notwithstanding anyotherwrittenlaw,beintituled“AppealByChildren”andindealing

withanysuchappeal,sections12and15shallapply,withsuchmodificationsasmay benecessary, to theHighCourt.
Restrictions on order of imprisonment
96. (1) A child under the ageof fourteenyears shall not—
(a) be ordered tobe imprisoned for anyoffence;or
(b) becommittedtoprison indefaultofpaymentofafine,compensationorcosts.
(2) A childagedfourteenyears or aboveshall notbeordered
to be imprisoned if he can be suitably dealt with in any otherwaywhether by probation, or fine, or being sent to a place ofdetentionoran approved school, oraHenryGurney School, orotherwise.
(3) A childagedfourteenyears or aboveshall not, if orderedtobeimprisoned,beallowedtoassociatewithadultprisoners.
Death
97. (1) Asentenceofdeathshallnotbepronouncedorrecordedagainst a person convicted of an offence if it appears to theCourt that at the timewhen the offencewas committed he wasachild.
(2) In lieu of a sentence of death, the Court shall order apersonconvictedofanoffencetobedetainedin aprisonduringthepleasureof—
(a) theYangdi-PertuanAgongiftheoffencewascommittedintheFederalTerritoryofKualaLumpurortheFederalTerritory ofLabuan; or
(b) the Ruler or theYang di-Pertua Negeri, if the offencewascommittedintheState.
(3) If the Court makes an order under subsection (2), thatpersonshall,notwithstandinganythinginthisAct—
(a) be liable tobe detained insuch prison andunder such
conditions as theYang di-PertuanAgong or the Ruleror theYang di-PertuaNegerimay direct;and

(b) whilesodetained,bedeemedtobeinlawfulcustody.
(4) If a person is ordered to be detained at a prison undersubsection (2), the BoardofVisitingJustices for that prison—
(a) shall review that person’s case at least once a year;and
(b) may recommend to the Yang di-PertuanAgong or theRulerortheYangdi-PertuaNegeriontheearlyreleaseor furtherdetentionof that person,
and the Yang di-Pertuan Agong or the Ruler or the Yang di-PertuaNegerimay thereuponorderhimtobereleasedorfurther
detained,asthecasemaybe.
Chapter 4
PROBATION
When probation may be ordered
98. (1) If a Court For Children by or before which a child is
foundguiltyofanoffenceotherthan—
(a) anygravecrime;
(b) voluntarilycausinggrievoushurt,rape,incestoroutragingmodesty; or
(c) anoffenceunder section 377b, 377C, 377d or377E ofthePenalCode,
is ofopinion that having regard to the circumstances, including
the nature of the offence and the character of the child, it isappropriatetodoso,theCourtForChildrenmaymakeaprobationorder.
(2) Beforemakingtheprobationorderundersubsection(1),theCourtForChildrenshallexplaintothechildinsimplelanguagesuitable to his age,maturityand understanding—
(a) theeffectoftheorder;and
(b) thatifhe—
(i) fails to complywith the probation order; or

(ii) commits another offence,
heshallbeliabletobedealtwithfortheoriginaloffence
aswellasfortheotheroffence.
(3) A probation order shall have effect for such period notless than one year and notmore than three years from the dateof the order asmaybe specified in the probationorder.
(4) Forthepurposesofsecuringthegoodconductandsupervisionoftheprobationerorpreventingarepetitionbyhimofthesameoffence or the commission of other offences, a probation ordershall—
(a) requiretheprobationertosubmitduringthatperiodtothesupervisionof a probationofficer;
(b) specifythattheprobationerisnottocommitanyoffenceduring the probationorder; and
(c) containsuchotherrequirements,astheCourthavingregardto the circumstances of the case considers necessaryincluding anyoneormoreof the following:
(i) that the probationer shall reside at a probationhostel,atthehomeofhisparentorguardianorrelativeoratsomeotherplace;
(ii) that the probationer shall attend an educationalinstitution to be recommended by the probationofficer;
(iii) that the probationer shall remain indoors at hisplace of residence, be it at the probation hosteloratahome,duringhourstobespecified.
(5) Without prejudice to thepowers of theCourt tomake anorderundersection91,thepaymentofsumsbywayofdamagesforinjuryorcompensationforlossshallnotbeincludedamongstthe requirementsofa probationorder.
(6) Beforemaking aprobationorder containing requirementsastoresidence,theCourt—
(a) shallconsiderthehomesurroundingsofachild;and
(b) iftheorderrequiresachildtoresideinaprobationhostel,shall specify in the order the period for which he is

