1. Introduction
A. BACKGROUND 1 Government of Madhya Pradesh (GoMP) with a sector project loan funding from Asian
Development Bank (ADB) has proposed to implement Madhya Pradesh Urban Services Improvement Project (MPUSIP), herein after referred as ‘The Project’. Madhya Pradesh Urban Development Company Limited (MPUDC) shall be the Implementing Agency (IA) and the State Urban Development and Housing Department (UDHD) shall be the executing agency for the Project. A project management unit (PMU) created under MPUDC is implementing MPUSIP.
2. The Resettlement Framework (RF) for MPUSIP outlines the objectives, policy principles and procedures for land acquisition, if any, compensation and other assistance measures for Displaced Persons1 (DPs)/Affected Persons (APs), if any.
3. An entitlement matrix, consistent with the existing norms and guidelines of the country and the state government, and ADB’s Safeguard Policy Statement has been prepared to cover losses identified in this Project. The matrix recognizes that the lack of title/customary rights recognized under law will not be a bar to entitlement and has special provisions for non-titled persons.
4. Need of the Sub-project: The town extracts water from underground sources, mainly from hand pumps, tube wells and tankers. There are 21 pumping stations on tube wells and 43 numbers of hand pumps in Bhainsdehi town, distributed in the 15 wards of the town. Out of 43 hand pumps 38 are operational and 5 are non-operational due to drop in the water level (Source CDP). Presently the water is supplied at the rate of 0.59 MLD, which is about 50 LPCD while demand is about 1.80 MLD. The amount of water supplied is not sufficient for the current water demand especially in the summer months when water is supplied to the town by private tankers. Due to the existing topography of the town, the water recharge scenario is unsatisfactory and hence affecting the ground water level. There is no WTP in Bhainsdehi. Currently, only bleaching powder is added to the water for treatment, which is not enough to ensure the quality of drinking water.
B. PROJECT DESCRIPTION
5. The salient features of the subproject are as below:
• Provision for supply of 1.8 MLD Raw Water from Krushi Dam up to WTP for Bhainsdehi town.
• Head Works (Collecting Well, Inspection Well and Jack well with Over Head Pump House) and BPT are proposed to be constructed in upstream of Krushi Dam
• Provision of Vertical Turbine Pumps for lifting of Raw Water from Jack well to BPT is also made.
• Design, supply, construction, installation, testing, commissioning of 1.5 MLD Water Treatment Plant at Bhainsdehi Town on Khasara No. 130/3
• Laying of Raw Water Rising Main (150 mm Diameter, DI, K-9) from Jack well to BPT of 150 m length and Raw Water Gravity Main (200 mm Diameter, DI, K-7) from BPT to WTP of length 9000 m.

• Laying of Clear Water Rising Main-1 (150 mm Diameter, DI, K-9) from WTP to existing OHT-1 of length 185 m and Clear Water Rising Main-2 (100 mm Diameter, DI, K-9) from WTP to existing OHT-2 of length 950 m
• Laying of distribution network (HDPE) of total length 24818 m 6. The main objectives of the project are as follows:
• Supplying Safe Surface Drinking Water.
• Promote sustainable measures to increase potable water supply to the population.
• Water supply through future sustainable source developments.
• Water supply through improvements of safe yield of existing water sources.
• Water supply through improvements to water treatment works.
• Drinking water supply contributes towards a sustainable regional development.
• To improve the current state of the water cycle of Bhainsdehi town through improvements in the separate components of the water supply system in investment program.
C. SCOPE OF THIS REPORT
7. This land acquisition and resettlement due diligence report is prepared for the proposed
Water Supply package for Bhainsdehi Municipal Council, Dist. Betul under which
Construction of Head Works (Collecting Well, Inspection Well Connection Main and Jack
Well), BPT, Water Treatment Plant, new pipe laying works usually along public road
which is under the ownership of Municipal. The proposed subproject will focus on metered
water supply for domestic, institutional and commercial users, including water resource
identification and treatment, water storage tanks, distribution pipes and metered
connections to each household in the towns covering a population of 13100 Souls in
Bhainsdehi (population as in 2018) and estimated population on which it is designed for
the year 2048 is 21300. All the municipal wards of the town are covered in the project.
8. A due diligence process was conducted to examine the land acquisition and resettlement
issues in detail, in line with ADB SPS 2009. This report describes the findings and
provides copies of relevant documents, resolutions, minutes of meetings and photographs.
This land acquisition and resettlement due diligence report needs to be read along with the
Resettlement Framework prepared for MPUSIP.
9. Upon project implementation, the Social Safeguards Personnel at PMU, MPUDC will be
required to undertake a review of this due diligence report, prepare a confirmation letter or
report documenting any modifications for the subproject and submit to ADB; and receive a
'no objection' confirmation from ADB prior to start of construction in the subproject.
2. POLICY FRAMEORK, AND INTITLEMENTS
10. The Resettlement Framework (RF) prepared for MPUSIP sets out the objectives, principles, eligibility criteria and entitlements for APs, based on ADB SPS, 2009 and LARR 2013 as well as national and state laws for protection of street vendors. Until recently, all activities related to rehabilitation and resettlement in the State of MP had been

based on the Madhya Pradesh Resettlement and Rehabilitation Policy, 2002 (MPRR) and National Rehabilitation and Resettlement Policy, 2007 (NRRP-2007). GoMP adopted LARR 2013 on 3rd October, 2014 with some specifications for operationalizing its implementation in the state2. Details of policies are in the Resettlement Framework for MPUSIP.

