A RESOLUTION ADOPTING THE ATHENS COUNTY MULTI- JURISDICTIONAL HAZAIID MITIGATION PLAN.

WHEREAS, it is agreed that it is beneficial for a community to determine the threats posed by various natural hazards and to plan for ways to reduce those threats; and

WHEREAS, the City of Nelsonville, Athens County, Ohio is required to have a Natural Hazard Mitigation Plan in order to be eligible to receive federal emergency funding in the event of a Presidentially-declared disaster; and

WHEREAS, the existing Natural Hazard Mitigation Plan for the City of Nelsonville expired in 20 1 1 ; and

WHEREAS, the Athens County Regional Planning Commission prepared the existing Natural Hazards Mitigation Plan for the City of Nelsonville in 2006; and

WHEREAS, the Athens County Regional Planning Commission has prepared a new Multi-jurisdictional Natural Hazards Mitigation Plan that will cover all political subdivisions in Athens County; and

WHEREAS, the City of Nelsonville is a member in good standing of the Athens County Regional Planning Commission;

NOW THEREFORE, BE IT RESOLVED by Council of the City of Nelsonville, Athens County, Ohio that the City of Nelsonville, Athens County, Ohio formally adopts the Athens County Multi-Jurisdictional Natural Hazard Mitigation Plan 201 4.

A RESOLUTION SUPPORTING THE REHABILITATION OF THE FORMER NELSONVILLE HIGH SCHOOL AND JUNIOR HIGH SCHOOL, AN AFFORDABLE HOUSING DEVELOPMENT FOR UP TO 43 HOUSING UNITS AND TO BE KNOWN AS THE NELSONVILLE SCHOOL COMMONS PROJECT AND DECLARING AN EMERGENCY.

WHEREAS, the adopted Nelsonville Comprehensive and Economic Plan identifies historic districts as having a positive impact on neighborhood reinvestment and a strengthening of homeowners' conviction that surrounding buildings will be cared for in a manner that reinforces the neighborhood's property values; and

1 WHEREAS, the WODA Group, Inc. desires to rehabilitate the former High School and Junior High School buildings which are located in the Nelsonville Historic District by designing and building high quality, safe, modem, accessible, energy efficient housing for young families, workers and seniors; and

WHEREAS, affordable family housing can attract and retain young professionals or small families that might consider calling Nelsonville their permanent home and provide new alternatives for seniors considering downsizing out of their current homes to accessible apartments with modem living amenities and low-cost utility bills which is desirable to the City and in accordance with its Comprehensive and Economic Plan; and

WHEREAS, Nelsonville's historic buildings represent one of its greatest assets and one that can play a significant role in the City's economic growth and regional reputation.

WHEREAS, the proposed Nelsonville School Commons project, consisting of one and two-bedroom apartments, will provide workforce housing in conjunction with economic and employment growth opportunity plus provide rehabilitation of major structures located in the Nelsonville Historic District; and

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF CITY OF NELSONVILLE, ATHENS COUNTY, OHIO, AS FOLLOWS:

1. That the Nelsonville City Council does hereby support the rehabilitation of the former Nelsonville High School and Junior High School located on Fayette Street to be known as the Nelsonville School Commons Apartment Project, a development that will provide new units for work force housing serving households primarily at 60% of the Area Median Income.

2. This Resolution is being passed as an emergency measure pursuant to O.R.C. 731.30 because the immediate passage of the Resolution is necessary so that the funding deadline for the project can be met, and this Resolution shall be in full force and effect upon its adoption.

The lessons I've learned from Sgt. Kurtz go way beyond the work place and into my personal life. We is truly a mentor, and a ma11 I look up to with the utmost respect.

On any day you will find Sgt. Kurtz constantly striving to better the Nelsonville Division of Police, be it taking trash to the dumpster, transporting evidence, or wrestling in the mud with a violent offender.

