Constitutional Responsibility
S205 (3) The objects of the police service are to prevent, combat and investigate crime, to maintain public order, to protect and secure the inhabitants of the Republic and their property, and to uphold and enforce the law
S207 (2) The National Commissioner must exercise control over and manage the police service in accordance with the national policing policy and the directions of the Cabinet member responsible for policing.

86. Offences and penalties.
(1) An accounting officer is guilty of an offence and liable on conviction to a fine, or to imprisonment for a period not exceeding five years, if that accounting officer wilfully or in a grossly negligent way fails to comply with a provision of section 38, 39 or 40.
(2) An accounting authority is guilty of an offence and liable on conviction to a fine, or to imprisonment for a period not exceeding five years, if that accounting authority wilfully or in a grossly negligent way fails to comply with a provision of section 50, 51 or 55.

In Khayelitsha, CPFs are “not functioning effectively” according to a 2012 SAPS Task Team report.
Victim Friendly Rooms (VFRs)
These rooms provide a safe and friendly environment where victims of crime can be dealt with in a dignified and professional manner.
Aim of SAPS: 1 VFR per police station
Reality: 200 stations (nearly 1 out of every 5) have no VFR
• Khayelitsha Police Station: VFR is in an unusable condition
• Harare Police Station: VFR is unmanned
• 79 park homes were delivered for use as VFRs but returned since they didn’t meet specification
• Many Wendy houses used at VFRs have deteriorated and are unusable

• National head office should conduct an audit of resources and review resource allocation
• Station and detective commanders must ensure detectives adhere to procedures when managing crime scenes and dockets
• National Head office should link IS systems to those of other departments
• Police must initiate discussion with the rest of the Criminal Justice Cluster on synchronising efforts
