Far too often, members use the wrong resource to address an issue they may have or do not know which resource to use in a given situation. There are three main sources to reference for any particular question that may arise as a member of the UAW. Every member should make themselves familiar with all three of this triad of information. These sources are the UAW Constitution; your facility’s Collective Bargaining Agreement (CBA), also known as your “Contract;” and your Local Union By-Laws. Reading and knowing all of these documents are essential to educate yourself on how your Union works and to know your rights. This article will be a multi-part series that will address some of the basics regarding each of them and when and how to use them. Because of the current events regarding the “referendum vote;” the Consent Decree entered by United States District Court Judge David Lawson on January 29, 2021; and the upcoming 38th Constitutional Convention in 2022; it seems fitting that we should begin with the UAW Constitution. What is the UAW Constitution? Much like the United States Constitution is for us as Americans, the UAW Constitution is the foundation of our UAW. It provides the cornerstone for the procedures/ processes of the operation of the UAW and defines the rights and responsibilities of every UAW member. The UAW Constitution has been adopted and can be amended, only by a majority vote of the delegates at regular Constitutional Conventions or at Special Conventions. It is the highest law of the UAW and governs all actions of its members through checks and balances. Article 2 of the UAW Constitution outlines the “Objects,” or purpose, of the United Automobile, Aerospace and Agricultural Implement Workers of America (UAW). Whether you are a new member or a seniority employee, you should always be aware of the basics

regarding your rights and the operation of your Union. Far too often, members use the wrong resource to address an issue they may have or do not know which resource to use in a given situation. There are three main sources to reference for any particular question that may arise as a member of the UAW. Every member should make themselves familiar with all three of this triad of information. These sources are the UAW Constitution; your facility’s Collective Bargaining Agreement (CBA), also known as your “Contract;” and your Local Union By-Laws. Reading and knowing all of these documents are essential to educate yourself on how your Union works and to know your rights. What is the UAW Constitution? Much like the United States Constitution is for us as Americans, the UAW Constitution is the foundation of our UAW. It provides the cornerstone for the procedures/processes of the operation of the UAW and defines the rights and responsibilities of every UAW member. The UAW Constitution

has been adopted and can be amended, only by a majority vote of the delegates at regular Constitutional Conventions or at Special Conventions. It is the highest law of the UAW and governs all actions of its members through checks and balances. Article 2 of the UAW Constitution outlines the “Objects,” or purpose, of the United Automobile, Aerospace and Agricultural Implement Workers of America (UAW). Paraphrased, it states, in part:• To protect and improve for all UAW

members: hours of work, working conditions, wages, health care, and pensions.

• To unite in one organization regardless of religion, race, creed, color, sex, political affiliation or nationality, age, disability, marital status, sexual orientation, or gender identity or gender expression.

Hello Brothers and Sisters, It is my pleasure to announce that, for all Ford Retirees covered under the UAW Medical Benefits Trust, we will be bringing back our “Health Fair,” to address all of the upcoming changes in 2022 (see page 5 of this issue of the Local Motion). It will be held on October 8, 2021 at UAW Local 400. There will be two (2) sessions on that day. The first session will be at 10:00 a.m. and the second will be at 1:00 p.m. The same material will be covered, so you will only have to attend one of the sessions. All of the relevant providers will be in attendance and the UAW Medical Benefits Trust representatives will head up the meetings. Watch your mail, as well. Very soon, we will be receiving the 2022 Benefits Highlight Packet showing any changes in benefits that may be coming! NOTICE: Our Retiree Picnic is scheduled on September 30, 2021 at River Bends Park (see back page of this issue of the Local Motion). It feels good to be able to gather together again, as the pandemic has prevented it for so long. Your UAW Local 400 is still adhering to all of the guidelines and taking precautions to keep everyone safe. If you have symptoms or feel ill on that day, please stay home so as not to put your Brothers and Sisters at risk. We have lost many of our UAW family to this virus and our thoughts and prayers go out to anyone who this terrible virus has touched. Remember: Hold your dreams close and don’t fall to your fears.

To My Brothers and Sisters of Local 400, I would like to wish you all a happy ending to Michigan’s summer season. It’s a tough realization, but we have about 6 weeks left. This can be hard to believe when the hot, humid, “air you can wear” days are upon us. That hot humid air can be dangerous, and we all need to be aware of “heat stress,” and strong storm patterns. Heat stress can affect us as we golf, garden, or just enjoy life outdoors. So, drink lots of water, and take frequent breaks. Strong storms can pop up almost out of nowhere this time of the year. Heavy rain and high winds can be devastating. I have experienced power outages more this year than ever before. That has spurred me to be prepared for the worst weather possible. I recommend that we all do our best in preparing our homes with backup generators, candles, and flashlights. Having emergency evacuation and shelter in place plans, that are discussed and practiced with the family, are also a good idea. I thought the year 2020, with all the challenges that we faced, would have prepared us for the challenges of today. But I was wrong! The year 2021 has been just as challenging, if not more, for our labor union. We have all heard of or worked under the condition of a labor shortage. We have learned to live with COVID-19 and its variants, and we all have had to deal with the ongoing social issues of today. I want to thank all of you who have persevered through these challenges. I thank those who have worked the overtime to make up for the labor shortage. I thank those who have worn the mask during these extended periods

