R&T’s product range - including in-wall cisterns, toilet seats, cistern valves and seals, FOW cisterns, and disabled-compliant products and components – is designed and developed exclusively in-house, ensuring complete control over product quality.

1. The Company is bound only by these conditions. Any other conditions, warranties and representations (including any implied by law) are excluded and negated.

2. Only the Company may vary these conditions.

3. Prices are those contained in the Company’s published price list, and include GST, and may be altered without notice.

4. Subject to the conditions of Bathroom Products Australia Freight Schedule (refer Freight schedule)

5. Where supplied, all pallets will be invoiced at the Company’s cost. Where returned or exchange, a full credit will be issued.

6. Delivery dates are estimates only and the Company is not liable for any loss or damage for failure to deliver by the estimated delivery date.

7. No liability is accepted for damage or shortage of product unless written notification is received within 2 working days after delivery. Insurance of goods in transit is the responsibility of the buyer.

8. All goods of faulty manufacture (excluding imperfections permitted within AS1976 Vitreous China Used In Sanitary Appliances) will be credited or replaced if the Company is advised within a reasonable time after delivery, and the faulty product is made available for inspection and return. To the extent permitted by the Trade Practices Act and other relevant legislation, the Company’s liability is limited to: The cost of replacing the goods; The cost of obtaining equivalent goods; or The cost of having the goods repaired.

9. The Company is not responsible for any lack of operation or performance of goods (or any loss or damage) where goods are used or adapted for a purpose for which they are not designed.

10. The Company is not responsible for any lack of operation or performance of goods (or any loss or damage) where goods are combined or integrated with other goods not supplied by the Company.

11. Goods returned for credit must be authorized by the Sales Representative or Agent, and must be in resalable condition, including packaging. The Customer will pay freight for returns.

12. A restocking charge of 20% applies to all authorized goods returned for credit unless agreed to the contrary.

13. The Company’s responsibility and risk for goods ceases at the date of delivery.

14. Title:

• Whilst the risk in the goods passes after delivery, legal and equitable title remains with the Company until payment is made to it in full for those goods and all other goods and services supplied to the Customer by the Company at any time. Prior to title in the goods passing to the Customer, the Customer must:

• Hold the goods as bailee and fiduciary agent of the Company;

• Where feasible, store the goods within the premises

of the Customer and separate them from other goods of its own or any third party, or alternatively, in such a way as to clearly identify at all times that the goods are owned by the Company; and

• Ensure that, at all times, the goods are properly stored, protected, readily identifiable and insured for their full replacement value.

• With the prior written consent of the Company, the Customer may sell or deal in the ordinary course of business with the goods provided that any such sale or dealing is at arm’s length and on agreed market terms and any proceeds of such sale are held on trust for the Company in a separate account.

• The Company however reserves the following rights in relation to the goods until all amounts owed by the Company are fully paid its legal and equitable ownership of the goods;

• To retake possession of the goods; and

• To keep or resell any of the goods repossessed pursuant to clause 14.5 below.

• Without prejudice to the rights of the Company in clause 14.3 above in the event of a breach of these terms by the Customer including, without limitation, failure by the Customer to make the agreed payment for the goods before their delivery, the Customer must return the goods to the Company on demand.

• If the Customer does not return the goods to the Company within 48 (forty-eight) hours of receipt of the demand, the Company shall be entitled without notice to enter upon any premises where the goods may for the time being be placed or stored for the purpose of retaking possession of the goods and to retake possession of the goods. The Customer hereby grants full leave and irrevocable license to the Company and any person it authorises for this purpose. If the Company so enters upon any premises where the goods may for the time being be placed or stored for the purpose of retaking possession of the goods, then the Customer hereby agrees that it:

• Shall be liable for all costs, losses, damages, expenses or any other sums of money incurred or suffered by the Company, including consequential losses and damages as a result of the Company retaking possession of the goods or otherwise exercising its rights under this clause 14.5; and

• Shall indemnify the Company for all fees (including legal fees on a full indemnity basis), costs and expenses incurred or suffered as a result of any and all prosecution, actions, demands, claims or proceedings brought by or against the Company in connection with the retaking possession of the goods or the exercise by the Company of its rights under this clause 14.5 and the Customer shall repay all such fees, costs, losses, damages expenses or any other sums of money on demand.

15. Personal Property Securities Act 2009 (PPSA)

• The Customer acknowledges and agrees these terms

and conditions of sale are a security agreement for the purposes of the PPSA and that the Company will register its security interest in the goods and their proceeds as a purchase money security interest (PMSI) on the PPSA Register.

