1.2 GENERAL INFORMATION

The Brighton District Cricket Club (BDCC) was formed in July 2006 and is the amalgamation between Brighton East (BECC) and Brighton Central Cricket (BCCC) clubs.

Both clubs have long and established proud histories, however in 2005 they decided to take part in a 'trial merger' for the 2005/06 season.

The trial proved successful and in July 2006, the members of the two clubs voted to officially merge and become the "Brighton District Cricket Club".

The Brighton District Cricket Club offers something to you that very few local cricket clubs can. The Brighton District Cricket Club field teams for all players Men's, Women's and juniors, ALL abilities. We offer Junior Boys, U12, U14 and U16, and a new Junior Girls team is underway. For the younger ones, we offer In2Cricket (5 to 7 yrs old) and T20 Blast (7 to 9 yrs old).

1.3 FACILITIES

The Brighton District Cricket Club fields teams in both turf and synthetic competitions. There are three (3) turf and three (3) synthetic wickets at Dendy Park which are occupied and maintained by the Brighton District Cricket Club.

Training Facilities are also at Dendy Park and consists of five (5) training nets (synthetic) for its senior and junior teams.

The Brighton District Cricket Club utilises the ‘West’ Pavilion (former home of Brighton Central CC) for its social functions and major events / matches. The Brighton District Cricket Club also has access to ‘East’ Jamieson Pavilion for match days.

The Brighton District Cricket Club Canteen is open all training sessions and game days. Beverages are served as per the listed guidelines of the Brighton District Cricket Club Liquor License. Light Meals, Snacks, Merchandise and club attire is also available at the Canteen.

1.7 TRAINING SESSIONS ATTENDANCE

Attendance and performance at practice and training sessions will come into consideration at all Team selections. If any member or social player is unable to practice at the designated times the Chair person of Selectors (COS) or a member of the selection committee is to be advised.

PRACTICE REQUIREMENTS Practice is facilitated by the delegated Brighton District Cricket Club Training Captain or delegated Brighton District Cricket Club Coach.

Official Brighton District Cricket Club training attire is to be worn at all times. Official training attire consists of the BDCC white training shirt and BDCC navy blue training shorts. New members or social players appropriate cricket attire is required to be worn for practice which includes at minimum a white shirt. Smoking and drinking of alcohol is not appropriate during training sessions. All members and social players are expected to assist with the packing up and putting away of practice gear. PRE SEASON TRAINING Pre-season training and times varies each season. Preseason sessions, locations and times will be communicated via social media mediums (Facebook and Twitter),

EQUIPMENT

The Brighton District Cricket Club has used cricket equipment available for lower Men’s and Women’s Senior and Junior grades. However the Brighton District Cricket Club strongly recommends and encourages that all members and social players provide their own individual equipment.

1.8 ANNUAL MEMBERSHIP FEES

The amount of the annual membership subscription to be paid by club members is listed below and is due for payment by the completion of Round Four (4) every season.

Members over the age of sixteen (16), as of the current cricket season, who attend school or a tertiary educational institution as full-time students shall be liable to pay annual subscriptions and weekly levies on the same basis as players under the age of sixteen years playing in senior competition.

The general committee may direct the Chair person of Selectors and the selection committee not to select un-financial members. For the framework and guidelines regarding Team Selections refer to the Brighton District Cricket Club Constitution provided.

Life Members are not liable to pay annual membership subscription but must pay appropriate weekly levies if they participate in any club match in any season. Finally be advised individuals who participate in a five (5) or more designated BDCC matches must commit financially to the relevant and applicable annual BDCC membership. Additionally these members who financially commit will be entitled to participate in finals matches, where appropriate if selected, and will be considered for nomination for official BDCC Awards and trophies.

1.10 BRIGHTON DISTRICT CRICKET CLUB MATCH DAY REQUIREMENTS DRESS

Only official Brighton District Cricket Club Baseball caps, Baggy Blue Caps or plain white wide brimmed hats are to be worn. All official club caps can be purchased from the Brighton District Cricket Club merchandise representative. All caps are to be worn appropriately, not sideways or backwards. Batting helmets are to be navy blue. Brighton District Cricket Club shirts with the B.D.C.C logo are to be worn and can be purchased from the Brighton District Cricket Club merchandise representative. If wearing jumpers with coloured trim, the trim must be in the Brighton District Cricket Club colours navy blue. Trousers and Shoes must be predominantly white. TIMES & ATTENDANCE All members and social players are to ensure they are at their playing venue and ready to play at least 1 hour and prior to starting time. If a member or social player cannot attend by the required time or is delayed the player must contact the team captain. Members and social players must report to the match ground in the event of inclement weather and all players will be advised and contacted if matches are abandoned by the Team captain or chair person of selectors (COS). In the event of a player having to withdraw after Thursday team selection the player must contact and advise the Chair person of Selectors (COS) and team captain and advise of the reason for withdrawal. Members who fail to turn up on any day of a match will be referred to the general committee for discussion. MEMBER AND SOCIAL PLAYER EXPECTATIONS

All members, social players, officials, parents and supporters are expected to abide by the Spirit of Cricket. Reported players may be penalised by the general committee or executive in addition to any imposed by the South East Cricket Association (S.E.C.A), Cricket South East Bayside (CSEB) or Cricket Victoria (CV)

The delegated and nominated team captain sets the direction on match day and all players are to support the captains’ decisions. Players may be required to assist with transport, preparation of ground, scoring, umpiring and packing up of gear.

