The Defendant Sadusk was a public servant a sworn Correctional Officer employed by the Florida Department of Corrections a state agency The Defendant agreed to accept something of value a summer job for his minor son The benefit was something ofvalue to the Defendant Sadusk andor his minor son in whose welfare the Defendant was interested and was not authorized by law The agreement was corruptly made for future petformance in the Defendants position as a public servant to wit Defendant Sadusk attempted to circumvent inmate transfer procedures and expedite the transfer of an inmate to Tomoka Correctional Instituion and the Defendant represented this action as either being within his discretion in perfonnance ofhis duty or in violation ofhis public duty The Defendant also used an electronic communications device (cellular phone) to facilitate the commission of that aforementioned felony to wit

Senior Classification Officer Deborah Rowland provided a sworn recorded statement on February 2 2017 She reported that she was contacted by Officer Sadusk on January 31 2017 it approximately 845am Officer Sadusk contacted Ms Rowland from B-Donnitory at Tomeka Correctional Institution Ms Rowland - was in her officein the classification department ofTomoka CI During this conversation Officer Sadusk asked Ms

Officer Sadusk informed Ms Rowland that Kathy Whittenton Inmate Whittentons wife had agreed to give Officer Sadusks son a j~b at an unidentified sports complex ifhe could assist with Inmate Whittentons transfer Ms Rowland asked for the inmat~s information and ended the conversation Ms Rowland reported these events to her supervisor in an incident report on January 31 At the end ofher statement Ms Rowland agreed to participate in a recorded phone call to assist this investigation in accordance with Florida Statute 93403(2)(c)

Inmate Whittenton is currently assigned to Holmes CI and has requested and been approved for a good adjustment transfer with Tomoka CJ as his first choice and Putnam CI and Lake CI as his second and third choice (respectively) As of the writing of this affidavit the Department of Corrections has not set and target date (date by which the transfer will be completed) or finalized the destination (the institution to which Inmate Whittenton will be transferred) middot

Securus phone calls made using Inmate Whittentons personal identification number (PIN) at Hohnes Correctional Institution-were reviewed It should be noted that Securus accounts are linked to voice recognition technology that prevents a user other than the account holder from making phone calls

During a call placed on January 30 2017 Inmate Whittenton contacted a female at phone number 386-527-5401 The female stated that she had contacted her friend This person is referred as both her friend and Bo by Inmate Whittenton and Ms Whittenton Your affiant has prior knowledge that inmates commonly refer to Officer Sadusk as Bo

The female infonned Inmate Whittenton that her friend would check it all out-tomorrow (January 31) and contact her Later in the call Inmate Whittenton asked if Bo was just going to check on the status of the transfer the female informed Inmate Whittenton that Bo knows some really well and was going to help with the transfer The female described the conversation with Bo as very promising During the call Inmate Whittenton stated IfBo needs some money I will get it for him and I know how he is I dont care ifits $100000 The female replied He wants his boy to start working The female stated that she would get his boy hooked up There was ilso mention ofan officiating position for the boy

On February 3 your affiant Inspector Kyle Totten and Inspector Supervisor Dennis McIntosh supervised an attempted controlled recorded phone call during which Ms Rowland attempted to contact Officer Sadusk on his personal phone number listed in Department records The two attempted calls were not connected and resulted in an error message

Ms Rowland reported that Officer Sadusk had contacted her by telephone at approximately 926am on February 6 According to Ms Rowland he provided phone number I to her and indicated that he was in training Ms Rowland told him that she would call him later that day

Your affiant Inspector Kyle Totten and Senior Inspector Zacharie Mulharan supervised a controlled recorded phone call between Ms Rowland and Officer Sadusk on February 6 2017 at approximately 11 10am

During the call Ms Rowland stated multiple times that Department procedure prohibited her from influencing the transfer When asked Officer Sadusk stated that he was one-hundred percent sure that his son would get a job if she helped with the transfer Officer Sadusk stated that his son would bemiddotumpiring baseball games during the summer Officer Sadusk stated She said that she was gonna give him every you know like every night thats open and its $4000 a game So he could make $8000 a night on a minimum Ms Rowland informed him that the transfer would be this Thursday (February 9) or the nexi Thursday (February 16) During the call Officer Sadusk stated that he met the lady when he coached and had not spoken with her for years Officer Sadusk stated that she contacted him and asked him to help her with the transfer After he agreed to help her she asked ifthere was anything that she could do for him Officer Sadusk stated that he told her that she could do something for him and infonned her that he was trying to get a job for his 16 year old son According to Officer Sadusk the lady said Ifyou can do this Ill work him every single night Officer Sadusk offered to buy lunch for Ms Rowland for giving him assistance she declined