• The Customer acknowledges and agrees that the Company may register its security interest (including registering it as a PMSI) in the goods at any time before or after delivery.

• The Company may apply amounts it receives from the Customer towards amounts owing to it as the Company may choose.

• Where the PPSA applies to action taken by the Company in relation to the goods, the Customer waives its right to the maximum extent permitted by law to receive any notices required under section 95, 118, 121(4), 125, 130, 132(3)(d), 132(4) , 135, 142 and 143 of the PPSA.

• The Customer waives its rights under section 157 of the PPSA to receive notice of a verification statement.

• The parties agree to not disclose information of the kind referred to in section 275(1) except in circumstances required by sub sections 275(7)(b) (e) of the PPSA.

• The Customer must do anything requested by the Company to ensure that its security interest is a perfected security interest and a PMSI and has priority over all other security interests in the goods.

• Nothing in this clause 15.8 is limited by any other provision of these terms or any other agreement between the parties.

• If a term used in this clause 15 has a particular meaning in the PPSA, it has the same meaning in this clause.

16. Irrespective of Condition 14&15 the Customer may sell goods in the normal course of business.

17. Payment of Customers accounts are strictly 30 days from

the end of month in which the goods were delivered. A finance charge of 1% per month will be applied to overdue monies.

18. If there is default in payment of the goods the Company may enter upon the premises of the Customer and recover the goods that have not been paid for.

19. Orders for goods by the Customer are irrevocable, except where the Company agrees to the contrary.

20. The Goods & Services Tax (GST) component (currently 10%) has been included in the Company’s published Recommended Retail price list.

21. The company reserves the right to vary, alter or amend designs, drawings and the performance of its products without notice.

22. Drawings specifications, explanatory literature and other materials provide for descriptive purposes are not binding on the Company, nor do they constitute representations by the Company.

23. Agents or distributors of the Company’s products have no right or authority, express or implied, to bind the Company.

24. The Company is not responsible for any failure to abide by these conditions which apply to it where failure is due to strikes, accidents, or circumstances beyond its reasonable control.

In these Conditions: “Company” means Bathroom Products Australia Industries Pty Ltd its successors and assigns Date of Delivery” means the date the goods leaves the Company’s warehouse or the delivery to the rail, wharf, Carriers Depot, or Merchants store under Conditions 4 as the case may be.

“Goods” means products ordered by the Customer from the Company.

“Published Price List” means the Companies list of prices, issued from time to time, in respect of its goods.


GENERAL WARRANTY TERMS

Johnson Suisse is a brand owned by Bathroom Products Australia PL (hereafter referred to as BPA).

BPA is proud of the quality of the products that we offer over our different brands and full after- sales service is offered, should this be necessary.

In Australia, consumers are protected from the consequences of faulty or defective products by the Australian Competition and Consumer Act. Products must be fit for purpose and free from material and manufacturing defects.

BPA offers warranty terms that in many cases exceed the basic requirements, and different product types have different warranty periods and conditions. Warranty applies from the date of purchase (not installation), or for new buildings, from the date of handover.

This guide provides a reference as to what is covered by warranty and for how long. This first general terms section details the various warranty periods and the second section details the required conditions.

Note:

Some BPA products may have a warranty period that differs based on whether they are used for Residential or Commercial purposes.Where terms and conditions for Commercial use are different to these of Residential use, they have been specifically detailed.

Commercial use includes all use types other than for normal domestic residential purposes.

BPA Reserves the right to make changes to its products at any time without prior notification.

Any part or product not specifically listed has a 1 year warranty period.

Explanation of terms:

Parts and labor - this is the warranty period during which the cost of removal and re-installation of a replacement product, should that be required, is covered.

Product replacement - this is the warranty period during which an equivalent replacement product will be supplied (note that this may not include installation - see below).

GENERAL WARRANTY TERMS

Marbletrend brand is owned by Bathroom Products Australia PL (hereafter referred to as BPA) since May, 2015*.

BPA is proud of the quality of the products that we offer over our different brands and full after- sales service is offered, should this be necessary.

In Australia, consumers are protected from the consequences of faulty or defective products by the Australian Competition and Consumer Act. Products must be fit for purpose and free from material and manufacturing defects.

BPA offers warranty terms that in many cases exceed the basic requirements, and different product types have different warranty periods and conditions. Warranty applies from the date of purchase (not installation), or for new buildings, from the date of handover.