1.11 BRIGHTON DISTRICT CRICKET CLUB CONSTITUTION Current Version July 2012

1. NAME

The Club shall be named the BRIGHTON DISTRICT CRICKET CLUB Incorporated; hereinafter referred to as “the Club”.

2. CLUB COLOURS

The colours of the Club shall be navy blue and white. 3. OBJECTIVES

The objectives of the Club shall be to: 3.1 Promote the game of cricket within the community 3.2 offer competitive opportunities, training and coaching in cricket for members of all

ages 3.3 foster a better acquaintance and social spirit amongst the members in a non-

sectarian and non-political environment 3.4 become a member of and co-operate with any Association(s) whose objects are

altogether or in part similar to those of the Club. 4. MEMBERSHIP 4.1 A financial member of the Club shall be defined as those persons who, having

applied, have been duly admitted by the Committee and who have paid the relevant Club membership fees.

4.2 Membership shall be renewable annually and shall be paid in full by the end of the third round of scheduled matches in each season. Membership shall remain valid until 31st October in the following year with full retention of all entitlements including voting rights.

4.3 Any member who ceases to be a member of the Club whether by resignation or in any other manner whatsoever shall forfeit all rights and claims upon the Club and its property, assets and funds

4.4 There shall be four categories of membership available as follows: 4.5 Senior Member:

A person who has attained the age of seventeen years, by the first day of October in the current cricket season and who is otherwise not eligible for any other category of membership

4.6 Life Member: 4.6.1 All Life Members of the former entities (Brighton East and Brighton Central

Cricket Clubs) shall be deemed to be Life Members of the club. 4.6.2 A person who has been duly elected as a Life Member having satisfied the

procedure and criteria as defined herein: 4.6.3 The Committee shall have the power to recommend to the Annual General

Meeting the election of one or more Life Members each year, providing that any such recommendation shall be approved by at least a two-thirds majority of the full Committee

4.6.4 Any financial Club member may submit to the Committee a nomination for

Life Membership of a current or former member provided that such nomination shall be in writing and shall be received by the Honorary Secretary not less than one month before the Annual General Meeting.

4.6.5 Only those members who have given at least ten years of particular meritorious service to the Club shall be eligible for nomination. Previous service from either of the BECC or BCCC entities shall be included.

4.6.6 Life Members shall have all rights and privileges of senior members of the Club. 4.6.7 Life Members are not liable to pay annual membership subscription but must pay

appropriate weekly levies if they participate in any club match in any season. 4.6.8 The award of Life Membership shall be known as the ‘Stan Kennedy Medal’. 4.7 Junior Member:

A person, who is under the age of seventeen, as of the first day of October of the current cricket season, or who is otherwise eligible to participate as a Club representative in any cricket competition classified as juniors’ competition.

4.8 Social Member: A person who is not a regular player for the Club, may, at the discretion of the Committee, be admitted as a social member.

4.9 Either or both of the parents or guardians of a current junior member, may at their request, be considered by the Committee for admission as honorary Social Members for the current cricket season.

5. EXECUTIVE OFFICERS:

The Officers of the Club, collectively titled “the Executive”, shall be: President Senior Vice-President Vice-Presidents x 2 Honorary Secretary Honorary Treasurer

5.1 Wherever this Constitution empowers the Executive to make a decision, a majority of the full Executive shall be sufficient for an affirmative vote. The quorum required for such meetings of the Executive shall be (4).

1. THE GENERAL COMMITTEE:

6.1 The General Committee hereinafter referred to as “the Committee” shall consist

of the Officers of the Club and up to 9 other Club members, at least one of whom shall represent the Junior Section. At the discretion of the Executive, further members may be elected to the General Committee.

6.2 The President or other members of the Executive may assign members of the Committee to any particular area(s) of responsibility, at any time, as deemed appropriate.

6.3 The Committee shall meet at agreed intervals and not less than (6) times per year.

6.4 Not less than seven days advance notice shall be given to all members for all Committee meetings. Such notice shall include a summary of any special items of business for such meeting.

6.5 The quorum required for all Committee meetings shall be (8) members which must include at least 1 of either the President, Senior Vice-President or 1 of the Vice-Presidents. Should no quorum be present within 30 minutes of the advertised starting time of the meeting, such meeting will lapse.

6.6 All meetings shall be presided over by the President as Chairperson, or in their absence, the senior Vice President, or in their absence, one of the Vice-Presidents.

6.7 Any member absenting himself/herself from two consecutive meetings with or without apologies, shall, in the absence of satisfactory reason being furnished to the Committee, forfeit his/her membership of the Committee.

6.8 Each Committee member present at a Committee meeting shall be entitled to one vote except the President/Chairperson. Voting on motions at Committee meetings shall be by show of hands, except for decisions directly involving a member/s of the Committee, when a ballot may be held. A member of the Committee may request the President/Chairperson that a ballot be held in consideration of any motion brought before the Committee. The President’s/Chairperson’s ruling in this regard shall be final and binding. A vote shall be by simple majority except in the case of Life Membership and Committee Honorariums.

