The Chair called for a motion in regards to the minutes of the February 2, 2017 meeting. Upon a motion by the Vice Chair, seconded by Ms. Daub, it was voted on and unanimously carried to approve the minutes of the February 2, 2017 meeting as circulated.

asked if anyone else was interested in attending to let her know so that she can apply for funding.

SB 504 Relating to Controlled Substances. The EO reported on the status of the following bills still that are still moving

through this session:

SB 984 Relating to Workers’ Compensation Physician This bill crossed over to the House and was referred to the LAB/HLT and CPC

Committees. At its February 2, 2017 meeting, the Board’s position was to support. Since no

amendments were made to the bill, the Board’s position has not changed.

HB 912, HD2/SB 401, SD1 Relating to Nursing Both bills crossed over to the other side. HB 912 was referred to CPH and SB 401 was referred to HLT/IAC, CPC Committees. Both bills include APRNs, except SB 401 refers to APRNs with prescriptive authority. The Board previously determined that “prescriptive authority” did not have to be specified in the sections for an APRN to practice to their full scope and to provide primary medical services to adolescents as a care provider. The Board’s position is to support, but that specifying prescriptive authority was not necessary. HB 1272, HD1 Relating to Improving Access to Psychiatric Care for Medicaid Patients This bill crossed over to the Senate and was referred to the HMS/CPH, WAM Committees. Tracking only.

SB 505, SD1 Relating to Health This bill crossed over and was referred to the HLT, CPC Committees.

This bill includes APRNs as a health care practitioner to whom a patient may be

referred to for concurrent care or consultation if the opioid therapy continues for longer than 6 months.

The Board takes no position on the intent of the bill, only that APRNs be included

and allowed to practice to their full scope. Tracking only. SB 1312, SD2 Relating to Licensure of Certified Professional Midwives This bill crossed over and was referred to HLT, CPC, FIN Committees. The Board is no longer involved, tracking only. SB 1129, SD2 Relating to Health SD1 included APRNs under the definition of “counseling”. SD2 deleted reference to APRNs under definitions of “consulting provider” and

“counseling”. Both bills included APRNs under the definition of “attending provider”. This bill crossed over and was referred to HLT, JUD Committees.

Amendments to Title 16, Chapter 89 – Discussion of Draft #8

Draft 7 Amendments include, but is not limited to the following:

Placing a limit (3) as to how many times a candidate may sit for the NCLEX before being required to take a remedial course;

Allows the Board to require all nurse applicants to obtain an additional background check, including a self-query report from the National Practitioner Data Bank;

Includes failure to report oneself or the director of nursing, nursing supervisor, peer or colleague, any disciplinary action, termination or resignation of a nurse before conclusion of any disciplinary proceeding as “unprofessional conduct”;

Amends APRN “recognition” to APRN “license”; and

Allows the Board to conduct a random audit of the renewal of APRNs with prescriptive authority compliance with the continuing education requirement.

Members received and reviewed a draft that included the recommendations made at the January meeting.

The EO stated there may be some non-substantive changes that need to be made to the draft for grammar and formatting. There being no further discussion, upon a motion by Mr. Joslyn, seconded by the Vice Chair it was voted on and unanimously carried to approve the current draft, and move forward with the rules adoption process.

Continuing Competency Program

Report by Joanna Smith on CPC Information – Comments from T. Joslyn, Liane Muraoka, Laura Reichhardt

Ms. Smith reported on the draft of the Continuing Competency/Guidance Document for Nurses and Employers that was provided to the Board. She stated based on the conversation at the last meeting she made changes to the draft that the Board is reviewing today. She also stated that she was contacted by HGEA asking if they could get access to this draft so they could get an idea of what their members will be responsible for or the kinds of opportunities they can utilize from this list.

The EO stated the Board is still working on this draft, however she can send it to

them, but must stress that it is still a draft and subject to change. The EO asked Mr. Duldulao as someone who is not a nurse, was he able to

understand the document? Mr. Duldulao replied yes, he could understand it. Mr. Joslyn asked if the statement “Any learning activity option taken prior to July 1,

2017, will not count” can be printed in large bold font? He also stated that under 1. b) National certifying body; “National Board of Certification and Recertification of Nurse Anesthetists (NBCRNA) needs to be included because it is the organization that certifies and recertifies nurse anesthetists.