This guide provides a reference as to what iscovered by warranty and for how long. This first general terms section details the various warranty periods and the second section details the required conditions.

Note:

Some BPA products may have a warranty period that differs based on whether they are used for Residential or Commercial purposes. Where terms and conditions for Commercial use are different to these of Residential use, they have been specifically detailed.

Commercial use includes all use types other than for normal domestic residential purposes.

BPA Reserves the right to make changes to its products at any time without prior notification.

Any part or product not specifically listed has a 1 year warranty period.

*Claims for products purchased prior to this date will not be accepted.

Explanation of terms:

Parts and labor - this is the warranty period during which the cost of removal and re-installation of a replacement product, should that be required, is covered.

Product replacement - this is the warranty period during which an equivalent replacement product will be supplied (note that this may not include installation - see below).

Product WarrantyThe benefits given by the warranty set out in this document are in addition to any other rights and remedies you may have under a law in relation to the goods to which the warranty relates. Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for amajor failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The periods of warranty and terms of cover (i.e. product replacement or parts and labour only) are detailed below Warranty applies fromdate of purchase, not fromdate of installation.

Warranty ClaimsTo make a claim under this warranty you must contact either the Merchant from which the goods were purchased or BPA directly by telephone, fax or email as set out above, with the following information:

• Details of the product type and product code

• A brief description of the product fault (with photographs of the fault)

• Proof of purchase of the goods including the date of purchase and where the goods have been installed

• Details of the licensed plumber who installed the goods.

• Your contact details and Handover documentation (if relevant)

BPA will then contact you within 7 days of first being advised of the claim by you or by the merchant (as the case may be) and depending on the circumstances arrange to either

(a) replace the goods (b) repair the goods (c) replace and install new goods (d) requestmore information (e) reject the claim.

Where the goods claimed have not been installed, you must return the goods at your expense to either their point of purchase, or your nearest BPA distribution centre for evaluation. If the claim is then accepted, BPA will refund the freight cost to you when you give BPA proof of payment of the freight cost and the amount paid.

Water DamageSome claims may include a claim for rectification of water damage to surrounding areas as a result of leaking froma product. Such claims will require a site-call by a BPA representative who will evaluate the claim. A further inspection by an insurance representative may also be required before a claimcan be determined.

Warranty ConditionsBPA will not accept claims against this warranty where the following conditions are found to exist:

• Plumbing installations have not been carried out by a licensed plumber.

• Installations that are not in compliance with the Australian PlumbingCode (AS3500) and ABCBGuidelines.

• The goods have been installed by a licensed plumber but not correctly installed.

• The goods have been installed correctly by a licensed plumber, but subsequent repairs, modifications and/or adjustments to the goods after installation have not been carried out by a licensed plumber.

• Claims against faulty cistern valves and seals will be rejected where after-market sanitising additives have been introduced into the cistern tank rather than the toilet bowl.

• Claims for visual defects to product surfaces may be rejected where harsh cleaning or scouring products have been used (rather than mild household detergent and soft, non-abrasive cloths).

• Claims against vitreous china product faulty dimensions or glazing imperfections that are permitted under AS1976 - Vitreous China used in Sanitary Applications. It is permitted that vitreous china products will vary up to ±3mmon any surface and be acceptable due to the unique conditions of the product’s manufacturing process.

• Claimswhere proof of purchase is not provided.

Warranty LimitationsTo the extent permitted under Australian Consumer Law, BPA’s responsibility is limited in the following circumstances:

• BPA is not responsible for any lack of operation or performance of goods (or loss or damage) where the goods have been subject tomisuse, negligence, accident

• BPA is not responsible where goods are used or adapted for a purpose for which they were not designed.

• BPA is not responsible for any lack of operation or performance of goods (or loss or damage) where the goods are combined or integrated with other goods not supplied byBPA.

• It is the responsibility of the purchaser and/or installer, before installation, to ensure the goods are correct and free from obvious visible faults or defects.

• BPA is not responsible for labour and rectification costs incurredin the above circumstances.

• Breakage of any Glass part is not covered by warranty. Glass parts not reported broken upon receipt of goods, will not be replaced.

Except as expressly stated, and to the extent permitted by law, this warranty does not include any right to be reimbursed or compensated for physical or financial injury, loss, damage, expense, time or inconvenience (whether direct or indirect) or special or consequential losses arising out of the occurrence of a defect in the parts or products or caused by use or installation of the products or damages cause by acts of nature.