so required to reside, but that period shall not extendbeyondtwelvemonthsfromthedateoftheorder.
(7) The Court For Children which makes a probation ordershall—
(a) immediately give a copy of the order—
(i) to the probationer;
(ii) totheprobationofficerorotherpersonunderwhosesupervision the probationer isplaced; and
(iii) to thepersoninchargeof theprobationhostelorotherplaceinwhichtheprobationerisrequiredbytheordertoreside;and
(b) exceptifitisitselftheSupervisingCourt,sendtotheCourtForChildrenforthedistrictorareanamedintheorderinwhichtheprobationerisrequiredtoresideduringthe probation period a copy of the order togetherwithsuchdocumentsandinformationrelating tothecaseasit considers likely tobe of assistance to thatCourt.
(8) A Court For Children on making a probation order may,ifit thinksit isexpedient forthereformationof theprobationer,give the probationer to the charge of any person who consentsto accept the probationer, on that person’s giving security forthegoodbehaviouroftheprobationer;and theprovisionsoftheCriminal Procedure Code on forfeiture of bonds shall apply inrelationtothesecurity.
Failure to comply with probation order
99. (1) If atany timeduring the probation period itappears toaSupervisingCourtthataprobationerhasfailedtocomplywithany of the requirements of theprobation order under paragraph98(4)(a) or (c),theSupervisingCourtmayissue—
(a) a summons requiring the probationer to appear at theplace and time specified in the summons;or
(b) awarrantforhisarrest.

(2) Awarrantunder subsection (1) shallnotbe issued exceptoninformationinwritingandonoathsubmittedbytheprobationofficer.
(3) Asummonsorwarrantissuedunderthissectionshalldirectthe probationer to appear or be brought before the SupervisingCourt.
(4) A probationer when arrested under subsection (1) may,if not brought immediately before the Supervising Court undersubsection (3)—
(a) bedetainedinaplaceofdetention;or
(b) bereleasedonbail,withorwithoutsureties,
until such time as he can be brought before the SupervisingCourt.
(5) If it is proved to the sat isfact ion of the SupervisingCourt that a probationer has failed to comply with any of therequirementsof the probationorderunderparagraph98(4)(a) or(c) the Court may, without prejudice to the continuance of theprobation order—
(a) imposeonhimafinenotexceedingfivethousandringgit;or
(b) dealwith the probationer for the offence in respect ofwhichtheprobationorderwasmadeinanymannerinwhich the Court could dealwith him if the Court had justfoundhimguiltyofthatoffence.
(6) A fine imposed under this section for failing to complywithanyof the requirements of aprobationorder shall be—
(a) deemedforthepurposeofanywrittenlawtobeasumadjudgedtobepaidonaconviction;and
(b) takenintoaccountinmakinganysubsequentorderupontheprobationerunder this section or section 100.
(7) For the purposes of paragraph (6)(a), “a sum adjudgedto be paid on a conviction” includes any costs, damages orcompensationadjudgedtobepaidonaconviction,ofwhichtheamount is ascertained by theconviction.
(8) Aprobationerwhofailstocomplywithparagraph98(4)(b)shall be dealtwithunder section 100.

Commission of further offence
100. (1) If it appears to theSupervisingCourt that—
(a) a probationer has been found guilty by a Court of anoffencecommittedduring theprobation period; and
(b) the probationer has been dealt with in respect of thatoffence,
theSupervisingCourtmayissue—
(aa) a summons requiring the probationer to appear at theplace and time specified in the summons;or
(bb) awarrantforhisarrest.
(2) Awarrantunder subsection (1) shallnotbe issued exceptoninformationinwritingandonoathsubmittedbytheprobationofficer.
(3) AsummonsorwarrantissuedunderthissectionshalldirecttheprobationertoappearortobebroughtbeforetheSupervising
Court.
(4) If it isproved to thesatisfactionof theSupervisingCourtthat a probationer in whose case the order wasmade has beenfound guilty and dealt with in respect of an offence committedduringtheprobationperiod,theCourtmaydealwithhimfortheoffence for which the order wasmade in anymanner inwhichtheCourt could deal with him if theCourt had just found himguiltyofthatoffence.
Effects of probation
101. (1) The findingof guilt for an offence forwhich an orderis made under this Chapter placing the offender on probationshall be deemed not to be a conviction for any purpose otherthanforthepurposesof—
(a) the proceedings inwhich the order ismade; and
(b) anysubsequentproceedingswhichmaybetakenagainsta child under this Chapter.

(2) Subsection (1)shall notaffect—
(a) therightofanysuchchild—
(i) to appeal against a finding of guilt; or
(ii) torelyonafindingofguiltinbarofanysubsequentproceedingsforthesameoffence;or
(b) therevestingorrestorationofanypropertyinconsequenceofthefindingofguiltofanysuchchild.
Amendment of probation order
102. (1) If the SupervisingCourt issatisfied that aprobationerproposestochangeorhaschangedhisresidencefromthedistrictorareanamedintheprobationordertoanotherdistrictorarea,the Courtmay, and if an application on that behalf ismade bythe probation officer, shall, byorder amend the probation orderbysubstitutingforthedistrictorareanamedthereinthedistrictorareawheretheprobationerproposestoresideorisresiding.
(2) Iftheprobationordercontains requirementswhich, in the
opinionoftheSupervisingCourt,cannotbecompliedwithunlesstheprobationercontinuestoresideinthedistrictorareanamedin the order, the Supervising Court shall not amend the orderexcept in accordancewith subsection (4).
(3) If aprobationorder is amendedunder subsection (1), theSupervisingCourtshallsendtotheCourtForChildrenforthenewdistrictorareanamedintheorderacopyoftheordertogetherwith such documents and information relating to the case as itconsiders likely tobe of assistance to theCourt ForChildren.
(4) Withoutprejudicetosubsections(1)and(3)theSupervisingCourt may, on an application made by the probation officer orbytheprobationer,byorderamendtheprobationorderby—
(a) revokinganyoftherequirementsintheprobationorder;or
(b) insertingintheprobationorder,eitherinadditiontoorinsubstitution forany such requirement, any requirement
which could be included intheorder iftheorderwerethenbeingmadebytheCourtinaccordancewithsection98.