The EO stated we can definitely make that statement larger and bolder and she

will add the NBCRNA. Questions from the Hawaii State Center for Nursing The Board reviewed separate emails from Ms. Reichhardt and Ms. Muraoka. Ms.

Reichhardt states that item #8 on the draft of the Continuing Competency/Guidance Document for Nurses and Employers is written in the draft quite different from the language that is in Act 127. The Act language is as follows:

(8) Developing and conducting a nursing education presentation or presentations

totaling a minimum of five contact hours of actual organized instruction that qualifies as continuing education;.

The EO stated we have to stay with the language that is in the law.

Ms. Smith stated she will correct the language on #8 to the language that is in the law.

Ms. Muraoka indicated the following comments/questions:

1. National Certification or recertification related to the nurse's practice role a. No additional questions related to this area

2. Thirty contact hours of continuing education activities. a. What about accepting other Hawaii healthcare boards -

pharmacy, social work, medicine, etc. - Yes. As long as body/organization presenting activity is certified by a national certifying body.

3. Completion of a board approved refresher course a. No additional questions related to this area

4. Completion of a minimum of two semester credits of post-licensure academic education related to nursing practice from an accredited nursing program

a. Per Pat Nishimoto conversation (May 2016 BON meeting), non-nursing courses related to nursing practice (i.e. study of death) will count. Can language for that be provided that speaks to nursing related topics that are not from nursing programs? - College courses which are applied toward nursing degree completion such content offered in basic nursing education programs, can be used to satisfy the requirements of “contact hours.” Independent study course work can be applied toward state competency requirements if course work is directly related to healthcare and/or to your area of specialty.

5. Participation as a preceptor, for at least one nursing student or employee transitioning into new clinical practice hours for at least one hundred twenty hours.

a. Recommendation: Organized through employer organization and preceptor has received formal training through employer or a nationally accredited entity (see attachment A - preceptor training table). – The Board will take under advisement.

b. Consideration: DNP/PhD chairperson receives credit for precepting student. – The Board will take under advisement.

a. Precepting students (Nursing faculty precepting students

fieldwork). Committee chairperson or faculty advisor for non-clinical fieldwork. Committee chairperson is a 1.0 equivalent to contact hours; committee members are 0.5.

c. Count for one license cycle only. - Yes, only one license cycle. 6. Completion as a principal or co-principal investigator of a nursing research

project that is an institution review board project or evidence-based practice project that has been preapproved by the board.

a. Timeframe for pre-approval? – For evidence-based practice project, approximately 3-4 months.

b. Is the assumption that completion is within the license period? If completed project is expanded and spans multiple licensing periods, is expansion eligible to meet CC requirements? – Completion must be within the license period.

c. Recommendation: For nursing research project, IRB approval must be shown. For EBP, it should be an official project through their employer or school of nursing in which they are enrolled. Yes. Through employer, professional organization, or school of nursing.

7. Authoring or coauthoring a peer reviewed published nursing or health-related article, book, or book chapter.

a. Recommendation: It must be published within the licensing time-period. Articles pending publication should not count. – Completion (published) must be within the license period.

8. Developing and conducting a nursing education presentation or presentations totaling a minimum of five contact hours of actual organized instruction that qualifies as continuing education.

a. Question: For nurse educators, will conducting presentations, that total 5 contact hours, including ACLS, TNCC, PALS, etc., meet the requirement? – No.

b. Recommendation: Developing and conducting education presentations count, only if the content is updated from prior license period. – No, not updated. Must be new.

9. Completion of a board-recognized nurse residency program. a. Recommendation: Include the HSCN NRP MODEL (licensed from

Vizient) is accredited nationally. HPH Academy or similar programs count as residency programs for both new grads and employees transitioning into a new practice area. – Yes.

Questions from Kris Tsuda, Department of Human Services

The Board reviewed the following questions from Kris Tsuda regarding learning activity options “h” from Board of Nursing FAQ sheet dated November 2015:

“Developing and conducting a nursing education presentation or presentations totaling a minimum of 5 contact hours of actual organized instruction that qualifies as continuing education”.

The Board discussed and responded to Ms. Tsuda’s questions as follows:

1. Is this allowed as a collaborative effort? Meaning could there be RNs working collaboratively to present education modules? No.

2. Do we submit a proposal of the education module to DCCA for prior approval? The Board will not approve proposed courses. In order to obtain credit for this learning activity option, the actual course that was presented and proof that it was presented and for at least 5 hours, will have to be submitted in order to receive credit.

