Chairman’s Message ItwaswithconsiderableenthusiasmthatIacceptedthechairmanshipoftheQuebecEmployersCouncilboardofdirectorsinNovember2010.Fulfillingsucharoleinsuchaprestigiousandinfluentialorganization,whilehelpingtomobilizeQuebec’semployersaroundthemajorchallengesfacingoursocietyasawhole,isanidealopportunityformetogetinvolvedinsupportofQuebec’sprosperity.
ThisreportprovidesanoverviewofthemanyinterventionstheCouncilhasconductedinthepastyearandthegainsthathavebeenmadeforQuebecemployers.Itisimperativethatemployerscontinuetoconversewithdecision-makersandthegeneralpublicinastrongandunifiedvoice,andthattheentirebusinesscommunityformsacommonfrontbyjoiningtheQuebecEmployersCouncilandgettinginvolvedinitsmainorganizationalbodies,inaspiritofemployersolidarity.

Active and committed participation in debates and decision-making processes
Anobservertrackingtheorganization’sinterventionswillhavenotedthat,morethanever,theQuebecEmployersCouncilhassteadfastlyparticipatedinallthemajordebatesandrepresentedtheemployerswithrigourandpragmatismonthemainissuesthathavegrippedQuebecsocietyoverthelast12months.Healthandworksafety,labourrelations,federalandprovincialbudgets,universityfunding,shalegas,theconstructionindustry,innovation,payrolltaxes,thePortofMontreal:thesearesomeofthemanydossiersinwhichtheCouncil’scontributionbroughtaddedvaluetothepublicdebate.
Effective, mobilizing representation on behalf of stakeholders
Indefendingtheemployers’positioninmanydossiersin2010,theQuebecEmployersCouncilendeavouredtoconductsustainedandrepeatedrepresentationstoallofthepartiesinvolved.InadditiontoannualmeetingswithpoliticalpartycaucusesinQuébecCityandOttawaandoccasionalmeetingswiththeministersandaffectedoppositionspokespeople,theQuebecEmployersCouncilthenwentonvarioustours,jointlywithotheremployerrepresentatives;thetourswerebasedaroundaseriesofmajorissuesfortheemployers,particularlylabourrelationsintheconstructionindustry,fundingofemploymentinsuranceandupdatingtheoccupationalhealthandsafetyplan.
Development of significant and pragmatic content
Alongwithadoptinganewstrategicplanandplatformforthe2010-13period,in2010theQuebecEmployersCouncilpublishedassortedbriefs,studiesandsurveyswhichsubstantiallyhelpedinraisingpublicdebateonmanyissues.TheflagshippublicationofthelastyearwasdefinitelytheReport Card on Quebec Prosperity,whichdrewonacomprehensiveanalysisandvalidateddatatoprovideafairandoverallportraitofthecreationofwealthandprosperityinQuebec.
Dynamic and constructive communication with its target audience
TheQuebecEmployersCouncilgaveitselfafinemakeoverin2010byadoptingadynamicandcontemporaryvisualidentity,anewsignaturetagline(“AlliedforProsperity”)andbyraisingitsvisibilityontheInternet,refreshingitswebsite(www.cpq.qc.ca)andreinforcingitspresenceinthesocialmedia.Thesetangibleactions,backbysustainedandsignificantinterventionsincurrentevents,allowedtheQuebecEmployersCounciltoincreaseitspresenceintheelectronicandprintmediaandontheInternetby140%,sothatthevoiceofthebusinesscommunitycouldbeheard.
An organization in better health and with enhanced value
ThearrivalofmanynewcomerstotheQuebecEmployersCouncil’spermanentstaffandboardofdirectorsin2010generatedarenewedenergyandvibrancyintheorganization,andthiscontributedtoitssuccess.TheworkoftheQuebecEmployersCouncilinthedossiersinwhichitwasinvolvedbroughtmeasurableresultsinregardtotheorganization’sfinancialsituationin2010,withthefiscalyearendshowingacurrentoperatingsurplusof$189,700and$279,422oncealloftheQuebecEmployersCouncil’sfinancialobligationsweretakenintoaccount.
TheQuebecEmployersCouncilissolidlypositionedtoboldly,energeticallyandenthusiasticallytacklethemanychallengeswaitingitinthecomingyear.AsthepresidentoftheQuebecEmployersCouncil,Iurgetheentirebusinesscommunitytoshowemployersolidarityandallyforprosperitybyjoiningourorganization,soitcancontinue,morethanever,tobetheindispensablereferenceinQuebec’sbusinesscommunity.

