VFW POST 5760 MERCER ISLAND, WASHINGTON

3.PAYMENT DamageDepositA$400PerformanceandDamageSecurityDepositwillbepaidbychecktoVFWPost5760atthetimetheRentalAgreementissubmittedbyPatron.APostRentalInspection(PRI)willbeconductedbyaVFWrepresentative,andifnodamagehasoccurred,andallotheragreedtoVFWRentalStandardshavebeenmet,theSecurityDepositwillberefundedlessa$35ManagementandMaintenanceFee.Ifdamagehasoccurred,orRentalStandardsnotmet,Patronswillbechargedonafair-costbasisforrepairsorotherworkthatmustbeaccomplishedtoreturntheVFWtooriginalcondition,andsuchcostswillbedeductedfromtheDamageDeposituptotheentireamountoftheDamageDeposit.3.1RentalFeesTheentirerentalfeemustbepaidbychecktoVFWPost5760atthetimePatronreceivesakeytotheVFWfortheirrental.IfpaymentisnotreceivedfromPatronatthistime,theVFWreservestherighttocanceltherentalagreementandrefusetoallowPatronuseoftheVFWfortheirevent.3.2ChangestoRentalAgreementAnychangesthetoPatron’srentaleventplansorrequirementswithregardtodate(s)ortime(s)orboth,willrequirePATRONtorequestsuchchangesinwriting(emailisacceptable)totheVFW.ChangestotheexistingCONTRACTmaybemadebyattachingemailsfromPATRONtotheVFWandrequestingthenewdate(s)ortime(s)orboth,andareturnemailfromtheVFWconfirmingthenewdate(s)ortime(s)orboth.ThoseemailswillbeattachedtotheoriginalCONTRACTasanagreedADDENDUMtotheCONTRACT.3.3CancellationofRentalAgreementIfPATRONwishestocancelanexecutedCONTRACT,theymustrequestcancellationinwriting(emailsareacceptable)atleast4weekspriortotheirscheduledeventdate.AnycancellationnoticereceivedbyVFWwithinthe4weekperiodpriortotherentaldatemayberefusedbytheVFWandtheentireDamageDepositwithheldduetopotentiallossofincomebysavingthedatecontractedbyPATRONforrentaloftheKeewaydinClubhouse.Ifahardshipariseswithintherequired4weeknoticeperiodthataffectsPATRON’SabilitytoperformasrequiredbytheCONTRACT,thePC,RentalManager,oranauthorizedOfficeroftheVFWmay,attheirsolediscretion,allowall,some,ornoneoftheSecurityDeposittobereturnedtoPATRON.4.AUTHORIZATION&REPRESENTATIONTheVFWPostCommanderistheauthorizingofficialforallrentalagreements.Assuch,heorsheservesinthedual–capacityasbothPostCommander(PC)andGeneralManager(GM)fortheKeewaydinClubhouse.TheVFWPC–GMmustreview,approveandsignallrentalagreementsinorderforthemtobeEnforceable.UntilSuchtimeasthePC–GMsignsandapprovestheCONTRACTforuseofthefacility,VFWandPATRONrecognizeonlyandinitialofferforrentalservicestothePATRONpendingapproval.PC-GMmaychoosetoappointaRentalManager(RM)foranotherVFWOfficertosignaCONTRACTSonbehalfofthePC-GM.ACONTRACTsignedbyaRMoranotherVFWOfficerisbindingasifthePC–GMhadsignedit.Uponapproval,PC-GM,VFWrecognizestheCONTRACTasExecutoryuntilsuchtimeasrentalserviceperformancehasbeenprovided.ShouldVFWrecognizeaproceduralproblemwiththeCONTRACTpriortoExecutionofsuchrentalservice,theCONTRACTmaybedeemedUnenforceableandsubsequentlyVoidablebytheVFW.