(5) TheSupervisingCourt shall not amendaprobationorderunder subsection (4)by—
(a) reducing theprobation period; or
(b) extending that period such that the probation periodbecomesmore than three years.
Discharge of probation order
103. (1) TheCourtForChildrenbywhichaprobationorderwasmadeortheSupervisingCourtmay,onanapplicationmadebythe probation officer, the parent or guardian of the probationeror the probationer, discharge theprobation order.
(2) TheCourtForChildrenshallnotdealwithanapplicationunder subsection (1)without summoning the probationerunlesstheapplication ismadeby theprobationofficer.
(3) If—
(a) theCourtdischargesaprobationorderundersubsection(1);or
(b) aprobationerisdealtwithundersection99or100fortheoffenceforwhichhewasplacedonprobation,
theprobationordershallceasetohaveeffect.
Court to give copies of amending or discharging order toprobation officer
104. On the making of an order amending or discharging a
probation orderunder section 102 or 103 respectively—(a) the Court shall forthwith give sufficient copies of theamendingordischargingordertotheprobationofficer;and
(b) theprobationofficershallgiveacopyof theamendingordischarging order to—
(i) the probationer; and
(ii) the person in charge of the probation hostel orplaceinwhichtheprobationerisorwasrequiredbytheordertoreside.

INTHECAREOFFITANDPROPERPERSON
Child placed in the care of fit and proper person
105. (1) This section shall apply in relation to an order madeunder this Act placing a child in the care of a fit and properperson.
(2) An order placing a child in the care of a fit and properpersonmay be varied or revoked by the Court For Children ortheSupervisingCourtonanapplicationmadeby—
(a) theparentorguardianofthechild;
(b) the Protector; or
(c) the probation officer,
asthecasemaybe.
(3) If—
(a) onanapplicationmadebytheparentorguardianoranynearrelativeofachildorderedtobeplacedinthecareof a fit andproperpersonunder subsection (1); and
(b) theCourtForChildrenortheSupervisingCourthavingpower to varyor revoke the order is satisfied that thechild is not being brought up in accordance with hisreligionasdecidedbyhisparentorguardian,
the Court For Children or the Supervising Court, as the casemay be, shall, unless a satisfactoryundertaking isgiven by theperson in whose care the child has been placed, either revokethe order or vary the order in such manner as the Court thinksbest to secure that the child is from that time onwards broughtup in accordancewith that religion.
Child who escapes or is removed from the care of fit andproper person
106. (1) A child who escapes from a person in whose care he
hasbeenplacedunderthisActmaybe—
(a) arrestedwithoutawarrant; and

(2) TheCourtForChildrenortheSupervisingCourtbeforewhichachildisbroughtundersubsection(1)shallimmediatelyinquireinto the case and after taking into account the recommendationof the Protector orprobationofficer, as the casemaybe—
(a) orderthechildtobebroughtbacktothatperson,ifheiswillingtoreceivethechild;or
(b) makeanorderwhichtheCourtcouldhavemadeifthechildhadbeenbroughtbeforetheCourtasbeingachild
havingnoparentorguardian.
Offence of removing or helping a child to escape from thecare of fit and proper person
107. (1) Anypersonwho—
(a) removesachildfromthecareofafitandproperpersonwithoutlawfulauthority;
(b) knowingly assists or induces, directly or indirectly, achild to escape from the person in whose care he hasbeenplaced;or
(c) knowingly harbours or conceals a child who has soescaped,or prevents him from returning to the careofsuchperson,
commits an offence and shall on conviction be liable to a finenotexceedingtenthousandringgitortoimprisonmentforaterm
notexceedingfiveyearsortoboth.