President’s Message
The Employers Council: More than ever the crossroad of employer solidarity in Quebec Fromeverystandpoint,2010hasbeenamemorableyearfortheQuebecEmployersCouncil.Againthisyear–41yearsafteritsinception–theorganizationhasdemonstrateditsleadership,credibilityandrelevanceastheQuebecbusinesscommunityspokesperson,withgovernments,employers,unions,themediaandgeneralpublic.AsQuebecpreparestoconfrontthemajorchallengesthatwillhaveanunprecedentedimpactonitsabilitytocreatewealthandprosperity,itbecomesessentialforemployerstobeboldandtakeanactivepartinfindingsolutionsasmajorplayersinaQuebecsocietythatnowevolvesinaglobaleconomicenvironment.

QuebecemployerscancountontheactiveandcommittedparticipationofthepresidentandotherQuebecEmployersCouncilspokespersonswithvariousbodieswherethepoliciesaffectingcompaniesaredeveloped.In2010,theQuebecEmployersCouncilrepresentedemployersonthefollowingbodiesinparticular:
theBoardofDirectorsoftheCSSTandtheIRSST,andthemanycommitteesoftheCSST;
theBoardofDirectorsoftheCommissiondespartenairesdumarchédutravailandtheCommission’smanyworkinggroups;
theConseildespartenaireséconomiques;
theConseilconsultatifdutravailetdelamain-d’œuvre;
theComitédesintervenantséconomiquesdusous-ministredel’Immigration;
MNAsandMembersofParliament,notablythroughanannualtourofpoliticalpartycaucuses.
Since2010,theQuebecEmployersCouncilalsorepresentsemployersonthetripartiteroundtablecomprisedofHumanResourcesandSkillsDevelopmentCanada,CanadianEmployersCouncil,theCanadianLabourCongressoninternationallabourstandardsandatthenationalCommitteeprogramofprofessionalandtechnicalstudies.
Alongwiththisstatutoryandregularparticipation,theQuebecEmployersCouncilhascontinuedtomonitorandconductenergeticadhocinterventionswithotherpoliticalandgovernmentbodieswhosedecisionsaffectemployers.Here,byareaofintervention,arethemainrepresentationsmadebytheQuebecEmployersCouncilattheprovinciallevelin2010.

Federal and provincial budgets
SeveralinterventionsbytheQuebecEmployersCouncilinconjunctionwiththe2010pre-budgetconsultationsinQuebecCityandOttawaledtotangibleresultsforemployerswhenthetwobudgetswereannounced,notablyinregardtothecontrolofpublicspendingandthereturntobalancedbudgets.
Labour dispute at the Port of Montreal
AfterahighlypublicizedinterventionbytheQuebecEmployersCouncil,CanadianLabourMinister,thehonourableLisaRaitt,assignedtheCanadianIndustrialRelationsBoardwiththemandateofsummoningtheMaritimesEmployersAssociationandtheunionrepresentingthePortofMontreallongshorementoresumenegotiationsinthelabourconflictatthePortofMontreal.Thisannouncementbroughttheresumptionofnegotiationsandledtoanagreementinprinciplebetweenthetwopartiestwodayslater.
Contract for the renewal of Montreal’s fleet of subway cars
TheQuebecEmployersCouncilcloselymonitoredthedossierregardingtherenewalofMontreal’sfleetofsubwaycars.Itspositionpromotingtheurgencyofhavingnewsubwaycarsassoonaspossible–endorsedbymanyemployerandunionassociations–contributedtotheswiftadoptionofBill116,Loi sur l’acquisition de voitures pour le métro de Montréal,andthisavoidednewdelays.
Many tangible gains for employersTheinterventionsandrepresentationstheQuebecEmployersCouncilmadein2010wereproductive.TheQuebecEmployersCouncilispleasedtoreportsignificantresultsandtangiblegainsforemployers.Herearesomeexamples:

