• The CBPCA 2008 HERS Basic Rater Certification Training provides the classroom and field training required to qualify as a California Field Verification and Diagnostic Testing Rater under the new 2008 Standards. This course will qualify successful participants for rating existing homes for Title 24 field verifications and testing homes for utility HVAC incentive programs. The CBPCA is not yet certified for newly constructed buildings or whole-house home energy raters.
• Basic HERS also provides prerequisite training for Building Performance Contractor Trainings and Whole House Home Energy Rater Trainings (HERS ll – pending curriculum approval)

$33 Million to California in Jeopardy
Court Freezes Stimulus Funds for Energy Efficiency Days Before Deadline SACRAMENTO – A $33 million statewide energy efficiency jobs program has been forced to stop after a Riverside County judge issued a temporary restraining order against the California Energy Commission. The judge, disregarding a looming federal deadline, also blocked the Energy Commission from spending the funding for any other purpose, including energy upgrades to residential, commercial or state buildings. The federal requirement for the state to encumber the funds is October 21. In a hearing this morning instigated by Western Riverside Council of Governments, a Riverside County Superior Court judge set a November 4, 2010 hearing date to consider if the Energy Commission is in contempt of court for canceling a solicitation that was rendered obsolete by changes in federal banking regulations. The Department of Energy awarded the Recovery Act money to the Energy Commission and encouraged the Commission to use it to set up financing systems that would make it cost-effective for homeowners to upgrade their homes so they use less electricity. “There is absolutely no basis for this order – this litigation centers on a solicitation that the Energy Commission has canceled,” said Karen Douglas, California Energy Commission Chairman. “Western Riverside’s lawsuit threatens to derail a comprehensive statewide jobs program by holding up $33 million in stimulus funds – funds that would benefit the entire state, including citizens of Riverside County. ” Late last year, the Energy Commission released a $30 million federal stimulus funded solicitation calling for proposals to create a Property Assessed Clean Energy or PACE program which would have financed energy efficiency and renewable energy systems for California residential and commercial consumers. Western Riverside submitted a $20 million PACE proposal but was disqualified because they ignored energy efficiency requirements in the guidelines and insisted that the funds should be spent only on installing solar panels. Western Riverside protested but was too late in filing their complaint to the Department of General Services (DGS). When DGS dismissed their complaint, Western Riverside sued DGS in Riverside County and a judge ordered DGS to hear their late protest. In addition, the judge also ordered the Energy Commission not to go forward with the winning contracts.
On July 6, 2010, however, the Federal Housing Finance Authority effectively pulled the plug on all PACE programs nationwide (including Western Riverside) making the Energy Commission’s $30 million financing award obsolete and soon afterward the financing solicitation and its five awards were canceled.
The Energy Commission has the discretion to cancel solicitations that will no longer achieve their intended objectives. In addition, the Energy Commission has the discretion and authority to determine how to best use the federal funds that it administers to meet state policy goals and the objectives of the Recovery Act. Racing against the federal time clock so the remaining $33 million in federal funds were not forfeited, the Energy Commission created Energy Upgrade California, a new comprehensive, statewide energy efficiency and renewable energy building improvement program sponsored by the PUC, utilities and local governments. Western Riverside returned to the Riverside court, filed a motion for a restraining order to stop Energy Upgrade California, claiming the Energy Commission should be held in contempt for violating the order that DGS should hold a protest hearing on the now-canceled PACE solicitation. “Western Riverside deliberately refused to engage the Energy Commission in a public forum and ambushed us with a baseless, last-minute contempt charge,” said Douglas. “This court order places us squarely in conflict with federal deadlines, at the expense of local governments across the state.” Energy Upgrade California would provide energy efficiency, renewable energy generation and water efficiency information on rebates and incentives, outreach and marketing, and financing opportunities to all California’s fifty-eight counties through an integrated web portal and a one-stop clearinghouse for financing options. “The misguided actions by Western Riverside will likely result in these Recovery Act dollars reverting to the federal government, thereby preventing the Energy Commission from launching a statewide, job creating energy efficiency program," said California Task Force Director Rick Rice. "Instead of working to put these Recovery Act dollars to good use, Western Riverside is choosing to put tens of millions of dollars at risk for local governments throughout the state that would otherwise be able to participate in this program.“ ###
SAN RAFAEL San Rafael appoints Assistant City Manager
The San Rafael City Council on Monday appointed Assistant City Manager Jim Schutz to interim city manager. The council made the unanimous decision in closed session.
In September, City Manager Ken Nordhoff announced he will take a job as Walnut Creek's city man-ager starting Nov. 18. Nordhoff has worked for San Rafael for 14 years.
Schutz will earn an annual salary of $169,903 while he serves as interim city manager. City officials expect the search for a permanent city manager to take about six months.
Cal Park Tunnel set to open in November
The $27 million Cal Park Hill Tunnel is expected to open to the public on Nov. 9. The tunnel will have a bike and pedestrian path and eventually trains and their riders.
The tunnel, last operational in 1978 and has been closed since the 1980s. The re-built tunnel, which is 30 feet wide and 25 feet tall, is divided, part dedicated to the rail right of way, the other to bicycle and pedestrian use.

