A Proclamation Commending Jonathan Chmura For Achieving the Status of Eagle Scout In the Boy Scouts of America

Commissioner Marvin E. Sauger,

On Behalf of the Board of Commissioners, Offers the Following Proclamation:

Whereas, the Boy Scouts of America was founded in 1910, with a goal of

encouraging boys to participate in an organization which fosters and develops physical as well as mental well-being through programs centered around outdoor and educational activities, as well as civic affairs, which are aimed at developing good citizenship and healthy and useful living; and

Whereas, the Boy Scouts of America has steadfastly taught its young members that service and assistance to others, rather than one’s self, are the highest attainable goals in life and scouting; and Whereas, an eagle candidate is required to direct a work crew as part of his project. Additionally, the candidate must either solicit donations of materials and/or hold a fundraising project to acquire the monies to purchase the materials needed. Neither the scout nor the Boy Scout troop can benefit in any way; and

Whereas, Jonathan Chmura is a Boy Scout who has faithfully and devotedly adhered to the teachings and principles of the Boy Scouts of America and participated to such an extent that he has earned and achieved the highest rank possible, that of “Eagle Scout,” which is worthy of public acknowledgement and commendation by this body; and

Whereas, Jonathan Chmura chose to control the flooding problem in Halmich Park in

the City of Warren for his Eagle Scout project. After meeting with the director of Warren’s Parks and Recreation Department, it was decided that a rain garden would help relieve the excess water problem. The hard work Jonathan and his team put forth in building the rain garden will soak up water, filter the water that drains into Red Run, and also provide a small wildlife habitat. Plants that are native to the area were chosen by Jonathan to further enhance the beauty of the garden.

Now, Therefore, Be It Resolved By The Board Of Commissioners, Speaking For And On Behalf Of All County Residents As Follows:

That By These Presents, the Macomb County Board of Commissioners hereby

publicly acknowledges and commends Jonathan Chmura on achieving the status of “Eagle Scout” a goal which is sought by all who join the Boy Scouts of America but seldom attained and is truly worthy of public recognition.

Be It Further Resolved that a suitable copy of this Proclamation be presented to Jonathan Chmura in recognition of his achieving the rank of Eagle Scout.

A Proclamation Commending K/E Electric Supply Corp. On Their Unique 25/50 Celebration

Commissioners Fred Miller and Joe Sabatini,

On Behalf of the Board of Commissioners, Offer the Following Proclamation:

Whereas, the Board of Commissioners commends K/E Electric Supply Corp.

on the 25th anniversary of opening their first warehouse in Mount Clemens; and Whereas, K/E Electric’s employees are celebrating 50 years of service to

contractors. K/E Electric opened as a subsidiary of parent company, Kuchenmeister Electric Supply Corp.; and

Whereas, Wayne and Norman Kuchenmeister opened Kuchenmeister Electric Supply Corp. in November 1962 and in October 1988 Wayne amicably split and opened K/E Electric Supply Corp.; and

Whereas, in 2011 Rock Kuchenmeister bought out his sister and brother to

become the owner of K/E Electric Supply Corp. making him the next successive generation of Kuchenmeisters to own the company. Rock, his wife, Cheryl, and their three sons, Rocky, Ryan and Rhandi, all work together to run the company.

Whereas, K/E Electric Supply Corp. prides itself on its quality products and superior service. Since opening, they have taken on many huge local projects and jobs and have expanded to four locations and employ sixty-three people.