6.9 The President/Chairperson shall not vote on any motion except where a vote is tied. The Chairman shall then exercise a casting vote.

6.10 Any motion brought to the notice of the meeting shall be explained in full by the mover of such motion, but it shall not be then discussed until such motion is seconded. If no seconder comes forward such motion shall automatically lapse.

6.11 Every motion, once seconded, may be discussed, but each member shall be allowed to speak only once on each motion, except the mover of the motion, who shall be allowed to speak again before the motion is put to vote in order that they may answer any queries raised.

6.12 Committee members wishing to speak on any motion may only do so with the permission of the President/Chairperson. The President/Chairperson shall direct that a member speaking in favour of a motion shall speak immediately after a member speaking against such a motion. Discussion on any motion shall cease when no more members wish to speak for or against such motion.

6.13 All meetings of the Committee shall be conducted according to the generally accepted tenets of appropriate conduct of meetings.

6.14 The Secretary or their nominated representative shall keep complete minutes and records of all proceedings at all meetings held by the Committee. Minutes shall be circulated to all Committee members not later than 1 week prior to the next Committee meeting.

6.15 Honorariums may be paid to any Executive officer of the Club or any other person should a two-thirds majority of the full committee so decide.

6.16 So far as approved by the Committee and as may be permitted by law, every member of any committee of the Club shall be entitled to be indemnified by the Club against all costs, charges, losses, expenses and liabilities incurred by him or her in the proper discharge of their duties or exercise of their powers

6.17 An Auditor shall be elected annually. The position of auditor does not carry the right of committee membership and it may be filled by any member already elected to any position on the committee.

1.2 SUB-COMMITTEES

The Committee shall have the power to appoint a sub-committee for any desired purpose and delegate powers and responsibilities to such subcommittee. Members of such sub-committee may or may not be members of the General Committee.

2. MANAGEMENT

The club shall be under the management and control of the committee whose decisions shall be final and binding in all matters appertaining to the affairs of the club.

7.1 The following rules will apply to the sale and consumption of liquor, in accordance with Schedule 1 of the Liquor Control Act 1987:

7.1.1 A visitor to the club must not be supplied with liquor in the club premises unless he/she has signed the visitor’s book as an invited guest of a financial member.

7.1.2 A person shall not be admitted as an honorary or temporary member of the Club, or; for membership of the Club

7.1.3 A person shall not be exempted from the obligation to pay the ordinary subscription for membership of the Club; unless the person is of a class as specified in the rules and the admission or exemption is in accordance with the rules.

7.1.4 A register of visitors shall be kept by the Club. 3. ELECTION OF EXECUTIVE AND COMMITTEE MEMBERS:

8.1 All Committee members (including the Executive) shall be elected at the

Annual General Meeting. Nominations for all Executive and General Committee positions shall be in writing. Nominations shall be signed and seconded by two senior financial members of the Club and signed by the nominee who shall also be a senior financial member. Nominations should be received by the Honorary Secretary prior to the Annual General Meeting, however, may be accepted at the Annual General Meeting, at the discretion of the Executive.

8.2 Where there is more than one candidate for any position, a ballot will be conducted. Each member present is entitled to one vote. In the event of a tie, the Chairperson shall have a casting vote. There is no entitlement to postal or proxy votes. Counting of votes shall be carried out by the President and the Hon. Secretary. The result shall be determined by simple majority.

8.3 Should a new President be elected, then that new President shall immediately assume the Chair and proceed with carrying out the election of the remaining Committee positions.

8.4 Only Life Members, financial senior members and social members are eligible to vote at Annual General Meetings.

8.5 Should no nominations for a position be received at the Annual General Meeting, such vacancy shall be filled subsequently, by appointment, by the new Committee.

8.6 All elected members of the Executive/Committee are elected for a period of one year, or until the next Annual General meeting, but may offer themselves for re-election at the Annual General Meeting.

8.7 Should any position become vacant during the year, such casual vacancy may be filled at a meeting of the Committee for any duration, and by any number of separate persons, up to the holding of the next Annual General Meeting.

8.8 In the event of a temporary inability to serve on the Committee, the Committee may appoint either, one of the existing Committee members to serve in a dual capacity or any general Club member as the Committee sees fit.

10. POWERS AND DUTIES OF THE COMMITTEE 10.1 The Committee shall have the duty to control the affairs of the Club on behalf of

the members. 10.2 The Committee shall have the power to make rules in order to implement all parts

of this Constitution and to settle any disputed points not otherwise provided by this Constitution. The Committee may amend and enforce such rules as it deems necessary for the proper operation of the Club.

10.3 The Honorary Secretary shall have power to transact Club related business and shall report same at the next subsequent Committee or General Meeting.

10.4 The Committee shall have the power to delegate any duty or responsibility to any member of the Committee, and such member shall then be responsible to the Committee for its proper execution.

