AMERICAN CONSERVATIVE UNION’S 2015 Ratings of Missouri

Dear Fellow Conservatives,

I am pleased to present the American Conservative Union Foundation’s ratings for the 2015 meeting of the Missouri General Assembly. Like our Congressional Ratings, our State Ratings reflect how elected officials view the role of government in an individual's life. The Missouri legislators with the strongest scores voted most consistently with the ideals articulated in the US Constitution: limited and transparent government, individual rights, personal responsibility, and a healthy culture.

The 2014 election completed a political transformation that began in 2010 and resulted in voters of almost half the states, 23 in all, entrusting Republicans with the governorships as well as control of both chambers in the respective state, the biggest sweep since the first half of the 20th Century.

By examining all our State Ratings (which cover a wide variety of issues) we can see which states have best used their Republican majorities to apply conservative principles, how others have struggled, and in yet other states, how conservatives have stood up against liberal majorities. I know that this guide will provide you with the most comprehensive evaluative tool to learn how your legislators measure up.

We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. 1. SB 12 Beef Promotion Taxes. This bill, among other provisions, eliminates the state prohibition on a marketing promotion for beef that duplicates the federal program under the farm bill. ACU opposes these programs that allow large companies to impose a tax on smaller companies to promote their products and opposed this bill. The Senate passed the bill on January 29, 2015 by a vote of 32-2.

2. SB 149 Special Tax Breaks. This bill exempts new or expanding data storage centers from sales and use taxes. ACU opposes special tax breaks for companies the government favors that leads to higher taxes to those not favored by the government and opposed this bill. The Senate passed the bill on February 17, 2015 by a vote of 28-4.

3. SB 24 Welfare Reform. This bill reduces the lifetime benefits under the Temporary Assistance for Needy Families Program from five years to 30 months and restores work requirements that were gutted by the Obama Administration through Executive Order. ACU supports keeping these temporary assistance programs temporary and supported this bill. The Senate passed the bill on February 23, 2015 by a vote of 25-8.

4. SB 239 Medical Malpractice Reform. This bill caps punitive damages in most medical malpractice cases to $400,000 or $700,000 for extreme cases. ACU supports medical malpractice reform that will help lower the cost of health care and supported this bill. The Senate passed the bill on March 12, 2015 by a vote of 28-2

5. SB 330 Stadium Bond Approval. This bill prevents the Governor from extending bonds for a new football stadium in St. Louis without a vote of the legislature or a referendum. ACU supports taxpayer accountability for increasing government debt and supported this bill. The Senate passed the bill on March 19, 2015 by a vote of 26-5.

6. HB 259 Dairy Subsidies. This bill increases subsidies for Missouri dairy producers who participate in the federal dairy subsidy program. ACU supports a free market in agriculture, opposes these depression-era programs that raise the cost of food and opposed this bill. The Senate passed the bill on March 19, 2015 by a vote of 31-2.

7. SB 93 Free Speech. This bill prohibits state universities from creating “free speech zones” on campuses and banning freedom of expression anywhere else. Missouri State University had restricted their free speech zone to a basketball court. ACU supports strengthening the constitutional protection of free speech and supported this bill. The Senate passed the bill on April 2, 2015 by a vote of 34-0.

8. HB 3 Higher Education Tuition. This bill requires illegal immigrants to pay the highest tuition the institution charges and removes their eligibility for any institutional scholarships. ACU opposes special tuition treatment for illegal immigrants and supported this bill. The Senate passed the bill on April 7, 2015 by a vote of 25-8.

9. HB 514 Government Agency Subsidies. This bill offers millions of dollars a year in tax revenue to subsidize a new headquarters for the National Geospatial Intelligence Agency, a federal agency that has threatened to use federal tax dollars to move its headquarters if the state doesn’t give it more money from state taxpayers. ACU believes the better course would be for Congress to prohibit federal agencies from this type of bureaucratic blackmail and that federal intelligence agencies should be more concerned with their mission rather than how nice their headquarters are and opposed this bill. The Senate passed the bill on April 30, 2015 by a vote of 32-1.

10. HB 42 Charter Schools. This bill allows more charter schools in Jackson and St. Louis counties and expands transfer options for those in unaccredited schools. ACU supports the expansion of school choice and supported this bill. The Senate passed the bill on May 5, 2015 by a vote of 23-11.