Site Calls and Technician VisitsWhere BPA has arranged a site-call, and a claim is rejected following inspection (often in the case of unlicensed or incorrect installation), the consumer will be charged a call-out fee of $105, payable to BPA.

In a case where BPA had arranged a repair or replacement, based on information received from a customer or merchant, and it was later found that BPA is not liable for the fault as identified on site, BPA will be entitled to recover any costs directly from the customer.

BPA reserves the right to charge a service fee, to be payable by the warranty claimant. It is the responsibility of the warranty claimant to ensure that installed products are easily accessible for BPA to carry out warranty service. BPA will not be responsible for any costs where adequate access to products is not provided.

Warranties only apply to the original owner and are non-transferable.

For hygiene reasons, Toilet Seats cannot be returned once the packaging had been opened.

WARRANTY CONDITIONS


Vitreous China Appliances

Vitreous china toilets and basins can be cleaned using mild detergent and warm water with a soft sponge. Avoid the use of harsh and abrasive cleaners as these may scratch the glaze surface.

The bowl should be regularly cleaned using a toilet brush and a proprietary bowl cleanser.

Toilet Seats and Plastic Cisterns

These plastic items can be cleaned using mild detergent and warm water with a soft sponge. Do not use abrasive-type cleaners as these will remove the smooth glossy surface of the plastic.

Care should be taken to avoid staining with household cleaners, bleach, solvents, cosmetics and medicines - any spills should be cleaned up immediately to minimise any discoloration or etching effects to the plastic surface.

Minor scratches may be able to be polished out by carefully using auto cutting compound and polish on the plastic surface. This treatment can also be tried to remove the marks left by minor burns.

Do not use in-cistern sanitizers as these can affect the life and performance of the flush valve seals.

Periodically check and tighten seat hinge fixings.

Bathroom Furniture

The best method of maintaining the glossy finish is simply to wipe over with a clean, soft cloth. It is important that no abrasive cleaners or wax-based creams are used as this can result in a build-up of deposits/scratches that will detract from the appearance. Avoid contact with hard, sharp objects. Should scratches occur on gloss lacquered cabinets, fine marks can be removed using a cutting compound normally used for car re-treatment, followed by a car polish and a clean, soft cloth. In case of spilling any chemicals such as hair lacquer, after shave lotion, nail polish and remover, white spirit and insecticides, remove any residual immediately by washing the product.

Steel Baths

Enamelled steel baths can be cleaned using mild detergent and warm water with a soft sponge. If accidental abrasions occur, the surface brilliance can be restored with a silicon-based polish.

Proprietary porcelain enamel cleaners may be used but any residue should be thoroughly rinsed off afterwards.

Acrylic Baths and Shower Walls

Hot water in contact with this product must not exceed 55°C.

The surface of this base will resist surface build-up. However, to preserve its high gloss it may be cleaned with a soft cloth using warm soapy water or household detergent. Avoid all forms of abrasive. If accidental abrasions occur the surface brilliance can be restored by polishing with “Marbletrend Ultra Gloss” or similar silicone-based polish.

Polymarble, SMC & Acrylic Shower Bases

Hot water in contact with this product must not exceed 55°C.

The surface of this base will resist surface build-up. However, to preserve its high glossy finish it may be cleaned with a soft cloth using warm soapy water or household detergent. Avoid all forms of abrasive. If accidental abrasions occur, the surface brilliance can be restored with a silicon-based polish.

Shower Screens

Shower screens are treated with EnduroShield®

easy-to-clean glass surface treatment. Please follow the care instructions affixed to the door panel to ensure that your treatment is long lasting.

After use, the shower should be cleaned with a mild detergent and water. This is particularly important in hard water districts where insoluble lime salts may be deposited and allowed to build up. Abrasive cleaners should not be used.

Care should be taken to avoid contact with strong chemicals such as organic solvents and strippers.

Tapware & Bathroom Accessories

Never use harsh detergents or abrasive cleaners, as these can scratch the surface. Where your tapware/accessories remain dry in use, a soft cloth can be used to remove surface dust. Alternatively, a wipe over with warm soapy water is all that is required to maintain the finish in perfect condition for a lifetime of use. Use of wax based furniture cream should be avoided as these can result in a buildup of deposits, which could affect the appearance.

Spout aerators should be removed and cleaned periodically (the frequency will be determined by the water quality).
