Commonly Used Terms

Class I Landfill: A landfill that accepts non-hazardous municipal solid wastes such as household wastes, approved special wastes, and commercial wastes.

Class III/IV Landfill: A landfill that accepts non-hazardous construction/demolition wastes, shredded tires and waste with similar characteristics.

Disposal: The process of permanently or indefinitely placing, confining, compacting, or cover-ing solid waste.

Diversion: The process of assigning a beneficial end use to materials that would otherwise have been disposed of in a Class I landfill.

Household Hazardous Waste: Household Hazardous Waste (HHW) is any unwanted or spent household product that can catch fire easily, eat away at or irritate living tissue, react violently with water or other chemicals, or be poisonous to humans and animals.

2015-2025 Solid Waste and Materials Management Plan: The 2015-2025 Solid Waste and Materials Management Plan is a guidance document developed to provide guidance in terms of goals, objectives for reaching those goals, timeframes and priorities, and roles and responsibili-ties for implementing programs. Grant Programs

Education and Outreach: The Education and Outreach Grant supports local governments’ efforts toward maintaining clarity of messaging concerning best practices for collection, separa-tion, and identification of acceptable recoverable materials.

Organics Management: The Organics Management Grant’s goal is to reduce the amount of organics entering landfills through the promotion of waste minimization practices, organics re-use, anaerobic digestion, and composting throughout the state of Tennessee. These grants are provided in support of Objective 4 of the 2015-2025 Solid Waste and Materials Management Plan.

Recycling Equipment: The Recycling Equipment Grant supports local governments’ efforts to increase volumes of recoverable materials collected. Funds are used to obtain many types of specialized equipment and infrastructure used exclusively for recycling collection and pro-cessing. These grants are provided in support of Objectives 2, 3, and 5 of the 2015-2025 Solid Waste and Materials Management Plan.

Recycling Hub and Spoke: The Recycling Hub and Spoke grant is designed to aid construction of large-scale centralized recycling facilities (Hubs), to which municipalities and county govern-ments (Spokes) can transport recycling commodities. This reduces the need for duplication of equipment and effort at smaller scales within those municipalities and county governments.

Special Project: Special Project Grants provide funds that support local governments’ efforts to maintain and adhere to requirements detailed within the Rules of Tennessee Dept. of Environ-ment and Conservation, Solid Waste Management, Chapter 0400-11-01, Solid Waste Processing and Disposal. Actions performed with this fund include, but are not limited to, planning, board development, request for information (RFI), request for proposal (RFP), and feasibility studies. Special Project funds are evaluated and distributed when a direct solid waste assistance need is identified by TDEC, and no other funding option is available.

Technical Assistance: The Technical Assistance Grant supports local governments’ efforts to-ward achieving their program goals or waste reduction and recycling goals through the provi-sion of quality technical assistance. Successful proposals will demonstrate how the requested projects will support and improve local government’s operating efficiencies Used Oil: The Used Oil Grant supports local governments’ efforts to comply with the Used Oil Collection Act of 1993, enacted by the General Assembly in April 1993. Funds provide collection, containments, and absorbent materials used to reduce the amount of improperly disposed used oil by providing incentives to increase the number of public collection facilities for used oil.

Waste Reduction: The Waste Reduction Grant supports local governments’ efforts for reduce volumes of materials destined for a landfill. Types of equipment that qualify for funding in-clude, but are not limited to, glass crushing equipment, material grinding equipment, and bail-ing/binding equipment.