TheunifyingleadershipoftheQuebecEmployersCouncilintheareaof……occupationalhealthandsafetyBecauseofitsefficientrepresentationstovariousCSSTbodiesandthemobilizationofemployersinpartnershipwithotherassociations,theQuebecEmployersCouncilobtainedmanytangiblegainsforemployersin2010:
Datingbackto2009,theemployerdelegationtotheCSSTboardofdirectorssucceededinlimitingtheincreaseintheemployers’CSSTcontributionrateto4%for2010;theemployerscoverthefullannualcostofmorethan$2.2billionforthesystem.Oneyearlater,thishasproventobetherightdecisionoverotheroptionsthatwouldhaveledtocosthikesintheareaof170to370milliondollars.
Thechangetothefundingpolicythatoccurredin2010willstabilizetherateforafive-yearperiodbyestablishingaratecaptoamortizethe$3.1deficitrelatedtoyieldlossestheCaissededépôtetplacementduQuébecrecordedin2008.Withoutthischange,itwouldhavecostemployers$186.5millionmore.
InJune,theQuebecEmployersCouncil,capitalizingontheadoptionofaunanimousmotionbytheNationalAssemblysupportingtheextendingoftheFor a Safe Maternity Experienceprogramtoworkersinbusinessesoffederaljurisdiction,sentalettertoMNAsremindingthemofcertainfactsabouttheprogramanditscosts,andurgingthemtoreconsidertheprogram.
Lastfall,theQuebecEmployersCouncilinitiatedapublicaffairscampaignonthemodernizingofQuebec’soccupationalhealthandsafetyplantocreateawarenessamongelectedofficialsandthegeneralpublicabouttheimportanceofadaptingtheplantocurrentworkplacerealitiesbyreducingcostsandmakingitmoreefficient,whileensuringworkers’healthand
safetyaremaintained.TheQuebecEmployersCouncilissued10newslettersonthevariousoccupationalhealthandsafetyproblems,includingaspecialeditionoftheInfoCPQnewsletter.AcolloquiumonthesubjectwasheldinNovember,bringingtogethersome100participants.
InJune,theQuebecEmployersCouncilactivelyintervenedwiththeLabourMinistertodenouncemanyaspectsofBill110aimedatsubjectingdomestichelperstotheoccupationalhealthandsafetyplan.TheQuebecEmployersCouncilinterventionledthenewLabourMinistertorequesttheministry’scivilservantstoreworkthedraftbill,whichmanydeemedtobediscriminatory.
InOctober,theQuebecEmployersCouncilandtheFédérationdeschambresdecommerceduQuébecjointlysubmittedtothestudygroupchargedwithmakingrecommendationsonQuebec’soccupationalhealthandsafetyplanthereportbyemployerrepresentativesprovidingadetailedaccountofproblemsnotedinhowthecurrentsystemworks.Thedocument,producedincollaborationwithaconsultationcommitteecomprisedof40employerassociationrepresentativesandcompaniesfromdiverseeconomicsectors,issued40recommendationsaimedatmakingtheplanmoreefficientandlesscostly,whileenhancingitsobjectivesintheareaofoccupationalinjuryprevention.