Housing Element Community Meeting
The Novato City Council will hold a public meeting on October 26, 2010, at 6:30pm at City Hall at 901 Sherman Avenue, Novato, CA. The City Council will hear and discuss a status report on the Housing Element update process, schedule, proposed workshops, and the City Manager’s Working Group, in-cluding the membership, purpose and role of the Group.

San Anselmo council re-considers plan to ban PG&E's smart meters
The town of San Anselmo will not stop Pacific Gas and Electric Co. from installing trademarked Smart-Meters after all.
The council revisited the issue at Tuesday night’s meeting and split 2-2 on the question, with Council-woman Kay Coleman recusing herself. The council voted 3-0 last month to draft an ordinance that would place a one-year moratorium on the meters. The council was concerned with the use radio waves to transmit data on energy usage to PG&E. Critics of the meters fear the production of radio-frequency radiation from a growing list of digital devices in the home could pose health threats.

Kalb's Q&A for Contractors By David Kalb, President of Capitol Services, Inc. I will ‘mow’ down a common misconception about adding ‘landscaping’ work to your General license. Two other questions help clarify how and when a ‘special’ waiver may be obtained by “A”, “B” or “C” contractors. First, we share the rules on when a DBA is appropriate in advertising a business name… Q: I am familiar with the CSLB’s advertising guidelines after having reviewed these on your website Online Resources page. Nevertheless, there still seems to be some uncertainty associated with these statutes (B&P 7029.6 and 7030.5). Our interest is to simplify our advertising whereby both our companies can advertise under the same ‘DBA’. Two questions: will the Board allow two companies with the same business name? Will we need to list the FULL company name plus the DBA? I know we’ll likely need to register any changes with our local government. A: I’m glad you found these guidelines useful. In answer to your first question, YES, in general the Board will allow the same fictitious business name (DBA) for two companies. However, it is very unlikely the Board would allow a General Partnership (GP) or a Limited Partnership (LP) to list a ‘DBA’ as is the case with one of your business entities. In response to your second question, NO, you’re not required to list the full company name – only the “DBA’ portion. Q: We’ve had a “B” license for many years. Our interest is to secure a “C-27” class to handle landscaping. Do you feel the CSLB would issue a waiver of this class under 7065.3?
A: According to Section 7065.3, the CSLB will look at whether a Specialty (“C”) classification is “closely related” to the class presently held by the contractor. Or as it relates to “A” or “B” contractors, the applicant will need to apply for a classification “which is a significant component of the licensed contractors construction business as determined by the Registrar”. While current law allows for an “add class” waiver, I do not believe the CSLB would grant a waiver for the landscaping classification. Q: I have a large roofing company client who wants to add the “B” to his existing “C-39” license. He has experience in carpentry, HVAC, electrical and plumbing while performing commercial re-roof projects. I would like to get him an exam waiver under B&P 7065.3. Can you help with this and do you think the CSLB would approve such a request? A: I have yet to see the Board approve a waiver for a General classification when the present class held is a ”C” specialty. As I responded to the prior questioner, the classification being applied for must be sufficiently related to the class presently held by the contractor. When 7065.3 was added to the Board’s statutes in 1990, its “general” purpose was to allow “A” or “B” contractors to secure a waiver of a related additional class that had been performed or supervised on a regular basis. For General builders, this would likely include (but not be limited to) Plumbing, Plastering, Carpentry, Painting, Drywall, or Roofing. For General engineering contractors, this would include Sanitation Systems, Pipeline or Earthwork and Paving for example.