Contribution by parent or guardian or other person
108. (1) If an order ismade—
(a) placingachildinthecareofafitandproperperson;

theCourt ForChildrenmaking the ordermay, at the same timeor subsequently, make a contribution order requiring the parentorguardian orotherpersonhavingcustody of the child—
(aa) atthetimeofthecommissionoftheoffenceresultinginthe order;
(bb) priortoanordermadeundersubsection(1);or
(cc) immed ia te ly before the commencemen t o f anyproceedings,
tomakesuchcontributionormonthlycontributionsinsuchmannerastheCourtthinksfit,havingregardtothemeansoftheparentorguardianortheotherperson.
(2) ACourtForChildrenshallnotmakeanycontributionorderunder subsection (1) if theCourt considers that itwould not be
just for the contribution order to be made having regard to thecircumstances andmeansof the parent orguardianor the otherperson.
(3) Ifacontributionorder ismadepursuant tosubsection (1),itshallbethedutyoftheparentorguardianortheotherpersonagainstwhomthecontributionorder ismadetocomplywiththecontributionorder.
(4) Allsumspayable undera contributionordershall be paidinto such Court or to such authority as the Court making theorder shall direct.
(5) TheCourtForChildrenmakinganysuchcontributionordermay, from time to time,on an applicationmade by—
(a) theparentorguardianortheotherpersonagainstwhomthecontribution order ismade;
(b) theProtector; or
(c) theprobationofficer,

rescind,make aneworvary the order as theCourt deems fit onproof of change in circumstances of the person against whomthe order is made or for other good cause being shown to the
satisfaction of theCourt.
(6) An order under subsection (1) shall not be made withoutgiving the parent or guardian of the child or the other personhavingcustody of the child an opportunity to be heard.
(7) Notwithstandingsubsection(6),anorderundersubsection(1)may be made if the Court is satisfied on information givenbyaProtectororprobationofficer,asthecasemaybe,thattheparentorguardian or the otherperson, havingbeen required to
attend,hasfailedtodoso,orisnotavailableorcannotbefoundwithina reasonable time.
(8) A contribution order shall remain in force—
(a) inthecaseofachildorderedtobeplacedinthecareof a fit and proper person, so long as the order is inforce;and
(b) in the case of a child ordered to be sent to a placeofrefuge,aprobationhostel,anapprovedschool,aHenry
GurneySchool,oranapprovedinstitutionorcentre,untilheceasestobeunderthecareofthepersoninchargeforthetimebeingoftheplaceofrefuge,probationhostel,approved school, Henry Gurney School, or approvedinstitutionor centre.
(9) A contribution is not payable under a contribution orderinrespectofanyperiodduringwhich—
(a) a child ordered to be sent to an approved school or a
Henry Gurney School is out with permission or underthesupervision ofa probation officer;or
(b) achildorderedtobesenttoaplaceofrefugeisonleaveofabsencefromtheplaceofrefugeorfrombeingunderthesupervision of aSocialWelfareOfficer.
(10) Ifanypersonwilfullyneglectstocomplywithacontributionorder,aMagistratemay,foreverybreachoftheorder—
(a) by warrant, direct the amount due to be levied in themanner by law provided for levying fines imposed byaMagistrate; or

(b) sentence the person to imprisonment for a term notexceeding one month for each month’s contributionremaining unpaid.
(11) Thetermofimprisonmentimposedunderparagraph(10)(b)shallterminatewhentheamountofcontributiondueispaid.
part XIII
INVESTIGATION,ARREST, SEARCH,SEIZURE, ETC .
Power of investigation
109. (1) A Protector or police officer may investigate thecommissionof any offenceunder thisAct.
(2) AProtectorwhenactingunderthisPartshall,ondemand,declare his office to the person against whom he is acting orfromwhomheseeksany information.
(3) Every person required by a Protector or police officer to
giveinformationorproduceanydocumentorotherthingsrelatingtothecommissionofanyoffencewhichisinthatperson’spowertogiveshallbelegallyboundtogivetheinformationorproducethe documentor other things.
Power to arrest without warrant
110. (1) Any police officer may arrest without a warrant anypersonwhomhe reasonablybelieves—
(a) hascommittedorattemptedtocommit;or
(b) employedoraidedanyotherpersontocommitorabetthecommissionof,
an offence against this Act, and may search any person soarrested.
(2) Any person arrested under subsection (1) shall, after thearrest, be dealt with as provided for by the Criminal ProcedureCode.

Search by warrant
111. (1) IfitappearstoaMagistrateuponwritteninformationonoaththatthereisreasonablecausetobelievethatinanypremisesthereisanyevidenceof—
(a) achildwhoisinneedofprotection;
(b) achildwhoisbeingconcealed,confinedordetainedincontraventionof thisAct; or
(c) the commission ofanoffenceagainst thisAct,
theMagistratemayissueasearchwarrantauthorizingaProtectororpolice officer towhom it isdirected, at any reasonable timebydayornightandwithorwithoutassistance,to—
(aa) enter and search the premises;
(bb) inspect,makecopiesof,ortakeextractsfrom,anybook,recordordocument;
(cc) searchanypersonwhoisinoronthepremises,andforthepurposesofthatsearchdetainthepersonandremovehim to any place asmay be necessary to facilitate thesearch, and seize and detain any article found on thatperson;and
(dd) searchand remove the child—
(i) who is in need of protection;
(ii) who is being concealed, confinedor detained incontraventionof thisAct; or
(iii) in respect of whom an offence against thisActhasbeencommitted,
to a place of safety or place of refuge.
(2) If a child has been placed in a place of safety pursuanttoparagraph(1)(dd),theProtectorshall,assoonaspracticable,inform the parent or guardian who has lawful custody of thechild thewhereaboutsof thechild.
(3) Whenever it is necessary to do so, aProtectoror policeofficer exercising any powerunder subsection (1)may—
(a) break open any outer or inner door orwindow of anypremisesinordertoeffectentryintothepremises;