Modernizing the Labour Code –TheQuebecEmployersCouncilwasanenthusiasticparticipantinthedebateonmodernizingtheLabourprovisionsregardingreplacementworkers.InseveralpressreleasesandinalettertotheLabourMinister,theQuebecEmployersCouncilurgedthegovernmentnottocreateanevengreaterimbalanceinfavouroftheunionsbyrestrictingemployers’rightstoresorttoalock-out.
Labour relations in the construction industry–In2010,theQuebecEmployersCouncilconductedaseriesofconsultationsandmeetingstobringconstructionentrepreneursandjobproviderstogetherinanefforttoreachacommonpositiononsomeofthelabourrelationsissuesintheconstructionindustry,includingcertainunproductivebonusesintheheavymachineryindustryandtheissueofunionplacementofthelabourforce.Fromthedialoguebetweenthevariousemployerrepresentatives,theAssociationdelaconstructionduQuébecnotablyobtainedtheeliminationofthepresentationbonusinthissector,incontract-renewalnegotiationsintheconstructionindustryinlatesummer.

Studies and documents
InAugust,theQuebecEmployersCouncilreleasedthefirsteditionofitsReport Card on Quebec Prosperity,anewinstrumentthatcomparesQuebec’sperformancetothatofotherCanadianprovincesandotherOrganizationforEconomicCooperationandDevelopment(OECD)countriesintermsofwealthcreationandprosperity.Publicationofthedocumentarousedconsiderablereactionandthepressconferenceannouncingthereleaseofthestudygeneratedextensivecoverageintheelectronicandprintmediaandonnews-orientedwebsites.
InOctober,theEmployersCouncilpublisheditsSpecial Report on 2010 Salary Forecasts,producedincollaborationwiththetophumanresourcesconsultingfirmsinQuebec(AonConseil,Mercer–Consultationenressourceshumaines,MorneauSobeco,TowersWatson).Morethan120humanresourcesmanagersandprofessionalsfromindustryassociationsandbusinessesofeverysizeattendedthelaunchofthedocument.
InMay,theQuebecEmployersCouncilpublishedtheresultsofasurvey among businesses on the quality of training initiatives certificate.ThesurveywasconductedwiththesupportoftheCommissiondespartenairesdumarchédutravailanditpolled48businesses.ItdealtwiththeRegulation respecting the exemption applicable to the holder of a training initiatives quality certificate,aregulationexemptingemployersthathavereceivedatraininginitiativesqualitycertificatefromtheAct to promote workforce skills development and recognition(orthe1%law).EmployersandlabourrepresentativesbothexpressedsatisfactionwiththeregulationandrecommendedtoQuebecbusinesseswhichmettheconditionsofeligibilitythattheymaketherequest.
InFebruary,theQuebecEmployersCouncilpublishedtheresultsofapublicopinionpolltheLégerMarketingfirmconductedamong350businessleaderstoassesstheirviewsaboutQuebec’spublicpoliciesandsomeoftheissuesrelatedtobusinesses.
InDecember,theQuebecEmployersCouncilreleasedtheresultsofasurveyconductedamong500universitystudentsontheirfinancialsituationandtheiropiniononsomeofthemeasurestoaddresstheproblemofuniversityfunding.Theresultshelpedtoputthecostofpost-secondaryeducationinQuebecintocontext.
Themaincommunicationtoolwithitsmembers,theQuebecEmployersCouncilpublished11issuesofitsInfoCPQnewsletterin2010(alongwithaspecialeditiononQuebec’soccupationalhealthandsafetyplan).Eachmonth,thenewslettercontainedasummaryoftheQuebecEmployersCouncil’sstanceonissuesand,ifapplicable,thelegislativeamendmentsorregulationsobtainedfollowingitsrepresentations.Asummaryofthemediacoverageextendedtoeachoftheinterventionswasalsoprovided.InfoCPQisoneofthemostwidelyreaddocumentsontheQuebecEmployersCouncilwebsite.