Law exzforcement is not carved in stone; many variables come into play when making decisions. I often ask myself, wkdt would Ed do? Many times, 1 have been indecisive and turned to Sgt. Kui-tz. He has always been there to assist me in analyzing the situation. No officer has all the answers, however, it's great to have a man of his caliber to turn to, discuss the issue, and mediate on an outcome that one can go home at night and feel comfortable with.

Sgt. Kur-tz has taught more than you can ever imagine about com~nunity relations. Most of this community lmows the name Sgt. Kurtz, and likewise he knows most of the community with his 251- years of serving this area, I have seen him arrest people from strangers, to actual family members, and never show impartiality. EIe takes his Bath very serious and upholds the law regardless of names, friends, fai~iily or your average Joe citizen. Most of all, he does it respecting their rights.

We joke with Sgt. Kurtz about being an officer in NeIsonvilXe before the first bricks were laid on the streets, but I would gladly enter any hostile, or potentially violent situation, with Sgt. Kurtz.

In closing, this is a man who has touched the lives of people in many ways including myself He is honest, hard working, reliable, and most of all a true leader. T have enjoyed working and learning from Sgt. Kurtz, and hopefully will for inany nzore years to come.

THEREFORE, be it resolved by the Nelsonville City Council that Ed be recognized for his hard work, selfless effort and dedication to the City of ville Police Department and that he be designated an Honorary Nelsonville

A RESOLUTION AMENDING THE FIRE DEPARTMENT PENSION PICK-UP FOR FIRE DEPARTMENT EMPLOYEES OF THE CITY OF NELSONVILLE, ATHENS COUNTY, OHIO IN THE OHIO POLICE & FIRE PENSION FUND EFFECTIVE JANUARY 1,2015.

WHEREAS, the Nelsonville City Council, Athens County, Ohio met at a duly called and authorized meetings of the Nelsonville City Council on the date set forth below, such meeting being duly called pursuant to a notice stating the time, place and purpose of the meeting received by all Council members, and the following resolution was made, seconded and adopted by those present at the meeting;

WHEREAS, the eligible employees of the Fire Department participate in the Ohio Police & Fire Pension Fund;

WHEREAS, the Council has previously adopted a pick-up of two percent (2%) of the eleven and fifty hundredths percent (1 1.5%) mandatory contributions required to be paid under Section 742.31 of the Ohio Revised Code for participating employees of the Fire Department who are members of the Ohio Police & Fire Pension Fund:

WHEREAS, Ohio Police & Fire Pension Fund has adopted new procedures for reporting pick-up contributions in order to properly prepare 1099-R forms for its members;

WHEREAS, the Council wishes to amend it prior resolution in order to continue the pick-up under the new procedures;

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NELSONVILLE, ATHENS COUNTY, OHIO:

Effective January 1, 2015, the Nelsonville City Council has determined to continue to pick-up two percent (2%) of the eleven and fifty hundredths percent (1 1 SO%) mandatory contributions by the Fire Department employees who are members of the Ohio Police & Fire Pension Fund by paying the contributions on behalf of the employees, with the employee paying nine and fifty hundredths percent (9.50%) of the mandatory employee contributions through salary reduction.

2. Said picked up contributions paid by the employer and through salary reduction, even though designated as employee contributions for state law purposes, are being paid by Nelsonville City in lieu of said contributions by the employee.

3. Said picked up contributions will not be included in the gross income of the employees for tax reporting purposes, that is, for federal or state income tax withholding taxes, until distributed from the Ohio Police and Fire Pension Fund.

4. Said employees shall not be entitled to any option of choosing to receive the contributed amounts directly instead of having them paid by the City of Nelsonville to the Ohio Police and Fire Pension Fund.

5. This Resolution is being passed as an emergency measure pursuant to O.R.C. 73 1.30 because the immediate passage of the Ordinance

A RESOLUTION AMENDING THE POLICE DEPARTMENT PENSION PICK-UP FOR POLICE DEPARTMENT EMPLOYEES OF THE CITU OF NELSONVILLE, ATHENS COUNTY, OHIO IN THE OHIO POLICE & FIRE PENSION FUND EFFECTIVE JANUARY 1,2015.

