Awareness Programmes organized by PIC-Kerala during the period January - March, 2010 Kerala State Council for Science, Technology & Environment organized the 22 nd Kerala Science Congress at Kerala Forest Research Institute, Thrissur from 28 th - 31 st January, 2010. The third technical session was chaired by Shri. N. K. Jayakumar, Vice-Chancellor, NUALS, Cochin, in which thefollowing four lectures were delivered .

The technical sessions were followed by an Expert Committee meeting which was chaired byProf. N. R. Madhava Menon, Member, Commission on Centre, State Relations, Govt. of India. Experts in the field of IPRattended the meeting. In the meeting, discussions on how to propagate and promote IPR in the State and how to increasethe IP output of the State were made. The Committee made a number of recommendations and decided to consolidate therecommendation after getting the comments from the experts and after that the recommendations should be forwarded tothe State Government. Around 1000 participants from various sectors including Scientists, Researchers, Students, LegalExperts, Grass root Innovators, Entrepreneurs, Industrialists, etc., participated in the event.

Seminar on"lnteliectual Property Rights" in AlappuzhaPIC-Kerala in association with Sanatana Dharma College, Alappuzha organized a one day Seminar on 'IntellectualProperty Rights' at S.D. College, Alappuzha, on 11thFebruary, 2010. Shri. KA Parameswara Iyer, Scientist (Rtd.),CPCRI, Kasaragod and Member, Board of Trustees, S.D. Vidyasala, inaugurated the Seminar. Dr. S. IPRNEWSWIPO launches enhanced patent information service

WIPO has launched an enhanced online patent information service that will improve public access toinformation on patents filed and granted around the world. WIPO's PATENTSCOPE which currently hostsdata on more than 1.6 million international patent applications filed under the Patent Co-operation Treaty,has been extended to include several collections of national and regional patent information.

In the first phase, WIPO's PATENTSCOPE include the patent data collections of eight patent offices likeAfrican Regional Intellectual Property Organization (ARIPO), CUBA, Israel, Republic of Korea, Mexico,Singapore, South Africa and Vietnam. The expansion of WI PO's PATENTSCOPE data collection makes itpossible to conduct high quality, detailed and free of charge searches of the patent information of theparticipating offices. The new service is the result of cooperation agreements between WIPO and theparticipating national and regional patent offices. WIPO provides technical assistance to offices to assistthem in the digitization and dissemination of their patent data. Similar agreements are underway withseveral additional offices and others will be added overtime.

Traditional knowledge: Concern on access pact

The access agreement that India has signed with foreign patent offices to share Traditional KnowledgeDigital Library (TKDL) in the form of a 'prior art' could undermine its confidentiality. 'Prior art' is meant toencompass everything that has been published, presented or otherwise disclosed to public on the date ofpatent and includes documents in foreign languages disclosed in any format in any country.

TKDL contains approximately 2.08 lakh formulations based on Ayurveda, Unani, Siddha and Yoga. Thesehave been transcribed in five international languages viz. English, French, German, Spanish andJapanese, with the objective of preventing its misappropriation at international patent offices.

Access agreement has been signed with the European Patent Office (EPO) and US Patents andTrademark Office (USPTO) on the premise that the database shall be used for search and examinationonly and shall not make any third party disclosure except for the purpose of giving a copy to theinventor/applicant as citation. But it is hard for the patent offices to keep the contents ofTKDL secret fromthird parties, since no patent could be granted without disclosing the entire gamut of coded traditionalknowledge (TK) associated with the invention to the claimant, says Mr. R.S. Praveen Raj who was who is aformer examiner of Indian Patent Office and presently Scientist in the National Institute for InterdisciplinaryScience and Technology (NIIST).

Proposed law to give copyright to film directors

The HRD Ministry has come up with a bill which confers copyright of a film not just up on the producer, butalso on the director. For films made after the proposed law comes in to force, the producer and director willbe 'treated jointly as the first owner of the copyright'. Thus, the director is finally getting his due as thecreator. Since the proposed clause equating the director with the producer will apply prospectively (fromthe day the law is enacted), the directors of films already produced will not get the full benefit of this reform.

The bill seeks to compensate them by extending the copyright term for such films from 60 years to 70 yearsafter the death of their first copyright owners.

The proposed Copyright Act Amendment Bill 2009 is being vetted by law ministry. After getting theclearance from the cabinet, it will be introduced in the Parliament.

HR min introduces Copyright amendment in Rajya Sabha

The Copyright Amendment Bill 2010 was introduced in the Rajya Sabha by the Union government on19th April, 2010, seeking amendments to the CopyrightAct, 1957.

India will bring its copyright laws in line with international standards in internet and digital technology, providingfor stringent punishment up to two years imprisonment for violation, a PTI report said.

"In order to extend protection of copyright material in India over digital networks such as internet and othercomputer networks related to literary, dramatic, musical and artistic works, films and sound recordings, theexisting Act is being amended to harmonise it with global treaties, Union Human Resource and Development(HRD) Minister Kapil Sibal said while introducing the amendment. He added that the changes are inconformity with the provisions of the World Intellectual Property Organisation's WIPO Copyright Treaty (WCT)and WIPO Performances and Phonograms Treaty (WPPT).

Once the amendments are incorporated in the Act, it will also ensure that film song lyricists, composers andscreenplay writers also get their rights on royalty, unlike now when they get just a one-time professional fee.