(b) forcibly enter any premises and any par t o f thepremises;
(c) removebyforceanyobstructiontoentry,search,seizure,
detentionorremovalasheisempoweredtoeffectundersubsection (2);
(d) detainanypersonfoundinoronanypremisessearchedunder subsection (1)until the search is completed.
(4) Afemalepersonshallnotbesearchedunderthissectionorsection110exceptbyanotherfemalepersonandamalepersonshall not be searched except by another male person and suchsearchshallbecarriedoutwithstrictregardtodecency.
(5) A person who by force, restraint, threats, inducement orother means causes any child who is in need of protection toconceal himself in or to leave any premises being searched orabouttobesearchedbyaProtectororapoliceofficerunderthissection,withtheintentthatthesearchbysuchProtectororpoliceofficermay beevaded or obstructed, commits anoffence.
(6) Itshallbethedutyoftheowneroroccupierofanypremises
searched under this section and any person found in or on thepremisesto—
(a) provide the Protector or police officer with all suchfacilities and assistance as hemay reasonably require;and
(b) givetheProtectororpoliceofficerallreasonableinformationrequired byhim.
Search without warrant
112. If a Protector or police officer has reasonable cause tobelieve that by reason of delay in obtaining a search warrantunder section 111—
(a) the investigationwouldbeadverselyaffected; or
(b) theobjectoftheentryislikelytobefrustrated,
hemayexercisein,andinrespectof,thepremisesallthepowersreferredtointhatsectioninasfullandampleamannerasifhewasauthorized todo so by awarrant issuedunder that section.

Power to examine person
113. (1) A Protector or police officer investigating an offence
underthisActmayorderanyperson—
(a) acquaintedwiththefactsandcircumstancesofanoffence
to attend beforehim to be examined orally in relation
toanymatterwhichmayassistintheinvestigationinto
theoffence;or
(b) toproduce any child or any book, articleordocument
whichmay assist in the investigation into theoffence.
(2) Apersontowhomanorderhasbeengivenunderparagraph(1)(a)—
(a) shallattendinaccordancewiththetermsoftheorderto
beexamined; and
(b) duringsuchexamination—
(i) shall discloseallinformationwhich iswithin his
knowledgeorwhichisavailabletohiminrespect
of the matter in relation to which he is being
examined;
(ii) shallansweranyquestionputtohimtruthfullyand
tothebestofhisknowledgeandbelief;and
(iii) shall not refuse to answer any question on the
groundthatittendstoincriminatehim.
(3) A person to whom an order has been given under
paragraph (1)(b)—(a) shall produce the child unless it can be shown to the
satisfactionoftheProtectorthatthechild—
(i) is no longer under the custody or control of that
person;and
(ii) that thewhereabouts of the child are not known
tothatperson;and
(b) shallnotconceal,destroy,alterordisposeofanybook,articleordocument specified in theorder.

(4) A person towhom an order is givenunder subsection (1)
shall comply with the order and with subsections (2) and (3)
notwithstandinganywrittenlaworruleoflawtothecontrary.
(5) A Protector examining a person under paragraph (1)(a)
shall record in writing any statement made by the person so
examined and the statement so recorded shall be signed by the
personmakingitoraffixedwithhisthumb-print,asthecasemay
be,after—
(a) ithasbeenreadtohiminthelanguageinwhichhemade
it;and
(b) hehasbeengivenanopportunitytomakeanycorrectionhemaywish.
(6) If apersonexaminedunder this sectionrefuses to signor
affixhisthumb-printonthestatement,theProtectorshallendorse
on the record under his hand the fact of such refusal and the
reason for it, if any, statedby the person examined.
(7) Notwithstanding any written law or rule of law to the
contrary, the record of an examination under paragraph (1)(a)and any book, article or document produced under paragraph
(1)(b) shallbeadmissible inevidencein anyproceedingsinany
Court for or in relation toan offenceunder thisAct, regardless
ofwhether suchproceedings are against—
(a) thepersonwhowas examined;
(b) thepersonwhoproducedthebook,articleordocument;
or
(c) anyotherperson.
(8) Any person who contravenes this section commits an
offence.
Inspection
114. If anorderismadeplacinga child inthe careofa fitand
properpersonorrequiringtheparentorguardianofthechildtoexercise proper care and guardianship over him, the Protector