WHEREAS, the Nelsonville City Council, Athens County, Ohio met at duly called and authorized meetings of the Nelsonville City Council on the date set forth below, such meeting being duly called pursuant to a notice stating the time, place and purpose of the meeting received by all Council members, and the following resolution was made, seconded and adopted by those present at the meeting;

WHEREAS, the eligible employees of the Police Department participate in the Ohio Police & Fire Pension Fund;

WHEREAS, the Council has previously adopted a pick-up of two percent (2%) of the eleven and fifty hundredths percent (1 1.50%) mandatory contributions required to be paid under Section 742.31 of the Ohio Revised Code for participating employees of the Police Department who are members of the Ohio Police & Fire Pension Fund:

WHEREAS, Ohio Police & Fire Pension Fund has adopted new procedures for reporting pick-up contributions in order to properly prepare 1099-R forms for its members;

WHEREAS, the Council wishes to amend it prior resolution in order to continue the pick-up under the new procedures;

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITU OF NELSONVILLE, ATHENS COUNTY, OHIO:

1. Effective January 1, 201 5, the Nelsonville City Council has determined to continue to pick-up two percent (2%) of the eleven and fifty hundredths percent (1 1 SO%) mandatory contributions by the Police Department employees who are members of the Ohio Police & Fire Pension Fund by paying the contributions on behalf of the employees, with the employee paying nine and fifty hundredths percent (9.50%) of the mandatory employee contributions through salary reduction.

2. Said picked up contributions paid by the employer and through salary reduction, even though designated as employee contributions for state law purposes, are being paid by Nelsonville City in lieu of said contributions by the employee.

3. Said picked up contributions will not be included in the gross income of the employees for tax reporting purposes, that is, for federal or state income tax withholding taxes, until distributed from the Ohio Police and Fire Pension Fund.

4. Said employees shall not be entitled to any option of choosing to receive the contributed amounts directly instead of having them paid by the City of Nelsonville to the Ohio Police and Fire Pension Fund.

5. This Resolution is being passed as an emergency measure pursuant to O.R.C. 73 1.30 because the immediate passage of the Ordinance

WHEREAS, the City of Nelsonville has applied for and been tentatively awarded Presidential Disaster Relief Funds under the Disaster Relief Act (Public Law 288, 23rd Congress); and

WHEREAS, the City of Nelsonville, a public entity established under the laws of the State of Ohio, as a requirement of the grant must authorize an agent to provide to the State and to the Federal Emergency Management Agency (FEMA) for all matters pertaining to such Federal disaster assistance the assurances and agreements listed in the Grant Agreement.

A RESOLUTION REQUESTING THE CITY ATTORNEY TAKE ACTION TO ENFORCE THE EXCLUSIVE SOLID WASTE FRANCHISE OF SOUTHERN OHIO WASTE DISPOSAL.

WHEREAS, the City of Nelsonville has for many years had exclusive solid waste franchises for commercial and residential collection;

WHERIEAS, several haulers have consistently violated this exclusive franchise, claiming automatic rollover contracts entitle them to continue hauling within the corporate limits without a franchise;

WHEREAS, the City does not recognize automatic rollover contracts that should have ended years ago;

WHEREAS, the current solid waste franchisee, Southern Ohio Waste Disposal, has requested the City enforce its exclusive franchise for commercial and residential collection within the city;

NOW THEREFORE, BE I'I' RESOLVED BY THE COUNCIL OF THE CITY OF NELSONVILLE, ATHENS COUNTY, OHIO:

1. That City Council hereby requests the City Attorney take action to enforce the exclusive solid waste franchise of Southern Ohio Waste Disposal.

