Green vsFair Association
As you know, weve beenwaiting for the City to send
us a copy of District One
Councilman George Greens
response to the ethics charges
filed against him by the Comal
County Fair Association - a response
that the San Antonio Express News and the
Houston-owned Herald-Zeitung had last week,
and which Green declined to send us, despite
repeated requests, while at the same timecomplaining to our newsroom that the HZ had
misrepresented said response.
As far as were concerned, if youre not
going to let us see your statement its probably
not a great idea to complain about what
someone else did with it.
Confusing? Yes, because it doesnt makes
sense in the real world. But this is politics,
where reason is cast aside in favor of just
about anything when attempting to manipulatethe media. Lets bring you up to speed:
BackstoryIf youre unfamiliar with the reason that the
Fair Association is going after Green, we
recommend, nay,insist, that you read the First
Word column from October 24, 2014, a link
to which is pinned to the top of our Facebook
page at facebook.com/txcitizen. Its important
that you read that article, preferably beforethis one, because it contains highly relevant
quotes from Councilman Green that contradict
his motives as put forth in his official response.
In short, Green was upset about not being
allowed to park/stand in restricted areas of
the fairgrounds, and subsequently turned the
Fair Association in for code violations, which
the City looked into, only to find the Fair in
compliance. Twice. Then he called for the
cancellation that their lease agreement withthe City. And that they be audited. #warpath
Now City Hall has hired an attorney (a
law partner of former NB City Attorney Charlie
Freakin Zech) to keep Greens case from
going before the Citys Ethics Commission.
This attorney has been retained by City
Council to make arguments to City Council
about why the Ethics Commission shouldnt get
to review the charges against Green. You read
that right. This is like police officer requestingpermission from your lawyer before issuing
you a speeding ticket.
FrontstoryCity Hall has since provided us
with Greens statement, andhas put itself in a precarious
situation - If Green is found
justified in his complaints about
the non-existent code violations,
the City is making a de facto
accusation of incompetence against its
own building department.
The head of that department adamantly,
and during an open Council meeting,
declared the Fair in compliance on the issuewhich Green continues to pound on in his
effort to cover his tracks. In the end, this isnt
just Green against the Fair, this is Green vs
City Building Honcho Bob Kinsey. Those Dale
Carnegie courses are not paying off.
Whole Story1) Green believes he should have been
allowed to park/stand where he had parked/
stood in the past, even though those areas arenow restricted, because he is a City official
and the City owns part of the land the fair sits
on. The Do you know who I am? argument
didnt fly at the Fair.
2) Green has suggested that he was turned
away because he is African-American. As one
might expect, this makes him very upset. This
grievance would carry more weight if there had
been white Council members parked/standing
in the area in question, which there were not.3) Green saw an opportunity to nail
the Fair Association on what a friend of his
told him was non-compliant electrical work,
and took it. The friend in question is not an
electrician, and probably should have kept his
stupid mouth shut about things of which he has
no knowledge. Let this whole situation be a
life-lesson for both Green and that friend.
4) The City checked out Greens complaint
right away. Turns out there wasnt a problemat all. So Green complained a second time.
The City checked a second time. Still wasnt a
problem. Since Green didnt get any traction
there, he decided to bring the Fair Association
up for a full audit at the next Council Meeting,
and by doing so, ###### himself in a way
that no political enemy ever could.
Now hes doubling-down yet again. Lets
get a double-down tally before we move on:

For the record, if this started with a $10Game-One bet on the 2008 Detroit Lions, Greenwould now be in for over $2,500 just tryingto stay even. Kids, remember - its better to cut
your losses after the first mistake rather thancompound them. Just apologize and walk away.Green could have stopped this madness at
any time, and redeemed a measure of his honorby admitting he was wrong to get carried awayand throw his influence around. His reputationhas been tarnished by this, and that stain willonly become worse so until he goes back andtakes responsibility for the damage.
Instead hes chosen to go to the wall withit. As mentioned above, the City hired a special
attorney to justify why Green should not face thecharges, which, you know, adds up. Your taxdollars at work and whatnot. We analyzed theresponse that Greens attorney drafted, and theresults are interesting. Remember, when a clientis in the right, an attorney seeks to clarify. Whentheir client is standing on the short end of theargument, they do their best to confuse . You candecide for yourself which is happening.