of time. I thank those who may have had to work with the co-worker who does not agree with you socially. We are a strong union, made up of incredibly strong individuals. Thank you all for doing your part to try and make our world and our work environment better. Even though we have strived to make a difference, all unions continue to be under attack. Many of our neighbors do not believe in organized labor. Many of our politicians do not believe in organized labor. We must continue to fight for each other and for each other’s jobs. Our

families depend on us. If we fail, we fail our families. We must remain united and we must continue to stand for the American worker. It is important that we do our best to represent our Union to the best of our abilities. Many people have the opinion that we are lazy, overpaid, and underworked people. People seem to

forget the labor war that was fought. Nothing was given to us then, and nothing will be given to us now. Our retiree community paved the way for the younger generation. Those who are currently working must continue to pave the way for our future union Brothers and Sisters. Please get involved and stay engaged in some union activity, community event, or political movement. Attend union meetings. Your participation is needed. Your plant and Local Union need your input. Without you letting your voice be heard, we cannot do the work of the people. Retirees, I want to thank those who participated in the Golf Outing on August 12 and, in advance, thank those of you coming to the Retiree Picnic on September 30, 2021. These events are a great way to catch up with past co-workers. See you all then. I am, and always will be, your Brother in Solidarity.

that address issues specific to your workplace and Local Union (CBAs and Local By-laws). For example: if you are looking for promotional opportunities within your unit, you are likely to find the rules regarding seniority or qualifications for that in your facility’s contract. If you want to find out when your Local Union has its Joint Council or general membership meetings, you may find that in the Local By-laws. That is why it is imperative that you make yourself familiar with all three documents on a regular basis. In the beginning of your UAW Constitution is a Table of Contents, which lists the page number on the right side of each subject contained therein. On the left side, the Article of each subject is listed. If you turn to any given Article, you will see many Sections and/or sub Sections under each Article which has a key point related to it. For example, Article 16, “Initiation Fees and Dues,” has thirty-two separate Sections under this heading. Additionally, Section 2, for instance, has seven different sub-sections (a-g) which give more detail on the limits and requirements of membership dues. Some portions of your UAW Constitution do not have an Article listed beside them, although they are equally as important as those that do. The Preamble, which is an introduction to our Union and core values, should be read by every new member to the UAW. Scratch that – should be read by every member of the UAW – and should be re-read as needed to reinforce our resolve in what we stand for as a Union! Another segment that should be read as a new member and revisited frequently is the “Ethical Practices Codes,” found after all of the Articles. This is the ethical basis for all decisions related to the UAW, including in part: fair and uniform Union rules and laws, adequate safeguards so that all operations are conducted in a fair and democratic manner, restrictions and transparency regarding the use of Union funds, forbidden “conflict of interest” situations, and protection of the membership list from outside entities. The recent convictions of UAW leadership have been because of trusted members that have ignored these ethical principles. The main reason retired President Rory Gamble started the Member Advisory Committee on Ethics and the confidential Ethics Hotline was to prevent situations like that from happening again and to

review the processes we have in place to check ourselves and make sure we have enough safeguards to accommodate that prevention. Immediately following the “Ethical Practices Codes” of your UAW Constitution, you will find a Subject Index. This is extremely useful to find information quickly by subject matter. Each subject lists the Article, Section(s), and page the section(s) start on. Let’s say you want to know how they figure out the number of delegates for each local union. In the Subject Index, you would look under the bold print title “Convention, UAW.” All of the portions of the Constitution that relate to the UAW conventions are below that. You will see to the right of “Number of Delegates,” it lists Article 8, Sections 5-7, and they begin on page 15. Boom! You’re there! Some other subjects may be found in multiple places or under different “titles” depending on what you are looking to find specifically. For instance, under the bold print “Dues,” you will find it says, (See also Membership; Fees). This indicates that you can also find information on dues under the title “Membership” or under “Fees.” As you can see, when it comes to a subject matter resource of your UAW Constitution, this Subject Index can be indispensable. Have you ever watched (either live or on TV) a trial or civil suit? Many times, the plaintiff and defense attorneys will have a different opinion of how the law is interpreted. It is then up to the judge to make a decision on which argument has the most validity. Throughout the years, it has been necessary to add clarity to some Articles of the UAW Constitution, too. The final portion of the Constitution that does not have an article listed next to it is “Interpretations.” This can be found at the back of the softcover book (pages shaded in grey) or at the end of the downloaded version (unshaded), but in either case, beginning on page 165. All of the relevant Interpretations of the various Articles are here. Each Constitutional Convention (every 4 years), amendments are adopted that make some of the interpretations obsolete. When that happens, the irrelevant interpretations are deleted. The way to use this section is best explained on pg. 165:1. Find the subject of your question by

consulting the appropriate heading or headings in the index to the Constitution. This will give you the Article(s) or Section(s) which may contain the answer to your question. It will also give you the page of the