MACOMB COUNTY, MICHIGAN RESOLUTION TO: AUTHORIZE A BUDGET AMENDMENT IN THE AMOUNT OF $70,000 TO PROVIDE FUNDING THAT WILL ALLOW THE CLERK/REGISTER OF DEEDS TO HIRE FIVE TEMPORARY WORKERS FOR UP TO SIX MONTHS. THE BUDGET AMENDMENT WILL BE BUDGET NEUTRAL BY INCREASING CHARGES FOR SERVICES REVENUE BY $68,000, WITH CORRSPONDING INCREASES IN SALARIES AND WAGES OF $62,900 AND FRINGE BENEFITS OF $5,100. BACKGROUND: As the economy starts to improve and property sales increase, so does the work in the Register of Deeds office. The Clerk/Register of Deeds is requesting five temporary employees be hired for up to six months in 2013, at a cost not to exceed $68,000. Breakdown of the budget adjustment for the cost/funding of temporary workers:

The following chart shows the recent trends in the Register of Deeds office, including the recent increase in documents, expected to continue, despite the decrease of staff through budget cuts the last few years. The Register of Deeds’ office recorded more than 184,000 documents in 2012. This is almost a 30 percent increase and a number that has not been that high since 2007, before the combined offices lost 20 percent of the staff from budget cuts. During this time, the office also implemented the entry book, which prevents fraud by allowing the public to see real estate transactions waiting to be processed, but also adds steps to the recording process.

As a result of the vacancies and increased workload, the recording time on documents in the Register of Deeds Office has greatly increased and the Clerk’s Office has seen an increase in processing time in the court section and vital records. The revenue budget for the Register of Deeds for 2013 is $2,614,840. As indicated in the chart above, actual revenue for the past two fiscal years has exceeded this amount by more than the $70,000 being requested. Therefore, we believe that it is realistic to expect actual revenues to be at least $2,684,840 in 2013. We have discussed this with the Finance Department and they concur with our calculations and are supportive of this request.

North Macomb roads to get limestone

The sheer amount of dirt roads in northern Macomb County are hard to maintain and fix each year, but this year, as with

years past, the Macomb County Department of roads is looking to make the jobs of local municipalities easier.

The offer of limestone distribution from the county was started by Bob Hoepfner, director of the Macomb County

Department of Roads, three years ago and covers six northern Macomb townships. Each township is allowed to choose

the portion of roads they would like six inches of limestone to be installed by the county.

“I have made every attempt to budget for at least two miles of roads in each of the six municipalities and it has been

effective so far,” Hoepfner said last year at a public meeting held in Armada. “It is never a guarantee, but it has worked

well for everyone.”

This year Bruce, Armada, Richmond, Washington, Ray and Lenox townships will take part in the 90/10 program where

the county covers 90 percent of the cost and townships cover the remainder at $6,400 per mile.

In Ray Township, Supervisor Charlie Bohm said they have already chosen where limestone will be put down later this

year.

He said a stretch of 30 Mile Road headed west from North Avenue to Wolcott Road and another section from North

Avenue and 31 Mile Road headed west were chosen for 2013.

“It is a tremendous amount of help to us,” said Bohm. “It works well for both sides. For the county it is less grading and

dust control and for us it is an improvement of our roads for our residents and visitors.”

Bohm said the three miles of roads selected were based on traffic count figures.

In Richmond Township, Supervisor Cynthia Greenia will be going on the advice of those who are frequently using the

roads.

Greenia said her township has yet to select specific areas for limestone coverage; a topic that she said would be

discussed at their February meeting, but is relying on input from others.

She said Richmond/Lenox EMS Director Jeff White and those in the transportation department at Richmond district

schools will be major consultants in the process.

“They are on our roads a lot and their input is essential for us to look at before choosing,” she said.

Armada Township is expected to go with the framework of a two-year plan that was put in place last year.

Three miles were completed last year and this year they are looking to continue that work with the completion of Pratt

Road to Holmes Road and then Holmes Road to the north end of the township line.

“We put a plan in place last year and we are looking to finish it this year,” said Supervisor John Paterek. “We will still take

input from residents and members of the board, but that is the preliminary plan for now.”

Paterek also said after preliminary budget talks this week the township may be looking at getting an extra portion of

limestone to put down at the township transfer site for more stability for those dropping off large refuse items.

The township board will discuss the matter further once the new fiscal budget has been completed.

Last year the county applied 18 miles of limestone at a cost of $65,000. It takes 5,000 tons of limestone to cover a mile of

road.