(a) atanytimevisitandinspecttheplacewheresuchchildinrespectofwhomtheorderismadelivesorisbelievedtoliveortobe;and
(b) inquireintotheconditionsandcircumstancesofthechild,and for the purposes of such inquiry,may require anyperson toanswer anyquestion as hemay think propertoaskandsuchpersonshallbelegallyboundtoanswersuchquestiontruthfullytothebestofhisknowledgeorbelief.
Obstruction
115. Any personwho—
(a) refusestheProtectororSocialWelfareOfficeraccesstoanypremises,orfailstosubmittoasearchbyapersonauthorized to searchhimunder thisAct;
(b) assaults,obstructs,hinders,delaysorattemptstoassault,obstruct,hinderordelaytheProtectororSocialWelfareOfficer in the execution of his dutyunder thisAct;
(c) fails to comply with any lawful demand, order orrequirementof aProtectororSocialWelfareOfficer inthe execution of his dutyunder thisAct;
(d) omits,refusesorneglectstogivetoaProtectororSocialWelfareOfficeranyinformationwhichmaybereasonablyrequiredofhimandwhichheisempoweredtogive;
(e) fails to produce to, or conceals or attempts to concealfrom, a Protector or SocialWelfareOfficer, any childor any book, article or document in relation to whichthe Protector or SocialWelfareOfficer has reasonablegroundsforbelievingthatanoffenceunderthisActhasbeenorisbeingcommitted;
(f) rescuesorendeavourstorescueorcausestoberescuedanythingwhichhasbeendulyseized;or
(g) destroysanythingtopreventtheseizureofthething,orthesecuringofthething,

commits an offence and shall on conviction be liable to a finenotexceedingfivethousandringgitortoimprisonmentforatermnotexceedingtwoyearsortoboth.
Protection of informers
116. (1) Any person who gives any information that a child isinneedofprotectionshallnot incurany liability fordefamationorotherwiseinrespectofthegivingofsuchinformation.
(2) The giving of any information that a child is in need ofprotection shall not, in any proceedings before anyCourt or in
anyotherrespect,beheldtoconstitute—
(a) abreachofprofessionaletiquetteorethics;or
(b) a departure from accepted standards of professionalconduct.
(3) Exceptasprovidedinsubsections(4)and(6),awitnessinanycivilorcriminalproceedingsshallnotbeobligedorpermittedtodisclosethenameandaddressofaninformerorthesubstance
oftheinformationreceivedfromhimortostateanymatterwhichmight lead to his discovery.
(4) If anybook, record or document which is in evidenceorliabletoinspectioninanycivilorcriminalproceedingscontainsanyentryinwhichanyinformerisnamedordescribedorwhichmightleadtohisdiscovery,theCourtshallcauseallsuchpassagestobeconcealedfromviewortobeobliteratedsofarasmaybenecessary toprotect the informer from discovery.
(5) Thissectionshallapplytoaregisteredmedicalpractitioner,any member of the family or a child care provider who givesinformationundersection27,28or29respectivelyinthesamemanner as they apply to a personwho gives information that achildisinneedofprotection.
(6) If during the trial for any offence against this Act, theCourt after full inquiry into the case believes that the informerwilfully made in his complaint a material statement which hekneworbelievedtobefalseordidnotbelievetobetrue,orifinanyotherproceedingstheCourtisoftheopinionthatjustice

MISCELLANEOUS
Power of Court For Children conferred on High Court
117. NothinginthisActotherthansections96and97shallaffectthepowersoftheHighCourtandallthepowerswhichmaybeexercised under thisAct by a Court For Children in respect ofachildmayinlikemannerbeexercisedbytheHighCourt.
Register
118. The Registrar shall cause to be kept and maintained, in
such form as may be prescribed, a register to be known as the“RegisterofChildren inNeedofProtection”.
Contents of Register
119. TheRegister shall contain—
(a) detailsofeverycaseorsuspectedcaseofachildinneedofprotection; and
(b) suchothermattersin relationtosuchcaseorsuspectedcase as the Director General may from time to timedetermine.
Access to Register
120. (1) DetailscontainedintheRegister shall be furnished to—
(a) anyCourtwhenthereisbeforetheCourtanyproceedings
concerningachildinneedofprotection;
(b) anyCourtwhensorequestedbytheCourt;and

(2) Detailscontained in theRegistermaybe furnished to—
(a) personsengagedin bona fide researchwhoseaccessto
the Register is authorized by the Director General for
that purpose;or
(b) personsorclassesofpersonsauthorizedbytheDirectorGeneraltohaveaccesstotheRegisteronthegroundsthat
theiraccesstotheRegisterwillpromotetheprotection
ofachildorchildren.
(3) Details furnishedunder this section shall not include any
informationwhichdisclosesorlikelytoleadtothedisclosureof
theidentityofanypersonwhohasgivenanyinformationthata
childisinneedofprotection.
Offence in respect of Register
121. Anypersonwhofurnishestoanyotherpersonanydetails
contained in the Register other than pursuant to section 120
commits an offence and shall on conviction be liable to a fine
notexceedingtenthousandringgitortoimprisonmentforaterm
notexceedingtwoyearsortoboth.
Certificate of Registrar to be evidence
122. AcertificatepurportingtobeunderthehandoftheRegistrar
astoanyentryintheRegister,orastoanymatterorthingwhich
heisauthorizedbythisActoranyregulationmadeunderthisAct
todoortomakeshall,untilthecontraryisproved,beadmitted
inevidence as proof of the facts stated thereinas atthedateof
thecertificate.

