General Requirement

• Section 1605 of the Recovery Act, which provides that none of the ARRA funds may be used for a project or the construction, alteration, maintenance, or repair of a public building or public work unless all of the iron, steel, and manufactured goods used in the project are produced in the United States."

Definitions

• “Manufactured Good” means a good brought to the construction site for incorporation into the building or work that has been: (i) Processed into a specific form and shape; or (ii) Combined with other raw material to create a material that has different properties than the properties of the individual raw materials.

Definitions

• ARRA’s “Public Building” and “Public Work” are generally defined as anything in your award budgeted as a CDBG public facility or public infrastructure. Most projects are covered.

Waivers and Exceptions

• Allowed by law; however, requires submission of detailed request to HUD and (if approved) review by federal OMB panel along with publication in the Federal Register. Since you only have until January 25, 2009 to be under contract and implementing...