INTRODUCTION

The Solid Waste Management Act of 1991 (SWMA) provides for the cre-ation of a comprehensive, integrated solid waste management pro-gram. This program considers solid waste facility design, location, and operations. It ensures that facilities are safe for the public and the envi-ronment. The Tennessee Department of Environment and Conserva-tion (TDEC) works with local governments and counties to facilitate waste reduction. TDEC works with municipal and county governments and waste handlers and generators to minimize solid waste disposal. TDEC also helps to maximize the utilization of resources that would otherwise be disposed at solid waste facilities. Tennessee Code Annotated (T.C.A.) § 68-211-873 requires annual re-ports on this Solid Waste Management System. These reports must be submitted to the Governor and General Assembly. TDEC, the Division of Solid Waste Management (DSWM), and the Office of Policy and Sustain-able Practices (OPSP) work together to compile this report. The collec-tion schedule of some data overlaps with the State’s fiscal year report-ing and grant funding schedule. Consequently, this report analyzes both calendar year 2019 and fiscal year (FY) 2019-2020. This report Includes:

Statewide Sustainability Efforts

Tire Environmental Act Program

In 2015, the Tennessee Automotive Association partnered with TDEC and the General Assembly to enact Public Chapter 525. This established the Tire Environmental Fund (TEF) through the Tire Environmental Act (TEA). At the time of the first retail sale in Tennessee of a new motor ve-hicle, the state assesses a flat fee based on the number of the vehicle’s wheels. The purpose of the TEA and TEF are to fund projects creating or supporting beneficial end uses for waste tires. The Office of Policy and Sustainable Practices (OPSP) oversees TEA. The Tire Environmental Act Program (TEAP) was developed as grant to support TEA. Reports updating program progress and metrics will be made quarterly to TDEC’s Commissioner and the Chairs of the House and Senate Finance, Ways and Means Committees and the Transportation Committees of the Gen-eral Assembly. The New Tire Environmental Fee is imposed on the purchase of new motor vehicles pursuant to § 68-211-303. The Tire Pre-disposal Fee enacted in 1991 is imposed on the sale of new tires, ex-cept those tires sold as a component of a new or used motor vehicle. OPSP deposits funds col-lected through the Tire Environmental Fee in the Tire Environmental Fund for TEAP. The Tire Pre-Disposal Fee revenue is allocated to the Solid Waste Management Fund and to counties by the Tennessee Department of Revenue for beneficial end use of tires in accordance with T.C.A. Title 67, Chapter 4, Part 16, and § 68-211-867. In FY19-20, the OPSP awarded four new grant contracts. The Town of Troy, the Town of Tellico Plains, and Cedars of Lebanon State Park received grant awards to install porous pavement pathways derived from ground rubber. Friendly Environment, a company in Shelbyville that manufactures erosion control products out of chipped tires, received a grant award for recy-cling equipment and facility upgrades. The number of tires diverted to beneficial end-markets through the Tire Environmental Act Pro-gram fund this fiscal year is 964,809 tires or approximately 9,899 tons. To date, TEAP has helped divert over 2.6 million tires to beneficial end-markets.

Unwanted Pharmaceutical Program In 2011, OPSP launched a program to aid local governments in collecting unwanted pharma-ceuticals. This was in response to emerging concerns from the U.S. Geological Survey and the U.S. Environmental Protection Agency (EPA) regarding the growing levels of pharmaceutical and personal care products found in many of the nation’s drinking water supplies. Prior to the pro-gram, flushing or landfilling unwanted medicines and personal care products were the suggest-ed disposal methods. OPSP provides secure bins and guidance on collection and safe disposal to allow local law enforcement to provide additional disposal options for citizens. Other state and federal agencies partners include: the Drug Enforcement Administration, Safety and Homeland Security, Bureau of Investigation, Health, and Mental Health and Substance Abuse Prevention. This project effort placed bins in all 95 Tennessee counties, including 15 new bins distributed during FY 2019-2020 for a cumulative total of 353 collection bins. Local sites report-ed a total of 72,366.20 pounds of pharmaceuticals collected in FY 2019-2020 for a cumulative of 533,715.17 since 2011. State Facility Recycling Program The State Facility Recycling Program provides recycling access to employees at state facilities, including the main campuses in Memphis, Nashville, and Knoxville. In FY 2019-2020, employ-ees in state offices recycled mixed office paper, cardboard, and plastic and aluminum beverage containers. Combined, the State’s document destruction contract with Shred-It and the State Facility Recycling Program recycled over 3,800 tons of paper.