Protection against suit and legal proceedings
123. Anactionshallnotlieandprosecutionshallnotbebrought,instituted or maintained in any Court against the Government,Minister, Director General, Protector, Social Welfare Officer,probation officer, police officer ormedical officer for anythingdoneoromittedtobedoneunderthisAct—
(a) ingoodfaith;
(b) in the reasonable belief that it was necessary for thepurposeintendedtobeservedthereby;or
(c) forcarryingintoeffecttheprovisionsofthisAct.
Public servant
124. AllofficersappointedorauthorizedunderthisActshallbedeemed to be public servants within the meaning of the PenalCode.
General penalty
125. If no penalty is expressly provided for an offence underthisAct,apersonwhocommitssuchoffenceshallonconvictionbe liable to a fine not exceeding five thousand ringgit or toimprisonmentfor a termnot exceeding two years or toboth.
Institution and conduct of prosecution
126. (1) A prosecution in respect of an offenceunder thisActshall not be instituted except by orwith the consent inwritingofthePublicProsecutor.
(2) NotwithstandingthathehasbeenauthorizedundertheCriminalProcedureCode toprosecute, a personwho is the investigatingofficerofanoffenceunderthisActshallnotprosecutethecaseinrespectofthatoffence.
Service of document
127. (1) Serviceofdocumentonanypersonshallbeeffectedby—
(a) deliveringthedocumenttothatpersonorbydeliveringthe document at the last known place of residence ofthatpersontoanadultmemberofhisfamily;

(c) forwardingthedocumentbyregisteredpostinaprepaidletteraddressedtothatpersonathisusualorlastknownplace of residenceorbusiness.
(2) Ifadocumentisservedbyprepaid registeredpost itshallbe deemed to have been served on the day succeeding the dayonwhichthedocumentwouldhavebeenreceivedintheordinarycourse ofpost.
Power to make regulations
128. (1) TheMinistermaymakesuch regulations asappears tohimtobenecessaryorexpedientforcarryingouttheprovisionsofthisAct.
(2) Withoutprejudicetothegeneralityofthepowersconferredby subsection (1), theMinistermaymake regulations for all orany of the followingpurposes:
(a) to prescribe the conduct, management, discipline andcontrol of approved schools, Henry Gurney Schools,probation hostels or centres;
(b) toprovideforthemaintenance,discipline,treatmentandeducation, vocational or otherwise, of the children orother persons detained in approved schools or HenryGurneySchoolsincluding—
(i) the powers, duties and functions of theBoard ofVisitors;
(ii) thegrantofleaveofabsencetochildrenandotherpersons detained;
(iii) visitsto,andinspectionsof,theschoolsbypersonsor bodies of persons appointed by the Ministerfromtimetotimeforanyareaorareas;and
(iv) theorderorpunishmentforbreachesofdisciplineofchildren or otherpersons detained;

(c) toprescribethedutiesandresponsibilitiesofprobationofficers;
(d) toprescribetheconstitutionanddutiesofChildWelfare
Committees;
(e) to prescribe the qualifications, duties and training ofadvisers;
(f) to provide for the care, control, detention, discipline,admission,dischargeandaftercare,temporaryabsence,maintenance, educationand training ofchildren placedinplacesof safetyandplacesof refuge;
(g) toregulatethemanagement,administration,visitationandinspectionofplacesofsafetyandplacesofrefuge;
(h) toprovide for—
(i) the care,maintenance and education of childrenplaced in the care, custody orcontrol of any fitand proper person under the provisions of thisAct;and
(ii) thedutiesofsuchfitandproperpersonintaking
careofthechild;
(i) to prescribe the selection and qualifications of fit andproperpersonswithwhomachildinneedofcareandprotectionmay beplaced;
(j) torequirethepersonsinchargeofplacesofsafetyandplaces of refuge to submit to the Director Generalreturns, reports and information in respect of childrenplaced therein;
(k) to prescribe the duties and responsibilities of fosterparents;
(l) toprescribethecomposition,duties,functionsandproceduresof conducting thebusiness ofBoardsofVisitors;
(m) toprescribetheproceduresandpracticeofChildProtectionTeams;
(n) toprescribetheparticulars,photographsorothermeans
of identification to be furnished in relation to a childinneed ofprotection;