Dear Mr. Denton:Please accept this letter as my official
response to the complaint made by WarrenC. Montague with the City of New BraunfelsEthics Commission. I consider the allegationsan outrageous attempt to slander my nameand reputation with accusations that aretotally and completely baseless. The absurdity
of anyone to suggest or contend that I wouldput my personal reputation at risk to retaliateagainst an organization over a parking spaceis patently ludicrous on its face.
On September 19, 2014, I attended theBar-B-Q Fair Cook Off during the annual ComalCounty Fair to meet and greet people andenjoy the festivities as I have done for the past10 years. I have always attended the fair whenpossible, and its one of my favorite local events.My family has been involved with the Comal
County Fair for many years; back during thetime that my parents picked up trash and othermaintenance work at the fair. I am a productof this community along with 4 other siblings.I am a native Texan, born in Refugio, Texasand raised in New Braunfels, Texas. I attendedLamar Elementary (at the corner of Main &Veramendi Street one block from the ComalCounty Fair Grounds) from 2nd to 6th gradein New Braunfels ISD, then to New Braunfels
Jr. High and on to New Braunfels Sr. High from9th-12th. During grade school and high schoolI participated in 4-H and FFA youth activities atthe Comal County Fair Grounds. My first job
at the age of 7 was to clean horse stalls at thefairgrounds at the pay of $5.00/week. As Igrew older I became a Jockey and rode racehorses for Mr. Jack Mills and the general public.I graduated from New Braunfels High Schoolin 1975, and in 1979, I earned a Bachelor ofScience Degree in Agriculture Education withhonors from Sam Houston State University. Iwas elected to the New Braunfels City Councilin May, 2013 and I am very proud to say that
I am the first African-American ever elected andhonored to serve on the council. Included is ageneral list of my accomplishments.
At approximately 5:00pm, while at a Bar-B-Q pit visiting with several constituents who livein my district. It was pointed out to me that theguy who was working on a near-by telephonepole was allegedly a man named Fred Butler,a cable installer and allegedly not a licensedelectrician. The person identified as Mr. Butlerwas up on the pole for several hours, by my
estimate at least three hours. If this allegationwas true, I became concerned about the qualityof the electrical work being done, the safety ofthe repairs, and whether this individual was trulycompetent to safely perform what I considervery dangerous electrical repair work on city-owned electrical lines. As it started getting darkI departed the area and went home.
That night I gave this situation more thought.I began to think more deeply about the potentialhazards and dangers to the individual as wellas to the community and our citizens by theComal County Fair Associations alleged useof an unlicensed and uncertified electricianto work on high voltage power lines. As Iunderstand the law, as a general rule no personmay perform electrical work or residentialappliance installation unless the person is alicensed electrician, and the work being doneis performed through a licensed contractor. (seeTex. Occupations Code Sec. 1305.151 attached
as Exhibit A)After thinking about it more andmore, the next day, September 20th, I againtraveled to the fairgrounds to return to the FairBar-B-Q Cook-Off to get a closer look for myselfat the electrical work being done at the powerlines on the telephone pole. The catalyst was tosee what electrical job that this person was doingwas. Like the day before, I also planned to use itas an opportunity to meet and greet citizens andfriends as part of my outreach to constituents.
I drove up to the lot and attempted to
return to the Bar-B-Q area as I had done theday before. There were other cars and trucksparked in the very area where I wanted topark. But this time the fair association had theroad blocked off - unlike the day before. I onlyspoke to two people, the one who I first metat the block and asked why it was blockedand he told me that what the fair associatedwanted. I then asked him if I could speak tothe president who I had never met. No other
conversation was made.