5.PERFORMANCETheVFWdefinesitsrentalservice‘performance’underCONTRACTastheprovisionoftheKeewaydinClubhousefacilities,parking,grounds,gas,electricandwaterutilities,andrefuseservices.TheVFWalsodefinesspecificrental‘amenities’asthoseincludingtheuseofkitchenequipment,audio/visualequipment,fireplace,lightingfixtures,waterfaucets,toiletsandurinals.AlthoughVFWstrivestomakeeachamenityfullyoperativeduringeachrentalevent,thefunctionaluseofanysuchamenitylistedornotlistedabove,cannotbeguaranteed,andVFWinabilitytoprovidefullyfunctionalamenitiesasdescribedhereindoesnotconstitutefailuretoperformunderCONTRACT.6.REFUSALVFWreservestherighttodenyanofferorauthorizeanyCONTRACTprovisionrentalservicesfortheKeewaydinClubhousetoanyindividual,groupororganization(a)withahistoryofpreviousrentalproblems,(b)subscribingtobeliefsatconflicttheVFWprinciples,or(c)displaysindifferencetowardestablishedVFWrentalpolicesorstandardsherein.Undersuchcircumstances,theVFWPC-GMorauthorizedRMoralternativeVFWOfficer,maychoosetonotauthorizeanExecutableCONTRACT.7.IMPRACTICABILITYTheVFWrecognizesthat,undercertainunanticipatedeventsorhardshipsexperiencedbyeitherpartytotheCONTRACT,causeforexcusalofperformanceonthepartoftheVFWfromprovisionoftheKeewaydinClubhouserentalserviceiswarranted.Suchconditionsmayincludedamagetothefacilityfromsevereweatherorearthquake,floodingoranyothernaturalcausemakingitimpossibletousetheVFWsafely;unexpecteddeath,seriousinjurytokeypersonsessentialtothecoordinationorfulfillmentoftheCONTRACT,orForceMajeurecircumstancescompellingexcuseofallobligationsofoneorbothpartiesunderCONTRACT. 8.INSURANCETheVFWisanationallyrecognizednon-profitVeteransServiceOrganizationandassuch,theKeewaydinClubhouseisinsuredbytheVFWPostInsuranceProgramwrittenbyLocktonRiskServices,Inc.ThePATRON,althoughnotrequiredtodoso,isencouragedtopurchaseadditionaleventinsurancecoveragefromprivateprovidersduringCONTRACTuseofthefacility.9.HOLDHARMLESSWithknowledgeoftheforegoing,PATRONherebyagreesTOSAVE,DEFENDANDHOLDHARMLESSVFWOfficers,representatives,agentsand/oremployeesfromandagainstanyandallclaimsarisingfromPATRONuseofthefacility,orfromanyunlawfulornegligentactbythePATRONortheirrepresentatives,agents,employees,guests,customers,vendors,orlicensees.PATRONalsounderstandsandagreesthatthisindemnityisintendedtoincludeanyandallcostsofanylitigation,includingattorneyfees,expensesandliabilitiesincurredindefenseofanysuchclaimoranyactionorproceedingbroughtthereon.

10.CONCURRENCETOPOLICIESThePATRONhasreadandagreestothefollowingpolicies,eachapre-conditiontoenteringintoaCONTRACTwiththeVFW:10.1ExercisespecialcareduringContractuseofthefacilitytopreventstructural,fire,waterorothersuchdamagesastheKeewaydinClubhouseisastateandnationalhistoriclandmarklistedontheNationalRegisterofHistoricPlaces10.2Keepmusic,cateringandguestactivitynoisetoareasonablevolumeduringCONTRACTuseofthefacilityoutofrespectforneighboringresident’srighttopeace,privacyandproperty.10.3Refrainfromusinghighflame,opencandlesordirectedspaceheatersduringCONTRACTuseoffacility.PATRONunderstandsthattheKeewaydinClubhouseisaNONSMOKINGFACILITYandthatguestsarerequiredtosmokeoutsidethebuildingatadistanceofatleast10feetfromthebuilding.CigaretteandCigarbuttsshouldbeplacedinappropriatereceptaclesprovidedbyPATRONandnotthrownonthetarmacparkingareaoutsidethebuilding.Cans,plasticcups,napkins,foodandothermaterialsusedbyPATRON’sguestsshouldnotbelitteredoutsidethebuildingwhilesmoking.10.4ObtainaWashingtonStateBanquetPermitforLIQ158-40-6/60toservealcoholtopersonsatleast21yearsofageduringCONTRACTuseoffacility.PATRONalsounderstandsthatthispermitmaybeobtainedeasilyonlineandmustbedisplayedattheKeewaydinClubhouseduringthecourseoftheCONTRACTuseofthefacility.11.DISPUTERESOLUTIONPATRONagreesasapreconditionforauthorizedrentaloftheKeewaydinClubhousetoacceptno-costAlternativeDisputeResolution(ADR)servicesprovidedbyKingCountyasameansofresolvingcontractualorfinancialdisputesthatmayariseduringthecourseofCONTRACTuseofthefacilityshouldthePatronand/orVFWrepresentativesrequiresuchShouldVFWandthePATRONbeunabletoreconcileeithercontractualorfinancialdisputesthemselves,PATRONagreestoacceptasapre-conditionofCONTRACTuseofthefacilityADRservicesanddecisionsrenderedbyKingCounty.12.SIGNATUREByvalidsignaturebelowthePATRONandVFWacknowledgeandagreetotheabovelistedprovisionsofthisCONTRACT._________________________________________________________________PATRONSIGNATURE____________________________________DATE