(o) torequirethefurnishingofinformationastochangesofaddressofeverychildinneedofprotectionandofthepersonshavingcustodyofthechild,andthetransferof
records and registers in such cases;(p) toprescribe the records to be kept in respect of everychildinneedofprotectionandthemannerinwhichtherecords shall bekept;
(q) toprescribethekeepingandmaintenanceofRegisters;
(r) toprescribe theformstobeusedand information tobefurnished for anyof the purposes of thisAct;
(s) to prescribe the form of notices, orders, warrants,
summonses and bonds under thisAct and the mannerof service thereof;
(t) toprescribethefunctions,powersanddutiesofofficersandpersonsconferredwithpowersunderthisActandthemannerand conditions in andunderwhich the powersconferredby thisActshallbeexercisedbytheofficersorpersons;
(u) toprescribeanyothermatterrequiredorpermittedtobeprescribed under thisAct; and
(v) toprovideforanyothermatterwhichtheMinisterdeemsexpedientornecessary for the purposesof thisAct.
(3) Regulationsmade under subsection (1) may provide thatthecontraventionofanyprovisionintheregulationsisanoffenceand that the person who commits the offence is punishable onconviction with a fine or a term of imprisonment or both butmaynot provide for the fine to exceed five thousand ringgitorthetermofimprisonmenttoexceedtwoyears.

129. InthisPart—

Repeal
130. TheJuvenileCourtsAct1947,theWomenandGirlsProtectionAct1973andtheChildProtectionAct1991arerepealed.

131. (1) AllreferencestotheJuvenileCourt inanywrittenlaw,orinanyjudgment,sentence,order,rulingordecisionmadeundertherepealedActsandsubsistingimmediatelybeforetheappointeddate shall, on the appointed date, be construed as references totheCourtForChildren established under thisAct.
(2) The judgment, sentence, order, ruling or decision of theJuvenileCourt,SupervisingCourt,HighCourt,SessionsCourtor
Magistrate’sCourtundertherepealedActsshallontheappointeddatebe deemed tohave beenmade under thisAct andcontinuetobeinforceandhaveeffect.
(3) Anyinquiry,trialorproceedingsdone,takenorcommencedin or before the Courts referred to in subsection (2) before theappointed date in so far as it relates to a person under the ageof eighteen years shall be deemed to have been done, taken orcommenced in or before the Court For Children, Supervising
Court, High Court, Sessions Court or Magistrate’s Court underthisActandmayaccordinglybecontinuedandconcludedonandafter theappointeddate.
(4) Anyinquiry,trialorproceedingsdone,takenorcommencedunder the Women and Girls Protection Act 1973 before theappointed dateandare stillpending shall, inso far as it relatestoafemalepersonagedeighteenyearsandaboveandanyoffenceunderthesameAct,becontinuedandconcludedunder thesame
ActandforthispurposeitshallbetreatedasifthatActhadnotbeen repealed.

Continuance of Council, etc.
132. (1) TheCo-ordinatingCouncilfortheProtectionofChildren,
Child Protection Teams, Juvenile Welfare Committees, BoardsofVisitorsandcommitteesestablished,andofficersandpersonsappointed,undertherepealedActsshall,ontheappointeddate,bedeemedtohavebeenestablishedorappointedunderthisActand shall have the powers, rights, privileges, liabilities, dutiesandobligationsconferredontheCouncil,ChildProtectionTeams,Child Welfare Committees, Boards of Visitors and committeesestablished under thisAct.
(2) Themembers of theCouncil,Teams,Committees,Boards
and committees established under the repealed Acts and anyofficers and persons appointed under the repealedActs holdingofficeonthedayprecedingtheappointeddateshallcontinuetoholdofficeunderthisActuntiltheirtermsofappointmentexpireor they resign or their appointments are revoked in accordancewiththisActandshallhavethesamepowers,rights,privileges,liabilities, duties and obligations as if they had been appointedunder thisAct.
(3) Everyactorthingdone,takenorcommencedbythemembersoftheCouncil,Teams,Committees,Boards,committeesofficersandpersonsreferredtosubsections(1)and(2),andtheBoardofVisiting Justices, under the repealedActs before the appointeddate shall, on and after the appointed date, be deemed to havebeendone, takenor commenced under thisAct.
Continuance of rules, etc.
133. Allrules,regulations,orders,notices,forms,directionsandauthorizationlettersmade,issuedorgivenundertherepealedActsshall,insofarastheyareconsistentwiththisAct,continueinforceuntilrevokedorreplacedbythisAct.
Institutions established or appointed
134. All approved schools, Henry Gurney Schools, places ofdetention, probation hostels, places of safety, places of refugeand other institutions or centres established or appointed under
therepealedActsshallontheappointeddatebedeemedtohavebeen established or appointedunder thisAct.

Prevention of anomalies
135. (1) TheMinistermay,wheneveritappearstohimnecessaryor
expedienttodoso,whetherforthepurposeofremovingdifficultiesorpreventinganomaliesinconsequenceoftheenactmentofthisAct,byorderpublishedintheGazette makesuchmodificationsto any provision in this Act as he thinks fit but the Ministershallnotexercisethepowersconferredbythissectionaftertheexpirationoftwoyearsfromtheappointeddate.
(2) In this section, “modifications” includes amendments,additions,deletions,substitutions,adaptations,variations,alterationsandnon-applicationofanyprovisionofthisAct.
