On 19.02.2019 I attendedthe installation function of IMATuticorin. I thank the officebearers and members of thebranch for the affectionatehospitality they extended me.
On 24.02.2019 I attendedthe installation function of IMAPollachi. On both occasions Iwas accompanied by our statePresident Dr.S.Kanagasabhapathy. Actually I hadbeen invited to attend theinstallation function of IMADharmapuri also. Butunfortunately due to trafficbottlenecks on the highway Icouldn't reach there on time. Iapologise to the office bearersand members of IMADharmapuri for the same.Hope you will give me anotheropportunity to visit you in thenear future.
On 03.03.2019, I wasinvited to attend the WorldHearing Day workshop byIMA Erode. Two useful
projects, the national deafnessscreening program and learningdisability screening programwere inaugurated in the augustpresence of the state PresidentDr. S. Kanagasabhapathy andthe president elect Dr.C.N.Rajawhose pet projects they are.I wish both the projects a greatsuccess.
The same day I rushed toattend the installation functionof IMA Kovilpatti. I wasmoved by the affectionshowered by the office bearersand members of the branch. Forthe first time the branch ishaving an all women's team andI wish them a wonderful yearahead. They also gave me 22new member applications andpromised more.
On 09.03.2019 (Saturday)in the afternoon I participated
in the installation function ofIMA Madurai Meenakshi.
On 09.03.2019, I alongwith our state Presidentattended the installationfunction of IMA CumbamValley Branch for which thenational secretary general Dr.R. V. Ashokan was the chiefguest also graced by the stateTNGDA president Dr. K.Senthil. I wish the new team avery eventful year ahead.
On 14.03.2019 I attendeda CME program of IMAMadurai in which I waspresented with 40 new memberapplications and was promisedmore.
Currently we are goingthrough a membership drive byoffering a concession. Actuallythe likely life membersubscription for single fromApril is Rs.13,000/- and forcouple Rs. 20,000/-. Hence Irequest all branches' Officebearers to promote this offerand bring more members. Indemocracy number is thestrength and if the stategovernment and other agenciesare inviting us for decisionmaking it's because of ournumbers and our unitedresponse to our problems.

The month of March is the starting of summer and always we have exam fever for thestudents especially for +2 students.
This time we have the election fever in IMA also. The FSS and PPLSSS election processhave been started. These two schemes are most important schemes of IMA TNSB. I requestall the members to actively participate in the election which is online as in the past.
The FSS office Chairman Dr. L.V.K Moorthy, Secretary Dr. Balagan Raja, Treasurer Dr.Solomon Jay and the PPLSSS Chairman Dr. K. Prakasam, Secretary Dr Thiraviam Mohanand Treasurer Dr. Kuthalingam have done very good job. I congratulate them for their work.
We have made SOP (Standard Operating Procedure) for the entire IMA including all thewings and schemes in order to make it convenient transparent fool proof which shouldimplemented soon.
Dr. S. Kanagasabapathy State President convened a special meeting on 15th Marth todiscuss the same.

World Sleep Day is an annual eventthat calls to action important issuesrelated to sleep using collaborativeefforts energized by sleep professionalsall over the world. The focus of WSD isto bring cognizance to the many burdensof sleep problems. WSD publicly displaysefforts being taken toward preventionand management of sleep disorders.
World Sleep Day 2019:The theme isHealthy Sleep, Healthy ageing.
Sound sleep is one of the three pillarsof good health along with a balanced dietand regular exercise. There are close to100 sleep disorders, but most aremodifiable and manageable with the helpof sleep specialist. Individuals who getan entire night’s sleep without anyinterruptions experience lower rates ofhigh blood pressure, diabetes, obesity andother chronic illnesses.
Sleep problems constitute a global
epidemic that threatens health and quality of life for upto 45%of the world’s population. Three elements ofgood quality sleep are:
Duration: The length of sleep should be sufficientfor the sleeper to be rested and alert the following day.
Continuity: Sleep periods should be seamlesswithout fragmentation.
Depth: Sleep should be deep enough to berestorative.
Research shows that we spend up to one-third ofour lives sleeping. Sleep is a basic human need, muchlike eating and drinking, and is crucial to overall healthand well being. Sleep, like exercise and nutrition, isessential for metabolic regulation.Breathing regularlyduring sleep is critical to maintain well-being and health.Persistent interruption of the breathing function duringsleep is called sleep apnea. This is a pervasive and