During a phone call made using Inmate Whittentons Securus PIN on February 6 at approximately 646pm to phone number 386-527-5401 Inmate Whittenton contacted the female who had been contacted during the previous call The female infonned Inmate Whittenton that her friend had contacted her and he would be transferred this Thursday (February 9) or next Thursday (February 16) Inmate Whittenton later asked ifBo had said anything else The female said he said it was approved and usually took two weeks or three weeks tops The female said their bus is on Thursdays According to the female Bo said that he would find out an exact date when he worked on Wednesday

The phone list in Inmate Whittentons institutional file indicates that phone number 386-527-5401 should belong to Paulette Basile

On February 8 2017 Inmate Dwayne Whittenton was advised ofhis Miranda Rights and exercised his right to remain silent at Holmes Correctional Institution This interview was conducted by Senior Inspector Jennifer Skipper

On February 9 2017 Ms Basile was contacted at her home addressed and-interviewed by your affiant and Special Agent David Brown of the Federal Bureau ofinvestigation Ms Basile confirmed that she was routinely contacted by Inmate Whittenton at phone number 386-527-5410 Ms Basile identified herself as the Assistant Director of Sports and Recreation for the city ofSouth Daytona Ms Basile admitted that she had contacted Bo who she identified when shown a photograph of Officer Sadusk and asked how she could expedite the transfer She denied that she had asked Officer Sadusk to help with transfer Ms Basile admitted that she had discussed helping Officer Sadusks son get employment as a scorekeeper but denied that the employment was in exchange for anything being done by Officer Sadusk Ms Basile also denied that she ever discussed a possible transfer date with Inmate Whittenton during a phone conversation

As of the writing of this affidavit Ms Whittenton has not been contacted Your affiant and SA Brown made multiple attempts to contact her on February 9 2017 at her ho~e address It is not currently known if she was involved in the arrangement Ms Rowland denied that she had ever heard the name Paulette

On February 10 2017 Officer Sadusk was advised ofhis Miranda Rights and agreed to provide a statement Officer Sadusk reported that he was contacted by Paulette concerning Inmate Whittenton Officer Sadusk did not know Paulette last name but identified her as a supervisor of a sportsrecreation program Officer Sadusk stated that Paulette asked him to check on a good adjustment transfer Officer Sadusk stated that he called Ms Rowland and asked if the inmate could be transferred to Tomoka CI middot

Officer Sadusk admitted that Paulette asked if she could do anything for him middotand he mentioned that his minor son needed a job Officer Sadusk admitted that he told Ms Rowland that he was 100 percent sure his son would get a job if the transferred occurred Officer Sadusk denied that there was a definite agreement that his son would be employed ifthe transfer occurred During his statement Officer Sadusk read text conversations from his ATampT cellular phone between himself and Paulette The conversations involved Paulette repeatedly asking for a date of the transfer and reminding Officer Sadusk to have his son submit paperwork to her office

The Defendant Sadusk was a public servant a sworn Correctional Officer employed by the Florida Department of Corrections a state agency The Defendant agreed to accept something of value a summer job for his minor son The benefit was something ofvalue to the Defendant Sadusk andor his minor son in whose welfare the Defendant was interested and was not authorized by law The agreement was corruptly made for future petformance in the Defendants position as a public servant to wit Defendant Sadusk attempted to circumvent inmate transfer procedures and expedite the transfer of an inmate to Tomoka Correctional Instituion and the Defendant represented this action as either being within his discretion in perfonnance ofhis duty or in violation ofhis public duty The Defendant also used an electronic communications device (cellular phone) to facilitate the commission of that aforementioned felony to wit

Senior Classification Officer Deborah Rowland provided a sworn recorded statement on February 2 2017 She reported that she was contacted by Officer Sadusk on January 31 2017 it approximately 845am Officer Sadusk contacted Ms Rowland from B-Donnitory at Tomeka Correctional Institution Ms Rowland - was in her officein the classification department ofTomoka CI During this conversation Officer Sadusk asked Ms

Officer Sadusk informed Ms Rowland that Kathy Whittenton Inmate Whittentons wife had agreed to give Officer Sadusks son a j~b at an unidentified sports complex ifhe could assist with Inmate Whittentons transfer Ms Rowland asked for the inmat~s information and ended the conversation Ms Rowland reported these events to her supervisor in an incident report on January 31 At the end ofher statement Ms Rowland agreed to participate in a recorded phone call to assist this investigation in accordance with Florida Statute 93403(2)(c)