Response to Captain Tommy Ward:
I only asked Mr. Ward if I could gopark on the other side of the closed gate.There were other cars parked in that area.He said no. I asked him why not? He said itwas a public safety issue because they werehaving a Mutton Busting contest. I askedhim who was responsible, he told me thefair board president. I then asked to speakto the fair board president. That was the onlyconversation I had with Captain Ward; the restof his allegations are not true.
I did call Sheriff Holder and informed himof the incident and confirmed that we havenever had any problems with the Sheriffsdepartment and that everything was O.K.with the relationship between the Sheriffs
Department and the City.Response to Warren Montague:
I spoke to Mr. Montague, the Fair Boardpresident. I introduced myself and askedif I could get to the parking lot where myconstituents would have saved me a spot andhe told me no. I then asked him if he was awarethat there was someone there doing electricalwork who allegedly was not a licensed orcertified electrician. I followed up by askinghim if they had pulled all the proper permits.He claimed they did. I said OK but I plannedto look into it further. I then got in my truckand parked in another spot. I did not persist orinsist that I be allowed to park.
Given Mr. Montagues reaction, hisdemeanor and dismissive tone, it was veryapparent to me that he had no intent whatsoeverto investigate this allegation. I therefore sent anemail to the City Manager and asked if he wouldlook into the information I had been given by the
citizen. In bringing up the question regardingthe repair work being done on the power linesby an unqualified electrician, my intent was toalert Mr. Montague to the allegation so thathe or his staff could investigate the validityof the claim, and to take appropriate actionsas needed for the safety of the community. Icertainly didnt intend to use my position as acity official to threaten or retaliate for not gettinga parking space. It is patently preposterous for
anyone to link the two. Because of the seriousnature of this allegation, and the potential riskto the community I serve, I would have followedup with this no matter what - with or withoutaccess to the parking area. Any suggestion orconclusion that I had made up this allegationin an attempt to either exert undue influenceor to retaliate against the Comal County FairAssn. for not allowing me to park is completelybaseless and frankly, offensive and hateful.

It appears that thestaff with the Comal County Fair Assn. may havemisconstrued or misinterpreted my intentions.My actions and comments were apparently
perceived to be motivated by thoughts I did nothave for a purpose I did not seek.
As an elected public official of theCity of New Braunfels I take my duties andresponsibilities very seriously. What amazes me about great photographers
is not what they see, but how they see.
I can observe the same thing a
photographer sees but, somehow, they see
it, well, more. The photographer can seea moment in a depth I completely miss. The
photographer can see it in scales of light and
shadow that I dont consciously apprehend.
The photographer can see it in colors I
overlook. More importantly, the photographer
can comprehend the singularity of the moment
before I realize its uniqueness.
We have all heard about how photos
tell a story. I disagree. Photos are the images
from which stories spring. A good photo hints
at a mythos thats waiting to be explored,
expanded upon, waiting to be contextualized.
What makes a great photo interesting is not just
what it says but what it doesnt say. The photo
is waiting for the viewer to fill in the blanks.
So, as a great photographer, New
Braunfels Ralph Nordenhold doesnt just take
photos, he builds myths.
One of Ralphs more impressive photoswas of cowboys driving a small herd of
longhorns through the streets of San Antonio.
In black and white, this image looks as if it
could have been taken at the turn of the 20th
century, thus it speaks of the timelessness of
men and horses driving livestock.
Ralph, who spent 20 years in the Army
working on cryptology equipment, took up
photography in 1970. And, like most artists, he
cant tell you exactly why he chose his medium.What draws anyone to any art discipline?
he said. I just did. It just caught my interest.
Luckily, Ralph took up photography while he was
stationed in Europe, which offers a great deal of
visual candy for the erstwhile photographer.
As anyone who had worked with a camera
before the digital revolution can tell you, muchhas changed, and certainly not for the worse.
In the old days, to get the most out of a
shot, there was a great deal involved with the
processing of the photos. If you made a mistake
with the negatives, it was over. Now, blessedly,
you can edit photos through the computer,
making exposures that would have required
several gut-wrenching trials and errors with
hazardous chemicals, all underneath red lights.
However, dont be mislead good
photography still takes a great deal of work
and planning. A perfect example of this is an
image Ralph took of an old barn just a stones
throw from the H-E-B complex on Hwy. 46.
I took the picture at midday, and the
brightness outside and the shadows inside
were extreme, he said. I was able to bring
it together with five shots. I used a tripod
and measured the light inside, which was ata sixteenth of a second exposure, while the
outside was a thousandth of a second.
Ralph explained that high-resolution
photographs require more than one photo.
It takes at least three pictures:
Underexposing, to get the highlights;
overexposing, to pick up the details in the
shadows; and one in the middle. Then you
combine those three to make an image that
captures all of the light.Light seems to be a specialty of Ralphs,
which he said defines everything. For
example, his photos of the Christmas lights
downtown speak volumes to his skill and
attention to detail. His photos dont halo, instead
they shine with an enviable clarity. Ralph used
the nights dampness to his advantage, addingyet another dimension to the light show.
Some shots, you stumble upon them, he
said. Most of your shots, you just throw away
but those remaining five percent, if youre
lucky, can become something.
One example of stumbling onto a great shot
eventually became one of Ralphs favorites of his.
I was in Turkey, on a group tour in Istanbul,
and I left the group and took off down a side
street, he said. There, I saw an old woman
in black garb -- she must have been about 80
years old -- and she had basket of rolls and was
breaking off pieces of bread and feeding it to
this toddler. It was a really great scene.
I saw of negative of this photo and it was,
indeed, a phenomenal shot. Another I really liked
was of several elderly men playing cards in Italy.
It was an open space with one incandescent
light bulb on a telephone pole, he said.Like the photo of the longhorn drive, the
photo of the Italian card players was also
timeless, and one that launches the mind. The
mind creates stories around art because it
doesnt like voids and what it cant understand,
it will build. Art is frozen in time, but the mind
is not, and this is what gives great art its
timelessness. This is because art doesnt just
speak of the artist, but the viewer as well.
Beautiful and intriguing, Ralph Nordenholdsphotographs can keep the mind busy.
Oh, and he makes a great latte.