Le mot du présidentSanté et sécurité du travail : une réforme du régime s'impose
Le conseil d'administration de la Commission de la santé et de la sécurité du travail (CSST) a mandaté en mai 2009 un groupe de travail ayant pour mandat de lui faire des recommandations sur les mécanismes de prévention prévus par la Loi sur la santé et la sécurité du travail (LSST) et tout autre volet du régime de santé et de sécurité du travail.
Le Conseil du patronat du Québec (CPQ) conjointement avec la Fédération des chambres de commerce du Québec (FCCQ) a mis sur pied un comité consultatif chargé d'assurer la coordination des demandes patronales provenant de tous les secteurs d'activité économique afin de faire valoir les préoccupations des employeurs auprès du groupe de travail présidé par monsieur Viateur Camiré.
Vous trouverez dans les pages suivantes un résumé des grandes problématiques étudiées par le comité patronal ainsi qu'une liste complète des recommandations qu'il a faites dans son mémoire soumis au groupe de travail Camiré. Rappelons que ce comité représente plus de 72 000 employeurs issus des domaines privé, public et péripublic avec une masse salariale de plus de 45 milliards.

Bilan de 30 années en santé et sécurité
Depuis les 30 dernières années, les milieux de travail ont évolué en matière de gestion de la santé et de la sécurité du travail. L'avènement d'une tarification plus réactive ainsi que l'arrivée des mutuelles de prévention ont contribué notamment à hausser de
façon importante le niveau de la prise en charge de la santé et de la sécurité du travail par les milieux.
De 1999 à 2008, on a assisté à une baisse constante de la fréquence des accidents et des décès par accident, mais, étonnamment, les coûts des indemnités de remplacement du revenu (IRR) ont connu une hausse importante
pendant la même période. Ainsi, alors que la masse salariale a augmenté de 19 %, le nombre de cas indemnisés en IRR a baissé de 29 %. Quand on compare le nombre d'IRR par chaque million de salaire ajusté, la baisse est encore plus spectaculaire et se situe à 41 %.
Notons que la baisse du nombre de lésions se constate quel que soit le secteur d'activité, groupes prioritaires ou non.
En matière de décès résultant d'un accident du travail, le nombre de cas a aussi diminué considérablement, passant de 200 en 1989 à moins de 100 en 2008. Par 100 000 travailleurs, la baisse est de l'ordre de 65 %. Ce taux est inférieur à celui observé en Ontario et en Colombie-Britannique.
Par contre, les coûts des IRR pour les absences de court terme et long terme ont fortement augmenté. Le coût moyen (ajusté) d'une IRR représente unehausse de 69 % alors qu'en Alberta et en Colombie-Britannique on constate, pour la même période, une baisse significative. Il en coûte 20 % de plus au Québec qu'en Ontario au chapitre des accidents du travail lorsqu'on compare les dépenses des programmes de ces deux provinces.

Training and information sessions With the responsibility for training the 87 members of the Commission des lésions professionnelles (CLP) representing Quebec employers on that body, the Quebec Employers Council organized two two-day training sessions for them, in Quebec City and Montreal, respectively, in June and December. Labour relations in the construction industry
Throughouttheyear,theQuebecEmployersCouncilheldaseriesofmeetingstobringtheconstructionentrepreneursandjobprovidersclosertogetherinworkingtowardcommonpositionsintheindustry’slabourrelations,particularlyontheissueofunionplacementofthelabourforce.
Changes to laws and regulations
Tokeepemployerswellinformedabouttheirnewobligationswhenregulatoryorlegislativechangesoccur,theQuebecEmployersCouncilregularlyorganizesinformationsessionsforthem,particularlyonoccupationalhealthandsafetymatters.
Colloquium on CSST inspection
InMay,morethan150participants,inMontrealandQuebecCity,attendedthecolloquiumtheQuebecEmployersCouncilorganized,incollaborationwiththeCSSTandOgilvyRenault.NormandPaulin,DirectorGeneralPrevention-Inspectionandthepartnership,andJeanLajeunesse,RegionalDirectorMontréal-1totheCSST,presentedtheprovisionsplannedinBill35,particularlytheoneaimedatincreasingthefinesforinfractions.Thecolloquiumwasprecededbyaluncheon-conferenceatwhichClaudePlamondon,SeniorVice-PresidentofAonConseil,spokeonthetopic“CSST–Fundingandaverageratefor2011”.
Colloquium on the occupational health and safety plan
InNovember,morethan100participantswereonhandinMontrealforthecolloquiumonQuebec’soccupationalhealthandsafetyplanorganizedbytheQuebecEmployersCouncil,incollaborationwithOgilvyRenault.DanielDenis,apartneratSECOR,presentedthestudyhisfirmconductedontheplanfortheCSST,andBernardCliche(LangloisKronströmDesjardins),ClaudePlamondon(AonConseil)andGillesRousseau(Metro)providedanaccountofthereportpreparedbytheemployerssideandsubmittedtothegroupeCamiré.AndréBeaucheminandBrunoLabrecque,oftheCSST,alsodeliveredtheexclusiveannouncementaboutthenewmethodofinsurancepremiumpaymentstotheCSST.