VFWSTANDARDSFORALLPATRONSRENTINGTHEKEEWAYDINCLUBHOUSESAFETYAllPATRONSwill:

• ComplywithMercerIslandFireCodeandVFWrentalcapacityofnomorethan150personsinthefacilityatanyonetime

• Leavealldoorwayscleantoserveasfireexits• UtilizetheFirstAidKitinthekitchenfortreatmentofminorinjuriesorwilldial911inthe

eventofamajormedicalorotheremergency• Usecautionwhenusingelectricaloutlets;attemptstomodify,repair,improveoralterthe

facilityelectricalsystemoritscomponentsisunauthorized• Usecautionwhenusingthegasfireplaceandwillensurethatgasisturnedoffifusedbefore

closingthefacility• Usecautionwhenusingthekitchenfacilityequipmentandhighcapacitydishwasher.If

electricboosterheaterisused,ensureitisturnedoffafteruseandbeforeclosingthefacility• Usecautionwhenusingladdersorsteppingstoolsorothermeansofreachingabove

shoulderheight.NosuchaidswillbeprovidedbytheVFW• Usecautionwithlowflamecandlesbyusingglassvotivecandlesonly;openflamecandles

arenotauthorized• Noweapons,fireworks,flaringobjectsordomesticatedanimalsorpetsareallowedonVFW

propertyduringtherentalperiod.Onlyserviceanimalsareauthorized.CLEANINGAllPATRONSwill:

• Ensurethatthefacilityiscleanandorderlyaftertheireventanbeforeleavingthefacilitytheeveningoftheirrental

• Drymopthehardwoodfloors• Vacuumcarpetsintheentry,barandkitchenarea,• Returnallchairsandtablestothestorageareaandarrangesameinaneatandorderly

manner;stackredchairs6highusingrollingchairsasthebottomchairtotransportthestacktothestoragearea

• Ensurethatallcountertopsinkitchenandbararecleanedandwipeddown• Ensurethatallgarbageistakenoutandplacedinthedumpsteroutsidethebackkitchen

door;allboxesaretobebrokendownbeforebeingplacedinthedumpster• Returncleaningequipmentandsuppliestothestoragelockerinthekitchen• Ensurethatfoodthatiswashedoffplatesisdoneinthesinkwherethedishwasheris

locatedasthereisagarbagedisposalunderthatsink.Nofoodistobeputintothe2compartmentsinkinthekitchen

• Ensureifguestshavegoneoutsidetosmoke,thatallcigarorcigarettebuttshavebeenpickeduporsweptupandthatnogarbage,cups,cans,bottlesorfoodareintheparkingarea,stairsorinthelandscapingofthefacility.

• ANYDISCREPANCYCANRESULTINADEDUCTIONFROMTHEDAMAGEDEPOSITREFUND

CLOSINGAllPATRONSwill:

• Concludealleventactivitiesby12:00a.m.endingthedaystipulatedintherentalagreement• Ensurefireplacegasisturnedoffiffireplaceisused• Ensureboosterheaterinkitchenbydishwasheristurnedoffifused• Ensureheaterthermostatisturneddownto60F• Ensurethatallwindowsareclosed• Ensurethatalllightsareturnedoff:lightinentryisa24/7lightandstayson• Ensureceilingfansremainon• EnsureReservedParkingsignsarereturnedtotheirstoragelocationinthekitchen• Ensurethatthedumpsterislockedandthatkeytothegarbagedumpsterisreturnedtothe

hookbythebackkitchendoor• Ensurethattheaudio/visualequipmentisproperlyturnedoffifusedandremotecontrolis

returnedtochargingcradle• LeavetheirVFWkeyinthemailboxoutsidethefrontoftheVFW• Ensurealldoorsarelockedandproperlyclosedwhendeparting

ANYDISCREPANCYCANRESULTINADEDUCTIONFROMTHEDAMAGEDEPOSITREFUNDDECORATIONSTheVFWallowsamodest,safeamountofdecorationsforusewithinitsfacilityduringrentalevents.ThefollowingguidelinesmustbefollowedbyPATRONSwhendecoratingtheVFWfortheirevent.