10.5 The Honorary Secretary may delegate any of their duties to the Honorary Assistant Secretary.

10.6 The Committee shall have the duty to keep accurate accounts of the finances of the Club.

10.7 Audited Statements of Income and Expenditure for the year ended 31st May each year shall be submitted for adoption at each Annual General Meeting.

10.8 The Honorary Treasurer shall receive all moneys on behalf of the Club, which shall be paid within seven days into an account at the Club’s bank, the account to be named the Brighton District Cricket Club, General Account.

10.9 A further account named Brighton district Bar/Social Account shall be maintained with the clubs nominated bank for the purpose of receiving all moneys received in respect of social functions and refreshment takings respectively

10.10 The Bar Manager to be appointed by the Committee and the Social Chairperson shall be responsible for the proper recording of all such moneys and the accounts shall be reconciled at least twice each season, or as directed by the Treasurer, no later than the 31st December and cleared by the 30th May and the balance transferred to the General Account.

10.11 The Treasurer, the Bar Manager or the Social Chairperson shall provide a written report as to the current financial position under their control to each Committee Meeting

10.12 The Committee shall have the discretion to direct the Treasurer to open or change any bank account, as they deem fit.

10.13 At least one of the following office bearers; President, Treasurer or Secretary and one other member of the committee shall sign all cheques drawn on behalf of the Club, or transfers in the name of the Club.

10.14 The Honorary Treasurer shall pay from the General Account all accounts approved for payment by the Executive.

10.15 The Committee shall have the power to delegate authority to a representative of each team to collect moneys from the players in that team. The Honorary Secretary and the Honorary Assistant Secretary shall also have the power to collect moneys and pass same on to the Honorary Treasurer.

10.16 The Committee is empowered to borrow moneys on behalf of the Club and to enter into any financial arrangement it considers necessary and appropriate provided no moneys may be borrowed unless ratified at a Special General Meeting or an Annual General Meeting.

10.17 Financial arrangements other than the borrowing of moneys shall require two-thirds majority of the full committee.

11. ANNUAL GENERAL MEETINGS 11.1 The Annual General Meeting of the Club shall be held no later than the 30

th day

of June each year. A “Notice of Annual General Meeting” (including the formal Agenda for the meeting) shall be given not less than fourteen days in advance, to each Life Member and each financial senior and social member.

11.2 At the Annual General Meeting, the order of business shall be to: 11.2.1 Confirm the minutes of the previous Annual General Meeting and any other

Special meetings and then to receive the following reports: Executive Report Treasurer’s Report Auditor’s Report Delegates Reports Election of Executive/General Committee Election of Life Members (if any recommended) Set Annual Subscription Fees Election of Club Auditor (who may also be a Committee member) Transact such other business as formally advised in the “Notice of Annual General Meeting” Such other business as by common consent of the meeting the President/ Chairperson in his/her discretion permits.

11.3 Special General Meetings 11.3.1 A Special General Meeting of the Club shall be called by the Honorary

Secretary within seven days of receiving a written requisition signed by not less than fifteen financial senior members stating the business of such meeting

11.3.2 The Honorary Secretary shall send out a “Notice of Special General Meeting” stating the business of such meeting to all Life Members and financial senior members which shall be held not less than seven days or more than twenty-one days after the posting of such notice

11.3.3 At the Special General Meeting, the only order of business shall be the notice of motion.

11.4 The quorum required for an Annual General/Special General Meetings shall be twenty (20) financial senior members. Should no quorum be present within 30 minutes of the advertised staring time of the meeting, such meeting will lapse.

11.5 The President shall preside as Chairperson at all Annual General/Special General Meetings at which he/she is present; and in their absence, the Senior Vice President; or in their absence, such other senior office holder as elected by the meeting

11.6 No person who is not a financial member of the Club will be entitled to be present at a Annual General/Special General Meeting unless invited by the Chairperson and subject to approval by a majority of members present should any member require this.

11.7 No person shall be entitled to vote at any Annual General/Special General Meeting unless that person is a financial member.

11.8 Any abstention from voting at an Annual General/Special General Meeting shall be recorded but shall not count as a vote.

11.9 Proxies/postal votes shall not be recognized at any Annual General/Special General Meeting.

11.10 Every resolution passed at any Annual General/Special General Meeting will be binding on all members of the Club whether the members were present at such meeting or not.

Meeting shall be entitled to one vote only, except the Chairperson, who shall have only a casting vote in the event of a tied vote in relation to any motion.

11.12 The new cricket season shall be deemed to commence at the Annual General Meeting of each year.

12. SUBSCRIPTIONS 12.1 The amount of the annual membership subscription to be paid by club members,

to apply for the following season shall be set at the Annual General Meeting. 12.2 If a new player commences play during the season, a pro-rata subscription may

be permitted at the discretion of the committee. 12.3 Weekly subscriptions to be paid by each member on each day on which play is

scheduled, shall be fixed by the Committee. 12.4 Players over the age of sixteen, as of the current cricket season, who attend

school or a tertiary educational institution as full-time students shall be liable to pay annual subscriptions and weekly levies on the same basis as players under the age of sixteen years playing in senior competition.