at a local community college. My
students are writing their final essays
on a local problem; I have one student
who has decided to write about illegalimmigration (specifically Mexican).
We were discussing, as a class, each
students project, and this student
made a comment that I wish I had
reacted to differently.
He said that he encounters a
number of Mexicans who cant speak
English fluently, and since speaking
English must make it easier to gain legalcitizenship/entry, he assumes that
all (or most) or the Spanish-speaking
Mexicans must be illegals. My response
was to skip over the racism and move
on to another student. What should I
have said to help aware this student of
his racist assumptions?

mujer! Its your job as a profe to call out your
students on their reliance on Wikipedia, on
their horrendous grammar, and especially
on any racist assumptions they may have.
Of course, you also want to be constructive,
so this is what you should do: call out the
student on their assumptions in front of the
class, saying that while its okay to have
opinions (seriously, Aztlanista professors:
dont excoriate a conservative student just
because theyre conservative. Conservatives
are people, too), its not okay to make blind
assumptionsthats not the scholastic way.
Id have him explicitly state why he thinks
any Spanish-dominant Mexican is a mojado,
and ask for proof in the form of stats and
him procuring someone. Then Id ask him to
explain why foreign languages have been a
part of the United States since its founding,
and why immigrant enclaves never fully
disappear. Make it a teachable momentthat
is your job, after all. And if he cant do any of
the above, call him a pinche pendejo baboso
on Facebook so all your fellow profess can
laughit is a teachable moment, after all.

the motherland, I was raised to believe
in los reyes magos. When I came to the
U.S. I started to hear about a fat man
in red suit, called Santa Claus. Why doyou think many Mexicans here forget

just Los Reyes Magos Mexicans forget
about. Other Christmas traditions that
historically didnt make it across the Chevy
crossing la frontera include real posadas
(instead of doing nine days of reenacting
Mary and Josephs search for lodging
and going from house to house, many
Mexicans up here celebrate one day), Misa
de Gallo (Midnight Mass on Christmas), a
nacimiento (Nativity scene) that takes up
the entire living room, the December 28
celebration of Los Santos Inocentes, which
commemorates all the kiddies King Herod
had killed, and your aforementioned Reyes
Magos feast day, which gabachos call
Epiphany. But thats not surprising: actual
Mexican culture in the U.S. is always
watered down because of assimilation, a
tale as old as the myth of Quetzalcoatl.
That said, the Reconquista has brought
up many Mexican celebrations in the past
generation, like Da de los Muertos, Da de
los Nios, and the baking of rosca de reyes
(our version of the King Cake ser ved during
Mardi Gras) during Christmas. Gabachos:
save this column so when your half-Mexican
grandkids read this 40 years from now, youll
have proof that Mexicans once actually did
gabacho things.

