WHEREAS, in light of the situation that has been created by the COVID-19 pandemic, New York State Governor Andrew Cuomo has issued Executive Order No. 202.13 (“Continuing Temporary Suspension and Modification of Laws Relating to the Disaster Emergency”) on March 30, 2020 (the “Order”); and WHEREAS, the Order provides, in relevant part, that any school board election scheduled to take place in April or May of 2020 is postponed until at least June 1, 2020, subject to further directive as to the timing, location or manner of voting for such election; and WHEREAS, the New York State School Boards Association has obtained informal guidance from the Deputy Secretary for Education in New York that the Order was intended to cover not just school board “elections” but also school board “votes” in general (such as the District’s annual vote that had been scheduled to occur on May 19, 2020); and WHEREAS, the Board of Education of the District (the “Board”) wishes to empower the District Clerk to monitor the situation and to defer the pending initial publication of the District’s annual vote notice (or cease further publication of such notice, to the extent possible), until such time as further guidance is provided in accordance with the Order, and then to proceed as directed; NOW, THEREFORE, be it resolved that the District Clerk be, and hereby is, authorized and directed to monitor the events that are the subject of the Order, and to keep abreast of the future guidance that is anticipated to be delivered pursuant to the Order; and be it further RESOLVED, that the District Clerk shall, in the meantime, defer initial publication (or any further publication) of the District’s annual vote notice until such time as a date for the District’s annual vote has been established pursuant to the Order (or has otherwise been established by law or by another Executive Order), and then to proceed with such publication arrangements (including timing and frequency) as may be directed (without further action of the Board being necessary); and be it further RESOLVED, that this resolution shall take effect immediately. I am pleased to recommend Shelly Benjamin for a Long Term Substitute teaching position in the

Elementary School. Shelly is currently the Elementary Library Teaching Assistant. Shelly would fill the

role of 3rd grade teacher Kim Flood as Kim goes on maternity leave. Shelly has been in the TA position

for over five years and Shelly has recently taken on leadership positions in our building. Shelly has

strong connections to the students and to the 3rd grade team, which will make this transition during

uncertain times easier. Shelly also has a thorough knowledge of Elementary School systems, which will

help her in this position.

I am certain that Shelly will be a great fit in this role, and I look forward to seeing her contributions to the

team.

WHEREAS, the Board of Education of the Spencer-Van Etten Central School District desires to

enter into a contract with the Greater Southern Tier BOCES in order for the GST BOCES to furnish

certain services to the District pursuant to Education Law 1950(4)(jj), those services

being: provision of instructional computers and related peripheral equipment.

BE IT RESOLVED that the Board of Education of the Spencer-Van Etten Central School District

agrees to enter into a contract together with the Greater Southern Tier BOCES for the provision of

said services to the District not to exceed $150,000 plus related borrowing fees, plus yearly

BOCES support during the term of the contract, subject to the approval of the Commissioner of

Education, for a period of 5 Years from the date said agreement is signed and furthermore, that the

Superintendent and President of the Board be authorized to execute all documents necessary to

effectuate this resolution.

Re: Adoption of BOCES Resolutions

Welcome to another year participating in the Cooperative Purchasing Service. As you know our bidding year begins on July 1, 2020, and therefore we must have certain documents in place in order to service your district. Enclosed are the new 2020-2021 Resolutions for the Delaware-Chenango-Madison-Otsego BOCES Cooperative Purchasing Service, along with a Generic Resolution.

Although the Resolutions may, at first glance, appear to be identical, each resolution has a different purpose. In order to eliminate any confusion, a description and explanation for each resolution is listed below:

Cooperative Purchasing Resolution: To be signed by districts participating in the full Cooperative Purchasing Service.

This resolution authorizes BOCES to award bids on behalf of the participating school districts.

Cafeteria Supplies and Food Bid Resolution: To be signed by districts participating in the Cooperative Food Bid. This resolution appoints a committee to act on the districts’ behalf and for the district to abide by the committee recommendations and award of bids.

Generic Resolution: To be signed by all districts. This resolution authorizes BOCES to act on the

behalf of the districts in the preparation, advertising, and tabulation of bids but specifies that bids are to be awarded by the individual districts’ Board of Education based on the information supplied by BOCES

The appropriate resolutions must be adopted and signed by your School Board and returned to us as soon as possible.

Districts that are cross contracting with the Service must also provide a signed Cross Contract Request Form, which should accompany the signed resolutions. If your district is not a component district of the DCMO BOCES, then we will need the Cross Contract Request from

Shall the Board of Education establish a capital reserve fund under the provisions of Education Law §3651(1)? The purpose of the fund is for construction, repair and reconstruction of capital improvements. The ultimate amount of the fund shall be $3,000,000. The probable term shall be ten years. The source from which funds will be obtained can include any or all of the following: Unappropriated fund balances from the general fund as determined by the Board of Education; State Aid related to expenditures from the capital reserve fund; interest income related to investment of monies in the fund; and any other additional monies thereafter authorized by the voters of the District.