Many departments have recycling programs for agency-specific commodities. TDOT provides recycling for lead tire weights, highway signs, and automotive fluids. The Department of Cor-rection provides composting, cooking oil recycling, and textile recycling programs.

TDEC provides a “green cube” at their central office and each of their eight field offices for the collection of items that can be more difficult to recycle, listed in the table below.

Tennessee State Parks “Go Green With Us” Tennessee State Parks “Go Green With Us” (GGWU) program launched as a recycling initiative in 2015. Since then, the comprehensive “Go Green Guidelines” were created and released in No-vember of 2017. This program is the first of its kind to set a standard for sustainable practices, and to award recognition for the many environmentally-conscious procedures that state parks practice. The mission of this program is to preserve and protect state parks through sustaina-ble park operations, resource conservation, and recycling. Program components were divided into 9 separate categories that cover a diverse array of initiatives, including energy and water conservation through equipment and operations upgrades, recycling programs, projects to en-hance ecosystem health, and erosion control, among many others. The program was deemed mandatory for the 2019 participation year and all 56 State Parks submitted their applications to earn their initial level of Go Green Recognition. The points system is structured similar to a LEED certification in which there are different tiers of sustainability: bronze, silver, gold, and platinum. The Go Green With Us Program recognition results are illustrated below.

Tennessee State Parks Recycling and Waste Reduction A subcategory of the GGWU Program includes the recycling initiative within State Parks. The Di-vision of Solid Waste Materials Management Program, Office of Policy and Sustainable Practic-es, and TN State Parks partnered to make major recycling collection enhancements in late 2018. The overall goal of the upgrades is to create a recycling program with a uniform appear-ance at all TN State Parks to increase awareness of the importance of recycling to state park vis-itors. The upgrades were completed in separate phases to fully cover all 56 State Parks. The first phase implemented over 400 BearSaver outdoor recycling receptacles which are ADA compli-ant and pest proof. The second phase implemented over 170 RecycleAway interior recycling re-ceptacles made from pure recycled HDPE and meet all LEED requirements for recycled content. These recycling upgrades will allow us to meet the needs of our visitors and uphold our respon-sibility to protect Tennessee's public lands and natural resources. Since installation, these re-ceptacles have helped TN State Parks capture over 582 tons of recycling.

Get Food Smart TN Get Food Smart TN is a statewide program from TDEC’s Office of Policy and Sustainable Practic-es which engages consumers, restaurants, schools, businesses, and farmers in education and outreach, technical assistance, and recognition centered on the reduction, recovery, and diver-sion of food waste. Get Food Smart TN provides technical and educational resources and offers a recognition program that highlights organizations that are high achievers in reducing their food waste and associated impacts.

In the program’s inaugural year, Get Food Smart TN welcomed 144 Participants into the recog-nition program. Collectively, these Participants took 1,676 actions to reduce food waste, divert-ing over 32 million pounds of food from the landfill. The program also welcomed six organiza-tions as Partners of Get Food Smart TN. Additionally, in 2018 OPSP developed a number of new resources, including materials for grocers, consumers, restaurants and hospitality operations, and schools. The program hosted its first food waste and technical assistance related workshop at Cedars of Lebanon State Park, “Educate to Reduce Food Waste.” This led to the start of a “Road Show,” where Get Food Smart TN has partnered with organizations across the state to co-host workshops, stakeholder meetings, and other events to combat food waste. The Solid Waste Management Act of 1991 (TCA § 68-211-861) states: “the goal of the state is to reduce by twenty-five percent the amount of solid waste disposed of at Class I municipal solid waste disposal facilities and incinerators, measured on a per capita basis within Ten-nessee by weight.” TDEC interprets this percentage to include waste disposed in Class III/IV construction and demolition landfills. This interpretation reduces the tonnage of waste en-tering a Class I municipal solid waste landfill. All referenced calculations of waste reduction and diversion in this report include Class III/IV construction and demolition disposal totals.
