CALL TO ORDER Dr. Harbin called the meeting of the Georgia Composite Medical Board to order at 7:30 a.m.

AGENDA Dr. Marshall made a motion, seconded by Dr. Flint to approve the agenda of the June 3, 2021

meeting. The motion carried unanimously.

MINUTES Dr. Marshall made a motion, seconded by Dr. Collins to approve the minutes of the May 6, 2021

Recognize Dr. Marshall for his award by the State EMS Association

Catherine Caldicott, MD, PBI wants to offer coursework to assist with HB 458, which requires training for

Board members. The Board accepted as information.

The Board reviewed an email from Mr. Sean Hardwick, Regulatory Analyst, Mr. Cannabis Law, regarding

can a physician that certifies patients to use low THC oil have a financial interest, whether direct or indirect,

in an out-of-state marijuana business? For example, would having an interest in a marijuana business in a

state like Colorado or Washington violate GA Code § 16-12-224(b)? The Board referred Mr. Hardwick to

the Laws and Rules.

NURSE PROTOCOL ADVISORY COMMITTEE Dr. DeLoach presented the Nurse Protocol Report:


1. Seeking clarification on how physician supervision of mid-levels and extenders (e.g., nurse

practitioners and physician assistants) worked. Answer: A physician can supervise 4 NP’s

unless exempt, can have 8 NP’s but only 4 working at a time. PA’s went from two to four in

2020. Advised to review Georgia code 43-25-1.

2. Milene Vega, Latham & Watkins, LLP – Clarification regarding CRNA’s and PA’s.

Answer: (1) CRNA’s do not have the ability to prescribe in Georgia. Please defer to law.

Language refers to nurses. (2) Yes, PA’s can order controlled substances in hospital

setting. (3) No mandate for PA to register with DEA.

3. Request from Dr. William Rivers regarding the nurse protocol agreement and supervision. An

APRN would need separate protocol agreements to work with different physicians.