Tips for Incorporating Wellness Into Your Ergonomics Program
A good ergonomics program will address the occupational or physical risk factors of work. But, what about the non-occupational and individual risk factors such as obesity, physical inactivity, diet, smoking, and stress—all of which have been linked to an increased likelihood of developing musculoskeletal disorders (MSDs). Worksite wellness programs can help reduce non-occupational and physical risk factors as well as address other health concerns for employees.
Recent studies show that for every dollar invested in a worksite wellness program, approximately three dollars are returned through better employee health, improved productivity, and reduced absenteeism.
Below are some tips to encourage your employees to make small changes toward a healthier lifestyle.
• Educate your employees. Organize "lunch and learn" sessions on relevant topics such as nutrition, healthy cooking, weight management, smoking cessation, and stress reduction.
• Organize a wellness fair. Invite representatives from local medical facilities, gyms, or weight-loss clinics to set up tables for blood pressure and cholesterol screening, lifestyle evaluations, nutrition counseling, and fitness tests. Invite your STATE FUND loss control professional or ergonomist to set up a table on health, safety, and ergonomics.
• Organize walking groups. Encourage participation by providing maps of safe walking routes near the office. Provide ways for participants to track their progress. Make it competitive—who walks the furthest in a week, month, quarter, and year.
• Provide fruits and other healthy snacks at meetings.
• Provide better choices in the cafeteria or in vending machines such as 100 calorie snack packs, fruit, and water. Consider offering free fruit as an alternative to sugary snacks.
• Set up friendly competitions and challenges within your facility or with neighboring employers.
• Offer a variety of incentives to encourage employee participation. Consider offering "prizes" when goals are met. This may also encourage individuals to set new and higher goals.
• Contact local gyms or weight clinics as they may be willing to offer discounts to employees.
• Provide employees sufficient time and a place to practice wellness activities. Offer a meeting room for lunch time yoga or stretching classes. For those employees who go to the gym or participate in a walking group during lunch, consider giving them an extra 15 minutes for their lunch after their activity.
• Develop a newsletter or internal web page outlining your program and the benefits to employees.