Inmate Whittenton is currently assigned to Holmes CI and has requested and been approved for a good adjustment transfer with Tomoka CJ as his first choice and Putnam CI and Lake CI as his second and third choice (respectively) As of the writing of this affidavit the Department of Corrections has not set and target date (date by which the transfer will be completed) or finalized the destination (the institution to which Inmate Whittenton will be transferred) middot

Securus phone calls made using Inmate Whittentons personal identification number (PIN) at Hohnes Correctional Institution-were reviewed It should be noted that Securus accounts are linked to voice recognition technology that prevents a user other than the account holder from making phone calls

During a call placed on January 30 2017 Inmate Whittenton contacted a female at phone number 386-527-5401 The female stated that she had contacted her friend This person is referred as both her friend and Bo by Inmate Whittenton and Ms Whittenton Your affiant has prior knowledge that inmates commonly refer to Officer Sadusk as Bo

The female infonned Inmate Whittenton that her friend would check it all out-tomorrow (January 31) and contact her Later in the call Inmate Whittenton asked if Bo was just going to check on the status of the transfer the female informed Inmate Whittenton that Bo knows some really well and was going to help with the transfer The female described the conversation with Bo as very promising During the call Inmate Whittenton stated IfBo needs some money I will get it for him and I know how he is I dont care ifits $100000 The female replied He wants his boy to start working The female stated that she would get his boy hooked up There was ilso mention ofan officiating position for the boy

On February 3 your affiant Inspector Kyle Totten and Inspector Supervisor Dennis McIntosh supervised an attempted controlled recorded phone call during which Ms Rowland attempted to contact Officer Sadusk on his personal phone number listed in Department records The two attempted calls were not connected and resulted in an error message

Ms Rowland reported that Officer Sadusk had contacted her by telephone at approximately 926am on February 6 According to Ms Rowland he provided phone number I to her and indicated that he was in training Ms Rowland told him that she would call him later that day

Your affiant Inspector Kyle Totten and Senior Inspector Zacharie Mulharan supervised a controlled recorded phone call between Ms Rowland and Officer Sadusk on February 6 2017 at approximately 11 10am

During the call Ms Rowland stated multiple times that Department procedure prohibited her from influencing the transfer When asked Officer Sadusk stated that he was one-hundred percent sure that his son would get a job if she helped with the transfer Officer Sadusk stated that his son would bemiddotumpiring baseball games during the summer Officer Sadusk stated She said that she was gonna give him every you know like every night thats open and its $4000 a game So he could make $8000 a night on a minimum Ms Rowland informed him that the transfer would be this Thursday (February 9) or the nexi Thursday (February 16) During the call Officer Sadusk stated that he met the lady when he coached and had not spoken with her for years Officer Sadusk stated that she contacted him and asked him to help her with the transfer After he agreed to help her she asked ifthere was anything that she could do for him Officer Sadusk stated that he told her that she could do something for him and infonned her that he was trying to get a job for his 16 year old son According to Officer Sadusk the lady said Ifyou can do this Ill work him every single night Officer Sadusk offered to buy lunch for Ms Rowland for giving him assistance she declined

During a phone call made using Inmate Whittentons Securus PIN on February 6 at approximately 646pm to phone number 386-527-5401 Inmate Whittenton contacted the female who had been contacted during the previous call The female infonned Inmate Whittenton that her friend had contacted her and he would be transferred this Thursday (February 9) or next Thursday (February 16) Inmate Whittenton later asked ifBo had said anything else The female said he said it was approved and usually took two weeks or three weeks tops The female said their bus is on Thursdays According to the female Bo said that he would find out an exact date when he worked on Wednesday

The phone list in Inmate Whittentons institutional file indicates that phone number 386-527-5401 should belong to Paulette Basile

On February 8 2017 Inmate Dwayne Whittenton was advised ofhis Miranda Rights and exercised his right to remain silent at Holmes Correctional Institution This interview was conducted by Senior Inspector Jennifer Skipper

On February 9 2017 Ms Basile was contacted at her home addressed and-interviewed by your affiant and Special Agent David Brown of the Federal Bureau ofinvestigation Ms Basile confirmed that she was routinely contacted by Inmate Whittenton at phone number 386-527-5410 Ms Basile identified herself as the Assistant Director of Sports and Recreation for the city ofSouth Daytona Ms Basile admitted that she had contacted Bo who she identified when shown a photograph of Officer Sadusk and asked how she could expedite the transfer She denied that she had asked Officer Sadusk to help with transfer Ms Basile admitted that she had discussed helping Officer Sadusks son get employment as a scorekeeper but denied that the employment was in exchange for anything being done by Officer Sadusk Ms Basile also denied that she ever discussed a possible transfer date with Inmate Whittenton during a phone conversation