3. What is the criteria for a valid education module? OR 4. How do we ensure the education module used will be counted towards the

five (5) contact hours? In response to questions 3 & 4: (1) You must be the primary presenter of a first-time presentation. (2) The presentation or presentations must total at least five contact

hours of actual organized instruction. (3) The presentation or presentations were delivered in a structured

teaching/learning framework to nurses, other healthcare providers or the public as part of conferences, grand rounds, in-serves, seminars, CD-ROM content, internet-based or other e-learning formats, teleconferences, patient/family teaching, or public education.

Repeat presentations of the same material or modifications of the same material, presentations or lectures that were a required part of your job, or presentations for which you served as a panel moderator will not be accepted. Supporting documents include, but is not limited to copy of the presentation outline, abstract, letter accepting your abstract, or letter inviting you to speak as well as evidence that you actually presented the topic.

5. What kind of documentation is needed to verify the amount of contact hours? See above.

Criminal Background Checks – Status Report on Implementation

The EO reported staff is being trained and that effective July 1, 2017, all new

applicants and nurse applicants who received their Hawaii nurse license on or after July 1, 2017 will be subject to the electronic fingerprinting for the purpose of a criminal background check. Current licensees and/or those licensees who were issued a Hawaii nurse license prior to July 1, 2017 will be divided up into 3 groups and for the 2019, 2021 and 2023 renewals, will be required to comply with the criminal background check requirements in order to renew their license.

GEPN Student Nurse License

The EO reported that she will have a draft for the Education Committee to review

at their next meeting. Upon approval of a final draft of the language to amend the admin rules to issue a temporary license to GEPN students until they complete the GEPN program and receive a nursing degree, the Board will have an opportunity to review and make further recommendations.

Correspondence

RN Performing eyelash extensions

The Board reviewed the following email inquiry:

“I am inquiring about our state regulations regarding eyelash extensions certification. I was able to aquire my eyelash extension certification by showing my Healthcare credentials (I have my LPN, RN BSN, and CHPN for my current position as a Hospice case manager). I also own my own business as a solo artist and entertainer, which is what led me to become eyelash extension certified. I hope to pursue a nursing specialty in aesthetics, which this opportunity is quite limited on the big island. With that said I am aware that there are individuals who practice with no legal verification to do so. There are also some state which allows the Healthcare professional licenses as an appropriate candidate for this specialty and I am hoping Hawaii is one of them. I, however the outcome, value my professional license above all else and would appreciate a response in this matter.

If this is not a service that registered nurses can provide and be compensated for,

will there be a possible move to allow this to be a future business opportunity for those of us out there that would like to expand in aesthetics?”

Mr. Joslyn commented that the application of eyelash extensions is not considered

a nursing task.

The EO asked Ms. Smith if the continuing competency document included any organization or certification in aesthetic nursing?

Ms. Smith responded no. Ms. Kim stated she believes that they go through a special kind of training related

to cosmetology, aesthetician and the like, and receive a certification to perform this. It is not a nursing task. It may require a different type of professional license.

The EO asked the Board if they would consider aesthetic nursing in the future? The Chair stated the Board has no plans at the current time to pursue that. It was the consensus of the Board that at this time, application of eyelash

extensions is not considered a nursing task and that they do not anticipate nursing aesthetics as a specialty practice area for nursing.

Annual Pass Rates for Hawaii Nursing Programs The Board reviewed the Annual Pass Rates for Hawaii Nursing Programs for the

period January 1, 2016 through December 31, 2016. The EO stated that the Education Committee will be discussing the pass rates at

their next meeting but for now, the pass rates for 2016 will be posted on the Board’s web page.

Hawaii State No report. Center for Nursing: Applications: The Board moved into Executive Session. Executive Session: At 9:43 a.m. upon a motion by the Vice Chair, seconded by Ms. Daub, it was voted

on and unanimously carried to move into Executive Session in accordance with HRS, 92-5(a) (1) and (4), “To consider and evaluate personal information relating to individuals applying for nurse licensure;” and “To consult with the board’s attorney on questions and issues pertaining to the board’s powers, duties, privileges, immunities, and liabilities”.

At 10:04 a.m. upon a motion by Ms. Daub, seconded by Mr. Joslyn, it was voted on and unanimously carried to move out of executive session.

Pay $1,000 fine within 90 days; and

Take CE courses within 90 days.