4. FIELD WORK AND PUBLIC CONSULTATION
14. The Resettlement Plan was prepared in consultation with stakeholders including affected
persons, beneficiaries/local people, and ULB officials. Consultations and focus group discussions (FGDs) were conducted to seek feedback from local people and other important stakeholders on the proposed development interventions, perceived impacts and mitigation measures and their participation.
A. Outline of Fieldwork
15. During the visit, a field inspection of proposed subproject facility locations and pipeline alignments that had been identified was undertaken. These included field visit to the identified sites and alignments and stakeholder consultations. The entire land requirement for the proposed subproject component will be fulfilled by government lands. The details of selected lands for subproject components are given in the Appendix-1
B. Field work Report
• We met the ULB Officials, Public Representatives, Stake Holder and Prominent People
of Bhainsdehi Town. A List of officials from whom details of the town for preparation

of water supply scheme is collected during site visit. Held various discussions during
the meeting.
• During the meeting and discussion, we have gathered the present situation of water
supply in the town and the n requirement of the stack holder. Based on present water
supply arrangements and gaps arrives are well documented.
• With the ULB Authorities, we visited all the possible water supply sources and
identified locations for all other the components of water supply scheme.
• We have studied the all the options of possible water supply source, its dependability,
quality assurance of source available and the distance from the town.
• Water from the selected source was collected and tested from the Laboratory of Bhopal
Municipal Corporation Laboratory, Bhopal. Also test report is obtained for designing
purpose.
• We have ensured the water security from the concerned department like WRD etc such
that best chosen water source is made available to ULB for the purpose of water supply
scheme.
• We have contacted revenue authorities to ensure the land acquisition, secured in the
ownership of ULB or Revenue Department Govt. of Madhya Pradesh for Head Works,
BPT and WTP.
• After getting all the required data for the preparation of DPR, we have mobilized the
survey team for the survey work. Focusing road survey for water supply
distribution system. Based on elevation differences in individual command areas
and required pressure conditions at lines near households.
C. Public Consultation
16. Extensive consultations were undertaken with key stakeholders in line with ADB's
requirements pertaining to environment and social considerations. Focus group discussion
(FGD) conducted at Nagar Parishad office .The following outcomes of consultations:
(i) The consultations helped to identify the felt needs /concerns and apprehensions of the
communities related to the project and priorities of concerned stakeholders.
(ii) Consultations revealed that people are aware of the problems of the existing water supply
system in the town and are willing to cooperate in the proposed project.
(iii) Consultations with the key stakeholders revealed that drinking water supply system if a
problem area for the town and they will fully accept the project.
17. The major stakeholders targeted during consultations are:
(a) The municipalities, its elected members and staff who will be required to oversee the
construction of the distribution networks and WTP as well as be directly responsible for the
maintenance of the installations
(b) Local residents who will take initiative to connect their houses with the water distribution line.

(c) Local business people and traders
(d) The opinion makers are intimately acquainted to and well regarded by the community. They
need to be enlisted in spreading environmental awareness within the community as well as in
conveying the benefits of the project.

5. LAND AVAILABILITY AND INVOLUNTARY RESETTLEMENT IMPACTS
A. Water Supply
18. No land acquisition or resettlement impacts are anticipated for any of the proposed civil works
for Bhainsdehi water supply subproject.