2. This Ordinance is being passed as an emergency measure pursuant to O.R.C. 73 1.30 because the immediate passage of the Ordinance is necessary so that the City Attorney can begin work to enforce the exclusive franchise agreement for Southern Ohio Waste Disposal.

3. This Resolution shall be in full force and effect at the earliest moment permitted by law.

IRESOLUTION 2172 I I A RESOLUTION BY THE CITY OF NELSONVILLE, OHIO SUPPORTING THE ATHENS COUNTY ENHANCED COMMUNICATIONS PROJECT.

WHEREAS, Athens County 9-1-1 will apply for a loan from Ohio's Local Government Innovation Fund (LGIF) to improve emergency communications and provide opportunities for enhanced broadband connectivity; and

WHETBEAS, loan fbnds for the Athens County Enhanced Communications Project are available from Ohio's Local Government Innovation Fund; and

WHEREAS, emergency communications are an essential component of local government and Ohio University operations; and

WHEREAS, Athens County, due to its remote rural location and topographic relief, has problems with emergency communications and broadband connectivity; and

WHEIREAS, Athens County 9- 1 - 1, Ohio University, the City of Athens, the City of Nelsonville, and Athens Township have agreed to collaborate, with Athens County 9-1-1 as the loan applicant, in order to establish a wireless broadband network in Athens County. The City of Nelsonville, Ohio bears no financial responsibility for loan repayment but agrees to consider being an initial partner in the network. Partners, as described in the LGIF loan application, have agreed to collaborate as outlined in the Memorandum of Understanding, attached, and being a part of this Resolution.

NOW THEREFORE, BE IT IRESOLVED BY THE COUNCIL OF THE CITY OF NELSONVILLE, OHIO that:

The City of Nelsonville, Ohio hereby agrees to collaborate with Athens County 9-1-1 to facilitate the creation of a wireless broadband network in Athens County, in accordance with the Memorandum of Understanding attached hereto and incorporated herein by reference, md that this measure is hereby determined to be necessary for public health, safety, and welfare,

WHEREAS, the Nelsonville City Council, Athens County, Ohio met at duly called and authorized meetings of the Nelsonville City Council on the date set forth below, such meeting being duly called pursuant to a notice stating the time, place and purpose of the meeting received by all Council members, and the following resolution was made, seconded and adopted by those present at the meeting;

WHEREAS, the eligible employees of the Fire Department participate in the Ohio Police & Fire Pension Fund.,

WHEREAS, the Council has previously adopted a pick-up of two percent (2%) of the twelve and twenty-five liundredths percent (1 2.25%) mandatory contributions required to be paid under Section 742.3 1 of the Ohio Revised Code for participating employees of the Fire Department who are members of the Ohio Police & Fire Pension Fund:

WHEREAS, Ohio Police & Fire Pension Fund has adopted new procedures for reporting pick-up contributions in order to properly prepare 1099-R forms for its members;

WHEREAS, the Council wishes to amend it prior resolution in order to continue the pick-up under the new procedures;

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NELSONVILLE, ATHENS COUNTY, OHIO:

Effective July l ,20 1 5, the Nelsonville City Council has determined to continue to pick-up two percent (2%) of the twelve and twenty- five hundredths percent (12.25%) mandatory contributions by the Fire Department employees who are members of the Ohio Police & Fire Pension Fund by paying the contributions on behalf of the employees, with the employee paying ten and twenty-five hundredths percent (10.25%) of the mandatory employee contributions through salary reduction.

2. Said picked up contributions paid by the employer and through salary reduction, even though designated as employee contributions for state law purposes, are being paid by Nelsonville City in lieu of said contributions by the employee.

3. Said picked up contributions will not be included in the gross income of the employees for tax reporting purposes, that is, for federal or state income tax withholding taxes, until distributed form the Ohio Police and Fire Pension Fund.

4. Said employees shall not be entitled to any option of choosing to receive the contributed amounts directly instead of having them paid by the City of Nelsonville to the Ohio Police and Fire Pension Fund.