• DONOTusetacks,nails,pushpins,staples,adhesivehooksorhighstrengthadhesivetapeonanywalls,ceilingorfloorsurfaces.LowtacktapeistheonlytapeauthorizedtobeusedindecoratingONTHEWOODPANELINGONLY

• NOTHINGwillbeattachedinanywaytoanyofthemainhallchandeliersorwallsconces,orfromtheceilingbeams.

• DONOThanganybannersorsigns,streamers,flagsorbannersanywhereontheexteriorofthebuilding,includingroofgutters,handrailsandwindowledges.

• ANYDISCREPANCYCANRESULTINADEDUCTIONFROMTHEDAMAGEDEPOSITREFUND• ItisrecommendedthatyourdecorationplansbediscussedwiththeVFWPost

CommanderorRentalManagerbeforesigningthisRentalAgreement.RESTRICTIONSTheVFWwillnotallowanyofthefollowingactionsduringtherentalevents:

• Havingmusicreachinglevelssoasitisreportedtoauthoritiesbyneighbors• MovementofthePiano• MovementoftheUnitedStatesFlagorVFWFlagwithoutpriorapprovalbythePost

CommanderorRentalManagerafterPATRONhasbeeninstructedastoproperprocedurestobefollowedindoingso.

• Leavingvehiclesintheparkingareaovernight.• Movementofkitchenappliancesuchasrefrigeratorsorchestfreezer.• Parkingvehiclesonadjacentprivateproperties,indrivewaysorblockingrightofaccessto

thestreet.

EVENTSTHATWILLCAUSETHEVFWTORETAINSECURITYDEPOSITFUNDSEventsthatwillcausetheVFWtoretainsomeoralloftheprepaidSecurityDepositareasfollows:

• Failuretosecurethefacility,leavingadooropenorunlocked• Failuretoleaveakeyinthemailboxinfrontofthehall• Damagetoanypartoftheaudio–visualequipment• Damagetoanywindowsorlightfixtures• DamagetoanyVFWfurnishingssuchaschairs,tables,barstools,etc.• Failuretoturntheheaterthermostatdownto60Fbeforeleaving• Failuretoturnoffthedishwasherboosterheater• Failuretousethedishwashersinkforcleaningallplates,cookingpotsandpansthathold

food…thisiswherethegarbagedisposalislocated• FailuretoreturntheReservedParkingSignstotheirappropriatestorageareainthekitchen• Failuretobreakdownboxesbeforedepositingintothegarbagedumpster• Failuretotakeoutallgarbageandplaceitinthegarbagedumpster• Failuretoleavethemainfloorproperlyswept,largespillscleanedupasbestasyoucan• Barareaproperlycleanedandwiped

Byvalidsignature,thePATRONacknowledgesandagreestotheStandardsestablishedbytheVFWwhiletheContractisineffect:PATRONvalidsignatureDate:Month/Day/YearByvalidsignatureofPostCommanderorRentalManager,theVFWoffersPATRONrentalservicesoftheKeewaydinClubhouse.PCorRMvalidsignature Date:Month/Day/YearVFWPost5760doesnotrecognizetherentalagreementasacomplete,enforceablecontractwithoutvalidsignaturesfrombothparties.VFWPost5760doesnotdiscriminateinofferingprospectivepatronsrentalservicesoftheKeewaydinClubhouseregardlessofrace,religion,gender.ageorethnicity.VFWPostreservestherighttovoidthiscontractatanytimeforreasonsofillegalactivity,publicdisturbance,unsafeorindecentacts,damagingorpotentiallydangerousactions,orcircumstancesconflictingwithanyofitspoliciesorstandardsonthepartofthepatron,groupororganizationusingtheKeewaydinClubhouse.