common disorder that affects 4% of men and2% of women. Sleep apnea causes daytimesleepiness and fatigue, and may lead to conditionssuch as hypertension, ischemic heart disease,stroke and diabetes.
Lack of sleep or poor quality sleep is knownto have a significant negative impact on ourhealth in the long and short term. Next day effectsof poor quality sleep include a negative impacton our attention span, memory recall andlearning. Longer term effects are being studied,but poor quality sleep or sleep deprivation hasbeen associated with significant health problems,such as obesity, diabetes, weakened immunesystems and even some cancer. Lack of sleepis related to many psychological conditions suchas depression, anxiety and psychosis.
Consequences of Sleep Disorders
Sleep disorders cause significant individualand societal burdern and form a serious publichealth problem. Obstructive Sleep Apneasignificantly impacts health and well-being. Thedrop in oxygen that occurs when breathing stopsdue to OSA put a strain on the heart and canlead to a number of serious health conditions.Directly or indirectly, disrupted sleep can have anegative effect on family life and relationshipsby affecting a persons’s mood and the way inwhich they are able to perform daily activitiesand interact socially.
Obstructive Sleep Apnea (OSA) is oneof the common sleep disorder comes under sleepdisordered breathing. The prevalance rate is4%in male and 2% in female. 80% of the OSAis due to overweight and obesity and othercommon reason for OSA are hypothyroidism andcongenital cranio-facial anomaly mainlyretrognathia and micrognathia. The aggrevatingfactors are sleeping pills, smoking and alcohol.
The clinical features of OSA are habitualsnoring, choking, gasping , sleep awakening,
morning head ache,day time tiredeness andsleepiness and loss of libido. Snoring is anabnormal breathing sound due to narrowing ofupper airway behind retroglossal and retropalatalarea in which turbulence of airflow causes thesound because of vibration of upper airway wall.
Diagnosis of Obstructive Sleep Apnea basedon history like symptoms and overweight, obesityand confirmed by the overnight Polysomnography(Sleep Study). Now a daysOSA is diagnosed bythe home sleep test (level-3 portable home sleeptest monitoring).
Treatment consist of risk factor correctionlike weight reduction, hypothyroidism correctionand correction of craniofacial anomaly. Inchildren adenotonsilectomy is the preferredtreatment. The gold standard treatment for OSAis the Continous Positive Airway Pressure(CPAP). This positive airway pressuretreatment is act as a splint of upper airway.CPAP prevents collapse the upper airway duringsleep.
Complications of OSA mainly cardiovascularlike coronary artery disease, congestive heartfailuire, cerebrovascular accident, uncontrolledhypertension, pulmonary hypertension,uncontrolled Diabetes, uncontrolled Asthma,Cancers and accidents.
Obstructive Sleep Apnea is a very commonclinical problem but this is under recognized,under diagnosed and under treated condition.OSA needs lot of awareness among the medicalprofessional and general public to preventcomplication, morbidity and mortality. OSA isnowadays considered as a mother of modernepidemic diseases which is commonly associatedwith metabolic syndrome or syndrome X(obesity, diabetes, hypertension and dyslipidemia).Metabolic syndrome plus OSA is Syndrome Z.World Sleep Day is organised by the world sleepsociety to create awareness about sleep andsleep disorders. �

The Research published inJAMA found that 27.2% of the122356 students participants reporteddepression symptoms. This researchhas shown that before starting medicalcolleges, students have better mentalhealth than their would-be teacher orbusiness peers. But this changeswhen medical students get to colleges.The contributing factors as stresssleep deprivation, academic rigour,and exposure to traumatic clinicalsituations, debt, and moving away from lovedones.Successful suicides are highest amongmedical colleges students & Doctors factorsadding to stress and suicide risk among medicos.