12.5 The Executive shall have discretion to waive membership and weekly levies. 13. COACHING 13.1 The Committee shall have discretion to appoint coaching staff to any section of

the club. 13.2 The coaching staff may be playing or non-playing. 13.3 The coaching staff shall at all times be under the jurisdiction of the

Committee in all matters concerned with club affairs. 13.4 The coaching staff may be paid a suitable honorarium at the discretion of the

Committee. 13.5 The coaching staff need not be appointed to the captaincy of any team/s. 13.6 The coaching staff do not become members of the Committee, but may be

elected to the Committee in any capacity without jeopardising their appointment as coach/s.

13.7 Coaching staff positions shall be advertised prior to each new season and therefore the election of any coach shall be for the duration of one season only.

14. ELECTION OF CAPTAINS AND VICE-CAPTAINS

The captain and vice-captain of each senior team shall be elected/appointed by the Committee prior to the commencement of each season. Any casual vacancies shall also be also be elected/appointed by the Committee.

15. AWARDS AND TROPHIES 15.1 The Club shall provide awards and trophies in accordance with Appendix 1

(Article 30) 15.2 The Committee shall be empowered to institute new awards and/or trophies

when and as it deems fit. 15.3 The Committee shall have the power to alter the requirement and or criteria of

any award or trophy as documented in Appendix 1 Article 30, other than the award style or name.

15.4 Only current financial members of the Club shall be entitled to receive awards.

16. SELECTION COMMITTEE 16.1 The Committee shall have the power to appoint a Men’s’ and/or Women’s’

Selection Committee/s

The selection committee/s shall consist of;

A selection chairperson/s appointed by the Committee. The captain of the 1st XI The captain of the 2nd XI The club coach if they do not otherwise hold any of the other selection Committee positions

16.2 Should the Chairperson be unable to attend a particular meeting of the selection

committee, an acting Chairperson shall be appointed by the Executive. 16.3 Should any of the said captains be unable to attend a particular meeting of the

selection committee, their place shall be taken by the team’s vice captain or in the event of the vice-captain also being unable to attend, a senior player appointed by the Executive.

16.4 The senior teams shall be selected by the following persons; 16.4.1 1st XI - the selection committee 16.4.2 2nd XI - the selection committee together with the captain of the 3rd XI. 16.4.3 3rd XI - the selection committee together with the captains of the 3rd XI and the 4th

XI. 16.4.4 4th XI - the selection committee together with the captains of the 4th XI and the 5th

XI. 16.4.5 5th XI - the selection committee together with the captains of the 5th XI and 6th XI 16.4.6 6th XI and any subsequent XIs - the selection committee together with the

captain of that XI 16.5 Each eligible person present at the selection of a particular XI shall have the right

to one vote except in the case of an even number of votes when the Chairperson shall have an additional casting vote.

16.6 The selection committee shall have the sole right to select any player in one team and their decision shall be binding on the Club. In matters of Club policy, however, the Committee shall have the right to advise and direct the selection committee.

17. JUNIOR SECTION 17.1 The Junior Committee is to operate under the umbrella of the General

Committee to provide a focus for the operations of the junior section of the club The Junior Committee will reduce the workload of the General Committee and provide a response facility to service the requirements of junior members, team managers and coaches.

17.2 All office-bearers are to be appointed by the General Committee and shall comprise a Chairperson, a Secretary-Treasurer, junior coach and a representative from each junior team.

17.3 The Junior Committee shall exercise control of the junior section of the club subject to a mandate determined by the General Committee. Such a mandate would generally include the power to collect subscriptions, determine coaching arrangements, appointment of captains and team managers, team selections, registrations, organise equipment, arrange fund-raising and social functions and

any other matters relevant to the junior section of the club which the General Committee may from time to time delegate.

17.4 Matters which shall not be delegated to the Junior Committee unless by explicit decision of the General Committee include:

17.4.1 Determination of the number of underage teams; 17.4.2 Appointment of junior coach; 17.4.3 Suspension of players for misconduct; 17.4.4 Clearances. 17.5 A quorum for meetings will be three members including the Chairperson or in

their absence, the Secretary-Treasurer. The junior committee shall meet at least once a month during the cricket season. A report on each junior committee meeting shall be presented at the next appropriate General Committee meeting.

17.6 The Junior committee will operate its own account for the convenience of the Secretary-Treasurer. Such account must be capable of being drawn upon by the Treasurer of the General Committee who must receive regular bank statements and information as to the financial position of the Junior Committee. Expenditure from the account must only be in accordance with the mandate established by the General Committee.

17.7 The junior coach will be appointed for a period of one year and shall determine the policy to be pursued in regard to coaching of juniors. They should seek assistance from the junior and General Committees as they see fit.

17.8 Selection of teams in the junior section will be by the team managers and the junior coach with the junior coach having a casting vote, where necessary.

17.9 Discipline of members must be carried out only with the sanction of the General Committee.

17.10 Juniors will receive trophies and awards as determined by the General Committee; notwithstanding that the Committee shall have the power to alter the requirement and or criteria of any award or trophy as documented other than the award style or name.

