Message from the President Gary Duvall April 25, 2020 I hope that you are all well, as we face this coronavirus crisis together. This lake is our community, and our refuge in this difficult time. We will need to adapt our Lake Cavanaugh Community Association (LCIA) and Community Center (LCCC) events to conform to legal and insurance safety rules. Our collective good health should be our first priority. Our state has started gradually loosening the isolation orders, so we hope to hold our annual rummage sale and selected other events, while practicing safe distancing as required. Our first LCIA member meeting is scheduled for Saturday May 23rd at 10 am, and it will be an online Zoom video meeting. Future member meetings will be on July 4, Aug 1, and Sept 5, and we will notify members before each meeting whether it will be live or video. We will email details to all members who have paid their dues 10 days before each member meeting date. LITTER PICK UP THANK YOU BY CHRIS AND KATHY KANE

Thank you volunteers who helped celebrate Earth Day by joining the annual Around the Lake litter cleanup on the following Saturday, April 25th. As a community, we are looking neat and tidy even if it Is pouring rain. We would like to thank the following volunteers who came out to make our Lake Cavanaugh look so clean. Matt and Traci Douglas get the prize after cleaning up Deer Creek Road and bringing back two carloads of large black sacks and other heavy items. South Shore Drive had Gay and Gary Duvall, Rob and Wendy Patterman, Mark and Doni Henry, as well as,

Jessica Ward Vammen and her darling kids. West Shore Dr. was handled by Peter and Jani Nager and Jim Roberts and Cindy McGuiness. North Shore Dr. was covered by Larita and Brent Humble, Jaye Bywayer and Priscilla McElhose, and Kathy and Chris Kane. If you see any of these volunteers, please let them know you are grateful. You know, all those piles of things that you’ve been accumulating during your Stay-Safe-at-Home time, and you haven’t had anywhere to take it. We’ll take it! Please be sure your donations are clean, in good shape and sellable. We want to assure you that during the Rummage Sale we will comply with the current government safety guidelines that are in effect during that time and we will do everything we can to make this an enjoyable and profitable event for the community.

The Rummage Sale is our best and largest Fund Raiser aside from the dues and financial donations that our members contribute for the upkeep of the Community Center and the activities we sponsor. Please support us by joining the association, donating to the projects, and volunteering to help. If you are donating large items like furniture please do not leave unless there is someone at the Community Center to OK your donation and you leave your name and contact information. LOGGING ON FRAILEY MOUNTAIN APRIL 2020 UPDATE BY BOB MCCULLOUGH Breach of Covenant Lawsuit

Previous LCIA newsletter editions have com-municated the status of efforts by the Lake Cavanaugh Trust to ensure any logging of Frailey Mountain was safe and in accord-ance with law. This article concerns the companion effort of another resident to accomplish the same thing. Bob McCullough, a Lake Cavanaugh resident, has filed a lawsuit against two companies that propose to use a lot – 33242 South Shore Drive – in the Lake Cavanaugh subdivision #3for ingress and egress to log portions of approximately 300 acres on Frailey Mountain. When the original subdivisions for Lake Cavanaugh were platted back in 1948, there were restrictions placed on the lots that prohibits commercial use of the lots. Restriction #3 of Lake Cavanaugh Subdivision #3, where 33242 South Shore Drive is located, states: No Lots shall be used for commercial business or manufacturing purposes. It is believed the reason that the companies want to use the property - 33242 South Shore Drive – is that it is more expensive to use other dedicated rights-of-ways to access the harvest areas. Environmental restrictions make accessing their proposed harvest areas more difficult and costly which may be why Weyerhaeuser sold the property before logging it in the first place. A Breach of Covenant suit was filed in October 2019 to enforce the covenants that prohibit lots in Lake Cavanaugh Subdivision No. 3 from being used for commercial business. The suit is presently pursuing discovery to better assess how they intend to use the Property.

Unfortunately, the defendants have not provided the legally required response to the requested discovery and so now a Motion to Compel has been filed with the court asking the court to make them follow the law. Once the discovery materials are received, the assessment and preparation of arguments can be completed, and the suit can proceed to the hearing. There is no date for the hearing yet as the companies have not complied and have not provided the required materials. Once the date has been set, an update will be posted. While it is impossible to predict how a court might rule, this is a very strong case and the courts should uphold the covenants and prevent the use of 33242 South Shore Drive for this commercial business operation. To date, Bob has covered all the costs of this suit personally but has been pledged financial support from many residents at the lake that are dedicated to protecting and preserving our property rights. FROM PASTOR RE: LCCC CHURCH SERVICES BY IRENE SCHROERS

It is with sadness that our church pastor, Pat Vance, has recently decided not to Pastor our church this summer because of the fear of the COVID-19 virus affecting his family and him. Also, the rules of assembling make it very difficult for our Lake Cavanaugh Community Church to function. So, therefore we will not have any church services at the Community Center (barring any miracles) in the foreseeable future. May God bless you all as you go to church on the Internet. FYI: We had about 35 years of church services through many flu seasons without incident, so, we continue our perfect record!

This event is dedicated to Bob Sittner, our friend and former fire chief, who lost his life fighting a fire on South Shore Drive. He has been, and will continue to be, the driving force behind this race. All proceeds from this race are to benefit the development of the Lake Cavanaugh Volunteer Fire Department.