The Proposed Head Works and BPT location land is under the ownership of WRD Govt. of Madhya Pradesh bearing Khasara No. 64/4 and Land is vacant and looks unused and WTP capacity is of 1.5 MLD is proposed to be constructed at Khasra No – 130/3 Near 600 KL OHT beside Govt. Guest House in Bhainsdehi Town. The ownership of land is verified and is in possession of Revenue Department, Govt. of Madhya Pradesh and considered land is ensured for the purposed of water supply scheme. The said land is vacant and looks unused. The process has being initiated for the allocation land for construction. Note: - All Land belongs to Govt. Land and There is neither any Encroachment nor any informal users is available for all proposed components 19. Two existing OHT’s of Capacity 600 KL (OHT – I) and 150 KL (OHT – II) in the
Bhainsdehi Town are Proposed to be utilized in new scheme with some reconditioning.
OHT No. 01 of Capacity 600 KL is not connected with distribution system in the town, We
are covering 75% of Proposed Distribution system from this OHT No.01 and hence there
will be very little impact on the disruption of water Supply in the town during
reconditioning of OHT’s.
20. As per the Design Calculations, Raw Water Rising (RWRM) is to be laid from Jack well to
BPT of 150 mm Diameter, DI, K-9 Pipes having total length of 150 m and Raw Water
Gravity Main from BPT to WTP of 200 mm Diameter, DI, K-7 pipes having total length of
9000 m. The said RWRM and RWGM are passing through vacant and unused WRD land
and Row of PWD road under the ground and hence there will be no impact on traffic while
laying the Pipe line.
21. As per the design calculations, 2 numbers of Clear Water Rising Main (CWRM) are
proposed to be laid from Clear Water Sump at WTP. CWRM – I having dia150 mm and
length 185 m DI K-9 pipe will feed 600 KL (OHT – I) and CWRM – II having dia100 mm
and length 950 m DI K-9 pipe will feed 150 KL (OHT – II). Clear water rising mains will
be laid along Row of road from WTP to both OHT’s of length 1135 m. The road belongs to
Bhainsdehi Nagar Parishad and there will be no negative impact on traffic on the road
during laying of Pipe line.
Note: - All Land belongs to Govt. Land and There is neither any Encroachment nor any
informal users is available for all proposed components.
22. Separate centrifugal pumps are proposed for both CWRM’s to fill OHT I and OHT-II. For
CWRM-I, Q = 13 LPS and H = 30 m. For CWRM-II Q = 4 LPS and H = 21 m. The Clear
Water Pump House is also a Part of Water Treatment Plant and the Pump House shall be
located over the Clear Water Sump at WTP.
23. House Service connections : Providing house service connection tapping from a distribution
main/ sub-main including one tapping saddles, elbows, service pipe from tapping point to the
chamber near property boundary or inside the property boundary as per the direction with U-ball
valve, using 20mm Medium Density Polyethylene pipes (MDPE) pipe 5 m long. The work
shall include excavation, road restoration, etc complete. The connection shall have:-
i. Electro fusion Tapping Ferrule shall be provided with a SS-304 Brass cutter with cutting edges
for making hole / tapping on the Mains and Fusion joint in such manner that the 20-63mm
diameter outlet depending on requirement of the house service connections rotatable 3600

to the axis of pipeline. The town is having total number of household’s2091 .So all the
connections are considered in this project.
ii. Domestic water meters: Supply and installation of AMR compatible water meters for
each house service water connections 2091 nos. 15 mm size, brass body, horizontal
inferential multi jet type, magnetic drive with anti-fraud shield and dry dial with IP 68. Meter
shall be made of copper or any other suitable anti corrosive metallic.
iii. During the HSC activity, the existing water Supply shall not be disturbed. Once the
connection from proposed distribution system is ensured than only old system shall be
disconnected.
24. Site inspections and transect walk was carried all along the proposed laying of clear water
rising mains (150 mm and 100 mm). The proposed pipeline for clear water rising mains will be
laid along the sides of the existing town road ROW; the clear water rising mains to be laid in
Bhainsdehi will be along the Nagar Parishad roads. The 24818 m distribution network
pipelines in Bhainsdehi will be laid along the roads of the Nagar Parishad. Details of land
ownership for each water works component to be constructed are given in Appendix 1.
Note: - All Land belongs to Govt. Land and There is neither any Encroachment nor any
informal users is available for all proposed components
25. Civil works in the project include linear excavation for laying pipes along the roads,
placing pipes in the trench and refilling with the excavated soil. The trenches will be of 0.4 m
to 0.7 m wide and 0.8 to 1 m depth. Subsequent to completion of works, road reinstatement will
be undertaken by the contractor as part of the civil works. The roads in the core city area of both
the towns are very narrow and congested with pedestrians and vehicles, while the roads in
outer areas are wide. No necessity for full closure of roads is identified. Proposed distribution
pipe-laying on roads in most part of the town will not have any permanent or temporary IR
impact. Hawkers and vendors have been witnessed along the road side for most part of the
distribution network pipe-laying.
26. Laying of transmission mains and distribution network pipelines in the project area has been
carefully planned to minimize disturbance to pedestrians and traffic and avoid income loss
to businesses. Potential temporary impacts to traffic/access to shops and residence due to
digging and excavation for pipe laying are possible during construction; however, these
will be mitigated by ensuring access to properties through provision of pedestrian planks,
provision of adequate signage, and careful traffic management. Though there are no
mobile hawkers along the internal roads where the water works will be implemented, if
any such cases are reported, they will be assisted to move to nearby location to ensure that
their business remains uninterrupted. No income loss is anticipated.

A. Summary and Conclusions
27. No significant IR impacts are assessed at identified sites for sub-project components, as
adequate vacant land is available for the proposed facilities, within the compounds of
government lands. The site for Head works, BPT and WTP at Bhainsdehi was owned by WRD
and Revenue Department respectively. For which, NOC is under approval. For linear
components (pipe laying) or those proposed along government road ROWs, temporary
disruption to road users, pedestrians and community members will be avoided In the most
congested zones of Bhainsdehi Safety measures and mitigated during construction by the
contractor through simple measures such as provision of planks for pedestrian access to shops and
traffic management. It should also ensure to take all measures to maintain the equal
participation of both genders in each activity of project.
28. WRD, PWD and Revenue Department land will be acquired for the betterment of the Water
Supply Scheme and not in anticipation of ADB funding. There are no
encroachers/squatters/informal users present on government land that are identified for the
Project.
29. A budgetary provision is made for costs likely to be incurred for updating of this Project