On FergusonSometimes, I try to avoid a topic. Its usually
because I think it doesnt matter, but thats
not always the case. Every once in a while,
I stay away from a topic - believe it or
not because I think it will cause trouble;
such was the case with Ferguson, MO.
The Michael Brown case was so filled with
emotion that it seemed unlikely that any
rational discussion could be had. None
of that has changed, but I have been so
inundated with idiocy about the case that
I feel compelled to chime in, so here it is.
As I suspected all along, MichaelBrown was a thug. There really isnt any
prettier way to put this ugly truth. The
evidence from the grand jury supports the
story of Officer Wilson, that Brown attacked
him in his car, attempted to flee, and then,
foolishly, turned and charged Wilson. The
result was predictable: he was shot dead.
(The idea that some less-lethal means might
have been employed to apprehend Brown
is a silly bit of second-guessing.)
Im not sorry that Michael Brown is dead.
Call me callous if you like, but I see these types
of situations less as tragedies and more as
Darwinism. When a man not a child acts
in so decidedly stupid a manner, his removal
from the gene pool is not to be lamented.
I have a certain amount of sympathy for
Browns friends and family, they lost someone
they loved regardless of the circumstances,but their actions since the shooting have done
a good deal to ameliorate this concern.
Some might use the fact that I suspected
Browns guilt all along as evidence of the
racism inherent in the system, but they would
be wrong. These stories do come out of the
black community more often than not, but this
has nothing to do with race as far as I can
see. Instead, shootings of black males by thepolice seems to be a typically urban problem
and one that occurs almost exclusively
in neighborhoods where both crime and
unemployment are high. My suspicions reflect
only the reality that when these incidents
occur, they seem to follow a predictable script.
The other argument is that police treat
African-American* males differently than
they treat other citizens. I havent seen
any direct evidence of this, but I suspectit is probably true, just not in the way or
for the reasons being suggested. A police
officer, close to crime on a daily basis, is
probably very aware that an unreasonable
percentage of crime is committed by African-
Americans. I cant see how this wouldnt
affect the reactions of individual policeofficers even if they actively attempted to
prevent it from doing so. More likely than
this causing police to be more trigger happy
in cases involving young, black males is that
police will be more on-guard and aggressive
in their interactions with the group overall.
Taken in the aggregate, this is probably
much of the reason for the poor relationship
police often have with largely African-American neighborhoods. The reactions of
both sides are understandable if this is the
case, but the police are the professionals
here, and it should fall on their shoulders to
try to change this dynamic.
This would, of course, be a good deal
easier to do if opportunists like Al Sharpton
(et.al.)(Latin for and all those other guys)
would stop crying racism in cases where it
is clearly not true and encouraging peopleto act unlawfully. In this, I see a good deal of
racism. Somehow, it has become expected that
frustration in the African-American community
will, and should, result in lawless behavior. It
has become such a forgone conclusion that
this time around, the media showed up on the
scene to cover the meltdown like it was part
of sweeps week. Rarely are we disappointed
when people held to such a low standardare expected to drop to meet it. Just once,
it would be nice to see the agitators, media
and police all show up and find themselves
standing alone in quite streets as everyone
goes about their business.
America, like every other nation on
Earth, has an ugly tradition of racism. This
racism isnt exclusive to African-Americans;
weve always been equal opportunity
xenophobes. But, the reality of slavery makes
this history more damaging to African-
Americans than perhaps any other group.
(African-Americans should be thankful we
havent treated them to as much assistance
as the Native-American community.) This
fact, and our consistent well-intentioned
meddling, has just made things worse.
Poverty programs, racial quotas and
overblown civil-rights legislation have servedonly to cement the idea that blacks are
somehow inferior in the American mind.
When this is said out loud, it is almost always
predicated on cultural differences, but this
is just another way of saying they are less
sophisticated than us. I cant imagine a
more racist notion. Protected statuses are forchildren, and when applied to children its a
good and natural thing. Doing the same to
an entire class of people infantilizes them,
and theres nothing good or natural about it.
It encourages a mindset that America should
have left behind roughly 150 years ago.
So, what can be done? For the majority
of non-black Americans, nothing. Its none of
your business. Stop being a busybody. Theblack community, on the other hand, can
do a good deal. They should refuse to be
treated as a separate group of citizens (they
should drop this African-American nonsense,
yesterday). Dont wait for the police to change
the way they react to you, change the way
you react to them. Kill them with kindness.
Be polite and helpful in every interaction,
and every time that you are treated with
disrespect, complain and take that complaintup the chain of command, politely. Create
local community programs (private is better
here) to promote education, reduce crime
and increase local economic investment. Elect
officials who are prepared to fix the problems
in your community, not subsidize them.
And, it wouldnt hurt to infiltrate the police
departments so that the racial makeup of
the police force is a little more like the racialmakeup of the community it polices.
None of these things require any
governmental involvement at all (with the
exception of electing politicians willing to
get out if the way), and none of them require
the likes of Reverend Al. The African-
American community has suffered for
years. Its time for a liber tarian revolution
there. That would go a long way to solving
these problems, much farther than mindless
violence and lawlessness.
*I hate this term African-American.
Globalism has made it less than useless , but
I am bowing to political correctness (and a
certain amount of style) here. I do this only
to attempt to keep the discussion polite and
not distract from the overall issue.