Dynamic and constructive communicationWhetheritwasthroughitsfrequentandgrowingpresenceinthemediaoritsnewwebsite,unveiledinJune,theQuebecEmployersCouncil,in2010,effectivelycreatedmorepublicawarenessthaneverabouttheemployers’needsandconcerns.Theexpertiseofourspokespeoplealsoprovidedtheemployerswithastrongvoicetopromotetheirviewpointinmanyofthemorespecializedforumswhereitisimportantthatyoubeheard.And,byholdinganumberofhigh-profileevents,theQuebecEmployersCouncilwasabletoprovideitsmemberswithuniquenetworkingopportunities.
Inkeepingwithitsdesiretomaintainacontemporaryanddynamicimage,theQuebecEmployersCouncilgaveitselfanicemakeoverontheWebwithabrandnewsite(www.cpq.qc.ca)thathasanimproveddesignandnewfeatures.Modern,interactiveandfilledwithoriginalcontent,itallowsuserstoaccessawealthofdocumentsandinformation.Barelysevenmonthsafteritwasputonline,thestatisticsonthenumberofhitsforthewebsiteareimpressive:morethan20,000Internetusersvisitedmorethan50,000pagesbetweenJuneandDecember.
2010alsomarkedtheQuebecEmployersCouncil’sdebutonsocialmedia(Facebook,Twitter,LinkedInandYouTube).Distributingtheorganization’sinterventionsonthesenewplatformsallowsittoreachalargeraudienceinaquicker,interactivefashion;morethan1,000InternetusersfollowtheQuebecEmployersCouncil’sactivitiesinrealtimeonthesenetworks.
The Employers Council in the media: public interventions that are harder-hitting than everOne thousand seven hundred (1,700) articles and reports –TheQuebecEmployersCouncil’spositiononissueswasreportedinmorethan1,700articlesandnewsreportsbymediaoutletsin2010,anincreaseofabout140%over2009.Accordingtoanindependentassessment,thiscoveragehadapublicrelationsvalueofmorethan$15millionoverthetotalvalueobtainedin2009.
Seventy-seven (77) public interventions –Thisvisibilityistheresultof77publicinterventionsthroughouttheyear:59bymeansofapressreleaseand18intheformofopinionletters.

InFebruary,morethan150businessandassociationsectorrepresentativestookpartindevelopingtheareasofinterventionoftheQuebecEmployersCouncil’s2010-2013platform.Thebusiness-communityrepresentativesexchangedideas,discussedandadvocatedtheirpointofviewatsixworkshops,setupinconjunctionwithaone-dayforum.Thethemeoftheforumwas:“AUser’sGuidetotheRecovery–Emergingfromtherecession,howdoweprovideQuebecwiththebestpossibleconditionstosustainprosperityinaglobalcompetivenesscontext?”Inadditiontotheworkshops,participantslistenedtothreeprominentguestspeakers:QuebecFinanceMinisterRaymondBachand,RobertGagné,directoroftheCentresurlaproductivitéetlaprospéritéandprofesseurtitulaireàl’Institutd’économieappliquéedeHECMontréal,andAlainDubuc,acolumnistatLa Presse.
