Overview of Exchange Visitor Program (J-1 Visa)

The Exchange Visitor Program provides international candidates the opportunity to travel and gain experience in the United States.

Various activities:

• Conducting Research

• Participating in an Internship

• Receiving Training

• Teaching

Exchange Visitor Category

Depending on your program activities and length, you have been placed in one of the following categories (check number 4 on your DS-2019). Different rules apply depending on category.

Program Category: Maximum Program Length

Research Scholar: 5 years

Professor: 5 years

Short-Term Scholar: 6 months

Student Intern: 12 months

Specialist: 12 months

Document shows your Admission Record Number, Date of Entry, Class/Visa of Admission, etc.

Document may be needed at Department of Motor Vehicles, Social Security Administration Office, or to apply for certain immigration benefits.

Responsibilities of J-1 Exchange Visitors

Exchange Visitors must follow these rules in order to maintain status in the United States

• It is your personal responsibility to know and follow the rules of your visa category

• Failure to maintain status may result in termination of visa status, fees to correct status, or removal from the U.S., and can affect eligibility to return to the U.S. in future.

Responsibilities of J-1 Exchange Visitors

1. Engage in activities permitted for the Exchange Visitor category type.

• Research Scholar/Short-Term Scholar: Engage in arranged research.

• Student Intern: Follow Training/Internship Placement Plan T/IPP form

2. Report address changes in your living address and where you conduct research.

• Report change within 10 days

3. Maintain adequate health insurance

• Health Insurance is mandatory for all J-1 and J-2 visitors during entire J-program

Must meet Department of State requirements

(1) medical benefits of at least $100,000 per accident or illness;

(2) repatriation of remains in the amount of $25,000;

(3) expenses associated with medical evacuation of the exchange visitor to his or her home country in the amount of $50,000; and

(4) a deductible not to exceed $500 per accident or illness.

4. Report changes in program

• Changes in program such as research focus, sponsor, program length, employment, and finances need to be reported before change to OIS.scholar@oregonstate.edu

• Receive Transfer authorization prior to leaving OSU (if eligible).

• Apply for Program Extension prior to DS-2019 expiration (if eligible).

5. Maintain valid Passport, Visa, I-94 and DS-2019 documents

• Maintain valid documents

• Upload new documents to IP Connect OIS.Scholar@oregonstate.edu

6. Employment is only allowed with OIS authorization.

Employment must be directly related to objectives of exchange visitor program, incidental to primary program activities, and must not delay the completion date of the J-1 program.

7. Obtain Travel Signature Prior to Traveling Outside the U.S.

Travel requires:

Valid Passport

Valid U.S. Visa

Valid DS-2019 with TRAVEL SIGNATURE (valid for 12 months), and active program dates.

Visa to country to visit unless not required

• Contact OIS.Scholar@oregonstate.edu if you plan to remain outside of the U.S. for more than 30 days.

8. Depart the U.S. within the 30-Day Grace Period

• You can stay in the U.S. up to 30 days after the program end date on your DS-2019, or when you complete your program (whichever is earlier).

• J-2 Dependents that depart the U.S. prior to J-1, need to report early departure.

Future Plans: Responsibilities of J-1 Exchange Visitors

9. Bars to Future Program Participation

24 Month Bar: • J-1 Research Scholars and Professors cannot return again

under the J-1 Research Scholar/Professor category for 24 months after end of current program

12 Month Bar: • Other J exchange visitors (dependents, students,

interns, etc.) in the U.S. for more than 6 months must wait 12 months to use the Research Scholar or Professorcategory

10. Two Year Home Residency Requirement 212(e)

Certain exchange visitors (J-1) are subject to a two-year home-country physical presence requirement which requires them to return to their home country for at least two years at the end of their program. • Requirement based on:

When scholar is subject, he/she must fulfill 212(e) requirement before he/she can do the following:

• Change status while in the United States to the nonimmigrant categories of temporary worker (H) or intracompany transferee (L);

• Adjust status while in the United States to immigrant visa/lawful permanent resident status (LPR);

• Receive an immigrant visa at a U.S. Embassy or Consulate; or

• Receive a temporary worker (H), intracompany transferee (L), or fiancé (K) visa at a U.S. Embassy or Consulate.

212(e) Home Residency Requirement (cont.)

• You may return to the US on other visa types (e.g. tourist, student, exchange visitor)

• Your J-2 dependents are also subject to this requirement

• Check if you are subject to this requirement by requesting an Advisory Opinion

• Waiver of Two Year Home-Country Physical Presence Requirement - If you are not able to fulfill the home country presence requirement, you may be able to apply for a waiver at http://travel.state.gov/content/visas/english/study-exchange/student/residency-waiver.html .

J-2 Dependent is a Spouse and Children (unmarried children under the age of 21)

Dependents may study or work

• Full or Part-Time study allowed, Employment Authorization Document required for employment

Allowed to remain in the U.S. as long as the principle J-1 Visa holder has valid status

May not be left in the U.S. for a period longer than 30 days without the principle J-1 present
