Two legislations• The Older Americans Act and the Age Discrimination

in Employment Act are two civil rights legislations intended to protect the elderly population.

Older Americans Act (1965)

• The first federal level initiative aimed at providing comprehensive services (e.g., long-term care, recreation, adequate income in retirement) for elders.

Age Discrimination in Employment Act (ADEA)

• This law forbids:• employment discrimination against anyone 40+• the denial of benefits based on age• mandatory retirement• statements of age preferences in job notices or advertisements. • Forcing employees out of work once they become eligible for

government retirement benefits

Case of Walter Biggins

• Walter Biggins, a 62-year-old, was fired from his job as a chemist just a few weeks before he would have qualified for a pension.

• Mr. Biggins claimed that he was fired so the company would not have to pay his retirement.

• The Supreme Court decided that firing an employee due to pension benefits does not violate the ADEA*

*violates Employee Retirement Income Security Act