11. HB 116 Right To Work. This bill prohibits an employer from requiring a person to become a member of a labor union as a condition of employment. ACU supports the right to work and supported this bill. The Senate passed the bill on May 12, 2015 by a vote of 21-13.

12. HB 150 Unemployment Benefits. This bill reduces the state’s unemployment benefits to 13 weeks from 20 weeks when the state’s unemployment rate falls below 6 percent. ACU supports these reforms for benefits that are supposed to be temporary and supported this bill. The Senate voted to override the Governor’s veto on September 16, 2015 by a vote of 24-8.

13. HB 722 Minimum Wage. This bill prohibits municipalities, including Kansas City and St. Louis, from raising minimum wages above the state level. ACU opposes these artificial wages that harm those who need the most help for employment, such as students and less experienced workers and supported this bill. The Senate voted to override the Governor’s veto of the bill on September 16, 2015 by a vote of 23-9.

14. SB 224 Illegal Immigrant Benefits. This bill prohibits illegal immigrants from receiving scholarship benefits through the state’s A+ Schools Program. ACU opposes government benefits for illegal immigrants and supported this bill. The Senate voted to override the Governor’s veto of the bill on September 16, 2015 by a vote of 24-8.

1. HB 259 Dairy Subsidies. This bill increases subsidies for Missouri dairy producers who participate in the federal dairy subsidy program. ACU supports a free market in agriculture, opposes these depression-era programs that raise the cost of food and opposed this bill. The House passed the bill on February 4, 2015 by a vote of 110-49.

2. HB 30 Ballot Integrity. This bill requires a photo identification to vote. ACU supports strengthening ballot integrity to prevent vote fraud and supported this bill. The House passed the bill on February 19, 2015 by a vote of 118-37.

3. HB 190 Abortion Facility Inspections. This bill would require annual on-site inspections of ambulatory surgical centers that perform abortions and make the results of the inspections available to the public. ACU believes abortion is a human tragedy, supports restrictions on the practice and supported this bill. The House passed the bill on February 25, 2015 by a vote of 119-35.

4. HB 187 Illegal Immigrant Benefits. This bill prevents illegal immigrants from receiving state higher education benefits. ACU opposes special benefits for illegal immigrants and supported this bill. The House passed the bill on March 11, 2015 by a vote of 111-41.

7. HB 104 Religious Freedom. This bill prohibits universities from denying student benefits to groups that apply membership requirements based on their religious beliefs. ACU supports the constitutional protection of the free exercise of religion and supported this bill. The House passed the bill on March 19, 2015 by a vote of 117-38.

8. SB 149 Special Tax Breaks. This bill exempts new or expanding data storage centers from sales and use taxes. ACU opposes special tax breaks for companies the government favors that leads to higher taxes to those not favored by the government and opposed this bill. The House passed the bill on March 19, 2015 by a vote of 97-53.

9. HB 1019 Workplace Discrimination Lawsuits. This bill changes the Missouri standard for workplace discrimination from a “contributing factor” to a “motivating factor.” ACU supports these regulatory reforms to prevent frivolous lawsuits based on a vague standard that drives up the cost of business and supported this bill. The House passed the bill on April 9, 2015 by a vote of 95-60.

10. HB 523 Motorcycle Regulations. This bill allows motorcyclists 21 years of age or over with proper insurance to operate a motorcycle without a helmet. ACU supports the right of motorcyclists to decide for themselves whether to wear a helmet and supported this bill. The House passed the bill on April 13, 2015 by a vote of 97-57.

ACU supports medical malpractice reform that will help lower the cost of health care and supported this bill. The House passed the bill on April 21, 2015 by a vote of 125-27.

ACU opposes special tuition treatment for illegal immigrants and supported this bill. The House passed the bill on April 23, 2015 by a vote of 117-37.

13. HB 122 Castle Doctrine. This bill updates and expands the “castle doctrine” in Missouri so that guests in a home would be covered if they helped defend the owner of the home from someone breaking into the house. ACU supports the right to defend yourself and your property and supported this bill. The House passed the bill on April 30, 2015 by a vote of 112-34.

ACU supports these reforms for benefits that are supposed to be temporary and supported this bill. The House voted to override the Governor’s veto of the bill on May 5, 2015 by a vote of 109-53.