18. DISCIPLINE OF MEMBERS 18.1 All complaints regarding the behaviour of members must be submitted in writing

to the Committee. 18.2 The Committee shall meet to hear and investigate complaints to determine their

validity within 14 days of a complaint being lodged. 18.3 Should it be deemed expedient and in the best interests of the club, any player or

other member may be expelled, removed from Office, suspended, fined or censured by the Committee.

18.4 The outcome of the disciplinary hearing shall be notified in writing to the person who lodged the complaint and the member against whom the complaint was made within 14 days of the hearing.

18.5 Any person disqualified and/or suspended by any other cricket competition shall be ineligible to play with the Club during the period of his/her suspension and/or disqualification.

19. OPERATION OF, AMENDMENTS TO, AND INTERPRETATIONS OF, THE

CONSTITUTION 19.1 The Constitution and any rules made under the powers of the Constitution and

every decision of any Committee of the Club shall be jointly and severally binding on the Club and on every member of the Club.

19.2 This Constitution shall not be altered or amended except at an Annual General Meeting or at a Special General Meeting called for that specific purpose.

19.3 Any proposed amendment to the Constitution to be considered at the Annual General Meeting shall be in writing and proposed by a Senior Member of the Club and seconded by another Senior Member of the Club and shall be received by the Honorary Secretary by the 10th day of May prior to such meeting.

19.4 Such proposed alteration(s) shall only be passed if supported by two thirds of those financial members present at the meeting and voting. Any abstention shall be recorded but shall not count as a vote.

19.5 Any dispute concerning the interpretation or application of the Constitution shall be referred to the Committee, whose ruling shall be final and binding. However, should a dispute arise in the course of an Annual General Meeting or a Special General Meeting, the Chairperson's ruling shall be final and binding

20.

A resolution to dissolve the Club can only be passed at an Annual General Meeting or a Special Meeting convened for the purpose by a two-thirds majority vote. In the event of dissolution, the Club’s assets, after discharging all debts and liabilities, shall not be distributed amongst the members, but shall instead be distributed to any not-for-profit organization with community values similar to those of the Club as the Committee at that time directs.

MEMBERS AND TEAMS CODE OF BEHAVIOUR

All members are representatives and ambassadors of the Brighton District Cricket Club. All people involved in the game of cricket have a right to participate in a safe and supportive environment. Overzealous spectators, opinionated players and quick-tempered coaches may need to be reminded of appropriate behaviour when involved with the game of cricket The Laws of Cricket were modified in 2000 to include a preamble called The Spirit of Cricket. Cricket Australia and all lower Cricket Associations have adopted the laws of cricket preamble. The Brighton District Cricket Club (B.D.C.C) requires all members, officials, parents, spectators and supporters to abide by The Spirit of Cricket. LAWS OF CRICKET CODE 2000 - THE SPIRIT OF CRICKET Reference: See URL = <http://www.lords.org/data/files/laws-of-cricket-2000-code-4th-edition-final-10422.pdf> Cricket is a game that owes much of its unique appeal to the fact that it is expected to be played not only within its Laws, but also within the Spirit of the Game. Any action which is seen to abuse this spirit causes injury to the game itself. The major responsibility for ensuring the spirit of fair play rests with the captains. 4. There are two Laws which place the responsibility for the team's conduct firmly on the

captain.

A. Responsibility of captains The captains are responsible at all times for ensuring that play is conducted within the Spirit of the Game as well as within the Laws.

B. Player's conduct In the event of a player failing to comply with instructions by an umpire, or criticising by word or action the decisions of an umpire, or showing dissent, or generally behaving in a manner which might bring the game into disrepute, the umpire concerned shall in the first place report the matter to the other umpire and to the player's captain, and instruct the latter to take action. 5. Fair and unfair play

According to the Laws the umpires are the sole judges of fair and unfair play. The umpires may intervene at any time and it is the responsibility of the captain to take action where required. 6. The umpires are authorised to intervene in cases of:

A. Time wasting

B. Damaging the pitch

C. Dangerous or unfair bowling

D. Tampering with the ball or any other action that they consider to be unfair

A. To dispute an umpire's decision by word, action or gesture

B. To direct abusive language towards an opponent or umpire

C. To indulge in cheating or any sharp practice, for instance:

To appeal knowing that the batsman is not out

To advance towards an umpire in an aggressive manner when appealing

To seek to distract an opponent either verbally or by harassment with persistent clapping or unnecessary noise under the guise of enthusiasm and motivation of one's own side

6. Violence There is no place for any act of violence on the field of play. 7. Players Captains and umpires together set the tone for the conduct of a cricket match. Every player is expected to make an important contribution to this.

1.12 BRIGHTON DISTRICT CRICKET SOCIAL MEDIA POLICY SOCIAL MEDIA POLICY OVERVIEW AND PURPOSE

Social media is changing the way we communicate. This policy has been developed

to inform the Brighton District Cricket Club members about using social media so

individuals feel enabled to participate, while being mindful of their responsibilities and

obligations.

In particular, this policy provides practical guidance allowing all parties to benefit

from the use of social media, while minimising potential risks and protecting those

involved.

This policy assists to establish a culture of openness, trust and integrity in all online

activities related to the Brighton District Cricket Club.

This policy contains the Brighton District Cricket Club guidelines for the Brighton

District Cricket Club members to engage in social media use. It also includes details

of breaches of the policy.