Constitution where that Article or Section appears. It may be that your question is expressly covered by the language of the Constitution and you need look no further.

2. In virtually every instance, the language of the Article or Section will at least touch upon the answer you seek, but it may not be the specific answer to your problem. In that case, you turn to the interpretations listed under those Articles and Sections and read there the interpretations of the International Executive Board as they relate to your question. Where appropriate, cross-references to other Articles, Sections and interpretations are given at the end of the particular interpretation.

Knowledge is Power! In closing, remember that this is Your Union; Your UAW! The best way to be involved is to be educated on the history, rules, and procedures that govern our UAW. This explanation of the Constitution is one of three main ways to help you in that regard. The other two – your CBA and your Local By-laws – will be covered in future editions of the Local Motion. Probably the most immediate impact your Constitution can affect you is knowing the processes, rules, and eligibility for elections; most notably elections for Constitutional Convention Delegate(s). But, even if you are not ready for that step, you can still submit constitutional resolutions to your local governing body (forms will be available as we get closer to the 2022 Constitutional Convention) for changes you may wish to see in the UAW Constitution. Be involved; gain knowledge! Only together, as educated members of the UAW in Solidarity, do we have the power!

Health Fair Retiree Benefit Representative Jim Sorgi is once again putting together a Health Fair for all of our UAW/Ford retirees. All details are in his article and in the flyer below (please read)! For those who have recently retired, this event is important for you and your spouses to talk with our health care providers one on one. Honoring the late Josephine Ziarno Josephine passed away suddenly on July 8, 2021 – 4 days after her 104th birthday. To those who had sent her birthday cards, Josephine much appreciated your kindness, as they put a smile on her face and warmed her heart. Josephine was a firecracker of a

person, and very much involved with her Union and Retiree Chapter. Thank you, Josephine, for the memories! Fly high with the Angels as you start your new journey, Dear Union Sister! A big thank you to all the retirees who attended our Solidarity Golf Outing. It was a great success and all had a wonderful time. Greetings Brothers and Sisters, I hope everyone is enjoying their summer, even though it seems to be flying by. I want to use this month’s article to talk about things going on here at Romeo Engine. There were a lot of questions surrounding the canvassing of 20 legacy jobs at Sterling. The reason it was done that way is because the National language only allows us to bump in-zone when we have been put into an ILO status. We did not have any members sign up for the transfer of operation to Cleveland Engine with the Maverick Block line installation. That affected 20 jobs and the company was going to ILO low-seniority TFTs from Romeo. Meanwhile, Sterling Axle had a need for summertime help at the same time. We immediately called Job Security at International and explained the situation

and, with their help, we successfully negotiated those 20 jobs to be offered to our high seniority here at REP. We did have 20 members sign up to transfer with the last seniority date being 10/03/1994. Some have already transferred and the remaining members from that respective group will transfer on August 30th. There are still a lot of questions from the floor with certain situations, contractually, regarding our future. That is why we have brought in Job Security multiple times to walk the floor with us and answer questions. As other production lines leave Romeo for other facilities, we will still have transfer of operation opportunities. We know these are tough decisions for all members, but it is especially difficult for Skilled Trades, as they don’t have the same language in the hierarchy as production members do for In-Zone bumping rights when ILOs occur. The question we hear the most from production is: Will we be able to stay on

the East Side? When ILOs occur due to jobs being lost, then “yes,” by seniority, we have the rights to bump low In-Zone TFTs. While we are making sure our members have every opportunity made available to them, I can assure this membership that we still haven’t given up on trying to save

our beloved facility. We know it’s an uphill battle; however, it is our job to keep pushing on behalf of all of you. Jeremy Rickert, our Local 400 Officers, Region 1, and I have recently met with some top officials from Macomb County looking for support. Out of all the meetings over the past couple of years we have had with government officials,

I personally feel these were the most productive. I also have recently met with our new UAW Vice President, Chuck Browning. I’m glad that he is our new leader. He has the passion and drive that will earn back the trust of this membership. We will keep working hard on your behalf and keep you updated with any new information, as always.