Minimum wages revision committee is beingformed and representations from NHB & IMAhas been submitted. We are hopeful fordiscussions with trade unions under officials oflabour department shortly.
Regarding Fire safety & Ramp series ofmeetings are going on and recommendationsfrom the collective decisions taken in theBrainstorming session for fire safety & rampby NHB IMA TNSB has been submitted to thecourt through the health secretary’s expertcommittee. Hopefully the final meeting will beon 18th March 2019.
We have planned a meeting on 10th March2019 with all common biomedical wastemanagement facilities to have discussions on
revision of tariffs for hospitals & OP clinics.
Representations for increase in rate inGovernment Health schemes has also beengiven to the new Health Secretary. We hope tohave meetings subsequently.

I am happy to communicate to all members finally as the secretary of PPLSSS OF IMA TN.I thank each and everyone for your valuable continuous support. We had our 83rd ManagementCommittee Meeting & 21st Annual General Body Meeting on 03.02.2019 at IMA KanyakumariDr. Mathias Hall Nagercoil. I thank the state office under the leadership ofDr. S. Kanagasabhapathy, for giving us an opportunity to conduct the Meeting at Nagercoil. Itwas attended by all the office bearers of PPLSSS. I thank them for their participation.
Special thanks and appreciation goes to Our Leader & Chairman Dr. K. Prakasam for hisguidance during my secretary ship. The PPLSSS Trust Board Meet, was held in the morningsession of the Annual general Body Meeting and few important decisions were made. It wasdecided to make Legal Provision in the trust deed, and to reconstitute the trust board.
Most important decision made by our chairman was Fee Revision for lawyers. That decisionhas been approved by the Management Committee and General Body.
It has also been decided to form a new category with compensation of 20 lakhs and groupinsurance to give more coverage. Our Chairman informed that 5 lakhs scheme of PPLSSS willcontinue and it is particularly for General Practitioner and he has requested the Non Surgical andSurgical & Aneasthetist category Members, to opt for 10 lakhs, and above category which willbe formed at the earliest.
I take this opportunity to thank Dr K.Kuthaligam our finance secretary for his support andguidance. I also thank all the IMA members of Kanyakumari District,and in particular the president,secretary,treasurer of all the four branches. 1. I humbly submit that, even after thejudgment of the Hon’bleSuprpeme Courtin Jacob Mathew Case, the Policeofficers are in the practice of registering
FIR against the Doctors, without obtaining andindependent and competent opinion from a doctor ingovernment service, who is an expert in that particularfield as envisaged by the Hon’ble Apex Court. Someof the cases for which the Police officer failed toobtain and expert opinion are mentioned hereunder:
(i) It is evident from the FIR No.88/2013 dated22.02.2013 registered by Inspector of Police, B1 TownPolice Station Thiruvallur against one Dr.Mohanwhich subsequently culminated in a criminalcase on the file of the Judicial Magistrate – I atThiruvallur P.R.C.No.20/2015. It is pertinent to notethat, this Hon’ble Court was pleased to stay thecriminal case vide order dated 30.11.2016inCrl.O.P.No.25858/2016 after observing the principlelaid down in Jacob Mathew Case was not followed.The order copy of the same is annexed herewith. Thisis one of many instances where the guidelines of theHon’ble Supreme Court are not adhered to by thePolice authorities.
(ii) It is evident from the FIR No. RC MA120011A 0016 dated 15.03.2011 registered by CBI, ACBChennai against B1 Town Police Station Thiruvallur
against Dr. Ashok & other Doctors of Joseph eyeHospital Trichy, without obtaining an
opinion from an expert government

Doctor, the CBI had filed their Final Report on No.26/2011 By implicating Dr. Nelson Jesudasan& otherDoctor of Joseph Eye Hospital, Trichy.
(iii) It is evident from the FIR No.158/2011, dated21.04.2011 registered by Inspector of PoliceAsaripallam, Kanyakumari District for alleged medicalnegligence against one Dr. MuthuShenbagam& Dr.Ravindran without obtaining an opinion from anexpert Government Doctor the police had filed theircharge sheet dated 03.11.2014.
(iv) It is evident from the FIR .No.1017/2014 dated26.12.2014 registered by Inspector of Police B1, PoliceStation Dharmapuri against Dr.S.Ranganathan&another without obtaining an opinion from an expertGovernment Doctor.
(v) It is evident from the FIR No.225/2016 dated09.05.2016 registered filed by Saibaba Colony PoliceStation, Coimbatore against Dr. Ilangovan withoutobtaining an opinion from an expert GovernmentDoctor as envisaged by the Hon’ble Supreme Court.