As of the writing of this affidavit Ms Whittenton has not been contacted Your affiant and SA Brown made multiple attempts to contact her on February 9 2017 at her ho~e address It is not currently known if she was involved in the arrangement Ms Rowland denied that she had ever heard the name Paulette

On February 10 2017 Officer Sadusk was advised ofhis Miranda Rights and agreed to provide a statement Officer Sadusk reported that he was contacted by Paulette concerning Inmate Whittenton Officer Sadusk did not know Paulette last name but identified her as a supervisor of a sportsrecreation program Officer Sadusk stated that Paulette asked him to check on a good adjustment transfer Officer Sadusk stated that he called Ms Rowland and asked if the inmate could be transferred to Tomoka CI middot

Officer Sadusk admitted that Paulette asked if she could do anything for him middotand he mentioned that his minor son needed a job Officer Sadusk admitted that he told Ms Rowland that he was 100 percent sure his son would get a job if the transferred occurred Officer Sadusk denied that there was a definite agreement that his son would be employed ifthe transfer occurred During his statement Officer Sadusk read text conversations from his ATampT cellular phone between himself and Paulette The conversations involved Paulette repeatedly asking for a date of the transfer and reminding Officer Sadusk to have his son submit paperwork to her office

On February 9 2017 Ms Basile was contacted at her home addressed and-interviewed by your affiant and Special Agent David Brown of the Federal Bureau ofinvestigation Ms Basile confirmed that she was routinely contacted by Inmate Whittenton at phone number 386-527-5410 Ms Basile identified herself as the Assistant Director of Sports and Recreation for the city ofSouth Daytona Ms Basile admitted that she had contacted Bo who she identified when shown a photograph of Officer Sadusk and asked how she could expedite the transfer She denied that she had asked Officer Sadusk to help with transfer Ms Basile admitted that she had discussed helping Officer Sadusks son get employment as a scorekeeper but denied that the employment was in exchange for anything being done by Officer Sadusk Ms Basile also denied that she ever discussed a possible transfer date with Inmate Whittenton during a phone conversation

Officer Sadusk informed Ms Rowland that Kathy Whittenton Inmate Whittentons wife had agreed to give Officer Sadusks son a j~b at an unidentified sports complex ifhe could assist with Inmate Whittentons transfer Ms Rowland asked for the inmat~s information and ended the conversation Ms Rowland reported these events to her supervisor in an incident report on January 31 At the end ofher statement Ms Rowland agreed to participate in a recorded phone call to assist this investigation in accordance with Florida Statute 93403(2)(c)

Inmate Whittenton is currently assigned to Holmes CI and has requested and been approved for a good adjustment transfer with Tomoka CJ as his first choice and Putnam CI and Lake CI as his second and third choice (respectively) As of the writing of this affidavit the Department of Corrections has not set and target date (date by which the transfer will be completed) or finalized the destination (the institution to which Inmate Whittenton will be transferred) middot

Securus phone calls made using Inmate Whittentons personal identification number (PIN) at Hohnes Correctional Institution-were reviewed It should be noted that Securus accounts are linked to voice recognition technology that prevents a user other than the account holder from making phone calls

During a call placed on January 30 2017 Inmate Whittenton contacted a female at phone number 386-527-5401 The female stated that she had contacted her friend This person is referred as both her friend and Bo by Inmate Whittenton and Ms Whittenton Your affiant has prior knowledge that inmates commonly refer to Officer Sadusk as Bo

The female infonned Inmate Whittenton that her friend would check it all out-tomorrow (January 31) and contact her Later in the call Inmate Whittenton asked if Bo was just going to check on the status of the transfer the female informed Inmate Whittenton that Bo knows some really well and was going to help with the transfer The female described the conversation with Bo as very promising During the call Inmate Whittenton stated IfBo needs some money I will get it for him and I know how he is I dont care ifits $100000 The female replied He wants his boy to start working The female stated that she would get his boy hooked up There was ilso mention ofan officiating position for the boy

On February 3 your affiant Inspector Kyle Totten and Inspector Supervisor Dennis McIntosh supervised an attempted controlled recorded phone call during which Ms Rowland attempted to contact Officer Sadusk on his personal phone number listed in Department records The two attempted calls were not connected and resulted in an error message

Ms Rowland reported that Officer Sadusk had contacted her by telephone at approximately 926am on February 6 According to Ms Rowland he provided phone number I to her and indicated that he was in training Ms Rowland told him that she would call him later that day