In circumstances where guidance about social media issues have not been given in

this policy, we suggest individuals use common sense or seek out advice from the

Brighton District Cricket Club Committee who have approved this policy.

UNDERLYING PRINCIPLES

The Honorary President, Executives and elected Office Bearers of the Brighton

District Cricket Club are responsible for all matters related to this policy including

policy updates, version control, member communication and implementation.

COVERAGE

This policy applies to all persons who are involved with activities within the Brighton

District Cricket Club whether they are in a paid or unpaid/voluntary capacity

including:

members, including life members of Brighton District Cricket Club

persons appointed or elected to Brighton District Cricket Club committees and

sub-committees;

coaches and assistant coaches of the Brighton District Cricket Club;

support personnel, including team managers, team scorers, mentors

SCOPE

‘Social media’ refers to any online tools or functions that allow people to

communicate and/or share content via the internet.

This social media policy applies to all known platforms and mediums including, but

not limited to:

Social networking sites (e.g. Facebook, Twitter and Instagram)

Video and photo sharing websites or apps (e.g. YouTube, Vimeo, Instagram,

Flickr, Vine, etc)

Blogs and micro-blogging platforms (e.g. Tumblr, Wordpress, Blogger, etc)

Review sites (e.g. Yelp, Urban Spoon, etc)

Live broadcasting apps (e.g. Periscope, Meerkat, Facebook Mentions, etc)

Instant messaging (e.g. SMS, Skype, Snapchat, WhatsApp, Viber, etc)

Online voting or polls

Public and private online forums and discussion boards

Any other online technologies that allow individual users to upload and share

content

This policy is applicable when using social media as:

1. An officially designated individual representing the Brighton District Cricket Club

on social media; and

2. If individuals are posting content on any social media platform in relation to the

Brighton District Cricket Club that might affect the Brighton District Cricket Club’s

business, products, services, events, sponsors, members or reputation.

NOTE: This policy does not apply to the personal use of social media where it is not

related to or there is no reference to the Brighton District Cricket Club or its business,

competitions, teams, participants, products, services, events, sponsors, members or

reputation. However, any misuse by you of social media in a manner that does not

directly refer to the Brighton District Cricket Club may still be regulated by other

policies, rules or regulations of the Brighton District Cricket Club.

USING SOCIAL MEDIA IN AN OFFICIAL CAPACITY

Individuals must be authorised by the Brighton District Cricket Club before engaging

in social media as a representative of the Brighton District Cricket Club;

As a part of the Brighton District Cricket Club’s community you are an extension of

the Brighton District Cricket Club brand, image and reputation.

As such, the boundaries between when individuals are representing the Brighton

District Cricket Club can often be ‘blurred’. This becomes even more of an issue as

you increase your profile or position within the Brighton District Cricket Club.

Therefore it is important that individuals represent both themselves and the Brighton

District Cricket Club appropriately online at all times.

GUIDELINES

Individuals must adhere to the following guidelines when using social media related

to the Brighton District Cricket Club or its business processes, image, competitions,

teams, participants, services, events, sponsors, members or reputation.

USE COMMON SENSE

Whenever individuals are unsure as to whether or not the content you wish to share

is appropriate, seek advice from others before doing so or refrain from sharing the

content to be on the safe side.

When using social media, the lines between public and private, personal and

professional, may be blurred. Remember, you are an ambassador for the Brighton

District Cricket Club.

PROTECTING YOUR PRIVACY

Be smart about protecting privacy.

When posting content online there is potential for that content to become publicly

available through a variety of means, even if it was intended to be shared privately.

Therefore, individuals should refrain from posting any content online that you would

not be happy for anyone to see, even if you feel confident that a particular individual

would never see it.

Where possible, privacy settings on social media platforms should be set to limit

access. You should also be cautious about disclosing your personal details.

HONESTY

Individual’s honesty—or dishonesty—may be quickly noticed in the social media

environment. Do not say anything that is dishonest, untrue or misleading. If you are

unsure, check the source and the facts before uploading or posting anything. The

Brighton District Cricket Club recommends erring on the side of caution – if in doubt,

do not post or upload.

Individuals should not post anonymously, using pseudonyms or false screen names.

Individuals are to be transparent and honest. Use your real name, be clear about

who they are and the identify of any affiliations they have.

If individuals have a vested interest in something that is being discussed, point it out.

If individuals make an endorsement or recommendation about something they are

affiliated with, or have a close relationship with, individual must disclose that

affiliation.

The web is not anonymous. Individuals should assume that all information posted

online can be traced back to the individual. Individuals are accountable for their

actions both on and offline, including the information they post via their personal

social media accounts.

USE OF DISCLAIMERS

Wherever practical, individuals are to issue a prominent disclaimer stating who they

work for or are affiliated with (e.g. member of the Brighton District Cricket Club and

that anything they publish is their personal opinion and that they are not speaking

officially. This is good practice and is encouraged, but don't count on it to avoid

trouble -– it may not have legal effect.

REASONABLE USE

If you are a member of the Brighton District Cricket Club, you must ensure that your

personal use of social media does not interfere with your club commitments.