O R D E RThe petitioner is a practicing medical Doctor. He
filed the present writ petition seeking for mandamusdirecting the first respondent to Frame statutoryrules or executive instructions incorporatingguidelines as per the order of the Hon’ble Apex Courtin Crl.Appeal Nos.144-145 of 2004 decided on05.08.2005, Jacob Mathews vs. State of Punjabanother (reported in 2005n(6) SCC 1) in consultationwith the Indian Medical Association of Tamil Naduand the 2nd respondent herein pursuant to therecommendations dated 22.03.2014 submitted by theEthics Committee.
2. When the matter was taken up, on earlieroccasion, it was informed that already guidelines wereframed by the Tamil Nadu Government inG.O.Ms.No.220, Health and Family Welfare (21)Department, dated 04.07.2008. The learned AdditionalGovernment Pleader is directed to verify as to whetherany further guidelines are issued or the guidelinesissued in G.O.Ms.No.220 dated 04.07.2008, hold thefield as on today.

3. Accordingly, the matter is listed today forfurther hearing. The learned Additional GovernmentPleader produced a letter dated 22.01l2019 addressedby the Principal Secretary to Government to theAdditional Government Pleader of this Court, wherein,at Paragraph Nos.2 & 3, it is stated as follows:
“2. In this connection, I am to state that in thereference 2nd and 3rd cited, suitable instructions havebeen issued to All District Collectors, Commissionerof Police Chennai, Superintendent of Police, Directorof Medical Education, of Medical and Rural HealthServices and Director of Public Health and PreventiveMedicine to strictly follow the Acts and guideline atime of instances of attack on Hospital premises andpersonnel and also to instruct the following:-
i. As per the Tamil Nadu Medicare Servicespersons and Medicare Service Institutions(Prevention of Violence and Damage or Loss ofProperty) Act, 2008 (Act No.48) any office committedunder section 3 of the said Act shall be cognizableand non-bailable.
ii. the orders issued in G.O.(Ms).No.220, Healthand Family Welfare Department, dated:.4.7.2008 shallbe strictly followed while registering case againstthe Medical officer for negligent act or omission.
iii. Hospital and Health Care should be givenpriority to avoid untoward incident.
3. In addition, the District Collectors have beeninstructed to review the issues the in a quarter in thepresence of Joint Director (Health), Deputy Director(Health Services), Dean, wherever medical collegesare located along with local law enforcing authoritiesand a representative from India Medical Associationin that district will be a member to ensure that suchoccurrences are prevented. Moreover, in respect ofGovernment Medical College Hospitals and Tertiaryhospitals attached to them the Deans, concernedhave been requested to have a Hospital SecurityCommittee Monthly meeting to review the issues,every month and take necessary preventive andcorrective measures wherein the Residential MedicalOfficer, Vice Principals, Jurisdictional Assistant,Commissioner of Police/Deputy Superintendent ofPolice in the District, the representative from the TamilNadu Government Doctors Association, Nursesrepresentative, one representative Professor,
Assistant Professor, Post Graduate and CompulsoryRotatory Residential Internship (CRRI) Nomineeshould be included. The copy of the same enclosedherewith for ready reference.”
4. In view of the above stated facts andcircumstances, the learned counsel for the petitionersubmitted that the above submission made by thefirst respondent may be recorded and the writ petitionmay be closed.
5. Considering the fact that the guidelines werealready issued through G.O.Ms.No.220, Health andFamily Welfare (21) Department, dated 04.07.2008 andin view of the fact that those guidelines are stated tobe still in force, this writ petition is disposed of, byrecording the above facts and circumstances. “Thegovernment of Tamil Nadu is directed to inform theguidelines framed through G.O.Ms.No.220, Health andFamily Welfare (21) Department, dated 04.07.2008 toall the authorities concerned immediately. No costs.Connected miscellaneous petition is closed.”