“I am so pleased that communities in my district can benefit from such a great opportunity at a nominal cost again this

year. Limestone is invaluable in maintaining the quality of our gravel roads here in the north end of Macomb County,” said

Macomb County Commissioner Don Brown, who represents the residents in the affected communities.

Residents can contact their township offices directly to request that specific roads be considered for this program, or find

out when selected roads will be brought to the township board for approval. Limestone application is expected to begin

in mid-to-late June.

January 23, 2013 TO: Chairman David Flynn FROM: Commissioner Kathy Tocco RE: Ad Hoc Committee Regarding Rules I am writing regarding the status of the Ad Hoc Committee on Rules. The Committee met for several hours on Wednesday, January 16, 2013, with Corporation Counsel, (specifically George Brumbaugh and Jill Smith). We had a good and detailed discussion on the 2011 Rules. Mr. Brumbaugh and Ms. Smith revised the 2011 Rules consistent with the discussion at the January 16, 2012, meeting. I forwarded a copy of the 2011 Rules, and Mr. Brumbaugh forwarded a copy of the “revised” Rules to Andrew Richner, our independent counsel, for review. The Committee met for several hours on January 22, 2013, with Mr. Richner, Mr. Brumbaugh and Ms. Smith also in attendance. It is Mr. Richner’s opinion that there are multiple provisions in the 2011 Rules and the proposed revised Rules that are in conflict with state law and the county charter. In addition, because the Rules have been revised many times over the years, there is inconsistent and/or outdated language throughout the document. The Ad Hoc Committee is committed to producing a comprehensive set of rules (which is in full conformity with state law and the charter) for the Board’s consideration. I was over-zealous when I indicated on behalf of the Ad Hoc Committee that we would have a document ready for review at the Full Board meeting on Thursday, January 24, 2013. Mr. Richner anticipates having a revised set of Rules to the Ad Hoc Committee no later than Tuesday, January 29, 2013. The Committee will meet again and anticipates having a set of Rules for consideration prior to the February 28, 2013, Full Board meeting. KT

MACOMB COUNTY, MICHIGAN RESOLUTION TO: CONCUR IN THE APPOINTMENT OF THE KITCH LAW FIRM TO REPRESENT MACOMB COUNTY IN PENDING LITIGATION IN MACOMB COUNTY CIRCUIT COURT ENTITLED KENDZIERSKI, ET AL VS. MACOMB COUNTY INTRODUCED BY: David Flynn, Board Chairman There is presently pending in the Macomb County Circuit Court a lawsuit involving a group of retirees who have been certified as a “class” in an action against the County as a result of co-pays for retirees being increased. The Plaintiffs’ theory is that the Collective Bargaining Agreements provided in some instances for a specific co-pay amount and specified certain benefits and that the County was without authority to increase the co-pays. The “class of Plaintiffs” consist of retirees who were members of different bargaining units and whose rights to these health care benefits were reflected in the Collective Bargaining Agreements. The matter has been pending and numerous discussions with the Plaintiff class have been held but the matter is now proceeding into the discovery phase which will involve a great deal of disclosure of documents, taking of depositions, etc. The Office of Corporation Counsel is recommending the appointment of The Kitch Law Firm and, in particular, Ms. Karen Berkery of that firm to represent us along with the current law firm of McConaghy & Nyovich in this matter. Ms. Berkery has represented the County in the past and is the head of The Kitch Law Firm’s Human Resources / Personnel Litigation Division and has great experience in handling these types of personnel issues. The Kitch Law Firm will allow us to aggressively defend this case in light of the fact that this matter will now be proceeding to an eventual jury trial in front of Judge Druzinski. It is important that this law firm be involved in this suit at this time as they have a very experienced litigation staff and also are prepared to assist and help in hopefully filing dispositive motions in order to avoid a trial. We strongly urge the Commissioners to concur in the appointment of The Kitch Law Firm to represent the County in this pending litigation. COMMITTEE/MEETING DATE FULL BOARD – 1/24/13