RESPECT CONFIDENTIALITY AND SENSITIVITY

When using social media, individuals must maintain the privacy of the Brighton

District Cricket Club’s confidential information. This includes information that is not

publically accessible, widely known, or not expected to be shared outside of the

Brighton District Cricket Club.

Remember, if you are online, you are on the record—much of the content posted

online is public and searchable.

Within the scope of your authorisation by the Brighton District Cricket Club, it is

perfectly acceptable to talk about the Brighton District Cricket Club and have a

dialogue with the community, but it is not okay to publish confidential information of

the Brighton District Cricket Club. Confidential information includes things such as

details about litigation, unreleased product information and unpublished details about

our team selections, coaching practices, financial information and recruitment

When using social media you should be considerate to others and should not post

information when you have been asked not to, or where consent has not been

sought and given. You must also remove information about another person if that

person asks you to do so.

Permission should always be sought if the use or publication of information is not

incidental, but directly related to an individual. This is particularly relevant to

publishing any information regarding minors. In such circumstances, parental or

guardian consent is mandatory and a must.

GAINING PERMISSION WHEN PUBLISHING A PERSON’S IDENTIFIABLE

IMAGE

Individuals must obtain express permission from any individual to use a direct,

clearly identifiable image of that person.

Individuals should also refrain from posting any information or photos of a sensitive

nature. This could include accidents, incidents or controversial behaviour.

In every instance, individuals need to have consent of the owner of copyright in the

image.

COMPLYING WITH APPLICABLE LAWS

Individuals are not to post or link to content that contains illegal or indecent content,

including defamatory, vilifying or misleading and deceptive content.

ABIDING BY COPYRIGHT LAWS

It is critical that individuals comply with the laws governing copyright in relation to

material owned by others and the Brighton District Cricket Club’s own copyrights and

intellectual property.

Individuals should never quote or use more than short excerpts of someone else's

work, and they should always attribute such work to the original author/source. It is

good practice to link to others' work rather than reproduce it.

DISCRIMINATION, SEXUAL HARASSMENT AND BULLYING

The public in general, and the Brighton District Cricket Club's members, reflect a

diverse set of customs, values and points of view.

Individuals must not post any material that is offensive, harassing, discriminatory,

embarrassing, intimidating, sexually explicit, bullying, hateful, racist, sexist or

otherwise inappropriate.

When using social media individuals are bound by the Brighton District Cricket

Club‘s values and Anti-Discrimination, Harassment and Bullying Policy.

AVOIDING CONTROVERSIAL ISSUES

Within the scope of an individual member’s authorisation, by the Brighton District

Cricket Club, if they see misrepresentations made about the Brighton District Cricket

Club in the media, they may point that out to the relevant authority in the Brighton

District Cricket Club.

Always do so with respect and with the facts. If individuals speak about others, make

sure what you say is based on fact and does not discredit or belittle that party.

DEALING WITH MISTAKES

If the Brighton District Cricket Club or a member makes an error while posting on

social media, individuals are to be up front about the mistake and address it quickly.

If they choose to modify an earlier post, make it clear that they have done so. If

someone accuses the Brighton District Cricket Club of posting something improper

(such as their copyrighted material or a defamatory comment about them), the

Committee is to address it promptly and appropriately and if necessary, seek legal

advice.

CONSCIENTIOUS BEHAVIOUR AND AWARENESS OF THE CONSEQUENCES

Keep in mind that what any individual writes is their responsibility, and failure to

abide by these guidelines could put the Brighton District Cricket Club at risk.

Individuals should always follow the terms and conditions for any third-party Social

media sites in which they participate.

Breaches of this policy include but are not limited to:

organisation, clubs and/or its members.

Posting or sharing any content that is abusive, harassing, threatening,

demeaning, defamatory or libellous.

Posting or sharing any content that includes insulting, obscene, offensive,

provocative or hateful language.

Posting or sharing any content, which if said in person during the playing of the

game would result in a breach of the rules of the game.

Posting or sharing any content in breach of the Brighton District Cricket Club’s

anti-discrimination, racial discrimination, sexual harassment or other similar

policy.

Posting or sharing any content that is a breach of any state or Commonwealth

law.

Posting or sharing any material to our social media channels that infringes the

intellectual property rights of others.

Posting or sharing material that brings, or risks bringing the Brighton District

Cricket Club its affiliates, its sport, its officials, members or sponsors into

disrepute. In this context, bringing a person or organisation into disrepute is to

lower the reputation of that person or organisation in the eyes of the ordinary

members of the public.

REPORTING A BREACH

If individuals, or third parties, notice inappropriate or unlawful content online relating

to the Brighton District Cricket Club or any of its members, or content that may

otherwise have been published in breach of this policy, they should report the

circumstances immediately.

All cases are to be reported the Brighton District Cricket Club President or Secretary.

For a complaint about the misuse of social media relating to a match or

competition that occurs either prior to, during, or after a game; refer to the

Brighton District Cricket Club’s Constitution.

INVESTIGATION

Alleged breaches of this social media policy may be investigated according to the

Brighton District Cricket Club Constitution.

Where it is considered necessary, the Brighton District Cricket Club may report a

breach of this social media policy to police.