EXCAVATIONS An excavation is any man-made cut, cavity, hole, trench or depression made in the earth’s surface by the removal of soil. Workers in excavations can be exposed to cave-ins, engulfment, hazardous atmospheres and falls. Excavation safety training and procedures prevent serious injuries and accidents.
Before work on an excavation can begin, surface hazards such as unstable buildings, sidewalks, etc. that could endanger employees must be secured or removed. Hazards below the ground must also be identified and made safe before work can begin. At least 2 days before the excavation, contact private utility companies and USA North / Common Ground Alliance (CGA) at 811 or 1-800-227-2600 to see if there are buried pipes or utilities in the planned work area. Follow work procedures that avoid disturbing these installations during excavation.
Excavations near sewers, landfills, chemical plants, and storage tanks for hazardous materials may have hazardous atmospheres. Excavations require inspection for hazardous atmospheres like low oxygen levels, high chemical concentrations, and/or flammable/explosive gases. Excavations deeper than 4 feet need to have atmospheric testing. If there are atmospheric hazards present or they could be present, ventilation, respiratory protection, and rescue equipment must be provided for worker safety.
Signs of soil distress near an excavation may indicate collapse or cave-in dangers. Fissures, cracks, or sagging/slumping materials from the open face of the excavation can indicate a hazard. Bulges at the excavation bottom, sinking at the edge, and small amounts of dirt and rock falling into the excavation are also signs of instability.
If the excavation is more than 5 feet deep, it needs a permit from Cal/OSHA and there needs to be a protective system (benching, shoring, sloping, etc.) in place to protect the workers inside. For excavations more than 4 feet deep, there needs to be a way to enter and exit the work area at least every 25 feet via a ladder, ramp, or other sturdy device.
Excavation inspections are required before work starts, during work shifts, and after rainstorms. A competent person that is familiar with excavation regulations and safety systems, how to type soils, and how to recognize excavation hazards must do these inspections. Inspectors should look for signs of cave-ins, failing protective systems, and potentially hazardous atmospheres. If hazards are found, workers should exit the excavation until the work area is made safe.
To protect workers from falling soil and rocks during excavation operations, perform maintenance scaling of the open excavation face to remove loose rocks from the excavation face. Use protective shields and retaining fences to hold back loose material. Keep spoils, supplies, equipment, vehicles, and workers at least two feet from the working edge.
Avoid working in excavations that hold or accumulate water. If work MUST be done in this situation, use protective shield systems, pumping devices, and harnesses with safety lines as added protection. The pumping system must be monitored by a competent person. Diversion systems and dikes can be used to re-direct flowing and encroaching water sources

EXCAVACIONES Una excavación es cualquier corte, cavidad, hoyo, zanja o depresión hecha por el hombre en la superficie de la tierra mediante la extracción de suelo. Los trabajadores en excavaciones pueden estar expuestos a desmoronamientos, quedar sepultados, atmósferas peligrosas y caídas. Los signos de perturbación en el suelo cerca de una excavación pueden ser indicio de peligros de colapso o desmoronamientos. Las fisuras, las grietas, o los materiales con hundimientos/desplomes de la superficie abierta de la excavación pueden indicar un peligro. Los abultamientos en el fondo de la excavación, hundimientos en los bordes y pequeñas cantidades de tierra y roca que caen hacia la excavación son también signos de inestabilidad.
Si la excavación es mayor de 5 pies, es necesario obtener un permiso de Cal/OSHA y es necesario instalar un sistema de protección, rellanos, taludes, ademado, etc. en el sitio para proteger a los trabajadores en el interior. Para excavaciones mayores de 4 pies, deberá haber un medio para entrar y salir del área de trabajo en al menos cada 25 pies a través de una escalera, rampa u otro dispositivo robusto.
Es necesario realizar inspecciones de la excavación antes de que comience el trabajo, durante los turnos de trabajo, y después de las tormentas. Estas inspecciones deberá realizarlas una persona competente que esté familiarizada con las normativas de excavación y con los sistemas de seguridad, con las técnicas de clasificación de suelos, y con la detección de riesgos en las excavaciones. Los inspectores deberán buscar signos de desmoronamientos, sistemas protectores defectuosos y atmósferas potencialmente peligrosas. Si se encuentran peligros, los trabajadores deberán salir de la excavación y no ingresar al área de trabajo antes de que sea seguro hacerlo.
Para proteger a los trabajadores contra el suelo y rocas que caen durante las operaciones de excavación, lleve a cabo labores de rascado en la pared de la excavación abierta para eliminar las rocas sueltas de dicha pared de la excavación. Use pantallas protectoras y cercas de retención para retener el material suelto. Mantenga los trabajadores, las acumulaciones de material, los suministros, los equipos y los vehículos a una distancia mínima de dos pies del borde de trabajo.
Evite trabajar en excavaciones que retengan o acumulen agua. Si es IMPERATIVO trabajar en esta situación, use sistemas de pantallas protectoras, dispositivos de bombeo y arneses con líneas de rescate como protección adicional. El sistema de bombeo debe ser monitoreado por una persona competente. Los sistemas de desviación y diques pueden utilizarse para cambiar el curso y cauce de las fuentes de agua.
