theircontrol.Rumorsofamergerreachedafeverpitchinmid-January,andwerequelledjustasquicklywhenFCCChairmanKevin MartintoldreportersfollowingaJan.17FCCmeetingthatabanonasingleownerforbothsatelliteserviceswaswrittenintotheregulationsthatauthorizedthetwonationwidelicenses.Respondingtoaquestion,Martinsaid,“Thereisaprohibitionononeentityowningbothofthesebusinesses,”apparentlyreferringtoa1997satellite-radiolicensingorderthatrequirestherebetwoindependentsatelliteradiolicensees. Amidstthosewidespreadconcernsthatthedealwillnotwinregulatoryapproval,SiriusCEOMel KarmazinsaidduringaconferencecallwithstockanalystsonTuesday(Feb.20),“Iwouldnothavegonetoourboard[topromotethistransaction]…ifwedidn’tthinktherewasgreaterthana50-50chanceofapproval.”
